: According to Jewish law, there is a clear obligation to try to heal, and this duty devolves upon both the physician and the society. Jewish sources make it clear that health care is not only an individual and familial responsibility, but also a communal one. This social aspect of health care manifests itself in Jewish law in two ways: first, no community is complete until it has the personnel (and, one assumes, the facilities) to provide health care; second, the (...) community must pay for the health care of those who cannot afford it as part of its provision for the poor. The community, in turn, must use its resources wisely, which is the moral basis within the Jewish tradition for some system of managed care. Elliot Dorff and Louis Newman, the preeminent scholars of Jewish ethics who edited this first volume in the series, explain in their introduction that they sought to gather together “a variety of authors with many different Jewish beliefs and approaches” (xvi). They do not claim to present “what Judaism says,” but, rather, to anthologize a variety of Jewish perspectives. In doing so, they seek to follow the approach of the Bible and the Talmud, both of which contain “many, many voices articulating often diverse points of view” (xvi).On the other hand, Dorff and Newman reject the idea that “anything goes” when it comes to Jewish views about the body. They indicate that modern American Jews may be tempted to endorse such a perspective, accustomed as they are to the American notion that “I own my body.” But, Dorff and Newman suggest, American Jews would do well to consider the contrary notions that animate much of classical Jewish thought on the body: that God is the true owner of every human body, and that God makes demands about how one should use one’s body. The case studies that follow challenge readers to keep these ideas in mind as they consider duties to limit one’s body weight, refrain from tattooing one’s body, and avoid high-risk behaviors.The essays that make up the heart of this book do by and large embrace Dorff and Newman’s challenge. Objective: To develop an approach for seeking informed consent to examine tissues retained from a previous study of sudden infant death syndrome as part of a study on asthma, and to document responses and participation rate.Design: Pilot open-ended approach to 10 volunteer SIDS parents, followed by staged approach to seek consent from the target SIDS families for the asthma study.Participants: Parents of SIDS infants known to SIDS and Kids Victoria and parents of SIDS infants from the 1991–2 SIDS in Victoria (...) case–control study.Main outcomes: Qualitative responses of the piloted parents and study parents, and participation rates.Results: The pilot group responses were used to refine the written material to be provided. Of the 72 families for which contact details were available, 45 gave verbal consent for contact by the Victorian Institute of Forensic Medicine regarding the asthma study, three refused and 24 did not respond to two letters. Thirty-three completed consent forms, all positive for participation in the asthma study, giving a positive response rate of 73% .Conclusions: The use of postmortem tissue for research is acceptable to the next of kin when an approach is sensitive to their concerns and needs and is made by experienced counsellors from a familiar organisation. Despite the painful memories evoked by the approach of the research group, the acceptance rate among those who could be contacted was high. (shrink)

In this erudite new work, Elliot R. Wolfson explores philosophical gnosis in the writings of Susan Taubes, Gillian Rose, and Edith Wyschogrod. The juxtaposition of these three extraordinary, albeit relatively neglected, philosophers provides a prism through which Wolfson scrutinizes the interplay of ethics, politics, and theology. The bond that ties together the diverse and multifaceted worldviews promulgated by Taubes, Rose, and Wyschogrod is the mutual recognition of the need to enunciate a response to the calamities of the twentieth century (...) based on an incontrovertible acknowledgment of the decadence and malevolence of human beings, without, however, succumbing to acrimony and despair. The speculation of each of these philosophers on melancholia and the tragicomedy of being is unquestionably intricate, exhibiting subtle variations and idiosyncrasies, but we can nevertheless identify a common denominator in their attempt to find the midpoint positioned between hope and hopelessness. As Wolfson articulates, Taubes, Rose, and Wyschogrod exemplify a philosophical sensibility informed by a nocturnal seeing, which is not merely a seeing in the night but rather a seeing of the night. Ultimately, the book reveals the potential for these thinkers' ideas to enhance our moral sensitivity and to encourage participation in the ongoing struggle for meaning and decency in the present. Three kinds of things may be creative: persons, processes, and products. The standard definition of creativity, used nearly by consensus in psychological research, focuses specifically on products and says that a product is creative if and only if it is new and valuable. We argue that at least one further condition is necessary for a product to be creative: it must have been produced by the right kind of process. We argue furthermore that this point has an interesting epistemological implication: (...) when you judge a product to be creative--attributing creativity--you are not just judging it to be new and valuable. In this study, I examine Susan Taubes’s criticism of Heidegger’s Seinsdenken that pivots around her contention that he absolutized the nothingness of being in a manner that is analogous to but yet significantly different than the role assigned to the Godhead on the part of many mystical visionaries. The common denominator is in Heidegger’s insistence on being to the neglect of fully engaging with the rhythms of life. As a consequence, there is no purchase on the chaotic, which falls outside (...) the purview of what can be signified, and in the absence of the unsignifiable, there can be no signification. Every attempt to reconstruct the broken world into a totality contains the flaw of an ontological untruth. The effort at totalization is not only the methodological weakness of tragedy and mysticism, but it is also the nihilistic basis of the role accorded to the nothingness of being in Heidegger’s Seinsdenken. The erroneous nature of the world is not denied by Susan, but she struggled to uphold the ontological untruth that what is most wrong in our existence is what is most precious. The paradoxical retrieval of the truth of this untruth affords the poetic soul the opportunity to confront the limit by breaking it, an infringement of boundary that is redolent equally with the enduring transience of love and the transient endurance of death. The Body in French Queer Thought from Wittig to Preciado: Queer Permeability identifies a common concern in French queer works for the materiality of the body, and argues for a return to the body as fundamental to queer thought and politics, from HIV onwards.

Clear and distinct perception is the centrepiece of Descartes’s philosophy — it is the source of all certainty — but what does he mean by ‘clear’ and ‘distinct’? According to the prevailing approach, what it means for a perception to be clear is that its content has a certain objective property, like truth. I argue instead that clarity is at least partly a subjective, phenomenal quality whereby a content is presented as true to the perceiving subject. Clarity comes in degrees. (...) Any weak degree of clarity, available to the senses, can be merely subjective, since what it presents as true may not actually be true. But complete clarity, available to intellectual perception, has an objective dimension, since what it presents as true is always some truth, some bit of reality. Further, I argue that the other perceptual qualities that Descartes identifies — obscurity, confusion, and distinctness — are all defined in terms of clarity. Of particular note is the fact that distinctness is not a positive feature to be added to clarity: a distinct perception is just a completely clear perception. (shrink)

Descartes is widely portrayed as the arch proponent of “the epistemological transparency of thought” (or simply, “Transparency”). The most promising version of this view—Transparency-through-Introspection—says that introspecting (i.e., inwardly attending to) a thought guarantees certain knowledge of that thought. But Descartes rejects this view and provides numerous counterexamples to it. I argue that, instead, Descartes’s theory of self-knowledge is just an application of his general theory of knowledge. According to his general theory, certain knowledge is acquired only through clear and distinct (...) intellection. Thus, in his view, certain knowledge of one’s thoughts is acquired only through clear and distinct intellection of one’s thoughts. Introspection is a form of intellection and it can be clear and distinct. Ordinarily, however, introspection isn’t clear and distinct but is instead confused with dubitable perceptions of bodies. To make introspection clear and distinct, we need to “sharply separate” it from all perceptions of bodies by doubting all perceptions of bodies. Without such radical doubt, introspection remains confused and we lack certain knowledge not just of the specific features of our thoughts, but even of the minimal claim that a thought exists. Far from being the high priest of Transparency, Descartes is radically opposed to it. (shrink)
