Requirement‐sensitive legal moralism is a species of legal moralism in which the legitimacy of turning moral into legal demands depends on the existence of a legitimate moral requirement, producing a legitimate social requirement, which can then ground a legitimate legal requirement. Crucially, each step is defeasible by contingent or instrumental, but not intrinsic moral factors. There is no genuinely moral sphere (e.g., a private sphere) in which the law is not to interfere; only contingent, non‐moral factors can defeat this. Using (...) William A. Edmundson's Three Anarchical Fallacies as a foil, this idea is spelled out; it is shown why considerations based on the harm principle, consent, and the fact of pluralism do not immediately defeat it, but several problems with Edmundson's account are examined to point out where the idea could be further developed. Sexual activism (for, e.g., participants in the LGBT+ or BDSM communities) is prima facie commendable, at least for the liberal. However, it is unclear whether the end goal of such activism is toleration or recognition. The argument of this paper is that, on the level of authoritative political and social-moral rules, toleration is the only justifiable goal, while recognition may be pursued as an ideal outside the sphere of political and social-moral rules, that is, in civil society. In recent literature, there has been much debate about whether and how luck egalitarianism, given its focus on personal responsibility, can justify universal health care. In this paper we argue that, whether or not this is so, and in fact whether or not egalitarianism should be sensitive to responsibility at all, the question of personal responsibilization for health is not settled. This is the case because whether or not individuals are responsible for their own health condition is not all that (...) is relevant when considering whether we should somehow hold them responsible for their own health condition, e.g. cost-wise. There may also be efficiency-based reasons to hold them responsible, and there may even be egalitarian reasons. Defining universal health care as an insurance system where everyone’s deductible and premium is 0, we will argue that efficiency-based reasons for cost-responsibilization are not convincing, but that there are egalitarian reasons for cost-responsibilization. Luck egalitarianism, therefore, cannot, at least not on its own term, justify universal health care. (shrink)

Among other things, non-discrimination seems to imply that companies recognize and respect a range of religious preferences, including allowing religious clothing, e.g., by allowing Muslim women to wear headscarves. However, many companies do not believe that employees generally should be allowed to wear the kind (...) of clothes they please. In this paper, we discuss the asymmetry between the status of religious and secular clothing. We conclude that religious exemptions to dress codes can discriminate wrongfully. To solve this problem, companies should not ban religious clothing. Instead, companies should liberalize their dress codes, so that employees would be allowed to wear secular and religious types of clothing on an equal footing. (shrink)

We generalize the concept of Nash equilibrium in mixed strategies for strategic form games to allow for ambiguity in the players' expectations. In contrast to other contributions, we model ambiguity by means of so-called lower probability measures or belief functions, which makes it possible to distinguish between a player's assessment of ambiguity and his attitude towards ambiguity. We also generalize the concept of trembling hand perfect equilibrium. Finally, we demonstrate that for certain attitudes towards ambiguity it is possible to explain (...) cooperation in the one-shot Prisoner's Dilemma in a way that is in accordance with some recent experimental findings. Gillian Russell: Quine on the Analytic/Synthetic Distinction: This paper examines several of Quine's arguments against the analytic/synthetic distinction: the main arguments from “Two Dogmas of Empiricism” and several arguments against truth in virtue of meaning from “Truth by Convention” and “Carnap on Logical Truth.” It proposes a particular interpretation of the Circularity Argument that helps to make sense of several related puzzles concerning it, and endorses some of the epistemological lessons of the Argument from Confirmation Holism, but it argues that (...) these don't have the consequences for analyticity and necessity that Quine takes them to have. Finally, I argue that Quine's arguments against truth in virtue of meaning should not make us skeptics about it, but they really are useful for getting clearer about what kind of property truth in virtue of meaning must be. This paper uses a two-dimensional version of a standard common consequence experiment to test the intransitivity explanation of Allais-paradox-type violations of expected utility theory. We compare the common consequence effect of two choice problems differing only with respect to whether alternatives are statistically correlated or independent. We framed the experiment so that intransitive preferences could explain violating behavior when alternatives are independent, but not when they are correlated. We found the same pattern of violation in the two cases. This is (...) evidence against intransitivity as an explanation of the Allais Paradox. The question whether violations of expected utility are mainly due to intransitivity or to violation of independence is important since it is exactly on this issue the main new decision theories differ. Obtaining human genetic samples is vital for many biobank research purposes, yet, the ethics of obtainment seems to many fraught with difficulties. One key issue is consent: it is by many considered ethically vital that consent must be fully informed (at least ideally speaking) in order to be legitimate. In this paper, we argue for a more liberal approach to consent: a donor need not know all the specifics of future uses of the sample. We argue that blanket consent is (...) ethically defensible, and that this is buttressed by considerations of (justified) trust-relations. Given robust institutional oversight, blanket consent is a permissible form of consent in the bio-banking context. (shrink)

According to the standard story W. V. Quine ’s criticisms of the idea that logic is true by convention are directed against, and completely undermine, Rudolf Carnap’s idea that the logical truths of a language L are the sentences of L that are true-in- L solely in virtue of the linguistic conventions for L, and Quine himself had no interest in or use for any notion of truth by convention. This paper argues that and are both false. Carnap did not (...) endorse any truth -by- convention theses that are undermined by Quine ’s technical observations. Quine knew this. Quine ’s criticisms of the thesis that logic is true by convention are not directed against a truth -by- convention thesis that Carnap actually held, but are part of Quine ’s own project of articulating the consequences of his scientific naturalism. Quine found that logic is not true by convention in any naturalistically acceptable sense. But he also observed that in set theory and other highly abstract parts of science we sometimes deliberately adopt postulates with no justification other than that they are elegant and convenient. For Quine such postulations constitute a naturalistically acceptable and fallible sort of truth by convention. It is only when an act of adopting a postulate is not indispensible to natural science that Quine sees it as affording truth by convention ‘unalloyed’. A naturalist who accepts Quine ’s notion of truth by convention is therefore not limited to accepting only those postulates that she regards as indispensible to natural science. (shrink)

Carnap, Quine, and Putnam held that in our pursuit of truth we can do no better than to start in the middle, relying on already-established beliefs and inferences and applying our best methods for re-evaluating particular beliefs and inferences and arriving at new ones. In this collection of essays, Gary Ebbs interprets these thinkers' methodological views in the light of their own philosophical commitments, and in the process refutes some widespread misunderstandings of their views, reveals the real strengths of (...) their arguments, and exposes a number of problems that they face. To solve these problems, in many of the essays Ebbs also develops new philosophical approaches, including new theories of logical truth, language use, reference and truth, truth by convention, realism, trans-theoretical terms, agreement and disagreement, radical belief revision, and contextually a priori statements. The nub of the following argument is that there is a conflict between the idea of (liberal) neutrality on the one hand, and an intuitively plausible idea of political representation on the other. The conflict arises when neutrality is seen as a condition for political legitimacy: neutralist political representation is only legitimate insofar as the representative does not advance political ideas based on conceptions of the good that are not endorsed by the whole of the (reasonable) polity. However, we often (...) encounter examples of political representation that do not live up to this demand but nevertheless seem legitimate. Hence, neutralists should explain either why this counterintuitive notion of representation does not follow from neutrality or explain what representatives are meant and allowed to do in such a political arrangement. A plausible neutralist rejoinder to this is to say that legitimacy is not dependent on neutrality for all political decisions. Neutrality is important (only or predominantly) regarding a certain body of political decisions, viz., using the Rawlsian idiom, 'constitutional essentials and matters of basic justice.' However, such a two-levelled approach is not without its problems. I argue that a skein of theoretical and practical challenges to the two-levelled approach undermines, or at least weakens, this attempt to solve the problem about representation and neutrality, and that the two-levelled approach is unclear in certain key aspects. The aim of the article is, however, quite modest. It is not to challenge neutrality per se ; rather, it is a call for further clarification of the issues pertaining to the relationship between neutrality and representation. (shrink)

The Hilbert–Bernays Theorem establishes that for any satisfiable first-order quantificational schema S, one can write out linguistic expressions that are guaranteed to yield a true sentence of elementary arithmetic when they are substituted for the predicate letters in S. The theorem implies that if L is a consistent, fully interpreted language rich enough to express elementary arithmetic, then a schema S is valid if and only if every sentence of L that can be obtained by substituting predicates of L for (...) predicate letters in S is true. The theorem therefore licenses us to define validity substitutionally in languages rich enough to express arithmetic. The heart of the theorem is an arithmetization of Gödel's completeness proof for first-order predicate logic. Hilbert and Bernays were the first to prove that there is such an arithmetization. Does Carnap’s treatment of philosophical questions about existence, such as “Are there numbers?” and “Are there physical objects?”, depend on his analytic–synthetic distinction? If so, in what way? I answer these questions by clarifying, defending, and developing the reading of Carnap’s paper “Empiricism, Semantics, and Ontology” that W. V. Quine proposes, with little justification or explanation, in his paper “On Carnap’s Views on Ontology”. The primary methodological value of studying Quine’s reading of “Empiricism, Semantics, and Ontology” is that it prompts (...) us to look for, and helps us to see the significance of, passages by Carnap that reveal the logical foundations of his views on ontology. Guided in this way by Quine’s reading, I show that (1) in “Empiricism, Semantics, and Ontology” Carnap’s preferred treatment of philosophical questions relies on paraphrasing them so that their answers are immediately obvious elementary logical truths, and are therefore, by his standards, trivially analytic; and (2) in its most general form, Carnap’s treatment of philosophical questions about existence depends on his controversial view that the analytic truths of a language L may include sentences that are not elementary logical truths, but that are nevertheless, by Carnap’s standards, analytic-in-L simply because we have stipulated that they are to be among the “meaning postulates” of L. In two previous papers I explained why I believe that a certain sort of argument that seems to support skepticism about self-knowledge is actually self-undermining, in the sense that no one can justifiably accept all of its premises at once. Anthony Brueckner has recently tried to show that even if the central premises of my explanation are true, the skeptical argument in question is not self-undermining. He has also suggested that even if the skeptical argument is self-undermining, it can still (...) serve as a _reductio ad absurdum of the assumption that we have self-knowledge. My goal in this paper is to explain why I think neither of these responses is successful. (shrink)

In previous work I argued that skepticism about the compatibility ofanti-individualism with self-knowledge is incoherent. Anthony Brueckner isnot convinced by my argument, for reasons he has recently explained inprint. One premise in Brueckner's reasoning is that a person'sself-knowledge is confined to what she can derive solely from herfirst-person experiences of using her sentences. I argue that Brueckner'sacceptance of this premise undermines another part of his reasoning – hisattempt to justify his claims about what thoughts our sincere utterances ofcertain sentences would (...) express in various possible worlds. I describe aweird possible world in which a person who uses Brueckner's reasoning endsup with false beliefs about what thoughts her sincere utterances of certainsentences would express in various possible worlds. I recommend that wereject Brueckner's problematic conception of self-knowledge, and adopt onethat better fits the way we actually ascribe self-knowledge. (shrink)

David Chalmers has recently argued that Bayesian conditionalization is a constraint on conceptual constancy, and that this constraint, together with “standard Bayesian considerations about evidence and updating,” is incompatible with the Quinean claim that every belief is rationally revisable. Chalmers’s argument presupposes that the sort of conceptual constancy that is relevant to Bayesian conditionalization is the same as the sort of conceptual constancy that is relevant to the claim that every belief is rationally revisable. To challenge this presupposition I explicate (...) a sort of “conceptual role” constancy that a rational subject could take to be necessary and sufficient for a rule of Bayesian conditionalization to govern her belief updating, and show that a rational subject may simultaneously commit herself to updating her beliefs in accord with such a rule and accept the claim that every belief is rationally revisable. The concept of a rule that primarily interests Wittgenstein is one that is central to our understanding of 'what is possible before all new discoveries and inventions'. Wittgenstein's investigations of the concept of a rule run 'criss‐cross in every direction'. As Wittgenstein points out, 'any interpretation still hangs in the air along with what it interprets, and cannot give it any support'. Like our inner mental picture of a cube, what we think of as an interpretation of a rule doesn't (...) by itself predetermine the steps that accord with the rule it supposedly interprets. In his great work, Philosophical Investigations, Wittgenstein aims both to uncover the sources of these difficulties and to show his readers how to overcome them. In particular, he aims to expose the emptiness of tempting philosophical explanations of the notion of grounds for correct continuation of a rule. (shrink)

Socializing Metaphysics supplies diverse answers to the basic questions of social metaphysics, from a broad array of voices. It will interest all philosophers and social scientists concerned with mind, action, or the foundations of social theory.

The role of competitive funds as a source of funding for academic research has increased in many countries. For the individual researcher, the receipt of a grant can influence both scientific production and career paths. This paper focuses on the importance of the receipt of a research grant for researchers’ academic career paths utilizing a mixed methods approach that combines econometric analysis with in-depth qualitative interviews. The analysis has novel elements both in terms of its subject (impact of funding grants (...) on individuals’ academic career paths) and approach. The results of this study indicate that while research grants have a positive impact on the research performed under the grant itself, there are very important secondary effects on research performance through positive effects on academic career advancement. The probability of obtaining a full professorship for grant recipients is almost double that for rejected applicants, 16 percent compared to 9 percent. The probability for career advancement in general is about 9 percentage points higher for grant recipients. Qualitative interviews support these quantitative results by providing insights into how grants impact research careers, through heightened status, recognition, networking and other factors. W. V. Quine thinks logical truth can be defined in purely extensional terms, as follows: a logical truth is a true sentence that exemplifies a logical form all of whose instances are true. P. F. Strawson objects that one cannot say what it is for a particular use of a sentence to exemplify a logical form without appealing to intensional notions, and hence that Quine's efforts to define logical truth in purely extensional terms cannot succeed. Quine's reply to this criticism (...) is confused in ways that have not yet been noticed in the literature. This may seem to favour Strawson's side of the debate. In fact, however, a proper analysis of the difficulties that Quine's reply faces suggests a new way to clarify and defend the view that logical truth can be defined in purely extensional terms.
