I The existence of the legal profession is something most lawyers take for granted. Lawyers of course do many different things, and lead different sorts of lives, but those who make their living in the law tend to assume, without much reflection, that they have a bond or association of some sort with others who do the same and believe they share something important in common with them. It is not at all clear, however, what this common element is, and (...) the great diversity of tasks that lawyers perform – representing litigants, counseling clients, advising legislators, administering government programs, and deciding cases – can easily make one doubt whether the search for a link leads to anything but empty generalities. One may, of course, conclude that the main law jobs, as Karl Llewellyn called them, have nothing important in common, and that the legal profession is only a name for a disconnected collection of pursuits with no substance or reality of its own. This is not, however, a very satisfying view, to lawyers at least, and is likely to provoke the quick reply that what lawyers share in common is after all quite easy to discern. All lawyers, regardless of the nature of their work, possess a general knowledge of the law which they have acquired through a specialized program of instruction; laypersons lack such knowledge and it is this, one might argue, which marks the line between those who are lawyers and those who are not and, thus, defines the scope and nature of the profession. Addresses the connections between self-love and self-governance in the thought of St. Thomas Aquinas and defends three related theses. Accordingly, the book provides a systematic account of Aquinas's thoughts on the nature of a person's self-experience and the role that experience plays in self-governance.

St. Thomas Aquinas treats penance as both a sacrament and a virtue. In either form, penance’s principal human act is contrition—a willed sorrow for one’s sins and an intention to avoid future sins. A look at Aquinas’s understanding of penitential contrition reveals a complex interplay of the different objects of love, the gift of fear, and finally friendship with God. This article offers an analysis of Aquinas’s accounts of penance and contrition with respect to these key elements. I argue that (...) contrition performs a fundamental role in countering, restoring, and safeguarding a proper ordering of love and attainment of the ultimate good of union with God. In short, contrition is the act that directly counters the interior disorder wrought by sin and provides an ongoing counter to the threat of additional disorder. I argue that epistemic vices are bad on account of a lack of a good epistemic motive. Consequently, the source of the badness is specifically epistemic. I develop my argument through a consideration of Aquinas’s accounts of wonder and presumption, namely that what makes the latter bad is the lack of something thatthe former possesses. Scaliger brought critical standards and methodological innovations to the already extensive sixteenth-century interest in chronology. He invented the Julian Period, a device for the reckoning of dates, exposed historical forgeries, and showed the independent value of non-Biblical sources even acknowledging Egyptian dynastic chronology antedating the Biblical Creation, although he could not satisfactorily resolve this conflict. After Scaliger, the quality of chronological studies declined as questions were argued less on historical grounds than on theological ones, but the confusion this created eventually (...) contributed to breaking the hold of the Bible on chronology, along the lines anticipated by Scaliger. Golubiewski offers a thorough and compelling case that Aquinas indeed bases his ethics on these various broader principles, such that proper practical principles inextricably and fundamentally are an imitation of nature.Golubiewski details the full range of scholarship on Aquinas's natural law theory in order to set up his meticulous and comprehensive analysis. He motivates his interpretation by examining two opposed positions in current discussion. On one side is the view championed by Stephen Brock and others that focuses on Aquinas's metaphysics of the good, along with "the imitation of nature as the 'imitation of the divine mind'" as crucial to an accurate understanding of the natural law. On the other side is Martin Rhonheimer, who maintains, "natural law is not the 'imitative reflex' of the 'natural order'." While art does have the specific sense of right reason regarding the making of things, Aquinas also uses it more broadly and analogically as conveying any kind of right reason. Thus, when Aquinas speaks of art, particularly in terms of right reason as an imitation of nature, this includes prudence and all of the moral virtues it directs. Moreover, the notion of art also pertains to God's creative act. Insofar as created natures are the effect of divine art, the parameters of their goodness are already determined. In the case of rational natures, they are not free to determine their own goodness. By imitating nature, a person imitates the mind behind nature.Golubiewski devotes considerable attention to the sources of moral knowledge. This paper addresses the connections between love of self and love of God in terms of their impact on personal subjectivity according to the thought of Thomas Aquinas. I argue that Aquinas’s understanding of self-love illuminates the experience of oneself as a person. Part of this argument relies on Aquinas’s notion that love of self is more basic than love of others. Aquinas further affirms that one ought to love God more than oneself. I explore the implications of this claim (...) for my interpretation concerning personal self-experience. I maintain that our participation in God causes a pull toward goodness and God within one’s experience of self. Also, friendship with God through charity offers the highest fulfillment of self-experience. (shrink)

In this paper, I argue against John Crosby’s view that Aquinas does not have an account of the nature and role of subjectivity. I maintain that Aquinas’s notion of the love-based self-relation which is fully actualized in self-friendship is an account of subjectivity. I accept Crosby’s characterization of subjectivity as a foundational self-relation which constitutes interiority and is the foundation for experience and action. I proceed by showing how, for Aquinas, the relation of self-love automatically arises from human nature in (...) virtue of amor. Dilectio then transforms the self-relation into a relation of self-consciousness, and finally amicitia adds the note of a stable habit that fully actualizes the self-relation. I show how the actualized self-relation constitutes interiority and is the basis for properly human experience and action. (shrink)

In a recent article Margalit Finkelberg raises the question of whether or not the phrase κλοσ π;θιτον at Iliad 9.413 is indeed a Homeric formula: λετο μν μοι νóατοσ, τρ κλοσ π;θιτον σται Her purpose is to ‘test the antiquity of κλοσ π;θιτον on the internal grounds of Homeric diction’ .1 Proposing to use specifically the analytic techniques of oral theory, she argues that this phrase does not represent a survival from an Indo-European heroic poetry, as has been suggested from (...) the occurrence of its exact cognate, śápos;rdvas áksitam, in Vedic poetry. To this end Finkelberg presents a precise and carefully organized argument. I briefly summarize its two branches as follows: It is the formulae that comprise the oldest stratum of Homeric diction, and so it is here that one would find survivals of Indo-European poetic diction. κλοσ π;θιτον σται , however, cannot be judged a Homeric formula by the criterion of repetition since it is a unique phrase in Homer. Nor can it be judged a formula by the ‘functional’ criterion since the better attested κλοσ οὒ ποτ óλεται expresses the same essential idea in the same metrical shape. A unique phrase such as that in question might nonetheless be ancient. The development of the use of π;θιτοσ, first to modify concrete nouns, and only later with abstracts, however, would indicate that its use with κλοσ is late. The demonstration that κλοσ θιτον σται is a ‘formulaic expression’, moreover, argues that it was coined for this specific context in Iliad 9 by analogy with other Homeric formulae, and so does not preserve an Indo-European formula. Since the last century, vaccination has been one of the most important tools we possess for the prevention and elimination of disease. Yet the tremendous gains from vaccination are now threatened by a growing hesitance to vaccinate based on a variety of concerns or objections. Geographic clustering of some families who choose not to vaccinate has led to a number of well-publicized outbreaks of vaccine-preventable diseases. Of note is that some of these outbreaks are centered within some Christian religious groups (...) that increasingly avoid vaccination due to moral concerns, fears about safety, or doubts about the necessity of vaccines. We argue from the perspective of Catholic social teaching on why there is a moral duty to vaccinate. (shrink)

Discussions of the relationship between perception and cognition often proceed without a definition of these terms. The sensory-modality specific nature of low-level perceptual processes provides a means of distinguishing them from cognitive processes. A more explicit definition of terms provides insight into the nature of the evidence that can resolve questions about the relationship between perception and cognition.

Cancer is an evolutionary and ecological process in which complex interactions between tumour cells and their environment share many similarities with organismal evolution. Tumour cells with highest adaptive potential have a selective advantage over less fit cells. Naturally occurring transmissible cancers provide an ideal model system for investigating the evolutionary arms race between cancer cells and their surrounding micro‐environment and macro‐environment. However, the evolutionary landscapes in which contagious cancers reside have not been subjected to comprehensive investigation. Here, we provide a (...) multifocal analysis of transmissible tumour progression and discuss the selection forces that shape it. We demonstrate that transmissible cancers adapt to both their micro‐environment and macro‐environment, and evolutionary theories applied to organisms are also relevant to these unique diseases. The three naturally occurring transmissible cancers, canine transmissible venereal tumour (CTVT) and Tasmanian devil facial tumour disease (DFTD) and the recently discovered clam leukaemia, exhibit different evolutionary phases: (i) CTVT, the oldest naturally occurring cell line is remarkably stable; (ii) DFTD exhibits the signs of stepwise cancer evolution; and (iii) clam leukaemia shows genetic instability. While all three contagious cancers carry the signature of ongoing and fairly recent adaptations to selective forces, CTVT appears to have reached an evolutionary stalemate with its host, while DFTD and the clam leukaemia appear to be still at a more dynamic phase of their evolution. Parallel investigation of contagious cancer genomes and transcriptomes and of their micro‐environment and macro‐environment could shed light on the selective forces shaping tumour development at different time points: during the progressive phase and at the endpoint. A greater understanding of transmissible cancers from an evolutionary ecology perspective will provide novel avenues for the prevention and treatment of both contagious and non‐communicable cancers. Many older gay men experience diminished psychological well‐being (PWB) due to unique circumstances including discrimination, living with HIV, and aging through the HIV/AIDS crisis. However, there remains ambiguity as to how older gay men define and understand PWB. Our team interviewed and analyzed the accounts of 26 older (50+) self‐identifying English‐speaking men living in southwestern British Columbia, Canada. We drew on tenets of constructivist grounded theory and intersectionality to account for unique contextual considerations and power relations. Semi‐structured Zoom interviews were (...) conducted from August‐October 2022. Interview transcripts were compared to generate high‐order conceptual findings underpinned by processes understood as central to PWB. Three PWB temporal processes highlighted interlocking social and contextual circumstances intersecting with power and maturation: (1) being emotionally balanced, (2) living gratitude (3) and fully embracing self‐acceptance. Being emotionally balanced supported the affective and sustainable state of contentment, living gratitude drew from the wisdom of accrued experiences to cultivate a positive affective state inclusive to recognising social location privileges, whilst fully embracing self‐acceptance redressed the harms of anti‐gay discourses that men endured throughout their lives. The knowledge is relevant to service and resource development to deliver tailored PWB supports to older gay men. (shrink)

Most ?theories of consciousness? are based on vague speculations about the properties of conscious experience. We aim to provide a more solid basis for a science of consciousness. We argue that a theory of consciousness should provide an account of the very processes that allow us to acquire and use information about our own mental states ? the processes underlying introspection. This can be achieved through the construction of information processing models that can account for ?Type-C? processes. Type-C processes can (...) be specified experimentally by identifying paradigms in which awareness of the stimulus is necessary for an intentional action. The Shallice (1988b) framework is put forward as providing an initial account of Type-C processes, which can relate perceptual consciousness to consciously performed actions. Further, we suggest that this framework may be refined through the investigation of the functions of prefrontal cortex. The formulation of our approach requires us to consider fundamental conceptual and methodological issues associated with consciousness. The most significant of these issues concerns the scientific use of introspective evidence. We outline and justify a conservative methodological approach to the use of introspective evidence, with attention to the difficulties historically associated with its use in psychology. (shrink)

Using hypersets as an analytic tool, we compare traditionally Gibsonian (Chemero 2003; Turvey 1992) and representationalist (Sahin et al. this issue) understandings of the notion ‘affordance’. We show that representationalist understandings are incompatible with direct perception and erect barriers between animal and environment. They are, therefore, scarcely recognizable as understandings of ‘affordance’. In contrast, Gibsonian understandings are shown to treat animal-environment systems as unified complex systems and to be compatible with direct perception. We discuss the fruitful connections between Gibsonian affordances (...) and dynamical systems explanation in the behavioral sciences and point to prior fruitful application of Gibsonian affordances in robotics. We conclude that it is unnecessary to re-imagine affordances as representations in order to make them useful for researchers in robotics. (shrink)
