Since the late eighties, a sequel of annual workshops on logic and analytic philosophy has been held on the Island of Poel near Wismar, close to both Gottlob Frege’s grave and to his house in Bad Kleinen. The meeting last year, however, was held in Graal-Müritz and was devoted to Ontologic. It was organised by Jerzy Perzanowski, Uwe Scheffler and Max Urchs. The present number of Logic and Logical Philosophy is not exactly the proceedings of the 94’ conference. On (...) one hand, not all the papers presented at the workshop (see next page for the programme) are included in this volume, while others were changed considerably. Perspectives on Time deals with the problem of time from different perspectives such as logic, physics and philosophy. It contains 18 previously unpublished papers, written by philosophers from various European countries, as well as a large introduction about the history and the main situation in the respective fields today. The prominent issues which are addressed in this book concern the direction of time, the reality of tenses, the objectivity of becoming, the existence in time, and the logical structures of reasoning (...) about time. The paper outlines an analysis of token causation . It contains reasons for the choice of event tokens and a list of properties of causal relations. After defining the notion event it is shown, in which form classical philosophical problems arise and how they can be solved: Causality is interpreted as an second order property of first order relations. Temporal order can be induced from causal order. Token causation does not involve neither any kind of necessity, nor probability. Causal laws (...) are generalizations on sentences about token causation by quantifying over event types. Two explications of Causal law are suggested, differing in the ability of allowing for exceptions. (shrink)

Logiker würden doch nur Tautologien und Trivialitäten produzieren. Mit dieser Kritik werden Logiker an philosophischen Instituten oft konfrontiert. Es wird ebenfalls eingewendet, daß mathematische Methoden in der Philosophie unangemessen seien, daß man durch die Verwendung dieser Methoden auf eine bestimmte philosophische Position festgelegt sei und daß der philosophische Gewinn den mit einem logischen Apparat verbundenen Aufwand nicht rechtfertige. In der Arbeit wird dargelegt, inwieweit diese vier Vorwürfe berechtigt sind und inwieweit sie auf Mißver- ständnissen beruhen. Dazu werden folgende Fragen beantwortet: (...) Was sind formale Sprachen und formale Systeme? Was ist die Aufgabe logischer Untersuchungen in der Philosophie? Sollten philosophische Texte formalisiert werden? Inwieweit ist Logik nützlich? Gibt es Beispiele für philosophisch fruchtbare logische Resultate? Legt Logik auf eine bestimmte Philosophie fest? Logik, so wird gezeigt, dient der Überprüfung philosophischer Argumente und als Medium zum Philosophieren. (shrink)

Der kürzlich verstorbene US-amerikanische Soziologe Robert K. Merton war der prominenteste und einflußreichste Anomie-Theoretiker nach Emile Durkheim. Seine Typologie der Arten individueller Anpassung an anomische gesellschaftliche Situationen bietet heute noch eine wertvolle Grundlage zur Analyse von Gesellschaften. Dieser Beitrag konzentriert sich auf einen dieser Anpassungstypen, den Ritualismus, der Merton zufolge beinhaltet, daß einerseits die kulturellen Ziele, allen voran das des wirtschaftlichen Wohlstands, heruntergeschraubt oder aufgegeben und andererseits die institutionellen Normen zur Erreichung dieser Ziele beinahe zwanghaft befolgt werden. Diese Definition überdenkend (...) versucht der vorliegende Beitrag herauszuarbeiten, daß innerhalb des Systems der Anpassungsformen das Herunterschrauben der kulturellen Ziele nicht das Hauptcharakteristikum ritualistischen, sondern konformen Verhaltens darstellt. Ritualisten haben den Prozeß des Herunterschraubens vielmehr bereits beendet, indem sie jegliche kulturellen Ziele aufgegeben haben, bis auf den einen Wert an sich, nämlich die institutionellen Regeln einzuhalten.Ritualistische Anpassung ist aus Merton`s Sicht für die Soziologie abweichenden Verhaltens, ganz zu schweigen von den Kriminalwissenschaften, nicht von Interesse. Im Gegensatz zu dieser Einschätzung versucht dieser Artikel die verschiedenen soziologischen und sogar kriminologischen Implikationen ritualistischen Verhaltens darzustellen, mit dem Ergebnis, daß Ritualismus sehr wohl ein soziales Problem darstellt. Der Ritualist unterwirft sich nicht nur selbst den institutionellen Normen, sondern fühlt sich auch dazu berufen, andere ständig an die Einhaltung der Regeln zu gemahnen und sie zu überwachen. Deshalb gibt es viele typisch ritualistische Formen abweichenden Verhaltens, wie Denunziation, erzieherischer Tadel oder Mobbing, die sogar in kriminelles Verhalten wie falsche Verdächtigung, Nötigung oder Beleidigung kulminieren können.Am schillerndsten ist die Rolle des Ritualisten in der Kriminalpolitik, nicht zuletzt heute in der Bundesrepublik. Repression jeglicher Art ist seine Antwort auf Regelverstöße und die Kriminalpolitik macht zunehmend Zugeständnisse an ritualistische Forderungen nach härterer und schnellerer Bestrafung oder umfassender Überwachung des öffentlichen Raumes. Ritualisten dominieren den sozialen Diskurs und die allgemeine Wahrnehmung von Kriminalität nicht nur, weil sie wichtige Nutzer und damit Zielgruppe gewisser Massenmedien sind und gerne Leserbriefe schreiben. Sie sind so dominant, weil ihre Art der Anpassung bei zunehmender wirtschaftlicher Krise die Konformität der Wirtschaftswunderzeit zurückgedrängt hat und heute die am weitesten verbreitete in der deutschen Gesellschaft ist. Daher ist auch die schon seit Jahrzehnten zu beobachtende Verschiebung der theoretischen Strafzweckbegründung hin zur Positiven Generalprävention alles andere als ein Zufall. The recently deceased US-sociologist Robert K. Merton has been the most prominent and influential anomie theorist since Emile Durkheim. His typology of modes of adaptation to anomic social situations still constitutes a valuable basis for analyzing society. This contribution focuses on one of these types of adaptation, ritualism, which according to Merton, involves the scaling down or abandoning of the cultural goals, above all economic wealth, on the one hand and to abide almost compulsively by institutional norms to attain these goals on the other. In reconsidering this definition, this contribution attempts to elaborate that within the system of adaptive modes scaling down does not describe the main characteristic of ritualistic behaviour, but first of all characterizes conformity. Ritualists, on the contrary, have already completed the process of scaling down by finally abandoning any cultural goal except the one end-in-itself, that is to comply with the institutional rules.Ritualistic adaptation, in Merton`s view, is of no interest to the sociology of deviant behaviour, not to mention criminal sciences. In contrast to this evaluation this contribution tries to delineate the various sociological and even criminological implications of ritualistic behaviour, leading to the conclusion that Ritualism does indeed present a social problem. The ritualist does not only surrender himself to the institutional means but feels competent to constantly reminding others of abiding by the institutional norms and supervising them. Hence there are many typically ritualistic forms of deviant behaviour like denunciation, disciplinary reproof or mobbing that may even culminate in criminal behaviour like false suspicion, duress or insult.Most ambiguous is the ritualist`s part in criminal policy, not at least in contemporary Germany. Repression of any kind is his answer to breaches of the rules and criminal policy more and more concedes to ritualistic demands for more severe and rapid punishment or extensive supervision of public facilities. Ritualists dominate the social discourse and general perception of criminality, not only because they are important users and therefore the target group of certain mass media, and like to write letters to the editor. They do dominate because in times of increasing economic crisis their mode of adaptation has forced back the conformity of the German economic miracle era and is now the most common one in contemporary German society. Thus, the shift in the theoretical justification of punishment towards a theory of positive general prevention, noticeable for decades, is anything but accidental. (shrink)

W artykule rozważa się okresy warunkowe oparte na systemie ścisłego entailment Fs skonstruowanym przez Wessela. Poprzez uzupełnienie aksjomatyki i reguł inferencji Fs otrzymuje się system FSK, posiadający dwie struktury implikacyjne, typu: entailment i okresu warunkowego. Konsekwencją dalszej modyfikacji systemu FSK poprzez wprowadzenie dodatkowych reguł inferencji. systemy FSK5, FSK6 i FSK7, jest zmiana odpowiednich klas okresów warunkowych bez zmiany entailment.

"Why punish?" is one of the oldest and certainly the most crucial question confronting the criminal law. Yet surprisingly little has been accomplished in the systematization of individual theories of punishment. Discussions merely contrast absolute and relative theories or focus on the triad: retribution - general prevention - specific prevention. This article approaches the issue by undertaking an exhaustive systematization. First, it considers the relationship between theories of punishment and theories of criminality, both understood in the broad sense. Theories of (...) punishment thus can include approaches such as re-establishment of offender-victim parity, provision of reparations, radical non-intervention, or any number of agreements between the offender and the victim and/or state. Theories of criminality include so-called criminalization conceptions, such as the labeling approach or approaches based on a priori ideas of human nature. It then comes to light that virtually every theory of punishment in the broad sense can be linked to a group of theories of criminality. Furthermore, theories of punishment when viewed in their orientation toward the offender, the victim or the general community can be categorized in a comprehensive system which indicates that theoretically additional, as yet undiscussed, theories of punishment are conceivable, such as punishment of the victim or positive sanctioning of the offender. Finally, the article attempts to arrange the theories of punishment gained from the analysis such that they can be subordinated to various primary punishment goals: satisfaction of the demand for punishment of the offender, crime prevention, punishment equality, and keeping of peace within the legal community. Obwohl die Frage, warum eigentlich gestraft wird, eine der ältesten und wohl die entscheidenste des gesamten Strafrechts ist, hat man bisher erstaunlich wenig für die Systematisierung der einzelnen Straftheorien geleistet. Es werden immer nur die absoluten Straftheorien den relativen gegenübergestellt oder von der Trias Vergeltung - Generalprävention - Spezialprävention gesprochen. In dem vorliegenden Beitrag sollen nun weiterreichende Wege der Systematisierung gegangen werden: Zunächst einmal wird das Verhältnis der Straftheorien zu den Kriminalitätstheorien untersucht, wobei beide Begriffe sehr weit verstanden werden: Als Straftheorien können danach auch Konzeptionen wie Täter-Opfer-Ausgleich, Wiedergutmachung, Nonintervention oder Verständigung verstanden werden; zu den Kriminalitätstheorien werden auch die sog. Kriminalisierungskonzepte wie etwa der labeling approach oder eher geisteswissenschaftlich orientierte Konzepte gerechnet. Es stellt sich heraus, daß sich praktisch jede der Straftheorien im weiteren Sinne mit einer Gruppe so verstandener Kriminalitätstheorien verbinden läßt. Des weiteren lassen sich die Straftheorien, wenn man ihre Ausrichtung entweder auf den Täter oder das Opfer oder aber auf die Gesellschaft beachtet, in ein umfassendes System einordnen, in dem deutlich wird, daß theoretisch noch weitere, bisher nicht diskutierte Straftheorien denkbar sind, wie etwa die Opferbestrafung oder die positive Sanktionierung. Schließlich wird in dem Beitrag versucht, die so gewonnenen Straftheorien dahingehend zu ordnen, daß man sie verschiedenen übergeordneten Strafzielen - Befriedigung von Strafbedürfnissen, Vorbeugung von Straftaten, Gleichheit des Strafens, Schaffung von Rechtsfrieden - zuordnet. In times of modern information technology, the world of science is becoming smaller. Does this mean that there will be no more provinces? We do not think so. Setting out from Leszek Nowak's thought “province is where one thinks not on one's own account but on account of another,” we indicate a number of processes that perpetuate provinces. These processes are driven by specific access to scientific knowledge, by education, by new forms of communication, by shortage of financial support and (...) the concentration of resources. We look at the interplay between criteria of theory choice and location on the scientific map. Next, we explore the connection between geo-social and scientific provinces, taking into consideration political and cultural parameters. The conceptual framework of metropolises and provinces in science turns out to be, though not all-embracing, an extremely fruitful one. (shrink)

Morality can hardly perform a function, which is discussed in this chapter, unless it offers directives that not only can but frequently do differ from those of self-interest itself. The idea of potential congruence asserts that the relation between morality and the interests of the individual agent is characterized by a high degree of mutual accommodation, so that the frequency and severity of conflict between these two perspectives is significantly reduced. Conflicts are nevertheless possible in principle, but the extent to (...) which they arise in practice is not fixed or immutable. Instead, the frequency of conflict depends to a considerable degree on the character of the prevailing social and political institutions. Achieving convergence between morality and self-interest is in part a social and political task. The account of the “priority” of morality developed by Thomas Scanlon in his book What We Owe to Each Other is similar in a number of respects to this chapter's account of potential congruence. Durch technologische Veränderungen verändern sich permanent die Statusbestimmungen: Die Autonomie des Menschen konkurriert mit künstlich-intelligenten Maschinen, die Leidensfähigkeit mit der des Tieres, die Individualität mit der digitalen Selbstinszenierung und die Geschöpflichkeit mit der technologischen Selbstvergöttlichung. Die Beiträge suchen nach Bedingungen sozialer Anerkennung, die nicht zirkulär ausgehandelt werden können, sondern Kategorien einbringen, die auch von Menschen verwendet werden, wenn (...) sie von Gott sprechen. This paper first summarizes two central debates in the field of social scientific Internet research, namely the debate about the so-called ‘social impact of Internet use’ and the debate about the existence of community on the Internet. Early research discussed whether building up a community on the Internet was possible and what the effects of the use of the Internet were for its user. Recent research on the social consequences of Internet use suggests that ‘the’ Internet should no longer be (...) regarded as a constant that has uniform effects for its users. Rather, the consequences of its use depend on a number of contextual conditions. The paper presents some theories that explain which conditions and features of online groups facilitate the finding of solutions to bilateral or group-level problems of cooperation. (shrink)
