This article discusses Habermas’s project of reformulating Critical Theory through a pragmatic philosophy of communication, while defending post-metaphysical reason and commitment to grounded critique. Habermas’s use of pragmatics is contrasted with Rorty, who argues for a non-foundational pragmatism that eschews the idea of science as the only site of reason and social progress. The argument moves through three stages. First, it outlines Habermas’s project of recovering critical activity with particular attention to his debt to pragmatic philosophy and the departures from (...) earlier Critical Theory that this entailed. Second, it examines his theory of communicative action and identifies some key areas of contestation with sceptical approaches. Finally, it identifies some of the problems and limitations in Habermas’s pragmatic turn, suggesting that his quasi-transcendental critique is developed at the expense of a pragmatic commitment to grounding in embodied agency-in-the-world. It concludes that the spirit of pragmatism, rather than its detail, might help Critical Theory focus on political analysis and resistances to domination. (shrink)

The neurosciences challenge the ‘standard social science’ model of human behaviour particularly with reference to violence. Although explanations of violence are interdisciplinary it remains controversial to work across the division between the social and biological sciences. Neuroscience can be subject to familiar sociological critiques of scientism and reductionism but this paper considers whether this view should be reassessed. Concepts of brain plasticity and epigenetics could prompt reconsideration of the dichotomy of the social and natural while raising questions about the intersections (...) of materiality, embodiment and social action. Although violence is intimately bound up with the body, sociologies of both violence and the body remain on the surface and rarely go under the skin or skulls of violent actors. This article argues for a non-reductionist realist explanation of violent behaviour that is also interdisciplinary and offers the potential to generate nuanced understandings of violent processes. It concludes that sociology should engage critically and creatively with the neuroscience of violence. (shrink)

Violence presents a paradox. There is evidence that violence is universal in all in human societies. However, in writing mostly from the standpoint of relatively peaceful social spaces, violence often appears exceptional, and a product of the breakdown of integrating social institutions and conventions. Norbert Elias persuasively identified growing thresholds of repugnance towards violence with the transition to modernity, although understanding the balance between formalization and informalization poses some critical questions about his thesis. The discussion begins with these as a (...) means of opening a broader discussion of theories of violence which are developed through a critical analysis of Girard’s and Gans’ theories. It is argued that these may offer a way of addressing the informalization problem in a context of mimetic consumption desires in a context of apparent but false equalization in contemporary societies. This article reviews the implications of the collapse of Communism in Europe for some themes in recent social theory. It was often assumed that 1989 was part of a global process of normalization and routinization of social life that had been left behind earlier utopian hopes. Nothing that utopia is open to various interpretations, including utopias of the everyday, this article suggests, first that there were utopian dimensions to 1989, and, second, that these hopes continue to influence contemporary social and (...) political developments. The continuing role of substantive utopian expectations is illustrated with reference to the politics of lustration in Poland and the rise of nationalist parties in Hungary. This analysis is placed in the context of the already apparent impact of the global economic crisis in post-communist countries. It concludes that the unevenness and diversity of the post-1989 world elude overly generalized attempts at theorization and demand more nuanced analyses. (shrink)

In the UK and USA ‘Hate crime’ has become a topic of public controversy and social mobilization around issues of violence and harassment. This has largely but not exclusively addressed racism, homophobia and gender based violence. This article has three objectives. First, to situate hate crime legislation within a broad theory of modernity;secondly to examine the politics of its emergence as a public issue; thirdly to use data from the authors' recent research in Greater Manchester to illuminate the complexity of (...) the concept of ‘hate crime’. The centrality of ‘hate crime’ to current debates derives from the importance of rights-based regulation of complex societies and the juridical management of emotional life. Hatred and violence have become problematic behaviour thrown into relief by a long term civilizing process. Hate crimes have thus acquired powerful rhetorical focus for mobilization of victim and identity politics. With reference to racist violence in Oldham and elsewhere in Greater Manchester, we argue that in its application and construction, however, ‘hate crime’ is a complex phenomenon that might dramatize rather than regulate the problems it seeks to address. Hannah Arendt’s Jewish writings were central to her thinking about the human condition and engaged with the dialectics of modernity, universalism and identity. Her concept of the ‘conscious pariah’ attempted both to define a role for the public intellectual and understand the relationship between Jews and modernity. Controversially she accused Jewish victims of lack of resistance to the Nazis and argued that their victimization resulted from apolitical ‘worldlessness’. We argue that although Arendt’s analysis was original and challenging, her characterization of (...) Jewish history as one of ‘powerlessness’ is exaggerated but, more importantly, her underdeveloped concept of ‘the social’ is insensitive to the complex modalities of resistance and consciousness among subaltern Jewish communities. Furthermore, her lack of interest in religious observance obscures the importance of Judaism as a resource for resistance. This is illustrated by the ‘hidden transcripts’ of Jewish resistance from the early modern period. (shrink)

Ludwig Wittgenstein is perhaps the greatest philosopher of the twentieth century, and certainly one of the most original in the entire Western tradition. Given the inaccessibility of his work, it is remarkable that he has inspired poems, paintings, films, musical compositions, titles of books -- and even novels. In his splendid biography, Ray Monk has made this very compelling human being come alive in a way that perfectly explains the fascination he has evoked. Wittgenstein's life was one of great moral (...) and spiritual depth. Although his work addresses problems of logic, language, mind, and knowledge, he often described it as having an ethical point, and once said that he "could not help seeing every problem from a religious point of view." In successfully bridging the gap assumed by many to exist between Wittgenstein's life and his work, Monk's biography helps to explain the interest in Wittgenstein's later philosophy on the part of Buddhist scholars. Propositions are the things we believe, intend, desire, and so on, but discussions are often less precise than they could be and an important driver of this deficiency has been a focus on the objects but a neglect of the attitudinal relations we bear to them. In what follows, we will offer some thoughts on what it means for a proposition to be the object of an attitude and we will argue that an important part of the story lies with (...) the attitude relations rather than the propositions. As we will see there are infinitely many relations we might bear to a proposition, but the propositional attitude relations are special amongst them. Accounting for what makes them special will be an important component in the discussion that follows. We will argue that once one appreciates certain facts about propositional attitude relations, various claims that metaphysicians often make regarding propositions themselves begin to look undermotivated. In fact, many views on the metaphysical nature of propositions come to look like plausible candidates for being that to which our propositional attitudes relate us. As will emerge, we will see that the principle role of propositions in the theory of mind is simply to keep track of how our attitudinal states represent things as being. But, we argue, in order to do this work, very few constraints must be placed on the nature of propositions themselves. In particular, contra much of the recent work on the metaphysics of propositions, they need not represent nor must they be structured. In light of these observations, we conclude by sketching our own favored minimalist view of propositions. (shrink)

In 2009 Larry Alexander and Kimberly Ferzan published Crime and Culpability: A Theory of Criminal Law. The book set out a theory that those who deserve punishment should receive punishment commensurate with, but no greater than, that which they deserve. Reflections on Crime and Culpability: Problems and Puzzles expands on their innovative ideas on the application of punishment in criminal law. Theorists working in criminal law theory presuppose or ignore puzzles that lurk beneath the surface. Now those who wish (...) to examine these topics will have one monograph that combines the disparate puzzles in criminal law through a unified approach to culpability. Along with some suggestions as to how they might resolve the puzzles, Alexander and Ferzan lay out the arguments and analysis so future scholars can engage with questions about our understanding of culpability that very few have addressed. This chapter provides comments on some current longevity research. The ultimate aim of longevity research is to stop the aging process, so that none of us need die of old age. The chapter indicates the attitudes towards death and science. It discusses some worries about immortality raised by Leon Kass and Bernard Williams. In “Mortality and Morality: The Virtues of Finitude,” Leon Kass, raised many deep worries about immortality. One was that many of our greatest creations resulted from the recognition (...) of our own mortality. Bernard Williams notes that if our lives persisted unendingly through time, then there would either be significant alterations in a person's deepest projects, commitments, and character, or there would not. The author suggests that we should favor living well over living longer, and ongoing reproduction over immortality, and we should think long and hard before proceeding with certain lines of longevity research. It has recently been argued that our use of vague language poses an intractable problem for any account of content and communication on which (i) the things we assert are propositions and (ii) understanding an assertion requires recognizing which proposition the speaker asserted. John MacFarlane has argued that this problem concerning vague language is itself a species of an even more general problem for such traditional accounts – the problem posed by “felicitous” underspecification. Repurposing certain ideas from Allan Gibbard, MacFarlane (...) offers a novel theory of vagueness, plan-expressivism, as an account that can handle both vagueness and such underspecification in communication. -/- In this paper, I argue that despite its many virtues, plan-expressivism fails as a general account of meaning and communication. In particular, I show that when it comes to the problem of felicitous underspecification, plan-expressivism fares no better than the more traditional accounts of content and communication it is intended to replace. Along the way, I argue that the problem of felicitous underspecification puts considerable pressure on an assumption that is at the core of both plan-expressivism and the accounts of its more traditionalist rivals - namely, that in cases of successful linguistic communication, we must always be able to find something -- whether a propositional content or a conversational update -- that the speaker is intending to share with her audience. Using the example of Black people’s inequitable COVID-19 outcomes and their health outcomes prior to the pandemic, I argue that the pandemic has forever changed how we should think about the conceptual and practical nature of health equity. From here on, we can no longer think of health equity without the concept of intersectionality. In particular, we must acknowledge that discrimination (e.g. sexism, ableism, racism, classism, etc.) within our social institutions intersect to withhold resources needed for health from people who (...) themselves have intersecting identities that make them vulnerable to the effects of discrimination. To ignore intersectionality in our work on health equity would mean ignoring a great injustice imposed on some of the most overlooked people in our communities, which would also be a great disserve to bioethics’ professional longevity. Narratives have allowed us to show the limits of positivism in humanistic disciplines and to challenge dominant presuppositions. A recent development in feminist philosophy, epistemic injustice describes the ways in which marginalized peoples are unfairly deprived of the ability to participate in society's knowledge‐ and meaning‐making practices. Marginalized groups can respond with their own ways of thinking, speaking, acting, and organizing, thus resisting an oppressive status quo. Much like an economic monopoly, a “hermeneutical monopoly” exists where people are forced, both (...) by coercion and by lack of alternatives, to consume and use the dominant hermeneutical resources. The chapter describes an overlooked problem in the context of mass incarceration and thus to point to the need for a solution. The problem is the hermeneutical injustice and hermeneutical marginalization of prisoners, which is not adequately addressed by scholars who simply attend to the narratives of the oppressed. I argue that if intentions are what Grice, and most contemporary action theorists, take them to be, they are inessential for acts of speaker meaning. More specifically, my primary aim is to show that the consensus view of speaker meaning is in deep tension with certain plausible, and widely accepted, cognitive constraints on rational intention pertaining to an agent’s assessment of her prospects of achieving her goal. My secondary aim is to offer an initial case for thinking that the best (...) way to resolve this tension is to give up the claim that meaning is fundamentally a matter of intention. In pursuing this strategy, we will see some of the potential benefits of Bratman’s (1987) work on intentions, plans, and practical reasoning for the theory of meaning, including some interesting consequences of his rejection of the so-called ‘Simple View’ on which we intentionally do only those things that we specifically intend to do. Moreover, our discussion will help to illustrate how some familiar tools from decision theory might find new use in discussions of meaning and communication. (shrink)

In ‘What Reference Has to Tell Us about Meaning’, Stephen Schiffer argues that many of the objects of our beliefs, and the contents of our assertoric speech acts, have what he calls the relativity feature. A proposition has the relativity feature just in case it is an object-dependent proposition ‘the entertainment of which requires different people, or the same person at different times or places, to think of [the relevant object] in different ways’ (129). But as no Fregean or Russellian (...) proposition can possibly have such a feature, we must either (i) give up on these traditional theories of propositional content in favor of an account that can allow for the relativity feature, or else (ii) explain why the things we believe, and say, oftentimes seem to have this feature even though they, in fact, do not. Schiffer pursues the former option; in this essay, I pursue the latter. (shrink)
