The following description is based upon an actual case in which a patient initiated legal action after suffering a complication subsequent to an invasive diagnostic procedure performed by a senior fellow. Named as codefendants were the senior fellow, attending physician, and the hospital. Because any hospital with house staff is potentially vulnerable to similar litigation, Ethics Committees at Work is addressing the questions raised by this dilemma.

This study sought to identify content on the federal budget, national debt, and budget deficit in the 12 most commonly used high school and college-leveleconomics textbooks. Our systematic review of these sources leads to two key findings: (1) Textbooks are similar in how they represent fiscal policy yet treatthe federal budget, deficit, and debt differently across the sample, and (2) Textbooks treat the federal budget, budget deficit, and national debt as theoretical, without an examination of values and systemic electoral and (...) budgetary politics. These findings lead us to argue that curriculum is needed that will permit a careful examination of how everyday citizens can gain knowledge, acknowledge values, and work towards a reasoned and realitybased view of what is at stake with regard to these issues in the 21st Century. This volume addresses a wide variety of moral concerns regarding slavery as an institutionalized social practice. By considering the slave's critical appropriation of the natural rights doctrine, the ambiguous implications of various notions of consent and liberty are examined. The authors assume that, although slavery is undoubtedly an evil social practice, its moral assessment stands in need of a more nuanced treatment. They address the question of what is wrong with slavery by critically examining, and in some cases endorsing, certain (...) principles derived from communitarianism, paternalism, utilitarianism, and jurisprudence. Historically, nonclassical physics developed in three stages. First came a collection of ad hoc assumptions and then a cookbook of equations known as "quantum mechanics". The equations and their philosophical underpinnings were then collected into a model based on the mathematics of Hilbert space. From the Hilbert space model came the abstaction of "quantum logics". This book explores all three stages, but not in historical order. Instead, in an effort to illustrate how physics and abstract mathematics influence each other we (...) hop back and forth between a purely mathematical development of Hilbert space, and a physically motivated definition of a logic, partially linking the two throughout, and then bringing them together at the deepest level in the last two chapters. This book should be accessible to undergraduate and beginning graduate students in both mathematics and physics. The only strict prerequisites are calculus and linear algebra, but the level of mathematical sophistication assumes at least one or two intermediate courses, for example in mathematical analysis or advanced calculus. This paper analyzes business people's attitudes towards the tactics used for gathering competitive corporate intelligence both within their own and their competitors' corporations. Business people in large corporations are highly motivated to gather such intelligence. Their attitudes towards the ethicality of specific practices, however, are influenced by the corporate culture, their perceived effectiveness of the techniques, and their perception of the competitors' tactics. Interestingly enough, the most popular technique for securing information is socializing with competitors in nonbusiness settings. Business people (...) generally view their competitors negatively, believing that they go to much further lengths than does their own corporation in gathering competitive intelligence. (shrink)

We discuss the crucial, but easily missed, link between paternalism and incarceration. Legal paternalists believe law should be used to help individuals stay healthy or moral or become healthier or morally better. Criminal laws are paternalistic if they make it illegal to perform some action that would be bad for the actor to do, regardless of effects on others. Yet, one result of such laws is the punishment, including incarceration, of the very same actors—also clearly bad for them even if (...) meant to be rehabilitative. Therein lies an oddity: paternalist criminal law—and thepresumably rehabilitativepunishments that serve as responses to infringements of such laws—is meant to help the actor but in fact has the opposite effect on net. Incarceration is particularly problematic on this front as it harms the alleged criminal in ways that go beyond the harm they would have caused themselves. Incarceration also may undermine the actor’s ability to improve his decision-making abilities or his moral character. The effects of the punishment also drift to others—family and friends, as well as business associates, of the punished. Paternalists, inasmuch as they are motivated by beneficence or concern about moral character, must account for all of these costs as threats to well-being and the conditions for acting morally. Given the link between paternalism and incarceration, we propose that if we are to take seriously the problem of over-incarceration in the U.S., we must reconsider the use of paternalism in criminal law; we sketch several alternatives. Wes Morriston contends that William Lane Craig's argument for the impossibility of a beginningless past results in an equally good argument for the impossibility of an endless future. Craig disagrees. I show that Craig's reply reveals a commitment to an unmotivated position concerning the relationship between actuality and the actual infinite. I then assess alternative routes to the impossibility of a beginningless past that have been offered in the literature, and show that, contrary to initial appearances, these routes similarly (...) seem to support the impossibility of an endless future. Functionalism offers an account of the relations that hold between behavioural functions, information and neural processing, and conscious experience from which one can draw two inferences: for any discriminable difference between qualia there must be an equivalent discriminable difference in function; and for any discriminable functional difference within a behavioural domain associated with qualia, there must be a discriminable difference between qualia. The phenomenon of coloured hearing synaesthesia appears to contradict the second of these inferences. We report data showing that (...) this form of synaesthesia is genuine and probably results from an aberrant projection from cortical language areas to a region specialized for the perception of colour. Since functionalism purports to be a general account of consciousness, one such negative instance, if it can be further sustained empirically, is sufficient to invalidate it. (shrink)

I take a close look at Bernard Williams’s paper "Moral Luck," which put this notion on the philosophical agenda. Williams’s focal example is the painter Paul Gauguin. According to Williams, Gauguin’s morally dubious decision to desert his family so as to pursue an artistic career can be redeemed only by his partially fortuitous success as a painter. This is shown by the consideration that a successful Gauguin would not be able to regret his decision, whereas failure would have prompted regret. (...) I suggest that the best way to understand this claim is to see Gauguin’s decision to become an artist as a constitutive decision, which launches what for him proved to be a defining project. One cannot coherently regret the realization of such a project or the decision that gave rise to it because that would amount to wishing to be someone else: conditions of personal identity set the limits on the counterfactuals about ourselves that we can intelligibly entertain. However, not being able to regret the constitutive elements of one’s life is not the same as approving of these elements. So I disagree with Williams’s ultimate conclusion that the inability to regret a decision signals some justification for it, no matter how attenuated. (shrink)

To avoid potential abuse and respect patient autonomy, physicians have a moral obligation to obtain informed consent before performing any significant medical intervention. To give informed consent, a patient must be competent, understand her condition, options and their expected risks and benefits and must freely and expressly consent to one of those options. Shlomo Cohen challenges this conception of informed consent by constructing cases based on Edmund Gettier’s classic counterexamples to traditional theories of knowledge. In this paper, I argue (...) Cohen-style cases are not genuine threats to the concept of informed consent, however they provide an interesting challenge to theories of conscientious objection. (shrink)

If we attempt to comprehend this philosopher, whose name is synonymous with the School of Marburg, that small charming town in Hesse from which Kant’s works and influence spread abroad like the magic of an irresistible melody, then we are forced to appreciate those lovers of music and art that brought him the friendship of the violinist Joseph Joachim, the admiration of painters such as Max Liebermann, Lenid Pasternak, (...) the father of Boris, and others whose names are now distant from us. European culture is alive in philosophy, not merely as illustrative references, but as the achievements of the mind devoted to reason and the power of imagination. This culture was not simply created by a mind that ignored the senses. The body was appreciated as the source of subtle and artistic movement, its power to build and form depended upon the grace and delicacy of the hands, sound awakened in us the inexhaustible dimension and possibilities of communication and relationship, sight the sensitivity to colors, to a variety of architectural forms that evoke a sense of beauty and sublimity by their effect and receptivity, taste and touch cultivate form and allow us to receive and be receptive with a heightened sense of delicacy and appreciation allowing form to be given to us in indescribable and unexpected ways. Through the senses we develop that intimacy with others that the mind can only define and analyze but never feel. Cohen has come forth from his detractors and even from his admirers as the distant and unapproachable “professor” of a forgotten philosophical “system.” He did his service in Kant’s army of interpreters adding volumes of interpretation and appreciation to the old master. Here he paid his dues to his profession and university. Cohen was a cultured man, a deeply sensitive individual, a fine product of artistic sensitivity and generosity. When he turned to the arts, when he moved to music, to religion, to social activity, the humaneness of his personality overcame the professor in him; it showed that tenderness for human relationship, that deep respect for love that Cohen found in his beloved Wolfgang Amadeus Mozart, whose operas he believed reflected a sensitivity to moral and aesthetic values. The question that is posed regarding the Jewish response to Hegel’s philosophy forces us to question the meaning of the adjective ‘Jewish’, and whether it points to some peculiar and distinct path and way of interpretation. I would say that in response to Hegel’s philosophy three distinguished thinkers, Samuel Hirsch, Hermann Cohen, and Franz Rosenzweig, responded to Hegel’s attitude toward religion and to the principles of his logic which underlie his concept of religion. Their response cannot be divorced from (...) their commitment to both an ethical and eschatological Judaism. Philosophical thinking shares religious and nonreligious categories and attitudes with theological and religious traditions, but does not employ these in similar ways. What is philosophical thinking is not necessarily theological. Although they do not necessarily relate to each other, they are not oblivious to the influence and force they have on one another. We would venture to say that in reference to Hirsch, Cohen and Rosenzweig, there was a distinct and clear attempt to confront the truth of Christianity with a truth that was believed to be superior. The first half of the nineteenth century gave us four significant Jewish thinkers who were eager and firm in their attempt to focus upon the differences in these two religions. In addition to Hirsch, they were Joseph Salvador, Salomon Formstecher, and Ludwig Steinheim. This paper, however, deals only with Hirsch and Cohen. (shrink)

The late Jerry Cohen struggled to reconcile his egalitarian political principles with his personal style of life. His efforts were inconclusive, but instructive. This comment locates the core of Cohen’s discomfort in an abstract principle that connects what we morally ought to be compelled to do and what we have a duty to do anyway. The connection the principle states is more general and much tighter than Cohen and others, e.g. Thomas Nagel, have seen. Our principles of (...) justice always put our personal integrity to the test, unless those principles are designed not to. But to craft principles with an view to avoiding that test is, as Cohen argued, itself to undermine both justice and our integrity. (shrink)
