Bill Bowring’s book attempts to argue for a Marxist account of international law that embraces it as a tool for progressive politics and revolutionary change. He argues it is necessary to give a substantive account of both, locating them in the real struggles of the oppressed. Specifically, he locates human rights in the three great revolutions ‐ the French, the Russian and the anticolonial. However, this revolutionary heritage has been ‘degraded’ by recent events. As such, it is necessary to adopt (...) ‘revolutionary conservatism’, invoking international law’s origins against its current degradation. This review argues that, owing to international law’s indeterminacy, Bowring’s project is susceptible to imperial appropriation. This means, however, that Bowring cannot give an account of why we should use international law. It then argues that Bowring’s account of Pashukanis is wrong, and that Pashukanis’s work can better make sense of Bowring’s insights and international law more generally. (shrink)

According to J. M. E. McTaggart, all that exists is spiritual, where spirituality is defined as “the quality of having content, all of which is the content of one or more selves”. In view of the importance which he thus assigns to selves, one properly expects of McTaggart a clear, certainly a consistent, account of what a self is. Yet the picture one receives remains clouded—clouded mainly by positions which may be contradictory within themselves, and by what plainly look to (...) be incompatibilities of one position with another. In this paper, I shall try to clarify, and insofar as possible to support, McTaggart’s doctrine. In part I shall be seeking to decide which ones, if any, of the seeming contradictions are genuinely unresolvable. And then, in case no one consistent doctrine can be educed, I shall ask which one of various alternative positions would be most in harmony with McTaggart’s system as a whole. (shrink)

Among the artifacts produced by nineteenth-century Quellenforschung, few have exerted more influence or endured more censure than the lost Hellenistic epyllion which, as reconstructed by G. Knaack, told of the journey of Phaethon to the palace of the sun-god and his disastrous ride in the solar car. Relying chiefly upon the two versions of the story told by Ovid in his Metamorphoses and Nonnus in the Dionysiaca , and applying techniques comparable to the stemmatic method of textual criticism, Knaack traced (...) every shared feature of these two accounts to the inevitable lost Hellenistic ‘original’. Details from Lucian and Philostratus , who were also presumed to have read this lost poem, helped to fill in the blanks. Knaack's thesis illustrates the extremes of which source criticism was capable at a time when it was naively assumed that Roman poets were capable of little more than literal translation of their Greek models. In the early part of this century, a reaction set in against Knaack's method, when it was alleged that there was no common source for the two poets and that Nonnus derived his account of Phaethon directly from his reading of Ovid. The case was first made by J. Braune, who examined four episodes common to both works – Phaethon, Cadmus, Actaeon, and Daphne – and argued that correspondences between the two are due to imitation of Ovid by Nonnus. Braune's arguments did not win complete acceptance; it is noteworthy that even his supporters were not entirely convinced by three of his four test passages, for which abundant evidence survives of sources earlier than Ovid. Others must have shared my surprise at reading the two articles on this subject in the Classical Quarterly , one by Mr. P. H. Ling, writing ‘in the light of our present knowledge,’ and one by Professor H. J. Rose. Among the Hibeh Papyri is a fragment of an anthology which hereabouts contains quotations from Tragedy and Epicharmus. It gives four verses, the last of which was rightly identified by the editors Grenfell and Hunt. Of the lemma only a spot (...) of ink on a loose fibre remains. (shrink)

Research in the U.S. developed and validated the State Self-Compassion Scale, which measures self-compassionate reactions toward a specific negative event. The current study is aimed at developing the Japanese version of the State Self-Compassion Scale and extending previous findings in the U.S. by showing measurement invariance across sexes and demonstrating the construct validity of this scale. Across two studies, the bifactor exploratory structural equation modeling representation of the SSCS-J showed excellent fit in which a single global factor and most of (...) the specific factors were well defined. Study 1 further provided evidence for the measurement invariance across sexes. The SSCS-J was related with higher trait self-compassion and lower fear of and negative beliefs about self-compassion. In Study 2, participants who were instructed to be self-compassionate reported higher scores in the SSCS-J relative to those in the control condition. These results attest to the replicability of the factor structure of the SSCS in Japan and provide further evidence for the construct validity of this scale. (shrink)

Hegel once described his Phänomenologie des Geistes as his voyage of discovery. He also said that the book contained a good deal of ballast which might be thrown overboard in a subsequent edition. Unfortunately, the unballasted edition which he was preparing at his death never appeared, and his readers are left with the original exploratory voyage, a voyage which seems to many of them to have been made mainly in the dark and through mists and fog. For this reason a (...) commentary has long been desired, but it is really only in recent years that clues to some of the book’s difficulties have been made available through the publication of Hegel’s early manuscripts. Dilthey founded the modern critical study of Hegel by drawing attention to the theological writings of the philosopher’s Wanderjahre, and these were published by Nohl in 1907. It is a pity that J. B. Baillie seems to have overlooked them, for these indispensable aids to the study of the Phenomenology might have enabled him to improve the notes appended to his translation. Scarcely less important, however, are the Jena manuscripts published partly by Lasson in 1923 and partly by Hoffmeister in 1931–2. Armed with these reliquiae a scholar could approach the making of a commentary with fair confidence. (shrink)
