Since ought implies can, i.e., one cannot be obligated to do what one cannot do, the question of corporate responsibility cannot be discussed intelligibly without an inquiry into the range of corporate or managerial discretion. Hence, the moral relevance of a theory of the firm. Within classical or neo-classical economic theory, for instance, firms which act other than to maximize profit are eliminated. They cannot do otherwise, and thus either have no obligations at all or only the duty to maximize (...) profit. The thesis of the Managerial Revolution, if true, establishes only that management is free from direct stockholder control. By asserting that corporations have responsibilities to do other than maximize profit, philosophers assume a wide degree of managerial discretion, without considering recent developments in the theory of the firm which suggest that new incentives and constraints radically restrict managerial liberty in a capitalist society. The prevailing opinion in our culture is that bribery is in principle wrong. I challenge that view and offer an analysis that suggests that bribery is a morally neutral concept. The analysis closely parallels the legal notions, suggesting that this analysis may have a firm grounding in our own tradition in spite of the prevailing views. To bribe someone is to offer something of value to another with the intent of inducing an action that is contrary to the positional duties (...) of the office or role of that other person. Whether offering or accepting a bribe is morally correct or incorrect, then, depends entirely upon whether the relevant positional duties have moral backing, all things considered. One virtue of the analysis is that it provides a definition that allows for a cross-cultural comparison that does not impose the standards of one society on those of another but allows for moral judgment. To determine whether a Japanese official has accepted a bribe, for example, one must determine the positional duties of the official as defined in that culture. The analysis also reveals why most believe bribery to be prima facie wrong. This is explained historically by the fact that the concept originally applied exclusively to positional duties in the judicial system, where all believed it to be morally unjustified to transgress duties of impartiality, etc. Finally, the analysis suggests that beliefs about the immorality of commercial bribery rest on the assumption that the positional duties of corporate managers and agents are to abide by the fictitious free-market rules and that the rules of the free market are morally justified. Although Friedman's The Social Responsibility of Business is to Increase Profits is widely read, the central argument is rarely identified. Stone's discussion of Friedman in Where the Law Ends, is often used as a companion piece. Stone claims that the most important argument in Friedman is the Polestar argument but never succeeds in explaining what it is. This paper shows that Friedman's position must be read in the context of his theory of political economy, and that at least four distinct (...) utilitarian arguments are required to account for his views. Specifically, Friedman relies upon what I describe as Realistic Rule Utilitarianism in which utility is understood in terms of actual preferences. The weaknesses of this theory are then explained. In this paper I review the dispute over DeGeorge's analysis of the issue of the ethical responsibilities of engineers in large organizations. I argue that this issue is no different than the question of the ethical responsibilities of any other relevantly situated employee because engineers have no special duty to hold paramount the safety of the public distinct from that of others. I demonstrate how critics like Mankin, James, and Curd and May have misread and misinterpreted DeGeorge's position and his (...) argument. I then identify a serious logical problem in DeGeorge, unnoticed by critics, but conclude by defending the spirit of DeGeorge's approach. That spirit recognizes the limitations of attempting to provide necessary and sufficient conditions in response to many questions in applied philosophy. (shrink)

After examining Frederick's charge in his recently published Values, Nature, and Culture in the American Corporation that philosophers and others in the field of business ethics and business and society ignore nature and technology, the paper investigates Frederick's attempt to articulate and defend a New Normative Synthesis (NNS). Since the NNS is the result of a synthesis between Frederick's theory of business values and the body of principles in business ethics, I focus on the nature of each component, the nature (...) of the synthesis, and the nature of the resulting NNS itself. Inquiry reveals serious questions about the explanatory value of the theory of business values as a descriptive theory, as well as serious questions about the defense of the theory as normative theory. The analysis also discloses several possible interpretations of the NNS. (shrink)

This lecture was originally given at the Einstein Forum in Berlin. It contains a summary of some of the themes in my book The Construction of Social Reality and continues the line of argument I presented there.

This book shows that, far from repudiating Hegel, Dewey's entire pragmatic philosophy is premised on a "philosophy of spirit" inspired by Hegel's project.

There is a limited understanding amongst scientists, students and the public about realizing trust in scientific findings. This should be a paramount objective, or is it only about career ambition? What is the role of the individual? Scientists and the public need to know more about the link between the philosophy of science and the science research methods. There is a limited understanding of why accuracy is important and that it is not the same as precision. Also, there is often (...) the need to measure an approximation of a real system and the classic case is reductionism in biology versus whole organism biology. Although enterprise risk management (ERM) has many benefits for corporations, there has been virtually no discussion of the extent to which its practice may be said to constitute corporate social responsibility. This article presents a prima facie case for the convergence of the two and examines this case through a consideration of four possible objections or challenges. The conclusion of this article is a tempered optimism that ERM has the significant, but as yet untapped, potential to constitute socially responsible activity, (...) which, if realized, would enable Adam Smith's invisible hand of the marketplace to have an expanded sweep. This book argues that the sin of the devil compels a view of moral responsibility that undermines concerns about luck. It surveys the biblical account of the primal sin, its major interpretation in the tradition, and navigates that interpretation through objections from the perspective of moral luck.

The title of The Rediscovery of the Mind suggests the question "When was the mind lost?" Since most people may not be aware that it ever was lost, we must also then ask "Who lost it?" It was lost, of course, only by philosophers, by certain philosophers. This passed unnoticed by society at large. The "rediscovery" is also likely to pass unnoticed. But has the mind been rediscovered by the same philosophers who "lost" it? Probably not. John Searle is (...) an analytic philosopher, with some of the same notions as the positivists and behaviorists who rejected consciousness and "lost" the mind in the first place, but he also does not sound like the kind of reductionist who would have joined that crowd. His views, indeed, are sensible enough, and some of his insights so important, that it is a shame to find his thought profoundly limited by some of the same mistakes and prejudices that ruined philosophy, and not just philosophy of mind, under the influence of those positivists and behaviorists. There is enough of genuine value in his treatment, that it can easily be taken up and, with relatively slight modification, added to what is of permanent value in the history of philosophy. (shrink)

Ethical Considerations at the Intersection of Psychiatry and Religion aims to give mental health professionals a conceptual framework for understanding the role of R/S in ethical decision-making and serve as practical guidance for approaching challenging cases. In The Construction of Social Reality, John Searle argues that there are two kinds of facts--some that are independent of human observers, and some that require..

The renowned philosopher John Searle reveals the fundamental nature of social reality. What kinds of things are money, property, governments, nations, marriages, cocktail parties, and football games? Searle explains the key role played by language in the creation, constitution, and maintenance of social reality. We make statements about social facts that are completely objective, for example: Barack Obama is President of the United States, the piece of paper in my hand is a twenty-dollar bill, I got married in London, (...) etc. And yet these facts only exist because we think they exist. How is it possible that we can have factual objective knowledge of a reality that is created by subjective opinions? This is part of a much larger question: How can we give an account of ourselves, with our peculiar human traits DS mind, reason, freedom, society - in a world that we know independently consists of mindless, meaningless particles? How can we account for our social and mental existence in a realm of brute physical facts? In answering this question, Searle avoids postulating different realms of being, a mental and a physical, or worse yet, a mental, a physical, and a social. There is just one reality: Searle shows how the human reality fits into that one reality. Mind, language, and civilization are natural products of the basic facts of the physical world described by physics, chemistry and biology. Searle explains how language creates and maintains the elaborate structures of human social institutions. These institutions serve to create and distribute power relations that are pervasive and often invisible. These power relations motivate human actions in a way that provides the glue that holds human civilization together.
