  1. Are intellectual property rights compatible with Rawlsian principles of justice?Darryl J. Murphy - 2012 - Ethics and Information Technology 14 (2):109-121.
This paper argues that intellectual property rights are incompatible with Rawls’s principles of justice. This conclusion is based upon an analysis of the social stratification that emerges as a result of the patent mechanism which defines a marginalized group and ensure that its members remain alienated from the rights, benefits, and freedoms afforded by the patent product. This stratification is further complicated, so I argue, by the copyright mechanism that restricts and redistributes those rights already distributed by means of the (...)

The rhetoric of “unprincipled” philosophy. A critical notice of articulated experiences: Towards a radical phenomenology of contemporary social movements.Darryl J. Murphy - 2005 - The European Legacy 10 (4):389-395.
In this critical notice I review the main ideas presented in Peyman Vahabzadeh's thought-provoking investigation into the genesis of new social movements, Articulated Experiences: Towards a Radical Phenomenology of Contemporary Social Movements. I examine two central features of Vahabzadeh's work: (i) its notion of ?ultimate referentiality;? and (ii) the centrality of the role accorded to language in Vahabzadeh's overall theory. I argue that in his stipulation that language is the most fundamental mediating factor in articulation and acts of identification, Vahabzadeh (...)

The association of moral development and moral intensity with music piracy.Darryl J. Woolley - 2015 - Ethics and Information Technology 17 (3):211-218.
Prior research has not found a meaningful relationship between digital piracy and moral development, possibly because students do not recognize digital piracy as a moral issue. Rather than measure moral development as an individual characteristic, this study tests which components of moral development are seen as relevant to digital piracy. If some of the stages of moral development are applicable to music piracy behavior, people are more likely to pirate than to engage in other more morally intense behaviors. Some of (...)

Quantum Cosmology and the Laws of Nature: Scientific Perspectives on Divine Action.Robert J. Russell, Nancey C. Murphy & C. J. Isham (eds.) - 1993 - Vatican Observatory.
This collection of research papers explores the implications of quantum cosmology and the status of the laws of nature for theological and philosophical issues regarding God's action in the world. The main goal is to contribute to constructive theology as it engages current research in the natural sciences, and to investigate the philosophical and theological elements in ongoing theoretical research in the natural sciences.

    Differentiating insight from non-insight problems.K. J. Gilhooly & P. Murphy - 2005 - Thinking and Reasoning 11 (3):279 – 302.
This study aimed to investigate whether a range of tasks that have been generally classed as requiring insight form an empirically separable group of tasks distinct from tasks generally classed as non-insight. In this study, 24 insight tasks, 10 non-insight tasks, and tests of individual differences in cognitive abilities and working memory were administered to 60 participants. Cluster analysis of the problem-solving tasks indicated that the presumed insight problems did tend to cluster with other presumed insight problems, and similarly the (...)

Ambiguity and Hope: Disclosure Preferences of Less Acculturated Elderly Mexican Americans Concerning Terminal Cancer—A Case Story.Gelya Frank, Leslie J. Blackhall, Sheila T. Murphy, Vicki Michel, Stanley P. Azen, Haydee Mabel Preloran & Carole H. Browner - 2002 - Cambridge Quarterly of Healthcare Ethics 11 (2):117-126.
A major shift has taken place since the 1960s concerning disclosure to patients that they have a diagnosis of cancer and that their disease is considered terminal. Full disclosure is now considered the patient's right in the United States. However, there remain many countries in which nondisclosure is still the norm. When patients from those countries are diagnosed with cancer in America, differences in attitudes and expectations can cause conflict and misunderstanding.

Cross-Cultural and Site-Based Influences on Demographic, Well-being, and Social Network Predictors of Risk Perception in Hazard and Disaster Settings in Ecuador and Mexico.Eric C. Jones, Albert J. Faas, Arthur D. Murphy, Graham A. Tobin, Linda M. Whiteford & Christopher McCarty - 2013 - Human Nature 24 (1):5-32.
Although virtually all comparative research about risk perception focuses on which hazards are of concern to people in different culture groups, much can be gained by focusing on predictors of levels of risk perception in various countries and places. In this case, we examine standard and novel predictors of risk perception in seven sites among communities affected by a flood in Mexico (one site) and volcanic eruptions in Mexico (one site) and Ecuador (five sites). We conducted more than 450 interviews (...)

The conflict between courts and medicine is best shown in the mental health cases requiring judgment of whether a person should be confined, and whether they should be medicated or left free to decide for themselves. In such cases, deprivation of liberty for noncriminal offenders is at question, but if they are released, they may be exposed to injury or injure others. “Clear and convincing” evidence is hard to prove in such cases. The TOPOFF 2 terrorism preparedness exercise was two years (...)

Legacies of Love, Peace and Hope: How Bioethics Education can Overcome Hatred and Divide.Darryl R. J. Macer - 2020 - Bangladesh Journal of Bioethics 11 (3):33-42.
In our pursuit of a good life (eubios), both individuals and societies, need to educate themselves on the pursuit of love of life in all domains, self-love, love of others, loving good and love of life. In this paper I reflect on my own journey through growing up in Christchurch, and experiences around the world, that are the basis for that conclusion. In our efforts to pursuit bioethics education we can enhance peaceful and harmonius coexistence in our world, through nurturing (...)

Retribution, Justice, And Therapy: Essays in the Philosophy of Law.J. G. Murphy - 1979 - Springer Verlag.
One might legitimately ask what reasons other than vanity could prompt an author to issue a collection of his previously published essays. The best reason, I think, is the belief that the essays hang together in such a way that, as a book, they produce a whole which is in a sense greater than the sum of its parts. When this happens, as I hope it does in the present case, it is because the essays pursue related themes in such (...)

The Public and the Profession: Meeting at the Right Place.Donald J. Murphy - 1994 - Journal of Law, Medicine and Ethics 22 (2):161-162.
Spielman’s taxonomy of collective decision making about medical futility is timely and insightful. Her conclusion, that laws are the best reflection we have of collective values, may be accurate. However, a closer look at the six alternatives for collective decisions is necessary before we rely too heavily on the legislature. The first two alternatives, decisions by professional organizations and by health care facilities, smack of paternalism. Spielman suggests that statements from professional organizations or health care facilities express professional values and lack (...)

A central question of this chapter is how we can relate the unique ethos of Japan to the ways that influences of international bioethics, civil rights and legal reforms have shifted medical research in Japan from the legacy of the structured paternalism and impunity that allowed abuses to be committed by medical researchers in the World War II era, including in Unit 731 and in medical schools in Japan, to contemporary research agendas and policies. Throughout the twentieth century, Japan has (...)
