I argue that recognizing a human right to adequate food and enforcing it as a legal right is an important way to promote and ensure sustainable food security. I consider objections that have been raised against subsistence rights and socio-economic rights, including the argument that such rights are not feasible, that they are not justiciable, and that they are too amorphous—that it is not clear what is required to fulfill these rights and by whom. I defend the right to adequate (...) food against these objections by considering how this right has been interpreted and applied in international law and how it has been protected in other domestic legal systems. I analyze different dimensions of the right to adequate food and I apply these to recent issues concerning sustainable food security in the United States, such as food deserts. (shrink)

Although Kant argues that a world republic with coercive public law is the only rational way to secure a lawful cosmopolitan condition, he states that it is an unachievable ideal, and he proposes a voluntary, non-coercive federation of states as a substitute. While some scholars have criticized Kant for moving away from this ideal due merely to pragmatic considerations, I argue that his rejection of a coercive world republic is based on his conception of state sovereignty and what is required (...) for a lawful condition. I consider how we can institutionalize a lawful condition between states without a coercive world republic in ways that go beyond Kant’s voluntary federation. Critics of international law argue that it is not really law because it lacks a supranational system of coercive sanctions. International legal scholars and lawyers primarily refute this by demonstrating that international law is in fact enforced, albeit in decentralized and less coercive ways. I will focus instead on the presumption behind this skeptical view—the idea that law must be coercively enforced. First, I argue that coercive enforcement is not conceptually necessary for law or legal obligations. Second, I consider the (...) claim that coercive enforcement is nonetheless necessary for instrumental reasons. I argue that while physical coercion is instrumentally useful for increasing compliance in the domestic case, this is less effective and more problematic in the international case. What then is essential and distinctive about law, and what would increase the effectiveness of international law? First, international law needs to be generally accepted as binding by states, officials, and other agents; and second, international legal rules should be determinatively interpreted and applied by authoritative, adjudicative, and administrative institutions. Worries about scientific objectivity seem never-ending. Social critics and philosophers of science have argued that invocations of objectivity are often little more than attempts to boost the status of a claim, while calls for value neutrality may be used to suppress otherwise valid dissenting positions. Objectivity is used sometimes to advance democratic agendas, at other times to block them; sometimes for increasing the growth of knowledge, at others to resist it. Sandra Harding is not ready to throw out objectivity (...) quite yet. For all of its problems, she contends that objectivity is too powerful a concept simply to abandon. In Objectivity and Diversity, Harding calls for a science that is both more epistemically adequate and socially just, a science that would ask: How are the lives of the most economically and politically vulnerable groups affected by a particular piece of research? Do they have a say in whether and how the research is done? Should empirically reliable systems of indigenous knowledge count as "real science"? Ultimately, Harding argues for a shift from the ideal of a neutral, disinterested science to one that prizes fairness and responsibility. (shrink)

In _Sciences from Below_, the esteemed feminist science studies scholar Sandra Harding synthesizes modernity studies with progressive tendencies in science and technology studies to suggest how scientific and technological pursuits might be more productively linked to social justice projects around the world. Harding illuminates the idea of multiple modernities as well as the major contributions of post-Kuhnian Western, feminist, and postcolonial science studies. She explains how these schools of thought can help those seeking to implement progressive social projects refine (...) their thinking to overcome limiting ideas about what modernity and modernization are, the objectivity of scientific knowledge, patriarchy, and Eurocentricity. She also reveals how ideas about gender and colonialism frame the conventional contrast between modernity and tradition. As she has done before, Harding points the way forward in _Sciences from Below_. Describing the work of the post-Kuhnian science studies scholars Bruno Latour, Ulrich Beck, and the team of Michael Gibbons, Helga Nowtony, and Peter Scott, Harding reveals how, from different perspectives, they provide useful resources for rethinking the modernity versus tradition binary and its effects on the production of scientific knowledge. Yet, for the most part, they do not take feminist or postcolonial critiques into account. As Harding demonstrates, feminist science studies and postcolonial science studies have vital contributions to make; they bring to light not only the male supremacist investments in the Western conception of modernity and the historical and epistemological bases of Western science but also the empirical knowledge traditions of the global South. _Sciences from Below_ is a clear and compelling argument that modernity studies and post-Kuhnian, feminist, and postcolonial sciences studies each have something important, and necessary, to offer to those formulating socially progressive scientific research and policy. Burnout is a phenomenon characterized by fatigue and frustration, usually related to work stress and dedication to a cause, a way of life that does not match the person’s expectations. Although it seems to be associated with risk factors stemming from a professional environment, this problem may affect any person. Palliative care is provided in a challenging environment, where professionals often have to make demanding ethical decisions and deal with death and dying. This article reports on the findings of a (...) systematic review aimed at identifying described burnout levels in palliative care nurses and physicians, and the related risks and protective factors. The main findings indicate that burnout levels in palliative care, or in health care settings related to this field, do not seem to be higher than in other contexts. (shrink)

Detailed and innovative corpus linguistic analyses investigate the correlates of the degree of reversibility, linguistic constraints that influence the ordering and reversibility of binomials and the diachronic development of reversibility. In addition, judgment data are analyzed for their convergence and divergence with corpus data regarding degrees of reversibility. In this essay, I revisit and extend my arguments for a view of science that is pluralistic, perspectival and pragmatist. I attempt to resolve mismatches between metaphysical assumptions, epistemological desiderata, and scientific practice. I consider long-held views about unity of science and reductionism, emergent properties and physicalism, exceptionless necessity in explanatory laws, and in the justification for realism. My solutions appeal to the partiality of representation, the perspectivism of theories and data, and the interactive co-construction of warranted claims for realism.

In this chapter, the author articulates two Hobbesian models of interpersonal power relations that can be used to understand gender relations: what he will call the dominion model and the deference model. Hobbes himself analyses the relation between men and women through the dominion model. The author lays out Hobbes's model of interpersonal power relations as dominion, including his application of the model to the case of gender relations. The centerpiece of Hobbes's method is his “state of nature” thought experiment. (...) Hobbes's analysis is radical insofar as he understands familial relations according to the general model of interpersonal relations just outlined, without any reference to sui generis principles. The author indicates some shortcomings of the dominion model for grasping contemporary social life. This book presents a series of case studies and reflections on the historiographical assumptions, methods, and approaches that shape the way in which philosophers construct their own past. The chapters in the volume advance discussion of the methods of historians of philosophy, while at the same time illustrating the various ways in which philosophical canons come into existence, debunking the myth of analytical philosophy's ahistoricism, and providing a deeper understanding of the roles historiographical devices play in philosophical thought. It is true that not all women are born equal, and likewise, not all men are born equal, so before the game even starts, there are some athletes with longer legs, bigger hands and unusually high testosterone levels. These are natural properties and structures that have the potential to cause an unfair advantage. It is argued that since athletes are not born equal, natural properties should not be controlled or suppressed but ought to be considered as fair play in sports. (...) Forcing intersex female athletes to lower their testosterone levels to compete is not only sexist and discriminatory, it is unethical. The question of fair play is at the forefront here as I seek to work from the premise that natural inequalities have always existed and will continue to exist in competitive sports. As long as these exist, competitions will not be fair. Since athletes have no control over these natural inequalities, they are neither causally nor morally responsible for them. (shrink)

In this article a discussion of the phenomenon of wellness and its relevance to contemporary nursing practice is developed. Drawing on phenomenology, the research literature and the author's own wellness research, an exposition of the concept of wellness is presented. It is proposed that the experience of being well is lived as a continuity of time and that it involves both a taking‐for‐granted of the body and containment of the horizon of concern. The state of actually being well is also (...) clarified and contrasted with the more common understanding of wellness as an optimal or future state. This discussion has significance for nursing knowledge development, in terms of our understanding of the experience of wellness and illness. It also has implications for how nurses approach their practice, particularly in the area of health promotion. (shrink)

We analyse the nature of grassroots conflicts over the commercial logging of moabi by foreign firms in South-eastern Cameroon. Moabi offers a good starting point for understanding forest resistances because it crystallises nature conservation, commercial, as well as local interests as it provides oil, medicine and other use values to local populations and particularly to women. Combining a political ecology approach with elements of ecological economics, we find that the conflicts on moabi extraction can be analysed in terms of conflicting (...) languages of valuation — the defence of livelihood and customary institutions versus economic growth and the national laws. We discuss the historical and institutional components of the conflicts as well as the specific role of women. (shrink)

Since approval of the EU General Data Protection Regulation (GDPR) in 2016, it has been widely and repeatedly claimed that the GDPR will legally mandate a ‘right to explanation’ of all decisions made by automated or artificially intelligent algorithmic systems. This right to explanation is viewed as an ideal mechanism to enhance the accountability and transparency of automated decision-making. However, there are several reasons to doubt both the legal existence and the feasibility of such a right. In contrast to the (...) right to explanation of specific automated decisions claimed elsewhere, the GDPR only mandates that data subjects receive meaningful, but properly limited, information (Articles 13-15) about the logic involved, as well as the significance and the envisaged consequences of automated decision-making systems, what we term a ‘right to be informed’. Further, the ambiguity and limited scope of the ‘right not to be subject to automated decision-making’ contained in Article 22 (from which the alleged ‘right to explanation’ stems) raises questions over the protection actually afforded to data subjects. These problems show that the GDPR lacks precise language as well as explicit and well-defined rights and safeguards against automated decision-making, and therefore runs the risk of being toothless. We propose a number of legislative and policy steps that, if taken, may improve the transparency and accountability of automated decision-making when the GDPR comes into force in 2018. (shrink)

In this paper, we present a Lacanian perspective on football, while notably fathoming its normative dimension. Starting with a defining imperative, the prohibition against ‘handling’ or touching the ball with your hands, diverging football historically from rugby, we will subsequently focus our attention on the role of the foot, the eye (notably the eyes of the audience) and the ‘object a’ (in the context of gender). Against this backdrop, we will address pressing issues such as the troubled position of the (...) referee (as an ‘impossible profession’), the commercialisation of football, and the rising tides of violence, match—fixing and other instances of systemic deviance. As we will argue, football exemplifies modern sport as an arena defined by prohibitions and desire, by inclusion and exclusion, by purity and abuse, culminating in recent challenges involved in gender trouble. Symbolical practices, like modern football, are based on in- and exclusion. Instead of more regulations and dichotomies, we advocate careful attention to the delicate art of handling desire in practice. (shrink)
