' "1 Die Herausforderung dieser Worte lieB sich nur schwer abschatzen, als ich dem Stifter des Husserl-Archivs, meinem Freund Pater Van Breda, im Januar I974- zwei Monate vor seinem unzeitigen Hingang- den von ihm so sehr begruBten und geforderten EntschluB, eine Husserl-Bio­ graphie zu schreiben, naher erlauterte. Mancherlei ware darin ein­ zubringen gewesen: Ubersicht uber die Geschicke des Bismarck­ Staates und das aufkommende Hitler-Reich, Vertrautheit mit Stifter und (...) Hofmannsthal, Kenntnis der Theorie mathematischer Funktionen wie der Psychologie der Wurzburger Schule, Einsicht in die Einfuhlungslehre von Lipps wie auch Heideggers Seins­ frage. Aber solche Absicht erwies sich hauptsachlich deswegen als undurchfiihrbar, weil es derzeit noch am Notigsten fehlt: an einer verlaBlichen Durcharbeitung von Husserls Denken und seiner Entwicklung, wie sie sich in den veroffentlichten Werken, vor al­ lem aber im Meer bewahrter Manuskripte niederschlug. Hier galt es, da viel bisher im Dunkeln liegt, die Materialien zu einer Bio­ graphie erst einmal bereitzustellen und, wenn auch oft nur um­ riBhaft, fur die Zukunft sicherzustellen. Ergebnis dieser Beschei­ dung ist die vorliegende Chronik. GewiB, Husserl ware selbst der befugteste interpres sui gewe­ sen. Doch was er unterm 20. Juni rg2r an den Meiner Verlag schrieb - der,Stand seiner Lebensarbeit" erlaube es ihm zur Zeit nicht, zu der in diesem Verlag erscheinenden Reihe von Selbstdarstellungen einen Beitrag zu liefern (F I r8/r + 25) -, galt, wie gerade unsere Chronik deutlich macht, fur ihn zeitlebens. Mimesis is one of the root words of Ancient Philosophy and again plays an important role in contemporary French thought. In this essay, an original interpretation of mimesis is given which throws new light on art and literature, reading and writing, the mirror and the example, identity and difference, and last but not least on the traditional opposition between reality and illusion, between appearing and being.

In the postscript of Limited Inc., entitled “Vers une éthique de la discussion”, Jacques Derrida says: “The phrase which for certain individuals has become a sort of generally misunderstood deconstructionist slogan — il n’y a pas de hors texte — means nothing more than il n’y a pas de hors contexte”. He adds to this that while the latter formulation might perhaps be a little less shocking it is also less thought provoking. In any case, both formulations according to Derrida (...) mean “exactement la même chose” .The danger nevertheless remains that the second formulation might either through wear and tear — and concepts are frequently prey to wear and tear — or through overhasty analysis — and the average reader is always in a hurry — end up becoming trivial. Everything depends on what is meant by the terms ‘text’ and ‘context’ and what issues are at stake. (shrink)

In print for the first time in over ten years, Act and Crime provides a unified account of the theory of action presupposed by both Anglo-American criminal law and the morality that underlies it. The book defends the view that human actions are always volitionally caused bodily movements and nothing else. The theory is used to illuminate three major problems in the drafting and the interpretation of criminal codes: 1) what the voluntary act requirement both does and should require; 2) (...) what complex descriptions of actions prohibited by criminal codes both do and should require ; and 3) when two actions are 'the same' for purposes of assessing whether multiple prosecutions and multiple punishments are warranted. The book both contributes to the development of a coherent theory of action in philosophy, and it provides both legislators and judges a grounding in three of the most basic elements of criminal liability. In this short, dense essay, Jean Cavaillès evaluates philosophical efforts to determine the origin - logical or ontological - of scientific thought, arguing that, rather than seeking to found science in original intentional acts, a priori meanings, or foundational logical relations, any adequate theory must involve a history of the concept. Cavaillès insists on a historical epistemology that is conceptual rather than phenomenological, and a logic that is dialectical rather than transcendental. His famous call (cited by Foucault) to abandon "a (...) philosophy of consciousness" for "a philosophy of the concept" was crucial in displacing the focus of philosophical enquiry from aprioristic foundations toward structural historical shifts in the conceptual fabric. This new translation of Cavaillès's final work, written in 1942 during his imprisonment for Resistance activities, presents an opportunity to reencounter an original and lucid thinker. Cavaillès's subtle adjudication between positivistic claims that science has no need of philosophy, and philosophers' obstinate disregard for actual scientific events, speaks to a dilemma that remains pertinent for us today. His affirmation of the authority of scientific thinking combined with his commitment to conceptual creation yields a radical defense of the freedom of thought and the possibility of the new.
