In this paper, we report the case of an Inclusive Design workshop. Inclusive Design is a design method that includes elderly and disabled people not only in interviews, but also in the upstream design process such as basic design and survey analysis. In the workshop, participants designed scientific educational materials that visually impaired and sighted people can use together. To work together regardless of visual disability, participants used the image-processing system and the stereo copying machine to make images tactile. We (...) think that collaborative work with elderly and disabled people in Inclusive Design can teach participants different perspectives and help to correct their biased view of each other. In fact, participants of the workshop noticed several facts that they were not aware of before. That is, the Inclusive Design workshop can improve social awareness. (shrink)

Toda comprensión de la evolución de la idea de una filosofía práctica entre los griegos depende de reconocer que, aquí, ellos nos legaron dos tipos fundamentalmente diferentes, en relación con la clase de textos filosóficos en Platón y en Aristóteles. Por un lado, diálogos muy logrados que evocan a Sócrates o a uno semejante a él como si estuvieran presentes y, por el otro lado, renglones escritos sin arte de un espíritu que se articula, a través de un trabajo (...) de pensamiento y palabras de enseñanza. Uno es literatura en el alto sentido de la palabra. El otro es un material que es difícil de descifrar y que todavía debe ser despertado a una vida de ideas. Pero frente a ambos es el mismo ejercicio. La presente investigación tiene como meta el tratamiento del espacio y del tiempo como objetos de la imaginación en el pensamiento de Leonardo Polo. El tratamiento del espacio imaginado es oportuno en un estudio sobre su filosofía jurídica toda vez que Polo sostiene que es el “lugar” en donde se elabora lo técnico. Así pues, ahí tendría su origen todo ars humano, dentro de los cuales ocuparía un lugar destacado el ars iuris. Los juristas romanos entendían el ius como (...) el “ars boni et aequi”, lo cual indicaría que la jurisprudencia desde antiguo era considerada un arte o técnica. (shrink)

El presente artículo busca describir la crítica de F. H. Jacobi a la filosofía trascendental en torno al problema de la afección y la cosa en sí. Esta crítica atribuye al pensamiento de Kant un idealismo incompatible con toda noción de realismo. La interpretación de Jacobi, sin embargo, se apoya sobre un desconocimiento de la naturaleza metodológico-trascendental no solo de la terminología involucrada en el problema de la afección, sino de toda la reflexión kantiana acerca del conocimiento. El (...) modelo exegético de la two aspects view ha proporcionado instrumentos que nos permiten una reconstrucción hermenéutica del problema de la afección y ponen en evidencia el extravío metodológico en la crítica de Jacobi. Tal análisis busca demostrar, como tesis central, que ambas concepciones convergen en la configuración de una idea del sujeto autoconsciente en la que la interacción intersubjetiva se pone a la base de condición de posibilidad del “yo” (Fichte) o del “sí mismo” (Mead). Esta demostración obliga a explicitar los modelos de intersubjetividad que subyacen a (...) las respectivas nociones de autoconciencia, representados, en el caso de Fichte, en la teoría de la “exhortación” y, en Mead, en la teoría de la “asunción de roles”. En esta exploración se busca poner de manifiesto que ambas nociones describen un orden de la intersubjetividad práctica en virtud de la significación normativa contenida en ambos modelos, es decir, en virtud de las actitudes y comportamientos que exigen de los sujetos para toda relación intersubjetiva lograda. Background: Advocacy is an important role of psychiatric nurses because their patients are ethically, socially, and legally vulnerable. This study of Japanese expert psychiatric nurses’ judgments of interventions for patient advocacy will show effective strategies for ethical nursing practice and their relationship with Japanese culture. Objectives: This article explores Japanese psychiatric nurses’ decision to intervene as a patient advocate and examine their ethical, cultural, and social implications. Research design: Using semi-structured interviews verbatim, themes of the problems that required interventions were (...) inductively summarized by a qualitative analysis and their contexts and nursing judgments were examined. Participants and research context: The participants were 21 nurses with 5 or more years of experience in psychiatric nursing. Ethical considerations: The research was approved by Institutional Review Board of research site and study facilities. The participants gave written informed consent. Findings: Analysis of 45 cases showed that nurses decided to intervene when surrounding people’s opinions impeded patients’ safety, healthcare professionals’ policies impeded patients’ decision-making, own violent behaviors impeded treatment and welfare services for patients, own or families’ low acceptance of illness impeded patients’ self-actualization, inappropriate treatment or care impeded patients’ liberty, and their families abused patients’ property. Discussion: To solve conflicts between patients and their surrounding people, the nurses sought reconciliation between them, which is in accordance with Japanese cultural norms respecting harmony. When necessary, however, they protected patients’ rights against cultural norms. Therefore, their judgments cannot be explained by cultural norms alone. Conclusion: The findings indicate that the nurses’ judgments were based on respect for patients’ rights apart from cultural norms, and they first sought solutions fitting the cultural norms before other solutions. This seems to be an ethical, effective strategy if advocates know the culture in depth. (shrink)

This incisive book deals with the use of the criminal law to enforce morality, in particular sexual morality, a subject of particular interest and importance since the publication of the Wolfenden Report in 1957. Professor Hart first considers John Stuart Mill's famous declaration: "The only purpose for which power can be rightfully exercised over any member of a civilized community is to prevent harm to others." During the last hundred years this doctrine has twice been sharply challenged by two great (...) lawyers: Sir James Fitzjames Stephen, the great Victorian judge and historian of the common law, and Lord Devlin, who both argue that the use of the criminal law to enforce morality is justified. The paper defends the position that phenomenological interviews can provide a rich source of knowledge and that they are in no principled way less reliable or less valid than quantitative or experimental methods in general. It responds to several skeptic objections such as those raised against introspection, those targeting the unreliability of episodic memory, and those claiming that interviews cannot address the psychological, cognitive and biological correlates of experience. It argues that the skeptic must either heed the methodological and epistemological (...) justification of the phenomenological interview provided, or embrace a more fundamental skepticism, a “deep mistrust”, in which scientific discourse can have no recourse to conscious processes as explananda, with ensuing dire consequences for our conception of science.
