This paper presents a new way of thinking about the relationship between humans and the nonhuman animals in their care. Most ethical analysis of the treatment of nonhuman animals has focussed on questions of moral status, justice, and the wrongness of harming them. This paper does something different, it examines the role played by trust in interspecies relationships. In both agriculture and laboratory settings, humans deliberately foster trusting relationships with nonhuman animals. An intrinsic feature of the trusting relationship in these (...) settings is that it is created in order to be exploited and betrayed. However, little consideration has been given to asking what a deliberate betrayal of another species says about the character of those who carry out the betrayals. This paper argues that regardless of the moral status of nonhuman animals, a willingness to foster trust in order to exploit the vulnerability of a nonhuman suggests a serious character flaw. Our failure thus far to apprehend systematic forms of betrayal indicates a moral blind-spot when it comes to other species. (shrink)

The greatest threat faced by wild animals often comes from the destruction of their habitats by humans. Traditional environmental-conservation paradigms often fail to prevent this destruction. This paper claims that, where access to habitat is a necessary condition of their continued existence or wellbeing, wild animals have sufficiently strong interests in their habitat to generate rights to it. The paper argues that these rights should be instantiated in the form of collective usufructuary property rights, and, in cases of serious and (...) systematic violation of these rights, wild animals gain a remedial right of secession for their habitat. Animal agriculture predominantly involves farming social animals. At the same time, the nature of agriculture requires severely disrupting, eliminating, and controlling the relationships that matter to those animals, resulting in harm and unhappiness for them. These disruptions harm animals, both physically and psychologically. Stressed animals are also bad for farmers because stressed animals are less safe to handle, produce less, get sick more, and produce poorer quality meat. As a result, considerable efforts have gone into developing stress-reduction methods. Many of (...) these attempt to replicate behaviours or physiological responses that develop or constitute bonding between animals. In other words, humans try to mitigate or ameliorate the damage done by preventing and undermining intraspecies relationships. In doing so, the wrong of relational harms is compounded by an instrumentalisation of trust and care. The techniques used are emblematic of the welfarist approach to animal ethics. Using the example of gentle touching in the farming of cows for beef and dairy, the paper highlights two types of wrong. First, a wrong done in the form of relational harms, and second, a wrong done by instrumentalising relationships of care and trust. Relational harms are done to nonhuman animals, whilst instrumentalisation of care and trust indicates an insensitivity to morally salient features of the situation and a potential character flaw in the agents that carry it out. This paper outlines the moral contours of human relationships with companion animals. The paper details three sources of duties to and regarding companion animals: (1) from the animal’s status as property, (2) from the animal’s position in relationships of care, love, and dependency, and (3) from the animal’s status as a sentient being with a good of its own. These three sources of duties supplement one another and not only differentiate relationships with companion animals from wild animals and other categories (...) of domestic animals such as livestock, but they also overlap to provide moral agents with additional reasons for preventing and avoiding harm to companion animals. The paper concludes that not only do owners and bystanders have direct and indirect duties to protect companion animals from harm, but also that these duties have the potential, in some circumstances, to clash with duties owed to the state and fellow citizens. In this article I propose a cosmopolitan approach to animal rights based upon Kant's right of universal hospitality. Many approaches to animal rights buttress their arguments by finding similarities between humans and non-human animals; in this way they represent or resemble ethics of partiality. In this article I propose an approach to animal rights that initially rejects similarity approaches and is instead based upon the adoption of a cosmopolitan mindset acknowledging and respecting difference. Furthermore, and in agreement with Martha Nussbaum, (...) and Sue Donaldson and Will Kymlicka, I endorse the view that theories of animal rights need to be theories of justice and include a political component. Contra Donaldson and Kymlicka, however, I argue that the starting point for analysis of political theories of animal rights should be at the global rather than national level. Taking animals as strangers, I propose adopting a Kantian cosmopolitan mindset and ethic of universal hospitality towards them. I address how a ius cosmopoliticum that is hospitable to the interests of non-human animals can govern interactions with animals on fair terms, and I respond to concerns that cosmopolitanism cannot accommodate non-human animals because it is a democratic ideal, is grounded in logocentrism or rests upon ownership of territory by humans. Increasingly, protests occur across borders and are carried out by non-nationals. Many of these protests include elements that break the laws of their host country and are aimed at issues of global concern. Despite the increasing frequency of transnational protest, little ethical consideration has been given to it. This article provides a cosmopolitan justification for transnational disobedience on behalf of self and others. The article argues that individuals may be justified in illegally protesting in other states, and that in some (...) circumstances they may do so even when laws have been legitimately constituted by the domestic constituencies of those states. Using a cosmopolitan reading of the notion of civility and of the civil realm, the article argues that transnational protests are capable of conforming to the normative and conceptual standards necessary for them to be labelled civil disobedience. As a result, they ought to carry a privileged moral status compared with other forms of protest. The article applies the All Affected Principle to argue that a democratic deficit can provide transnational protesters and resident migrants with a right to civil disobedience even where that right is not held by members of the demos they protest within. Animal activists sometimes engage in vigils and acts of witnessing as forms of political protest. For example, the Animal Save Movement, a global activist network, regards witnessing the suffering of non-human animals as a moral duty of veganism. The act of witnessing is intended to non-violently communicate both attitudes and principles. These forms of activism are unlike other forms of protest, relying for much of their force upon passive, non-confrontational actions. This article explores the ethical character of vigils and witnessing (...) in order to evaluate their role in animal rights activism. It argues that the love-based ethic behind the Animal Save Movement's form of witnessing is overly demanding, overly expansive and overly deferential towards wrongdoers. In its place, this article offers a narrower account of witnessing, detached from controversial spiritual elements. Vigils and conscious acts of witnessing, it is claimed, are political acts aimed at fulfilling duties to seek justice for non-human animals. (shrink)

Many paradigmatic forms of animal rights and environmental activism have been classed as terrorism both in popular discourse and in law. This paper argues that the labelling of many violent forms of direct action carried out in the name of animal rights or environmentalism as ‘terrorism’ is incorrect. Furthermore, the claim is also made that even those acts which are correctly termed as terrorism are not necessarily wrongful acts. The result of this analysis is to call into question the terms (...) of public debate and the legitimacy of anti-terrorism laws targeting and punishing radical activism. (shrink)

ABSTRACTThis paper explores the international implications of liberal theories which extend justice to sentient animals. In particular, it asks whether they imply that coercive military intervention in a state by external agents to prevent, halt or minimise violations of basic animal rights can be justified. In so doing, it employs Simon Caney's theory of humanitarian intervention and applies it to non-human animals. It argues that while humane intervention can be justified in principle using Caney's assumptions, justifying any particular intervention on (...) behalf of animals is much more difficult – and in present circumstances impossible. If these claims are correct, a number of important conclusions follow. First, all states lack legitimacy because of the horrors that they inflict upon animals. Logical pluralism is the view that there is more than one formal logic that correctly (or best, or legitimately) codifies the logical consequence relation in natural language. This essay provides a taxonomy of different variations on the logical pluralist theme based on a five-part structure, and then identifies an unoccupied position in this taxonomy: perspectival logical pluralism. Perspectival pluralism provides an attractive position from which to formulate a philosophy of logic from a feminist perspective (and from other, identity-based perspectives, such (...) as critical race theory). An example of how such an account might be developed is sketched. The essay concludes by defusing an obvious objection to the perspectival approach: the claim that the correct logic (or logics), in virtue of the formal nature of logic, should be independent of considerations regarding the identity of the reasoner. This paper concerns top-down approaches in machine ethics. It is divided into three main parts. First, I briefly describe top-down design approaches, and in doing so I make clear what those approaches are committed to and what they involve when it comes to training an AI to behave ethically. In the second part, I formulate two underappreciated motivations for endorsing them, one relating to predictability of machine behavior and the other relating to scrutability of machine decision-making. Finally, I present three (...) major worries about such approaches, and I attempt to show that advocates of top-down approaches have some plausible avenues of response. I focus most of my attention on what I call the ‘technical manual objection’ to top-down approaches, inspired by the work of Annas (2004). In short, the idea is that top-down approaches treat ethical decision-making as being merely a matter of following some ethical instructions in the same way that one might follow some set of instructions contained in a technical manual (e.g., computer manual), and this invites sensible skepticism about the ethical wisdom of machines that have been trained on those approaches. I respond by claiming that the objection is successful only if it is understood as targeting machines that have certain kinds of goals, and it should not compel us to totally abandon top-down approaches. Such approaches could still be reasonably employed to design ethical AI that operate in contexts that include fairly noncontroversial answers to ethical questions. In fact, we should prefer top-down approaches when it comes to those types of context, or so I argue, due to the advantages I claim for them. (shrink)

I discuss the realizability and the ethical ramifications of Machine Ethics, from a number of different perspectives: I label these the anthropocentric, infocentric, biocentric and ecocentric perspectives. Each of these approaches takes a characteristic view of the position of humanity relative to other aspects of the designed and the natural worlds—or relative to the possibilities of ‘extra-human’ extensions to the ethical community. In the course of the discussion, a number of key issues emerge concerning the relation between technology and ethics, (...) and the nature of what it is to have moral status. Some radical challenges to certain technological presuppositions and ramifications of the infocentric approach will be discussed. Notwithstanding the obvious tensions between the infocentric perspective on one side and the biocentric and ecocentric perspectives on the other, we will see that there are also striking parallels in the way that each of these three approaches generates challenges to an anthropocentric ethical hegemony, and possible scope for some degree of convergence. Hospital ethics committees have evolved as a response to complicated legal, ethical, and social dilemmas that accompany modern medicine. In the United States, their growth has been augmented by Joint Commission for the Accreditation of Healthcare Organizations standards and the Patient Self-Determination Act. There appears to be an implicit presumption that all clinical ethics consultation practices are relatively similar. Finally, there is heightened awareness of the needs for quality standards and assessment of the outcomes of ethics consultations.

After the Second World War, Adorno was politically engaged as a critical public intellectual in the new Federal Republic of Germany. Nonetheless, in the 1960s, a time of active protest against established norms and the underlying socio‐economic and political conditions, he was widely perceived by the protesting activists as adopting an attitude of resignation in blatant contradiction to the aims of his critical social theory. The chapter considers the validity of this accusation. Section 37.1 sets out Adorno's position with regard (...) to the relationship between theory and praxis from the 1950s onwards. Section 37.2 considers the adequacy of his position from the point of view of Critical Social Theory's fundamental concern with radical societal transformation. Contending that Adorno does in effect adopt a stance of resignation vis‐à‐vis radical societal transformation, it draws attention to some questionable elements in his theory that push him toward adopting this stance. The No-No Paradox consists of a pair of statements, each of which ?says? the other is false. Roy Sorensen claims that the No-No Paradox provides an example of a true statement that has no truthmaker: Given the relevant instances of the T-schema, one of the two statements comprising the ?paradox? must be true (and the other false), but symmetry constraints prevent us from determining which, and thus prevent there being a truthmaker grounding the relevant assignment of truth values. Sorensen's view (...) is mistaken: situated within an appropriate background theory of truth, the statements comprising the No-No Paradox are genuinely paradoxical in the same sense as is the Liar (and thus, on Sorensen's view, must fail to have truth values). This result has consequences beyond Sorensen's semantic framework. In particular, the No-No Paradox, properly understood, is not only a new paradox, but also provides us with a new type of paradox, one which depends upon a general background theory of the truth predicate in a way that the Liar Paradox and similar constructions do not. Cybernetic-Existentialism: Freedom, Systems, and Being-for-Others in Contemporary Art and Performance offers a unique discourse and an original aesthetic theory. It argues that fusing perspectives from the philosophy of Existentialism with insights from the 'universal science' of cybernetics provides a new analytical lens and deconstructive methodology to critique art. Paradoxes threaten our basic understanding of central concepts such as space, time, motion, infinity, truth, knowledge, and belief. This special section on the later work of Paul Ricoeur is an attempt to examine the fruitfulness of that work for the social sciences. Of particular interest are his theorization and application of the notions of memory, identity, justice, and the relation to the other to political and ethical problems in the present. For example, his discourse links up the question of memory with that of justice and the problem of constructing new polities which can be considered just. To do (...) this, he introduces the concepts of ‘translation ethos’, the ‘exchange of memories’ and ‘non-forgetful forgiveness’ in order to examine the problem of the conditions for the imaginary construction of political entities in which dialogue can take place between interlocutors with different, maybe conflicting, interests and historical locations, and thus with different senses of belonging and identities. There is broad agreement that child labor is wrong and should be eliminated. This chapter examines the three main moral objections to child labor and considers their limitations: harm-based objections, objections from failing to benefit children, and objections from exploitation. Harm-based objections struggle with baselines for comparison and difficulties with Non-Identity problems. Even if child labor is not harmful, it may be wrong because it prevents children from enjoying other benefits, such as schooling. However, is schooling necessarily more beneficial for (...) children than work? Some kinds of child labor may not be harmful, and may benefit children, but they may still be wrong because they are exploitative. I consider some ways to address exploitative child labor, inspired by campaigns led by child workers. The chapter ends with a surprising conclusion that challenges the broad consensus with which we began: we may have duties to promote child labor. (shrink)
