Die Theorie der „reflexiven Modernisierung” erhebt den Anspruch, nicht nur eine neue Sicht auf die Gesellschaft zu entwickeln, sondern auch einen ganz neuen, bereits existierenden Gesellschaftszustand zu beschreiben. In dieser Sicht und in dieser Gesellschaft haben die Freiheit und die Gerechtigkeit eine andere Stellung und einen anderen Sinn als in den modernen politischen Theorien und in den modernen Gesellschaften. Wie und aus welchen theoretischen und politischen Gründen die für die politische Theorie so wichtigen Begriffe „Freiheit” und „Gerechtigkeit” in der Theorie (...) der „reflexiven Modernisierung” aufgelöst werden und was an ihre Stelle kommt – das sind die wichtigsten Fragen, auf die die Autorin Antworten sucht. Članak razmatra pojam demokracije Johna Deweya u odnosu na ranije i suvremene radikalno ljevičarske ideje. Ističu se slična epistemološka, antropološka i politička stajališta u ovim teorijama. Vrlo je važno odbacivanje ili podcjenjivanje političke demokracije i naglasak na demokratskom životu s ciljem stvaranja novog društva, posve drukčijeg od postojećih društava. Članak je podijeljen u tri dijela. Prvi dio istražuje razumijevanje demokracije kao nepolitičkog fenomena i kao sinonima za novi oblik ljudske egzistencije u mladog Marxa te kasnijim stavovima Marxa i Lenjina o (...) demokraciji kao »hipokriziji«. Drugi dio analizira Deweyev pojam demokracije kao »načina povezanog življenja« i skreće pozornost na neke značajne podudarnosti i, također, razlike spram Marxovih ranih ideja. Treći dio razmatra razumijevanje demokratskog društva kao identičnog s globalnim društvom u kojem komunikacija među ljudima nije ograničena političkim granicama. U ovom se pitanju također prepoznaju značajne podudarnosti u mišljenju Marxa, Deweya i nekih suvremenih mislilaca . Zaključak je da su politička demokracija i demokratsko društvo kompatibilni, no ideja neke vrste novog nepolitičkog demokratskog društva osim globalnog društva se smatra nerealističnom. (shrink)
The article considers the John Dewey’s concept of democracy with regard to earlier and to contemporary left-radical ideas. The article highlights similar epistemological, anthropological and political views in these theories. Very important is the rejection or the underestimation of the political democracy and the emphasis on the democratic life in order to build a new society, quite different from the existing societies. The article consists of three parts. The first part examines the understanding of democracy as a non political phenomenon (...) and as a synonym for a new type of human existence by the early Marx and the later view of Marx and Lenin on the democracy as “hypocrisy”. The second part analyzes the Dewey’s concept of democracy as “a mode of associated living” and draws attention to some significant resemblances and also some differences from the early conception of Marx. The third part considers the understanding of the democratic society as identical with the global society in which the communication of the people is not restricted by political borders. In this question there are also identified significant similarities between the conceptions of Marx, Dewey and some contemporary thinkers . The conclusion is that the political democracy and the democratic society are compatible, but the idea of some kind of new non-political democratic society besides global society is deemed as unrealistic. In dem Artikel werden die Auffassungen von John Dewey über die Demokratie in Bezug auf frühere und spätere linksradikale Theorien untersucht. Es werden viele Ähnlichkeiten in erkenntnistheoretischen, anthropologischen und philosophisch-politischen Fragen entdeckt. Als besonders wichtig erscheint die Ablehnung oder die Unterschätzung der politischen Demokratie und die Hervorhebung des demokratischen Lebens, um einer ganz neuen Gesellschaft Platz zu machen. Der Artikel besteht aus drei Teilen. Im ersten Teil wird die Auffassung des frühen Marx über die Demokratie als ein unpolitisches Phänomen und (...) als Synonym eines neuen menschlichen Daseins verfolgt und die spätere Umwandlung dieser Auffassung bei Marx selbst und bei Lenin, wo die politische Demokratie als eine „Heuchelei“ verstanden wird. Im zweiten Teil wird die Auffassung von Dewey über die Demokratie als „Modus des assoziierten Lebens“ analysiert, und es wird auf Ähnlichkeiten und auch auf Unterschiede zum früheren Demokratiekonzept von Marx hingewiesen. Der dritte Teil beschäftigt sich mit der Interpretation der demokratischen Gesellschaft als der identischen mit der globalen Gesellschaft, in der die menschliche Kommunikation uneingeschränkt von politischen Grenzen verläuft. In diesem Punkt werden auch ähnliche Positionen von Marx, Dewey und zeitgenössischen Autoren wie Giddens und Beck festgestellt. Zum Schluss wird die Vereinbarkeit zwischen politischer Demokratie und demokratischer Gesellschaft behauptet, gleichwohl wird die Idee von einer neuen unpolitischen demokratischen Gesellschaft und zwar einer globalen Gesellschaft als unrealistisch eingeschätzt. L‘article étudie la notion de démocratie chez John Dewey en la mettant en rapport avec les idées radicales de gauche passées et contemporaines . L‘article souligne les points de vue épistémologiques, anthropologiques et politiques communs à ces théories. Le rejet ou la sous-estimation de la démocratie politique ainsi que l‘accent mis sur la vie démocratique dans le but de créer une nouvelle société, complètement différente de toutes celles qui existent, relèvent d‘une importance particulière. L‘article est composé de trois parties. La (...) première explore la perception de la démocratie en tant que phénomène apolitique et synonyme d‘une nouvelle forme d‘existence humaine chez le jeune Marx, puis les regards ultérieurs de Marx et de Lénine sur la démocratie comme « hypocrisie ». La deuxième partie analyse le concept de démocratie selon Dewey en tant que « mode de vie connecté » et attire l‘attention sur quelques analogies significatives, tout comme sur les différences par rapport aux idées du jeune Marx. La troisième considère la perception de la société démocratique comme identique à la société globale dans laquelle la communication entre les hommes n‘est pas limitée par les frontières politiques. Sur cette question, on reconnaît des analogies significatives dans les pensées de Marx, Dewey et quelques penseurs contemporains . En conclusion, la démocratie politique et la société démocratique sont compatibles, mais l‘idée d‘une société apolitique démocratique autre que celle de la société globale est considérée comme irréaliste. De ce point de vue et dans cette société, la liberté et l’équité ont une position différente et un sens qui diffèrent dans les théories politiques modernes et dans les sociétés modernes. De quelle manière et pour quelles raisons théoriques et politiques sont annulés dans la théorie de la (...) « modernisation reflexive » les concepts de « liberté » et d’ « équité » qui sont si importants pour la théorie politique? In common law jurisdictions, legal professionals cite facts and legal principles from precedent cases to support their arguments before the court for their intended outcome in a current case. This practice stems from the doctrine of stare decisis, where cases that have similar facts should receive similar decisions with respect to the principles. It is essential for legal professionals to identify such facts and principles in precedent cases, though this is a highly time intensive task. In this paper, we present (...) studies that demonstrate that human annotators can achieve reasonable agreement on which sentences in legal judgements contain cited facts and principles. We further demonstrate that it is feasible to automatically annotate sentences containing such legal facts and principles in a supervised machine learning framework based on linguistic features, reporting per category precision and recall figures of between 0.79 and 0.89 for classifying sentences in legal judgements as cited facts, principles or neither using a Bayesian classifier, with an overall κ\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$\kappa$$\end{document} of 0.72 with the human-annotated gold standard. Confronted with an unprecedented scale of human-induced environmental crisis, there is a need for new modes of theorizing that would abandon human exceptionalism and anthropocentrism and instead focus on developing environmentally ethical projects suitable for our times. In this paper, we offer an anti-anthropocentric project of an ethos for living in the Anthropocene. We develop it through revisiting the notion of sustainability in order to problematize the linear vision of human-centric futurity and the uniform ‘we’ of humanity upon which it (...) relies. We ground our analyses in posthumanism and material feminism, using works by posthumanist and material feminist thinkers such as Stacy Alaimo, Rosi Braidotti, Donna Haraway and Jane Bennett, among others. In dialogue with them, we offer the concept of posthuman sustainability that decenters the human, re-positions it in its ecosystem and, while remaining attentive to difference, fosters the thriving of all instances of life. The issue of benefits in international clinical research is highly controversial. Against the background of wide recognition of the need to share benefits of research, the nature of benefits remains strongly contested. Little is known about the perspectives of research populations on this issue and the extent to which research ethics discourses and guidelines are salient to the expectations and aspirations existing on the ground. This exploratory study contributes to filling this void by examining perspectives of people in low-income South (...) African communities on benefits in international clinical research. Twenty-four individuals with and without experience of being involved in clinical research participated in in-depth interviews. Respondents felt that ancillary care should be provided to clinical research participants, while a clinical study conducted in particular community should bring better health to its members through post-trial benefits. Respondents' perspectives were grounded in the perception that the ultimate goal of international clinical research is to improve local health. We argue that perspectives and understandings of the respondents are shaped by local moral traditions rather than clinical research specificities and require attention as valid moral claims. It is necessary to acknowledge such claims and cultural worlds from which they emerge, thus building the foundation for equal and embracing dialogue to bridge different perspectives and handle contradicting expectations. ?Love hurts??as the saying goes?and a certain amount of pain and difficulty in intimate relationships is unavoidable. Sometimes it may even be beneficial, since adversity can lead to personal growth, self-discovery, and a range of other components of a life well-lived. But other times, love can be downright dangerous. It may bind a spouse to her domestic abuser, draw an unscrupulous adult toward sexual involvement with a child, put someone under the insidious spell of a cult leader, and even inspire (...) jealousy-fueled homicide. How might these perilous devotions be diminished? The ancients thought that treatments such as phlebotomy, exercise, or bloodletting could ?cure? an individual of love. But modern neuroscience and emerging developments in psychopharmacology open up a range of possible interventions that might actually work. These developments raise profound moral questions about the potential uses?and misuses?of such anti-love biotechnology. In this article, we describe a number of prospective love-diminishing interventions, and offer a preliminary ethical framework for dealing with them responsibly should they arise. (shrink)
The paper analyses and evaluates the linguistic policy of the Court of Justice of the European Union against the background of other multilingual courts and in the light of theories of legal interpretation. Multilingualism has a direct impact upon legal interpretation at the Court, displacing traditional approaches with a hermeneutic paradigm. It also creates challenges to the acceptance of the Court’s case-law in the Member States, which seem to have been adequately tackled by the Court’s idiosyncratic translation policy.
At the bedside, nurses are expected to be precise when they read indications on screens and on the bodies of patients and decide on the meaning of words framed by the context of acute care. In academia, although there is no incident report to fill when we misread or misrepresent complex philosophical ideas, the consequences of inaccurate reading include misplaced epistemological claims and poor scholarship. A long and broad convention of nursing phenomenological research, in its various forms, claims a philosophical (...) grounding in the ideas of Husserl, Heidegger, and other thinkers. But for nearly two decades, nurse phenomenologists' knowledge claims have been challenged by well‐informed criticisms, most notably by John Paley. At the heart of criticism lies an observation that Continental phenomenological thought is misrepresented in many nursing sources and that nursing phenomenology, both descriptive and interpretive, cannot appeal to the authority of either Husserl or Heidegger. Taking these criticisms seriously, I am asking, Is phenomenology after Paley possible? If misreading seems to be an issue, how can – or should – we read rigorously? My thinking through these questions is influenced by the ideas of Jacques Derrida. Under a condition of a play of language, of Derridian différance, when meaning is never self‐identical and never fully arrives, I suggest that one has to negotiate meanings through reading for differences. I develop this idea in relation to the methodological conventions of phenomenological nursing research and argue for a careful rereading of the whole field of phenomenological nursing research. Such rereading presupposes and necessitates interdisciplinary engagement between nursing and the humanities and interpretive social sciences. Greater familiarity with research practices of those disciplines that stress theoretical and writing rigour might make visible the limits of nursing research approaches and their quality criteria. An understanding of philosophical and theoretical works – a condition of quality scholarship – depends on our reading of both originary texts and contemporary literature from the humanities and the social sciences. This understanding, far from obliging researchers to always trace their work to its philosophical roots, opens other, often more sound, methodological possibilities. (shrink)
In this commentary, I reflect on the differences between two independent citizen approaches to monitoring radiological contamination, one in Belarus after the 1986 Chernobyl nuclear accident and the other in Japan following the 2011 Fukushima Daiichi accident. I examine these approaches from the perspective of their contribution to making radiological contamination more publicly visible. The analysis is grounded in my earlier work, where I examined how we have come to know what we know about post–Chernobyl contamination and its effects in (...) Belarus, a former Soviet republic most heavily affected by the fallout. As I described in this study, much of what we know about the consequences of Chernobyl is based on the work of the Belarusian nonprofit Institute of Radiation Safety, “Belrad.” I compare Belrad’s approach to radiological monitoring with the work of the volunteer network Safecast, arguably one of the best-known citizen science projects in the world, which is working to monitor the scope of the post–Fukushima contamination. Through this comparison of approaches, I raise broader questions about a form of sensing practices—data-related practices of citizen science that make environmental hazards publicly in/visible. In this paper I present a way of formally representing proper names in accordance with a description theory of reference–fixing and show that such arepresentation makes it possible to retain the claim about the rigidity of proper names and is not vulnerable to Kripke’s modal objection.
This paper attempts to be a contribution to the epistemological project of explaining complex conceptual structures departing from more basic ones. The central thesis of the paper is that there are what I call “functionally structured concepts”, these are non-harmonic concepts in Dummett’s sense that might be legitimized if there is a function that justifies the tie between the inferential connection the concept allows us to trace. Proving this requires enhancing the russellian existential analysis of definite descriptions to apply to (...) functions and using this in proving the legitimacy of such concepts. The utility of the proposal is shown for the case of thick ethical terms and an attempt is made to use it in explaining the development of natural numbers. This last move could allow us to go one step lower in explaining the genesis of natural numbers while maintaining the notion of abstract numbers as higher order entities. (shrink)
The role of bacterial variation in the waxing and waning of epidemics was a subject of lively debate in late nineteenth and early twentieth-century bacteriology and epidemiology. The notion that changes in bacterial virulence were responsible for the rise and fall of epidemic diseases was an often-voiced, but little investigated hypothesis made by late nineteenth-century epidemiologists. It was one of the first hypotheses to be tested by scientists who attempted to study epidemiological questions using laboratory methods. This paper examines how (...) two groups of experimental epidemiologists, the British group led by W. W. C. Topley and Major Greenwood, and an American group directed by Leslie T. Webster at the Rockefeller Institute, studied the role of variations in bacterial virulence in the course of laboratory epidemics of mouse typhoid. Relying on Ludwik Fleck’s concept of thought styles and thought collectives, the paper analyzes the fundamental conceptual differences between these two groups of researchers and analyzes the kinds of innovations they introduced as they attempted to integrate bacteriological and epidemiological approaches. The paper shows that the stylistic differences between the two groups can be understood better in the context of the institutional histories and disciplinary relations of epidemiology and bacteriology in the two countries. In this paper I argue that descriptive content associated with a proper name can serve as a truth-conditionally relevant adjunct and be an additional contribution of the name to the truth-conditions. Definite descriptions the so-and-so associated by speakers with a proper name can be used as qualifying prepositional phrases as so-and-so, so sentences containing a proper name NN is doing something could be understood as NN is doing something as NN. Used as an adjunct, the descriptive content of a proper (...) name expresses the additional circumstances of an action and constitute a part of a predicate. I argue that qualifying prepositional phrases should be analyzed as predicate modifiers and propose a formal representation of modified predicates. The additional truth-conditional relevance of the descriptive content of a proper name helps to explain the phenomenon of the substitution failure of coreferential names in simple sentences. (shrink)
In recent years, the biopharmaceutical industry has seen an increase in the development of so-called orphan drugs for the treatment of rare and neglected diseases. This increase has been spurred on by legislation in the United States, Europe, and elsewhere designed to promote orphan drug development. In this article, we examine the drivers of corporate social responsibility (CSR) activities in orphan drug markets and the extent to which biopharmaceutical firms engage in these activities with a strategic orientation. The unique context (...) of orphan drugs constitutes a research opportunity to test the applicability of existing theoretical perspectives on CSR and strategic CSR. Using Schwartz and Carroll’s (Bus Ethics Q, 13(4):503–530, 2003) three-domain approach to CSR and the literature on strategic CSR as a theoretical background, we employ a combination of semi-structured interviews and a quantitative website content analysis to study practices of biopharmaceutical firms in the United States and European Union. Our findings show that both US- and EU-based companies engaged in orphan drugs development perceive their involvement as a responsible business activity beyond the economic dimension of CSR. However, for the majority of these companies their CSR activities do not qualify as strategic according to the criteria established in the literature. We also find significant differences between larger and smaller firms in their use of CSR. Based on these findings, we make several suggestions regarding orphan drug legislation and other measures that might help firms exploit strategic CSR benefits. (shrink)
The processing, representation, and perception of bodily signals (interoception) plays an important role for human behavior. Theories of embodied cognition hold that higher cognitive processes operate on perceptual symbols and that concept use involves reactivations of the sensory-motor states that occur during experience with the world. Similarly, activation of interoceptive representations and meta-representations of bodily signals supporting interoceptive awareness are profoundly associated with emotional experience and cognitive functions. This article gives an overview over present findings and models on interoception and (...) mechanisms of embodiment and highlights its relevance for disorders that are suggested to represent a translation deficit of bodily states into subjective feelings and self-awareness. Ethical guidelines for psychologists are meant to stimulate and help psychologists to act appropriately with respect to clients, colleagues, and other individuals involved in their professional relations. This paper focuses on the similarity of codes of ethics of psychologists in European countries in general, and on specific ethical dilemmas in the area of work and organizations in particular. First, an overview is given of the development of ethical guidelines in Europe and the USA. Second, the results are presented of a (...) survey by E-mail amongst members of the European Federation of Psychologists’ Associations (EFPA) to identify the differences and similarities between ethical guidelines of the affiliate members. Third, the potential dilemmas of stakeholders in work and organizational assessment are addressed. Finally, the results of a survey among Dutch selection psychologists are presented. The purpose of this study was to examine a possible tension between normative behavior and attitudes about normal behavior. It was concluded that ethical guidelines of European countries cover comparable (sub-)principles and that there are indications that individual psychologists agree with the written principles. Зокрема, автори вважають найбільш дієвими заходами з боку держави реалізацію комплексних програм управління здоров'ям працівників, що включають такі пункти як зниження питомої ваги поведінкових чинників ризику. З огляду на це профілактична робота і в суспільстві, й на конкретному підприємстві повинна передбачати роботу з попередження шкідливих звичок, формування здоров'язберігаючого середовища і громадської думки, що підтримує практики здоров'язберігаючої поведінки. Важливим аспектом концепції здоров'я працездатного населення (...) автори вважають пріоритет соціальних детермінант над впливом медицини і системи охорони здоров'я. (shrink)
The paper explores memes, digital artefacts that acquire a viral character and become globally popular, as an aesthetic trend that not only entices but propels and molds subjective, collective and political becoming. Following both Simondon and Bakhtin, memes are first considered as aesthetic objects that mediate individuation. Here, resonance between psychic, collective and technical individuation is established and re-enacted through the aesthetic consummation of self, the collective and the technical in the various performances of meme cultures. Secondly, if memes are (...) followed in the making, from birth to their spill-over onto wider social networks, the very expressive form of meme turns out to be borne by specific technical architecture and mannerisms of a small number of platforms, and, most notably, the image board 4chan. The source of memes’ various forms of power is concentrated here. Memes are intimately linked to 4chan’s /b/ board, the birthplace of Lulzsec and the Anonymous hacking networks. Memes’ architectonics, as an inheritance of a few specific human-technical structures, in turn informs the production of new platforms, forms of networked. (shrink)
