Mi objetivo en este artículo es examinar la génesis y el desarrollo de la noción de derecho de gentes en el pensamiento de Kant. Para este propósito, reconstruyo, en un primer momento, las líneas principales del pensamiento de Gottfried Achenwall en su obra Elementa Iuris Naturae. En un segundo paso, analizo la Lección de derecho natural de 1784 en la cual Kant – sin todavía contar con su propia teoría legal de madurez – expone pero también discute de (...) manera sumamente crítica varias de las tesis de Achenwall concernientes al ius belli. Lo que pretendo con esto es mostrar en la última parte del presente artículo que muchas de las ideas de Kant en sus trabajos maduros de filosofía político-jurídica de la década de 1790 pueden rastrearse a la lección que dictó con base en el tratado de Achenwall, y que bajo esta perspectiva dichas ideas pueden ser comprendidas de mucho mejor manera. Por último, subrayo que las continuidades y las rupturas entre Achenwall y Kant revelan un profundo vínculo entre los dos autores susceptible de seguir siendo explorado. (shrink)

Kant’s Naturrecht Feyerabend has recently gained more sustained attention for its role in clarifying Kant’s published positions in political philosophy. However, too little attention has been given to the lecture’s relation to Gottfried Achenwall, whose book was the textbook for the course. In this paper, I will examine how Kant rejected and transforms Achenwall’s natural law system in the Feyerabend Lectures. Specifically, I will argue that Kant problematizes Achenwall’s foundational notion of a divine juridical state which (...) opens up a normative gap between objective law and subjective rights. In the absence of a divine sovereign, formal natural law is unable to justify subjective natural rights in the state of nature. In the Feyerabend Lectures, Kant, in order to close this gap, replaces the divine will with the “will of society”, making the state necessary for the possibility of rights. (shrink)

This article examines Kant’s theory of property through a comparative analysis of Gottfried Achenwall’s justification of ownership rights. I argue that at the core of Achenwall’s and Kant’s understanding of ownership rights lies the idea that rights are to be acquired through a juridical act (factum iuridicum, rechtlichen Act) of the will. However, while Achenwall thinks of this act as emerging from a private will, Kant holds that rights and obligations can only be brought about by (...) an act of the general will. By contrasting these two views, I aim to illuminate one of the main features of Kant’s theory of property, namely, that ownership rights are only possible in a rightfully constituted state. I conclude with a suggestion regarding Kant’s view of the notion of ‘provisional’ possession in the state of nature. (shrink)

I argue that by considering Kant’s engagement with previous theorists of natural right, we can gain a clearer understanding of how he transformed the discipline from its foundations. To do this, I focus my analysis on Kant’s (critical) reception of two models of natural right with which he was very familiar: one from Alexander Baumgarten’s Elements of First Practical Philosophy [Initia philosophiae practicae primae], the other from Gottfried Achenwall’s Natural Law [Ius naturae]. The Initia served as a basis (...) for Kant’s lectures on moral philosophy for over three decades and may thus be considered as having played an important role in shaping his practical philosophy as a whole. Achenwall’s Ius naturae was the textbook that Kant employed in his lectures on natural right for over two decades. I argue that Kant distances himself from previous models of natural right in three main regards: the identification of moral laws with laws of nature, the normative connection between the principles of right and a natural end, and the place of God as the author of moral laws. I then briefly discuss what Kant retains of Baumgarten’s and Achenwall’s models of natural right. Kant’s Metaphysics of Morals preserves the view that a rational doctrine of right belongs to a broader systematic doctrine that comprehends the entire system of duties. I address the question of the division of the Sittenlehre into two branches and claim that, whereas Kant did not consider Baumgarten’s answer to the problem of distinguishing juridical from ethical principles to be satisfactory, he found a key piece of his own resolution in Achenwall’s Ius naturae, namely the definition of right as a power to coerce. Zeno’s arrow does not move “in the now” (Phys. VI 8, 239b2) or, equivalently, “in the place it is” (DK 29 B 4). Zeno concludes from this that the arrow does not move at all. In Aristotle (ibid. 9, 239b5–9, 31–33), Zeno’s argument takes the form of an invalid inference from instants to periods of time. Insofar as it fails to bring out an inconsistency in Aristotle’s account of motion, the paradox is thus eliminated. That instantaneous motion is a contradiction (...) in terms belongs to the common ground Aristotle shares with Zeno. That’s why information concerning Zeno’s relevant argument must be sought elsewhere (see section 3). Aristotle’s discussion of the Arrow pertains to the conclusions drawn from the denial of instantaneous motion. But the argument he refutes is of his own making, or so I will argue (section 2). In particular, Aristotle fails to address the presentist commitment adumbrated in his account, which would leave nothing beyond the denial of instantaneous motion for Zeno to prove. Presentism is no option in Phys. VI where a tenseless account of time and motion is offered. I will argue that Aristotle’s account of the tenses in De interpretatione is prone to Zeno’s argument if the present is conceived as an instant – which it arguably is not (section 4). (shrink)

In General Inquiries on the Analysis of Notions and Truths, Leibniz articulates for the first time his favourite solution to the problem of contingency and displays the main features of his logical calculus. Leibniz composed the work in 1686, the same year in which he began to correspond with Arnauld and wrote the Discourse on Metaphysics. General Inquiries supplements these contemporary entries in Leibniz's philosophical oeuvre and demonstrates the intimate connection that links Leibniz's philosophy with the attempt to create a (...) new kind of logic. This edition presents the text and translation of the General Inquiries along with an introduction and commentary. Given the composite structure of the text, where logic and metaphysics strongly intertwine, Mugnai's introduction falls into two sections, respectively dedicated to logic and metaphysics. The first section ('Logic') begins with a preliminary account of Leibniz's project for a universal characteristic and focuses on the relationships between rational grammar and logic, and discusses the general structure and the main ingredients of Leibniz's logical calculus. The second section ('Metaphysics') is centred on the problem of contingency, which occupied Leibniz until the end of his life. The Discourse on Metaphysics is one of Leibniz's fundamental works. Written around January 1686, it is the most accomplished systematic expression of Leibniz's philosophy in the 1680s, the period in which Leibniz's philosophy reached maturity. The comparator-model, originally developed to explain motor action, has recently been invoked to explain several aspects of the self. However, in the first place it may not be used to explain a basic self-world distinction because it presupposes one. Our alternative account is based on specific systematic covariation between action and perception. Secondly, the comparator model cannot explain the feeling of ownership of thoughts. We argue—contra Frith and Campbell—that thoughts are not motor processes and therefore cannot be described by the (...) comparator-model. Rather, thoughts can be the triggering cause (intention) for actions. An alternative framework for the explanation of thought insertion in schizophrenics is presented. (shrink)
