Este trabajo presenta un argumento en favor de la exigencia de verdad de las proposiciones descriptivas de los hechos en controversias que normalmente integran el contenido de las sentencias en el derecho contemporáneo. Esta exigencia es, de este modo, un criterio de justificación de las decisiones judiciales. Para desarrollar el argumento se recurre al análisis de las nociones de “decisión judicial”, de “aplicación” de normas generales y de “justificación normativa”. Se revisan, asimismo, diversas formas del escepticismo kelseniano acerca de esa (...) exigencia de verdad y se sostiene que no son exitosas. (shrink)

Este trabajo se propone, como un paso final, el examen del argumento de Carlos Nino a favor de la existencia de una obligación moral de obedecer al derecho producido por un gobierno democrático. Este argumento vendría a mostrar además que la democracia es la única forma de gobierno moralmente legítima. En la idea de Nino ambas cuestiones son equivalentes y una respuesta positiva es considerada necesaria para determinar la posibilidad de justificación de las decisiones de los jueces. La tesis en (...) cuestión se apoya en una compleja concepción acerca de dimensión justificatoria del derecho y su conexión con la moral, como una condición necesaria. Por ello, se revisa las nociones de las que depende esa propuesta de Nino, especialmente las ideas de razón para la acción, justificación, principio moral y norma jurídica y se formula un interrogante acerca del éxito del argumento, si se acepta esa concepción general. This paper attempts to examine Carlos Nino’s argument supporting the existence of a moral obligation to obey the law produced by a democratic government. This argument also goes on to show that democracy is the only morally legitimate form of government. In Nino’s conception, both issues are equivalent, and a positive response is considered necessary to determine the possibility to justify judges’ decisions. The thesis in question rests on a complex conception regarding the law’s justificatory dimension, and its connection with morality as a necessary condition. This is why the notions upon which Nino’s proposal rests are examined, above all the ideas of reason for action, justification, moral principle and legal norm. If we accept this general conception, then we should ask about the success of the argument. (shrink)

En este trabajo se propone, en primer lugar, un análisis informal de las principales ideas de la concepción filosófica de Carlos Alchourrón en torno a la naturaleza de los lenguajes derrotables, en especial de los lenguajes normativos. Esta concepción que, a su vez, conforma el trasfondo de sus propuestas en el ámbito de la lógica de condicionales derrotables, supone que la derrotabilidad es un rasgo que se ubica en la dimensión pragmática del lenguaje. Se discuten sus consecuencias con relación a (...) diversas cuestiones, teniendo en cuenta la tesis de Alchourrón según la cual las proposiciones y las normas son el significado de las expresiones usadas en contextos definidos. En segundo lugar, se sostiene que lo que Alchourrón denomina "concepción disposicional de la derrotabilidad", en su artículo "Sobre Derecho y Lógica" representa -al menos en lo que respecta al ámbito normativo- un cambio sustancial de su idea de la derrotabilidad. Esta modificación supone, en relación a las normas, adoptar una versión de la teoría disposicional del valor. Se sostiene que, sin embargo, la nueva propuesta no es plausible, porque no puede superar a lo que puede ser denominado "el problema del límite de las disposiciones", por un lado, ni tampoco "el problema de la indeterminación necesaria", por el otro. The purpose of this paper is, in the first place, to provide an informal analysis of the main ideas of Carlos Alchourrón' s philosophical conception about the nature of defeasible languages, and in particular about that of normative languages. This conception, which constitutes also the background for his proposals in the field of the logic of defeasible conditionals, assumes that defeasibility belongs to the pragmatic dimension of language. Its consequences in relation to several questions are discussed, taking into account Alchourrón' s thesis according to which propositions and norms are the meaning of the expressions used in defined contexts. Secondly, it is maintained that what Alchourrón denominates "dispositional conception of defeasibility" in his article "On Law and Logic" represents a substantial change of his ideas about defeasibility, at least in what concerns the normative field. As far as norms are concerned this modification entails the adoption of a version of the dispositional theory of the value. Nevertheless, it is argued that this new proposal is not plausible because it cannot solve neither what can be called the "problem of the limit of dispositions" nor the "problem of the necessary indetermination". Este número de Análisis Filosófico, como el anterior, presenta trabajos elaborados en homenaje a Eugenio Bulygin, la mayoría de los cuales fueron presentados en el Seminario organizado por la Sociedad Argentina de Análisis Filosófico en octubre de 2012. Habida cuenta que en ese material se discuten tópicos de las más diversa índole, se ha optado por incluirlos en los dos números siguiendo el orden alfabético de sus autores.

Eugenio Bulygin mantiene la tesis según la cual la objetividad del derecho depende de la objetividad del conocimiento del derecho. Esta tesis depende de la distinción entre las normas y las proposiciones normativas. las proposiciones normativas son las que tienen que expresar ese conocimiento, en cuanto son aptas para ser verdaderas o falsas, a la inversa de las normas. Así, esa objetividad es una función de las condiciones de verdad de esas proposiciones. Como, además, según Bulygin, solo existen hechos en (...) la dimensión empírica, esas condiciones solo pueden referirse a esa clase de circunstancias. Sin embargo, se sostiene en este artículo, la distinción kelseniana entre sentidos subjetivos y objetivos y la idea correlativa de "validez normativa" plantean un problema a esa manera de entender las proposiciones normativas, a la hora de explicar la objetividad del derecho. Eugenio Bulygin supports the thesis according to which the objectivity of law depends on the objectivity of the knowledge of law. This thesis depends on the distinction between norms and normative propositions. Normative propositions are those that must express this knowledge, insofar as they are apt to be true or false, contrary to norms. Thus, this objectivity is a function of the truth conditions of these propositions. Also, as facts only exist in the empirical dimension according to Bulygin, these conditions can only refer to this class of circumstances. However, the Kelsenian distinction between subjective and objective senses and the idea of "normative validity", this article claims, poses a problem for this way of understanding normative propositions when it comes to explaining the objectivity of law. En este trabajo ofrezco un análisis de algunas de las ideas más importantes sostenidas por Ricardo Caracciolo en su ensayo sobre hechos y justifi cación de las decisiones judiciales. Estas tesis son: a) tesis de la aplicación posible. Las normas generales sólo se pueden aplicar a los casos que ellas regulan; b) tesis de la aplicación efectiva. Una norma general es aplicada a un hecho sólo si la premisa que describe ese hecho es verdadera. Este artículo muestra que (...) hay buenas razones para revisar ambas tesis ya que ellas pasan por alto una distinción relevante entre distintos sentidos de ‘casos individual’: casos individuales de un universo del discurso y casos individuales de un caso genérico. Como consecuencia de ello, se señala que es necesario modelar un concepto de justifi cación jurídica que no presuponga a esas mencionadas tesis. (shrink)

In this chapter, Ricardo Silvestre and Alan Herbert offer a reconstruction of the Gītā’s concept of God with a focus on the relationship between God and the world. They try to explain the claim that the Gītā is panentheistic. This is done with the help of some key notions of contemporary metaphysics (such as ontological dependence and fundamentality) along with the Indic notion of prakṛti, considered as a metaphysical primitive denoting the intimate relationship that exists between matter and conscious (...) living beings on the one hand, and God on the other. The use of new paradigms of false belief tasks allowed to reduce the age of children who pass the test from the previous 4 years in the standard version to only 15 months or even a striking 6 months in the nonverbal modification. These results are often taken as evidence that infants already possess an—at least implicit—theory of mind. We criticize this inferential leap on the grounds that inferring a ToM from the predictive success on a false belief task requires (...) to assume as premise that a belief reasoning is a necessary condition for correct action prediction. It is argued that the FBT does not satisfactorily constrain the predictive means, leaving room for the use of belief-independent inferences. These heuristics, when applied to the FBT, can achieve the same predictive success of a belief-based inference because information provided by the test stimulus allows the recognition of particular situations that can be subsumed by their ‘laws’. Instead of solving this issue by designing a single experimentum crucis that would render unfeasible the use of non-representational inferences, we suggest the application of a set of tests in which, although individually they can support inferences dissociated from a ToM, only an inference that makes use of false beliefs is able to correctly predict all the outcomes. Any plausibly just market exchange must balance two conflicting moral considerations: non-worseness (Wertheimer, 1999) and euvoluntariness (true voluntariness; Munger, 2011). We propose an analytical theory of just market exchange that partly resolves this conflict.

Is it possible to combine different logics into a coherent system with the goal of applying it to specific problems so that it sheds some light on foundational aspects of those logics? These are two of the most basic issues of combining logics. Paranormal modal logic is a combination of paraconsistent logic and modal logic. In this paper, I propose two further combinatory developments, focusing on each one of these two issues. On the foundational side, I combine paranormal modal logic (...) with normal modal logic, resulting into a paraconsistent and paracomplete multimodal logic dealing with the notions of plausibility and certainty. On the application side, I combine this logic with Reiter’s default logic, resulting into an inductive and consequently nonmonotonic paraconsistent and paracomplete logic able to represent some key inductive principles. We uncover fundamental dimensions of the process through which organizations embed the practice of fraternity through embarking on an organizational journey in the direction of the common good. Building on the latest encyclical of Pope Francis, _Fratelli Tutti_, about fraternal and social friendship, we offer insight into the understanding of what it means to become a fraternal organization and reflect on the key ethical and paradoxical challenges for organizations aiming at collectively contributing to the common good. We add to previous (...) work by characterizing this journey as a process involving unique ethical challenges that emerge from the paradoxes associated with this process and how this might change the nature of the relationships between organizations and others within the organizational landscape. Mathematics is a critical part of much scientific research. Physics in particular weaves math extensively into its instruction beginning in high school. Despite much research on the learning of both physics and math, the problem of how to effectively include math in physics in a way that reaches most students remains unsolved. In this paper, we suggest that a fundamental issue has received insufficient exploration: the fact that in science, we don’t just use math, we make meaning with it in (...) a different way than mathematicians do. In this reflective essay, we explore math as a language and consider the language of math in physics through the lens of cognitive linguistics. We begin by offering a number of examples that show how the use of math in physics differs from the use of math as typically found in math classes. We then explore basic concepts in cognitive semantics to show how humans make meaning with language in general. The critical elements are the roles of embodied cognition and interpretation in context. Then, we show how a theoretical framework commonly used in physics education research, resources, is coherent with and extends the ideas of cognitive semantics by connecting embodiment to phenomenological primitives and contextual interpretation to the dynamics of meaning-making with conceptual resources, epistemological resources, and affect. We present these ideas with illustrative case studies of students working on physics problems with math and demonstrate the dynamical nature of student reasoning with math in physics. We conclude with some thoughts about the implications for instruction. (shrink)
