This article explores the tensions between geopolitics and human rights under present conditions of world politics. It takes notes of the rise of human rights as a discourse in international law, and draws attention to the use of this discourse by powerful states, especially the United States, to validate non-defensive uses of force. It also notes the role of the media in facilitating the geopolitical agenda associated with exerting pressure on some conditions but exempting other situations as serious or more (...) so . This article also discusses the reliance on the human rights discourse by oppressed groups and by countries in the South, and the emergence of a counter-hegemonic tradition in human rights that challenges geopolitical projects in a variety of settings. This paper assesses recent trends in international law regarding the availability and character of reparations. Presently, reparations issues have arisen particularly in domestic societies searching for transitional justice in the aftermath of authoritarian rule. These issues are shaped by national legal systems, but are also influenced by international practice. In these transitional settings, the search for justice is affected by political preoccupations such as the persistent influence of displaced prior authoritarian leadership as well as by real and alleged limitations on (...) the financial capabilities of transitional states. No general approach can address the interplay between national and international law at this stage. Reliance must be placed on a case by case approach, considering matters of context such as the degree of suffering and disability inflicted on particular categories of claimants, the balance of claims versus the State’s demands for resources to fund sustainable and equitable development. Remoteness in time bears on the credibility of the claimants as present victims tend to be given priority over victims in the distant past when assessing relative merits. Scale and selectivity suggests that if the total of claims overwhelms the administrative capacity of the state, there will be a tendency to substitute apology and symbolic gestures for material ones, and award reparations based on individual need associated with the prior deprivation. International law informs background moral and political thinking about reparations, but practical considerations of capability and prudence are decisive in most instances, making the influence of international law indirect and sometimes marginal. This essay develops a theory of natural signs in order to show how evolutionary theory breathes new life into teleology. An argument to the contrary presented by Richard Taylor is refuted. The essay defends the view that the concept of negative feedback explicates purposiveness and that symbiotic evolution explains the occurrence of naturally adapted feedback systems. But evolution itself is not a teleological process, nor is it a negative feedback system. Several recent publications have questioned prevailing doctrines and offered new views on the antiquity of writing in early India and on the source and early development of the Indian scripts (Brāhmī and Kharoṣṭhī). Most of the new studies agree in assigning the origin of these scripts to a later period, i.e., the early Mauryan era (late fourth to mid third centuries B. C.), than has generally been done in the past, and in deriving them from prototypes in Semitic or Semitic-derived (...) scripts. The main works to be evaluated here are Oskar von Hinüber's Der Beginn der Schrift und frühe Schriftlichkeit in Indien and Harry Falk's Schrift im alten Indien: Ein Forschungsbericht mit Anmerkungen. Also discussed are two recent articles on similar topics, Gérard Fussman's "Les premiers systèmes d'écriture en Inde" and Kenneth R. Norman's "The Development of Writing in India and its Effect upon the Pāli Cannon," as well as some other relevant publications. The authority and significance of this new trend toward assigning a later date of origin for the Indian scripts is evaluated and placed in the context of broader historical and cultural issues. We are at a time when international law and the law of war are particularly important. The testing of nuclear weapons that is being used in the rhetoric surrounding threats of war is creating new fears and heightening current tensions. Richard Falk has for decades been an outspoken authority calling for nuclear disarmament and the enforcement of non-proliferation treaties. In this collection of essays, Falk examines the global threats to all humanity posed by nuclear weapons. He is (...) not satisfied with accepting arms control measures as a managerial stopgap to these threats and seeks no less than to move the world back from the nuclear precipice and towards denuclearization. You know that a two-child family has a son. What is the probability that the family has two sons? And what is this probability if you know that the family has a son born on a Tuesday? The former question has been widely discussed previously. The latter adds a new puzzling twist to the situation. In both cases the answer should depend on the specifics of the assumed underlying procedure by which the given information has been obtained. Quantitative analysis, assuming (...) one scenario, shows that the information on the son's day of birth changes the target probability. However, the relevance of being born on Tuesday to the question of the children's genders seems bizarre, since the same would be true for any other day. This apparent paradox is further probed in an attempt to alleviate the ensuing psychological difficulty. (shrink)

Many people share the intuition that by turning to works of literature something can be learned about the world. One way to explain the epistemic access to the world that fictional literature provides is by comparing it to thought experiments. Both? thought experiments and works of fiction? might be seen as imaginative exercises which help to find out what would or could happen if certain conditions were met. This comparison of fictional literature with thought experiments provides the point of departure (...) for the contributions in our volume. It contributes to the discussion of an approach that has quite recently entered the field of the philosophy of literature. (shrink)

This book offers a unique perspective on Zionism. The author, a geneticist by training, focuses on science, rather than history. He looks at the claims that Jews constitute a people with common biological roots. An argument that helps provide justification for the aspirations of this political movement dedicated to the return of the Jewish people to their homeland. His study explores two issues. The first considers the assertion that there is a biology of the Jews. The second deals with attempts (...) to integrate this idea into a consistent history. Both issues unfolded against the background of a romantic national culture of Western Europe in the 19th century: Jews, primarily from Eastern Europe, began to believe these notions and soon they took the lead in the re-formulation of Jewish and Zionist existence. The author does not intend to present a comprehensive picture of the biological literature of the origins of a people and the blood relations between them. He also recognizes that the subject is emotionally-loaded. The book does, however, present a profound mediation on three overlapping questions: What is special or unique to the Jews? Who were the genuine Jews? And how can one identify Jews? This volume is a revised and edited English version of Tzionut Vehabiologia shel Hayehudim, published in 2006. (shrink)

One would hardly be a human being if the good of others, or of society at large, could not weigh with one as a cogent reason for doing what will promote goodness. So one has not fully learned about living like a rational and moral being unless one has learned to appreciate that one ought to do things out of regard for others, and not only out of regard for oneself. In the first place, not everything done for oneself is (...) done for reasons of prudence. That one ought to insure one's house, save for one's old age, not put all one's money into one venture, are precepts of prudence. But it is not a precept of prudence, though it may be a good precept that someone ought to undergo a dangerous operation as a long shot to restoring his health rather than linger under a disability forever after. So entwirft er, vor dem Hintergrund einer neuartigen Epochendeutung ein geistesgeschichtliches Panorama, das von Comte und Schlegel und Kleist bis zu Kafka und Heidegger reicht. Das Buch zeigt vor dem Hintergrund der Wissenschaftsgeschichte des 20. Jahrhunderts, wie die Gestalt des personalen Gottes in den großen geistes- und naturwissenschaftlichen Innovationsschüben der Moderne zunehmend wieder in den Blick genommen wurde. Dabei erfahren die Ansätze von Foucault, Konrad Lorenz oder René Girard eine eigenwillige und profilierte, Natur- und Kulturwissenschaften innovativ miteinander verbindende Deutung. Das eigentliche Interesse des Buches ist aber nicht historischer Natur. Falk demonstriert eindrucksvoll, wie Glauben und Denken in der Gegenwart zugleich differenziert und integriert werden müssen, um auf der Höhe der Moderne wieder fruchtbar in ein Gespräch kommen zu können.
