In response to Albrecht et al.’s (J Agric Environ Ethics 26(4):827–845, 2013) discussion on the ethics of assisted migration, we emphasize the issues of risk and scientific uncertainty as an inextricable part of a comprehensive ethical evaluation. Insisting on a separation of risk and ethical considerations, although arguably common in many policy contexts, is at best misguided and at worst damaging.

Risk decisions often appear unsatisfactory after a calamity has taken place. This holds even when they are products of systematic risk analysis. Yet, if relevant considerations available to be known pre-accident were adequately taken into account and safety measures implemented accordingly, nobody seems morally blameworthy. In this paper, I advance a two-way argument. Firstly, I show how analysis of post-accident apologizing sheds new light on vexed tensions in ethical assessment of risk impositions. This amounts to exposing conflicting moral intuitions in (...) risk decisions, discussing problematic tenets in risk analysis as well as outlining three lines of arguments that destabilize the very notion of correct risk analysis. The analysis indicates that bringing different discussions of moral blameworthiness together facilitates resolving the tensions. It also calls for further and early-on collaboration between risk theorists and ethicists in order to carry these insights to risk analysis. Secondly, I argue that analysis of risk decisions, in part, reveals a discrepancy between the definitional work done on apology and what is required by ethics. Virtually every suggestion for the gold standard for apology involves moral blameworthiness as a necessary condition. I highlight different kinds of cases in which nobody is culpable, but an apology can be morally fitting or required. It would be nonsensical to say that, in these cases, one ought to apologize, but in a disingenuous manner. (shrink)

The SynBioSecurity argument says that synthetic biology introduces new risks of intentional misuse of synthetic pathogens and that, therefore, there is a need for extra regulations and oversight. This paper provides an analysis of the argument, sets forth a new version of it, and identifies three developments that raise biosecurity risks compared to the situation earlier. The developments include a spread of the required know-how, improved availability of the techniques, instruments and biological parts, and new technical possibilities such as “resurrecting” (...) disappeared pathogens. It is first shown that the general argument from SynBioSecurity needs to be qualified and that many improvements to biosecurity have already been implemented, most notably in the United States. Second, I suggest a new strain of the argument: the situation that most branches of synthetic biology fall under the gene technology regulation in the European Union and that this regulation in its current form does not adequately address SynBioSecurity risks together provide a weighty reason to review and possibly refine the legislation as well as the supervisory practices. Ethically speaking, the rise in the relative risk of bioterrorism brings to the fore new extrinsic issues. (shrink)

This paper spells out and discusses four assumptions of the deficit model type of thinking. The assumptions are: First, the public is ignorant of science. Second, the public has negative attitudes towards (specific instances of) science and technology. Third, ignorance is at the root of these negative attitudes. Fourth, the public’s knowledge deficit can be remedied by one-way science communication from scientists to citizens. It is argued that there is nothing wrong with ignorance-based explanations per se. Ignorance accounts at least (...) partially for many cases of opposition to specific instances of science and technology. Furthermore, more attention needs to be paid to the issue of relevance. In regard to the evaluation of a scientific experiment, a technology, or a product, the question is not only who knows best?, but also what knowledge is relevant and to what extent?. During recent years the relevance of environmental ethics to nature conservation has been increasingly questioned. This doubt mainly takes two forms: (1) Conservation biology is regarded as solely a scientific endeavor, and therefore ethics is redundant; (2) It is acknowledged that values are part and parcel of conservation science, practice and policy, but environmental ethics is considered to have little positive contribution to make. We focus on the latter form and argue that it enables only suppressed normative premises omitted from (...) critical scrutiny, and that relying on suppressed premises for making prescriptive conclusions is normatively unreasonable. Furthermore, even if the normative premises were well-founded, the stance has unwelcome implications. We show ways in which environmental ethics provides critical and structured manners of reasoning on normative premises. This invites more collaboration between nature conservation and environmental ethics in the future. (shrink)

Assisted migration is a controversial conservation measure that includes moving species threatened by climate change beyond their indigenous range. Sandler argues that assisted migration exhausts most of the value of the species moved and that assisted migration, thus, fails to be a workable conservation measure. We show how accepting the moral relevance of species' indigenous range helps to reconcile Sandler's argument with earlier arguments about value loss in ecosystem restoration by Elliot and Katz. Contrary to Sandler, they do not favour (...) losing a biological unit to retaining it in a human-influenced form. Drawing on the distinction between property- and history-based understandings of naturalness, we further argue that the outcomes of assisted migration to the predicted range are more natural in the property-based sense of the term, and thus retain more value, than the outcomes of "assisted migration" elsewhere. Die Untersuchung gliedert sich in drei durch eine Einführung und eine Schlussbetrachtung eingerahmte Hauptkapitel. Im ersten Hauptkapitel geht es um Kants Raum- und Zeitkonzeption in seiner vorkritischen Phase unter Berücksichtigung seiner Reaktion auf die zeitgenössische Kritik an seiner Konzeption von 1770. Dabei wird Kants komplexer Denkweg hin zu seiner Wende zum Verständnis von Raum und Zeit als reinen Anschauungen thematisiert. Hieran schließt sich im zweiten Hauptkapitel die Behandlung der prominenteren, systematisch ausgereiften Raum- und Zeitkonzeption in der Kritik der reinen Vernunft (...) an, wobei zunächst die unterschiedlichen Argumente aus der transzendentalen Ästhetik sukzessive und unter Einschluss der Forschungsliteratur diskutiert werden und Raum und Zeit als formale Anschauungen in der transzendentalen Analytik sowie als Ideen der Vernunft in der transzendentalen Dialektik zur Sprache kommen. Ein dritter Hauptteil widmet sich Kants Verständnis von Raum und Zeit in der Kritik der Urteilskraft, wo Kants Lehre neue Impulse erfährt und im Kontext der philosophischen Ästhetik, der Kultur sowie des Erhabenen relevant wird. This paper considers the question of whether the influential distinction between levels of explanation introduced by David Marr can be used as a general framework for contemplating levels of explanation in cognitive sciences. Marr introduced three levels at which we can explain cognitive processes: the computational, algorithmic, and implementational levels. Some argue that Marr’s levels of explanation can only be applied to modular cognitive systems. However, since many psychological processes are non-modular, it seems that Marr’s levels of explanation cannot explain (...) such psychological processes. To show that the latter claim is not convincing, the paper draws upon an influential paradigm from cognitive sciences that is based on the principle of free energy. Based on this paradigm, the paper argues that even non-modular psychological processes can be computationally analyzed and algorithmically implemented. The conclusion of the paper is that, at least under the assumption that the func- tion of the mind is to minimize free energy, Marr’s levels of explanation can be successfully used as a general framework for understanding psychological processes at different levels of description. The prediction error minimization framework denotes a family of views that aim at providing a unified theory of perception, cognition, and action. In this paper, I discuss some of the theoretical limitations of PEM. It appears that PEM cannot provide a satisfactory explanation of motivated reasoning, as instantiated in phenomena such as self-deception, because its cognitive ontology does not have a separate category for motivational states such as desires. However, it might be thought that this objection confuses levels of explanation. (...) Self-deception is a personal level phenomenon, while PEM offers subpersonal explanations of psychological abilities. Thus, the paper examines how subpersonal explanations couched in the PEM framework can be thought of as related to personal level explanations underlying self-deception. In this regard, three views on the relation between personal and subpersonal explanations are investigated: the autonomist, the functionalist, and the co-evolutionary perspective. I argue that, depending on which view of the relation between the personal and subpersonal is adopted, the PEM paradigm faces a dilemma: either its explanatory ambitions should be reduced to the subpersonal domain, or it cannot provide a satisfactory account of motivated reasoning as instantiated in self-deception. In the paper, I examine the conditions that are necessary for the correct characterization of the phenomenon of self-deception. Deflationists believe that the phenomenon of self-deception can be characterized as a kind of motivationally biased belief-forming process. They face the selectivity problem according to which the presence of a desire for something to be the case is not enough to produce a self-deceptive belief. Intentionalists argue that the solution to the selectivity problem consists in invoking the notion of intention. According (...) to them, self-deception involves intentional distortion of one's own belief-forming process. In this paper, I defend the claim that intentionalists also face the problem of selectivity. Accordingly, I argue that this objection cannot be used to determine which theory of self-deception is superior. Furthermore, I argue that limiting folk-psychological explanations to reason-based explanations might be responsible for the resilience of the selectivity problem. In that context, as an additional explanatory factor, I emphasize personality traits that, along with motives, play an important role in the psychological explanation of human behavior. In the rest of the paper, I explore how such an expanded view of the folk-psychological explanation can be used to better capture individual cases of self-deception. (shrink)

According to the so-called ‘Taking Condition’ (a label due to Boghossian 2014) on inference, for a response R in circumstances C to count as an instance of reasoning or inferring, it must be the case that the agent’s taking it that R is warranted or justified in C plays (the right sort of) explanatory role in her R-ing. The Taking Condition has come under much criticism in the theory of reasoning. While I believe that these criticisms can be answered, my (...) aim in this paper is to build a positive case for the Taking Condition. More specifically, I argue that views based on the Taking Condition do a much better job accounting for crucial features of reasoning—especially once we recognize the pervasiveness and significance of defeasibility in our reasoning. We discuss the difference between formal and natural languages, and argue that should the language metaphor have any foundation, it’s analogy with natural languages that should be taken into account. We discuss how such operation like reading, writing, sign, interpretation, etc., can be applied in the realm of the living and what can be gained, by such an approach, in order to understand the phenomenon of life.

In this new book, Marko Zlomislić argues that Slavoj Žižek's work does not contain any sort of radical emancipatory project, especially as it passes through the ideology of communism and Lacanian psychoanalysis. The evidence for the failure of communism is vast and includes the more than six hundred mass graves recently located in Žižek's homeland of Slovenia. Zlomislić demonstrates that the way out of the capitalist dilemma is not a repetition of communism but a return to the late medieval (...) notion of haecceity or "individual thisness" that was rejected by modernity. Haecceity, or the indescribable and indefinite here and now of the person, shows that the late medieval Franciscans were already "postmodernists." It is no wonder that the totalitarianism of the modernist Hegel is embraced by thinkers such as Žižek, Badiou, Hardt, Negri, and Laclau and was already rejected by Leibnitz, Kierkegaard, Nietzsche, Levinas, Deleuze, and Derrida. This important book shows that Žižek's work must be rejected because it does not uphold the dignity, worth, and uniqueness of the person. (shrink)

In this study, we examine the influence of senior leadership on firms’ corporate social responsibility. We integrate upper echelons research that has investigated either the influence of the CEO or the top management team on CSR. We contend that functional experience complementarity between CEOs and TMTs in formulating and implementing CSR strategy may underlie differentiated strategies in CSR. We find that when CEOs who have predominant experience in output functions are complemented by TMTs with a lower proportion of members who (...) have experience in output functions, there is a pronounced effect on the community, product, and diversity dimensions of CSR. In turn, when output-oriented CEOs are complemented by output-oriented TMTs, we observe an effect on the employee relations dimension of CSR. Interestingly, we find no influence of CEO-TMT complementarity on the environment dimension of CSR. In general, our empirical results support the relevance of the interaction between CEOs and their TMTs in defining their firms’ CSR profile. (shrink)

We provide a novel Bayesian justification of inference to the best explanation. More specifically, we present conditions under which explanatory considerations can provide a significant confirmatory boost for hypotheses that provide the best explanation of the relevant evidence. Furthermore, we show that the proposed Bayesian model of IBE is able to deal naturally with the best known criticisms of IBE such as van Fraassen?s?bad lot? argument.

Gilbert's kisceral argumentation is, roughly speaking, about arguing based on intuitions. In the forefront of such a (rhetorical) model are arguers and audiences, who resolve disagreements using kisceral arguments. Intuitions as reasons were more important in pre-modern law, when the law was not as explicit, precise, and determinate as today. Law influenced by religion or religious law was a typical example. In our much more secular modern era, intuitions are more or less subordinated to the (legal) logical mode of arguing. (...) However, in tough legal cases, when logic "runs out," it is values that decide them. The level of the aggression can be seen in the injury rate in that particular sport. This research objective is to find out the relation between self-confidence and the appearance of the aggressive behavior in basketball player. It involves 64 athletes in West (...) Jakarta between 17 to 28 years old. Data that was measured by questionnaires has shown there is a negative association between self-confidence and aggressive behavior in basketball athlete.  . Both G.F.W. Hegel and Carl Schmitt took seriously the problem of political sovereignty entailed by liberal political theories. In Dictatorship (1919) and Political Theology (1922), Schmitt rejects liberal political theories that argue for the immediate unity of democracy and legality i.e., popular sovereignty, because he thinks they cannot secure political sovereignty. In the Philosophy of Right, Hegel denounces popular sovereignty for similar reasons. Yet given Schmitt’s negative assessment of Hegel their positions are seldom related to one another. I argue in (...) this paper that Schmitt’s analysis of liberal political theories is similar to Hegel’s analysis of Rousseau’s liberal ideas. I contend, however, that Schmitt’s solution, which collapses the distinction between the executive and the legislative power in favor of the former, fails to secure political sovereignty. Contrary to Schmitt, Hegel conceives of the liberal predicament as a basic determination of any political state that rests on the division of the legislative and executive power. Hegel argues that the constitutional monarchy is a genuine instantiation of political sovereignty that can maintain not only the division of these powers, but also their unity. In this regard, I argue that Hegel’s conception of the division of powers provides a more convincing theory of the problem afflicting modern states than Schmitt’s and at least deserves to be taken more seriously by critics of Schmitt’s solution such as Hannah Arendt, Leo Strauss, Jurgen Habermas, Andreas Kalyvas and Chantal Mouffe. Attempts to explain behavior genetically face two major problems: the application of the concept of genetic coding and the theoretical possibility of decomposing behavior. This paper argues that using the notion of genetic coding is appropriate in explanations of protein synthesis but inadequate and even misleading in the context of explanations of behavior. Genes should be regarded as disparate components of mechanisms that account for behavior rather than as codes for behavioral phenotypes. Such mechanistic explanations, however, presuppose the possibility of (...) decomposing behavioral phenotypes, which is strongly disputed by researchers holding an interactionist view of behavior. It is argued that these researchers fail to distinguish etiological from constitutive decomposition, and that their objections apply to the former but not to the latter kind. Constitutive decomposition might identify genes as disparate components and open up the possibility of explaining behavior mechanistically by isolating causal paths from genes to behavior. Finally, research on the single gene disorder phenylketonuria is introduced to illustrate and test these views. In an intriguing but neglected passage in the Transcendental Deduction, Kant appears to link the synthetic activity of the understanding in experience with the phenomenon of attention (B156-7n). In this paper, we take up this hint, and draw upon Kant's remarks about attention in the Anthropology to shed light on the vexed question of what, exactly, the understanding's role in experience is for Kant. We argue that reading Kant's claims about synthesis in this light allows us to combine two aspects (...) of Kant's views that many commentators have thought are in tension with one another: on the one hand, Kant's apparent commitment to naïve realism about perception and, on the other, his apparent commitment to the necessity of synthetic activity by the understanding for any kind of cognitive contact with external objects. Does rationality require us to take the means to our ends? Intuitively, it seems clear that it does. And yet it has proven difficult to explain why this should be so: after all, if one is pursuing an end that one has decisive reason not to pursue, the balance of reasons will presumably speak against one's taking the means necessary to bring that end about. In this paper I propose a novel account of the instrumental requirement which addresses this problem. (...) On the view I develop, the instrumental requirement is normative not because agents have reasons to comply with it, but because it is anormative standardintrinsic to intentional action—i.e., it is a standard that partly spells out what it is to exercise one's agency well. Abstract.Evolutionary psychology and behavioural genomics are both approaches to explain human behaviour from a genetic point of view. Nonetheless, thus far the development of these disciplines is anything but interdependent. This paper examines the question whether evolutionary psychology can contribute to behavioural genomics. Firstly, a possible inconsistency between the two approaches is reviewed, viz. that evolutionary psychology focuses on the universal human nature and disregards the genetic variation studied by behavioural genomics. Secondly, we will discuss the structure of biological explanations. (...) Some philosophers rightly acknowledge that explanations do not involve laws which are exceptionless and universal. Instead, generalisations that are invariant suffice for successful explanation as long as two other stipulations are recognised: the domain within which the generalisation has no exceptions as well as the distribution of the mechanism described by the generalisation should both be specified. It is argued that evolutionary psychology can contribute to behavioural genomic explanations by accounting for these two specifications. (shrink)

Motivated by the analogy which holds within the context of discovery between mathematics and physics, we aim to show that there is a connection between two fields within the context of justification too. Based on the careful analysis of examples from science (especially within the domain of physics) we suggest that the logic of scientific research, which might appear as enumerative induction, is deduction, and we propose it to be universal generalization inference rule. This chapter serves as an introduction to the book, offering a description of problems in Lockean scholarship, the book's overall argument and approach, and more. Locke scholarship tends to be compartmentalized, which is problematic since Locke was a systematic polymath. Scholarship also tends to over-simplify the intense debates in which Locke found himself. Furthermore, scholars typically fail to make a distinction between Locke's programmatic and personal views. As a result of these tendencies, some label Locke as heterodox, others as orthodox, (...) and still others try to identify him as defending a particular sect, all depending on the narrative or issue the scholar is exploring. Most Lockean scholars approach him as being religiously surreptitious, sectarian, or sincere. This book adds to the voices that think Locke was forthright in his writings. This chapter also articulates the thesis for the entire book and the theses and coherence of the following chapters. (shrink)

Ever since Bishop Stillingfleet accused John Locke of having unwittingly paved the way with his Essay for the alleged heresy promulgated in John Toland's Christianity Not Mysterious, the latter two thinkers and works have been consistently joined in histories of philosophy covering the rise of natural religion in England. While scholars have generally thought that Locke got the better of the good bishop in their subsequent written exchanges initiated by the charge, they appear merely to assume that Stillingfleet correctly read (...) Toland and that Locke accepts that reading. Perhaps the most obvious piece of evidence favoring that stance is that while Locke clearly admits "above reason" doctrines, Toland dismisses them: Christianity is not mysterious! It is curious, however, that Toland scholars readily point out many concepts that Toland used as being the same as or different from Lockean notions about which many Locke scholars are admittedly perplexed. Through patient exposition of relevant texts and letters, deconstruction of scholarly works, and careful reasoning, this book shows that Toland's deviations from Locke regarding reason and faith are far more minor than anyone has concluded. Stillingfleet was correct to connect them, but was incorrect in the way that he did it. (shrink)

This volume presents a Type Theory of Law (TTL), claiming that this is a unique theory of law that stems from the philosophical understanding of Jung's psychological types applied to the phenomenon of law. Furthermore, the TTL claims to be a universal, general and descriptive account of law. To prove that, the book first presents the fundamentals of Jungian psychological types, as they had been invented by Jung and consequently developed further by his followers. The next part of the book (...) describes how the typological structure of an individual determines their understanding of law. It then addresses the way in which inclusive legal theory can be understood based on this typology. Finally, the book describes the TTL in general and descriptive terms and puts it into context. All in all, the book shows how the integral or inclusive approach to understanding the nature of law is not only in tune with our time, but also relevant for presenting a more persuasive picture of law than the older exclusivist or dualist approaches of strict natural law and rigid legal positivism did. This book presents my concept of poetic thinking in the context of debates around the anthropological question, that is 'what is being human?', building on 'thinking language' and dialogical thinking, developing a poetological anthropology. It evokes political and social issues to demonstrate why poetics is of general relevance for our times. The essay relates these questions to insights of quantum physics and neurosciences and discusses aspects of contemporary technology, media and medicine, employing notions from contemporary thinkers, such as atmospheres, immanent (...) transcendence, silence and presence. Poetic thinking considers the world in its togetherness, offering an alternative to the opposition of subject and object. It demonstrates the transformative power in the interaction of the form of language and the form of life. Poetic thinking takes place when a subject constitutes itself in creative and dialogical language, transforming its ways of feeling and thinking, in short, its way of perceiving the world. (shrink)
