The gift of life argument, the claim that suicide is immoral because our lives are not ours to dispose of as we are their guardians or stewards, is a persistent theme in debates about the morality of suicide, assisted-suicide, and euthanasia. I argue that this argument suffers from a fatal internal incoherence. The gift can either be interpreted literally or analogically. If it is interpreted literally there are serious problems in understanding who receives the gift. If it is understood analogically (...) the question arises whether the gift is understood to be a finite or everlasting existence. If it is finite then it is hard to see how one can be punished for bringing that existence to an end for one will not be around to be punished. If the existence is infinite it is impossible to see how one can be punished for ending one’s life because one cannot end it. However, there is still ethical mileage to be gained from the description of life as a gift and in the concluding section I indicate one way in which this is so. (shrink)

This paper describes the research carried out into small and medium enterprises (SMEs) and corporate responsibility (CR) in the Northwest of England during Phase I of Responsibility Northwest, a partnership programme designed to significantly increase the CR of the region. By engaging with significant numbers of SMEs and SME support providers across the region, key insights were gained in three key areas: • The current attitudes to, understanding of, and management of CR issues in the SME sector.• The barriers to (...) greater implementation of CR management.• The opportunities for overcoming the barriers and improving regional CR. The research revealed a large diversity both in terms of understanding of the issues and their management. Seven key barriers to improve CR performance were identified which centred round the inappropriateness and inaccessibility of current CR approaches and support services on CR, certain characteristics of SMEs which tend to reduce their interest and opportunities for engaging in CR activities and supply-chain barriers. Fortunately there was significant agreement on the mechanisms which should be used to overcome these barriers, in particular the importance of delivering CR support through existing business networks that are valued and trusted by SMEs. These results have been used to create the partnership programme, Responsibility Northwest Phase II that runs until 2008 and aims to significantly increase the overall CR of Northwest England. Kelly Aguirre, Phil Henderson, Cressida J. Heyes, Alana Lentin, and Corey Snelgrove engage with different aspects of Robert Nichols’ Theft is Property! Dispossession and Critical Theory. Henderson focuses on possible spaces for maneuver, agency, contradiction, or failure in subject formation available to individuals and communities interpellated through diremptive processes. Heyes homes in on the ritual of antiwill called “consent” that systematically conceals the operation of power. Aguirre foregrounds tensions in projects of critical theory scholarship that aim for dialogue (...) and solidarity with Indigenous decolonial struggles. Lentin draws attention to the role of race in undergirding the logic of Anglo-settler colonial domination that operates through dispossession, while Snelgrove emphasizes the link between alienation, capital, and colonialism. In his reply to his interlocutors, Nichols clarifies aspects of his “recursive logics” of dispossession, a dispossession or theft through which the right to property is generated. (shrink)

Debate concerning virtual reality is often drawn in terms of sharply defined dichotomies--for example, between "real" (or "actual") and "virtual," "authentic" and "inauthentic," and "natural" and "artificial." In this paper we offer an alternative approach by suggesting a conception of a virtual world that highlights a continuity and commonality with our sense of everyday reality. We accomplish this in part by an examination of the English picturesque garden as if it were a virtual world partially constructed out of ideas and (...) objects collected during travels to foreign lands on the Grand Tour. Such foreign travel transformed not only the English person's sense of self, but also altered the English landscape. We conclude that in one sense the "real" England is also a "virtual" reality. This article offers a preliminary critical-historical reconstruction of the concept of dispossession. Part I examines its role in eighteenth- and nineteenth- century struggles against European feudal land tenure. Drawing upon Marx’s critique of French anarchism in particular, I identify a persistent limitation at the heart of the concept. Since dispossession presupposes prior possession, recourse to it appears conservative and tends to reinforce the very proprietary and commoditized models of social relations that radical critics generally seek to undermine. Part II turns (...) to use of the term in Indigenous struggles against colonization, both in order to better grasp the stakes of the above problematic and suggest a way beyond it. Through a reconstruction of arguments by Indigenous scholars and activists, I seek to show the coherence and novelty of their formulation by suggesting that dispossession has come to name a unique historical process, one in which property is generated under conditions that require divestment and alienation from those who appear, only retroactively, as its original owners. In this way, theft and property are related in a recursive, rather than strictly unilinear, manner. Part III provides a specific historical example in the form of nineteenth-century US property law concerning squatters and homesteaders. (shrink)

Recently, Rueger and Sharp (1996) and Koperski (1998) have been concerned to show that certain procedural accounts of model confirmation are compromised by non-linear dynamics. We suggest that the issues raised are better approached by considering whether chaotic data analysis methods allow for reliable inference from data. We provide a framework and an example of this approach.

The aim of this chapter is to address the role of memory in past-life convictions. Although it is commonly accepted in the modern media - and popular western culture more generally - that people believe they have lived before because the memory contains detailed verifiable facts, little is known about how people actually reason about the veracity of their previous existence. To our knowledge, the current project is the most extensive research that probes the role of memory in past life (...) convictions. More specifically, we explore two questions. First, to what extent does memory lead to past-life belief, and is this conviction based on external validation or via the episodic sense of personal identity contained in the memory? Second, what is the conception of self on which one's current self is taken to be the same as the past-life self? -/- In what follows, we propose that memory plays an important role in convincing people that they have lived before. Fundamentally, this memory is episodic insofar as it represents the event as happened to the encoder. This memory contrasts with semantic memory - memory of facts...Further, we contend that it is the episodic sense of personal identity (rather than external validation) that typically contributes to the belief in a past life. Finally, we argue that the conception of self implicated in past-life belief is the non-trait conception. Of course, this fits naturally with the idea that the belief in a past life issues partly from the episodic sense of identity, since it is the non-trait conception of self that is implicated in the episodic sense of identity... -/- Our proposal in this chapter can be construed as a psychological extension of Reid's point in the context of past-life belief. People assume that they are the same person as someone in earlier times, despite large variations in the traits between those individuals, and they think this partly because of the testimony of their episodic memory. If our account is correct, then it makes the belief in a past life less bizarre, at least psychologically. For we are suggesting that the episodic sense of personal identity that led to your conviction that you existed at the time of your sixteenth birthday celebrations some decades ago, is also involved in other people's convictions that they existed 200 years ago. This proposal is also situated in recent cognitive approaches to the study of religion and religious experiences, which suggests that extraordinary convictions are often underpinned by the ordinary processes of social cognition (e.g. see Barrett 2000; Barrett 2007; Boyer 2001; Lawson and McCauley 1990; for reincarnation, see White Forthcoming-a,-b). This article examines the application of social contract theorizing to questions pertaining to the rights of indigenous peoples today, with particular reference to recent work by Jeremy Waldron. It is argued that such theorizing must be examined with reference not only to the content of its claims, but also with respect to its general mode of argumentation and its political function in specific contexts. Read in this light, social contract theory may function to unduly deny the claims of indigenous peoples, (...) oftentimes by shifting the register of debate to a relatively abstract and counter-factual level and relieving settler-colonial societies of the burden of proof. Martin Heidegger and Michel Foucault are two of the most important and influential thinkers of the twentieth century. Each has spawned volumes of secondary literature and sparked fierce, polarizing debates, particularly about the relationship between philosophy and politics. And yet, to date there exists almost no work that presents a systematic and comprehensive engagement of the two in relation to one another. _The World of Freedom_ addresses this lacuna. Neither apology nor polemic, the book demonstrates that it is not merely (...) interesting but necessary to read Heidegger and Foucault alongside one another if we are to properly understand the shape of twentieth-century Continental thought. Through close, scholarly engagement with primary texts, Robert Nichols develops original and demanding insights into the relationship between fundamental and historical ontology, modes of objectification and subjectification, and an ethopoetic conception of freedom. In the process, his book also reveals the role that Heidegger's reception in France played in Foucault's intellectual development—the first major work to do so while taking full advantage of the recent publication of Foucault's last Collège de France lectures of the 1980s, which mark a return to classical Greek and Roman philosophy, and thus to familiar Heideggerian loci of concern. This essay attends to the specificity of indigenous peoples’ political critique of state power and territorialized sovereignty in the North American context as an indispensible resource for realizing the decolonizing potential latent within the field of critical prison studies. I argue that although the incarceration of indigenous peoples is closely related to the experience of other racialized populations with regard to its causes, it is importantly distinct with respect to the normative foundation of its critique. Indigenous sovereignty calls forth an (...) alternative normativity that challenges the very existence of the carceral system, let alone its racialized organization and operation. (shrink)

The role of epistemology in philosophy of religion has transformed the discipline by diverting questions away from traditional metaphysical issues and toward concerns about justification and warrant. Leaders responsible for these changes, including Plantinga, Alston and Draper, use methods and arguments fromScottish Enlightenment figures. In general theists use and cite techniques pioneered by Reid and non-theists use and cite techniques pioneered by Hume, a split reduplicated among cognitive scientists of religion, with Justin Barrett and Scott Atran respectively framing their results (...) in Reid’s and in Hume’s language and argument. This state of affairs sets our agenda. First we identify Reid’s use in the epistemology of religion and in the cognitive science of religion. Then we turn to Reid’s texts in an effort to assess the interpretations and extrapolations of Reid given by participants in these debates. The answers to our research questions shed light on what Reid would believe today, were he apprised of the latest research in epistemology of and cognitive science of religion. (shrink)

These questions are not meant to prove that there are any serious problems with her argumentation. Since his death in 1997, Isaiah Berlin's writings have generated continual interest among scholars and educated readers, especially in regard to his ideas about liberalism, value pluralism, and "positive" and "negative" liberty. Most books on Berlin have examined his general political theory, but this volume uses a contemporary perspective to focus specifically on his ideas about freedom and liberty. Isaiah Berlin and the Politics of Freedom brings together an integrated collection of essays by noted and emerging political theorists that commemorate (...) in a critical spirit the recent 50th anniversary of Isaiah Berlin's famous lecture and essay, "Two Concepts of Liberty." The contributors use Berlin's essay as an occasion to rethink the larger politics of freedom from a twenty-first century standpoint, bringing Berlin's ideas into conversation with current political problems and perspectives rooted in postcolonial theory, feminist theory, democratic theory, and critical social theory. The editors begin by surveying the influence of Berlin's essay and the range of debates about freedom that it has inspired. Contributors' chapters then offer various analyses such as competing ways to contextualize Berlin's essay, how to reconsider Berlin's ideas in light of struggles over national self-determination, European colonialism, and racism, and how to view Berlin's controversial distinction between so-called "negative liberty" and "positive liberty." By relating Berlin's thinking about freedom to competing contemporary views of the politics of freedom, this book will be significant for both scholars of Berlin as well as people who are interested in larger debates about the meaning and conditions of freedom. This book presents a collection of contemporary discourses that reconsider the relationship of democracy as a political ideology and American ideal and education as the foundation of preparing democratic citizens in America.

From 1922 to 1924, the Iroquois Confederacy — a federal union of six aboriginal nations — sought resolution of a dispute between themselves and Canada at the League of Nations. In this paper, the historical events of the 1920s League are employed as a case study to explore the development of the international society of states in the early 20th century as it relates to the indigenous peoples of North America. Specifically, it will be argued that the early modern practice (...) of excluding Amerindians from international political forums is related to the negative representation of indigenous peoples in the dominant theoretical discourse of the time: social contract theory. The diplomatic activities of the Iroquois, and the members of the League during this time period, demonstrate exactly how social contract theory has relied on presenting indigenous peoples as residing in a non-political and non-sovereign form, thus denying them the right to participate at the international level on par with other peoples. Thinkers heavily indebted to Foucault—such as Wendy Brown, Judith Butler, Jodi Melamed and Jasbir Puar—are at the fore of a contemporary interrogation of queerness and racialized empire. This paper critically surveys this terrain, differentiates several strands of it, and attempts a theoretical reframing such that we may be better equipped to gain new vantage on the central problematic. I argue that the current conviviality of queerness and empire is best understood not only through a univocal ‘homonationist’ lens, but also requires (...) situating in the context of multiple languages of civilizational superiority and liberal tolerance. In particular, it requires the deployment of arguments about the ‘benchmark of civilization,’ in which whole societies are ranked along a unilinear trajectory of development according to standards set by the most powerful among them. One relatively recent addition to the criteria of civilizational adjudication is the capacity of societies to ‘tolerate’ new forms of societal difference. In this case, I argue, the most important of these are the strange pairing of sexual and religious dispositifs. (shrink)

This paper presents a critical survey of the use and interpretation of the work of Michel Foucault in the field of postcolonial studies. The paper uses debates about Foucault’s legacy and his contributions (or lack thereof) to postcolonialism as a means of parsing out the main lines of contestation within the field—that is, as a means of tracing the contours of the space of questioning or field of problematization, in part to foreground what has been at stake and, more to (...) the point, what has not been at stake. Part I provides a general survey of what “Postcolonial Studies” is: what its major questions and debates have been. Part II examines the ways in which Foucault has been taken up, interpreted and used within the field, and Part III comments on what aspects of Foucault’s work have not been taken up, suggesting that this is most revealing about the state of postcolonial studies today. This paper proposes the ‘AGENCY model’ of conscious state attribution, according to which an entity's displaying certain relatively simple features (e.g. eyes, distinctive motions, interactive behavior) automatically triggers a disposition to attribute conscious states to that entity. To test the model's predictions, participants completed a speeded object/attribution task, in which they responded positively or negatively to attributions of mental properties (including conscious and non-conscious states) to different sorts of entities (insects, plants, artifacts, etc.). As predicted, participants responded positively to conscious (...) state attributions only for those entities that typically display the simple features identified in the AGENCY model (eyes, distinctive motion, interaction) and took longer to deny conscious states to those entities. Measuring neuronal activity with electrophysiological methods may be useful in detecting neurological dysfunctions, such as mild traumatic brain injury (mTBI). This approach may be particularly valuable for rapid detection in at-risk populations including military service members and athletes. Electrophysiological methods, such as quantitative electroencephalography (qEEG) and recording event-related potentials (ERPs) may be promising; however, the field is nascent and significant controversy exists on the efficacy and accuracy of the approaches as diagnostic tools. For example, the specific measures derived from an (...) electroencephalogram (EEG) that are most suitable as markers of dysfunction have not been clearly established. A study was conducted to summarize and evaluate the statistical rigor of evidence on the overall utility of qEEG as an mTBI detection tool. The analysis evaluated qEEG measures/parameters that may be most suitable as fieldable diagnostic tools, identified other types of EEG measures and analysis methods of promise, recommended specific measures and analysis methods for further development as mTBI detection tools, identified research gaps in the field, and recommended future research and development thrust areas. The qEEG study group formed the following conclusions: 1. Individual qEEG measures provide limited diagnostic utility for mTBI. However, many measures can be important features of qEEG discriminant functions, which do show significant promise as mTBI detection tools. 2. ERPs offer utility in mTBI detection. In fact, evidence indicates that ERPs can identify abnormalities in cases where EEGs alone are nondisclosing. 3. The standard mathematical procedures used in the characterization of mTBI EEGs should be expanded to incorporate newer methods of analysis including nonlinear dynamical analysis, complexity measures, analysis of causal interactions, graph theory and information dynamics. 4. and 5. are too long to include here. We present a one per cent measurement of the cosmic distance scale from the detections of the baryon acoustic oscillations in the clustering of galaxies from the Baryon Oscillation Spectroscopic Survey, which is part of the Sloan Digital Sky Survey III. Our results come from the Data Release 11 sample, containing nearly one million galaxies and covering approximately 8500 square degrees and the redshift range 0.2 < z < 0.7. We also compare these results with those from the publicly released (...) DR9 and DR10 samples. Assuming a concordance Λ cold dark matter cosmological model, the DR11 sample covers a volume of 13 Gpc3 and is the largest region of the Universe ever surveyed at this density. We measure the correlation function and power spectrum, including density-field reconstruction of the BAO feature. The acoustic features are detected at a significance of over 7σ in both the correlation function and power spectrum. Fitting for the position of the acoustic features measures the distance relative to the sound horizon at the drag epoch, rd, which has a value of rd,fid = 149.28 Mpc in our fiducial cosmology. We find DV = at z = 0.32 and DV = at z = 0.57. At 1.0 per cent, this latter measure is the most precise distance constraint ever obtained from a galaxy survey. Separating the clustering along and transverse to the line of sight yields measurements at z = 0.57 of DA = and H =. Our measurements of the distance scale are in good agreement with previous BAO measurements and with the predictions from cosmic microwave background data for a spatially flat CDM model with a cosmological constant. © 2014 The Author Published by Oxford University Press on behalf of the Royal Astronomical Society.
