The doctrine of the mature minor began as an emergency exception to the rule of parental consent. Over time, the doctrine crept into cases that were non-emergent. In this essay, we show how the doctrine also developed in the context of the latter part of the 20th century, at the same time that the sexual revolution, the pill, and sexual liberation came to be seen as important symbols of female liberation—liberation that required that female minors be granted the status of (...) a mature minor. To do so moves sexual morality out of the domain of the family, where it had always been situated, and into the domain of the state. We also show how a phenomenological account of the care of the body in the family conforms to the latest in neuroscientific understandings of adolescent brain development. The family attenuates the dependency of adolescents and provides an important social contextualization for the care of the body, including the inculcation of sexual mores in adolescence. We conclude that the drive to push sexual decision making as a matter of state concern further undermines the foundations of the moral meanings of sex and sexuality. (shrink)

Honor walks are ceremonies that purportedly honor organ donors as they make their final journey from the ICU to the OR. In this paper, we draw on Ronald Grimes’ work in ritual studies to examine honor walks as ceremonial rituals that display medico-technological power in a symbolic social drama (Grimes, 1982). We argue that while honor walks claim to honor organ donors, ceremonies cannot primarily honor donors, but can only honor donation itself. Honor walks promote the quasi-religious idea of donation (...) as a “good death,” and mask the ambiguity and discomfort inherent in organ donation to promote greater acceptance by the medical community. While some goods may be achieved through honor walks, particularly for donor families, it is still important to examine the negative work done by this practice. (shrink)

Sally Gadow influenced our work when we first began exploring the meaning of nursing philosophically. In this article, we discuss two major themes of Gadow's work that have influenced us: existential advocacy and treating the body objectively without reducing the patient to the moral status of an object. Our treatment of these issues is appreciative but not uncritical. We argue that existential advocacy makes an important contribution to the meaning of nursing but that it cannot be its essential meaning. We (...) contend that Gadow, by making self‐direction the essence of care, tends to diminish the intersubjective nature of care. Then we show how Gadow recovers the intersubjective nature of care by disclosing how nurses and patients both become subjects in personal relationships, even when tending to the body objectively. We show how hermeneutic phenomenology, which we favour, can contribute to Gadow's existential phenomenology by using examples from nursing practice to disclose the meaning of nursing. Gadow's major contribution to our work has been in the ways her work has evoked creative thought from us concerning the meaning of nursing. (shrink)

The paper describes the approach by which ethics are integrated into the undergraduate curriculum at Northern Illinois University''s College of Business. Literature is reviewed to identify conceptual frameworks for, and issues associated with, the teaching of business ethics. From the review, a set of guidelines for teaching ethics is developed and proposed. The objectives and strategies implemented for teaching ethics is discussed. Foundation and follow-up coursework, measurement issues and ancillary programs are also discussed.

Contextual emergence was originally proposed as an inter-level relation between different levels of description to describe an epistemic notion of emergence in physics. Here, we discuss the ontic extension of this relation to different domains or levels of physical reality using the properties of temperature and molecular shape as detailed case studies. We emphasize the concepts of stability conditions and multiple realizability as key features of contextual emergence. Some broader implications contextual emergence has for the foundations of physics and cognitive (...) and neural sciences are given in the concluding discussion. This article commemorates Jean Baudrillard’s career with an account of the consistency of his interventionist logic, the subtlety of his styles of argument and the prescience of his observations. It provides an account of Baudrillard’s sustained engagement with the intensification of simulation that has increasingly codified trends in communications, technology politics, the social, the psychological and economics in the name of functionality. The consistency of Baudrillard’s arguments belies the many superficial judgements made about them, which were anyway often knowingly encouraged (...) by Baudrillard’s rhetorical strategies. (shrink)

In this article we outline the ways in which questions of language have both revealed problems with conceptions of knowledge and suggested constructive ways of addressing those problems. Having examined the limitations of instrumental notions of language, we outline some alternatives, especially those developed from the middle of the 19th and throughout the 20th century. We locate forceful and influential philosophical interventions in the writings of Nietzsche and Heidegger and foundational revisions in the linguistics of Ferdinand de Saussure and his (...) structuralist inheritors. We also chart the parallel path of literary theory from Mallarmé through Blanchot and poststructuralism to deconstruction. We conclude, after making some observations about the politicization of language in the works of feminist and postcolonial theorists, with some remarks about how the question of language helps to problematize global knowledge. Violence is spoken of in several senses but its most basic definition, as a force exerted by one thing on another, harbors serious problems, especially when it comes to a consideration of its source or cause. We begin this article by identifying some of the aporias of violence with reference to philosophical and religious discourses and then we go on to analyze how violence problematizes concepts of law and justice in world historical contexts. We examine several traditions including Indo-European mythology, (...) as well as Hindu, Taoist, and ancient Greek philosophy, before addressing the concept of violence in modern thought, as a revision of Christianity. Compelled by recent public and politicized cases in which withdrawal of nutrition and hydration were at issue, this essay examines recent Church statements and argues that the distinction between private and public forms of human life is being lost. Effacing the distinction between the sphere of the home (oikos), where the maintenance of life (zoē) occurs, and the city (polis), where political and public life (bios) occurs, may have unforeseen and unwanted consequences. Through their well-intentioned efforts to preserve the sanctity (...) of life, certain bishops and the Congregation for the Doctrine of the Faith have unfortunately brought political considerations into the home, taking decision-making authority away from those most intimately related to the patient. Thus, the question of removing nutrition and hydration in the case of patients such as Schiavo and Englaro becomes politicized and abstract, in contrast with the Church's previous positions on the importance of proportionate means in the maintenance of life, local decision making, and its recognition of life as a penultimate end. The article examines the distinction between the state of emergency and the normal state and an inherent undecidability at the base of the distinction. We argue that states of emergency arise from strategic sovereign decisions to divide visible from invisible, enemy from ally, underground economy from above-ground, illegitimate war from legitimate war. The capacity to so divide is manifested, for instance, in the technology of air raid sirens in a way that indicates the momentum of the technicity that covertly underlies (...) sovereign power. The article, furthermore, shows how the distinction between the visible and the invisible can serve as a mystification, perpetuating the state of emergency by disguising the intrinsic connection between the two domains. The article examines the sensorium and how it is has been divided to argue that touch underlies what we refer to as hearing. It explores Stockhausen's "Helicopter Quartet" as an extended meditation on the mediation of the senses and the foregrounding of touch in the piece through teletechnologies that serve as prosthetic devices for sound, sight and touch.

In cognitive neuroscience and in philosophy of mind, causation is a notion that is immensely important but usually not defined precisely enough to afford careful application. A widespread basic flaw is the confusion of causation with correlation. All empirical knowledge in the sciences is based on observing correlations; assigning causal relations to them or interpreting them causally always requires a theoretical background that is implicitly or (better) explicitly stated. This entails that differing theoretical approaches might lead to different interpretations of (...) correlations. The main objective is to conduct a systematic review of randomised trials where the intervention involves manipulating either (a) practitioner empathy or (b) patient expectations, or (c) both.

This piece presents the work of academics and architects in a collaborative venture. It provides an architectural design and a series of statements towards the hypothetical creation of an unconventional city centre in the Chinese city of Shenzhen. The idea is to create a linear university that would run the 20-kilometer length of the Shenzhen Strip: the 20K university. The contributors outline, in the diversity of their idioms, a complex spatial condition fundamental to life, and demonstrate new relationships between knowledge (...) and the city. The design of the proposed ‘open university space’ responds to two simultaneous and interrelated challenges: that posed to architecture, and that posed to science. The university would embody the meeting of these at the intersection of the urban infrastructure and the knowledge infrastructure. The purpose is thus also to develop the notion of knowledge, embodied in institutions, as urban infrastructure. (shrink)

Introduction Currently, The nature and scope of Clinical Ethics Protocols in Madrid are not well understood.Objectives The main objective is to describe the features of ‘guideline/recommendation’ type CEPs that have been or are being developed by existing Clinical Ethics Committees in Madrid. Secondary objectives include characterisation of those CECs that have been the most prolific in reference to CEP creation and implementation and identification of any trends in future CEP development.Methods We collected CEPs produced and in process by CECs accredited (...) in the public hospitals in Madrid, Spain, from 1996 to 2008.Results CECs developed 30 CEPs, with 10 more in process. The most common topic is refusal of treatment . If CEPs addressing terminal illness, Do-Not-Resuscitate orders and advance directives are placed into a separate ‘ethical problems at the end of life’ category, this CEP subject emerges as the most common . There is a relationship between the age of the CEC and the development of CEPs . CECs now seem to be more likely to engage in CEP development.Conclusions The CECs in Madrid, Spain, have developed a significant number of CEPs and there is a trend towards continued development. The most frequent topics are ethical problems at the end of life and refusal of treatment by the patient. (shrink)

The generality problem is widely considered to be a devastating objection to reliabilist theories of justification. My goal in this paper is to argue that a version of the generality problem applies to all plausible theories of justification. Assume that any plausible theory must allow for the possibility of reflective justification—S's belief, B, is justified on the basis of S's knowledge that she arrived at B as a result of a highly (but not perfectly) reliable way of reasoning, R. The (...) generality problem applies to all cases of reflective justification: Given that is the product of a process-token that is an instance of indefinitely many belief-forming process-types (or BFPTs), why is the reliability of R, rather than the reliability of one of the indefinitely many other BFPTs, relevant to B's justificatory status? This form of the generality problem is restricted because it applies only to cases of reflective justification. But unless it is solved, the generality problem haunts all plausible theories of justification, not just reliabilist ones. (shrink)

What is it like to live with the label “Disability?” NIB editorial staff and narrative symposium editors, Jeffery Bishop and Naomi Sunderland developed a call for stories, which was sent to several list serves, shared with the 1000 Voices Project community and posted on Narrative Inquiry in Bioethics ’ website. The request for personal stories from people who identify with the label “disabled” asked them to: consider how the label “disability” interacts with other aspects of their life in health (...) care settings; does the term “disability” reflect their actual embodied experiences of impairment or does it fail to do justice to their particular experience of impairment; describe the kind of experiences that are possible because of the impairment(s); discuss how the label has affected their “authentic voice”; and many other concepts about what effects the label has on their lives. These authors share deeply personal experiences that will help readers understand their world, challenges, and joys. Thirteen stories are found in the print version of the journal and an additional five supplemental stories are published online only through Project MUSE. The stories are complemented by four commentary articles by Elizabeth R. Schiltz; Lorna Hallahan; Nicole Matthews, Kathleen Ellem, and Lesley Chenoweth; and Jeffery Bishop, Rachelle Barina, and Devan Stahl. These scholars come from the disciplines of law, social work, media studies, medicine, and bioethics from Australia and the United States. Together, the symposium’s storytellers and commentators offer striking and informative insights into the everydayness of living with disabilities. (shrink)

This book adds to a realist account of laws of nature the framework for a related realist understanding of causation. It has two main parts: the first is concerned with laws, the second with causation. In the first main part, Tooley surveys sophisticated regularity accounts of laws and argues that none is successful. One of his central themes is that regularity accounts fail to meet the intuition that there can be underived laws which lack relevant instances--an intuition which Tooley supports (...) by appeal to two crucial examples. Tooley's diagnosis is that the reductionist assumption that the truth-makers for laws of nature are facts about particulars must be abandoned, and that laws must therefore be facts about universals. What kinds of facts? Tooley sets out a careful specification of the theoretical concept of a nomological relation. But he grants a need to go beyond this in order to make his account illuminating: Just how much has been explicated by the claim that what makes it a law that whatever has property P also has property Q is that the universals P and Q stand in a certain "nomic" relation? To answer this, and to dispel other doubts, Tooley offers the speculative suggestion that for it to be a law that whatever is P is also Q is for the conjunctive universal P-and-Q to exist, and for the universal P to exist, but only "dependently," as part of the conjunctive universal P-and-Q. Tooley argues that his specification of nomic relations can be extended to cover the case of probabilistic laws. It is unclear, however, how his speculative metaphysics could be extended to cover the probabilistic case: Can the universal P exist only to some degree as part of the conjunctive universal P-and-Q, and at the same time to another degree as part of the universal P-and-R? BOOK REVIEWS $0 5 David Berman. George Ber~ley: Idealism anti the Man. Oxford: Oxford University Press, 1994. Pp. xi + 230. Cloth, $42.00. Professor Berman's focus on Berkeley is more on "the Man" than on the metaphysics and this engaging study will therefore be of greater value to those with a historical, rather than a philosophical, interest in the good bishop. The book is aptly subtitled, particularly if we understand 'idealism' in its first, or Platonic sense , rather than (...) just in the peculiarly Berkeleyan metaphysical sense. The first three of its eight chapters deal with Berkeley's metaphysics, but the bulk of the book is concerned with extraphilosophical events in Berkeley's life, in particular with the two most significant ones: the abortive Bermuda Project and the messianic, indeed almost mystical, devotion to tar-water as a medical panacea. One of the great virtues of Berman's book is that it ties together the three periods of Berkeley's career--"each marked by an.. (shrink)
