For many of Spinoza's contemporaries and predecessors the very notion of causa sui was utterly absurd, akin to a Baron Munchausen attempting to lift himself above a river by pulling his hair up. This chapter examines Descartes’ engagement with the notion of causa sui, and shows that Spinoza understood the causation of causa sui as efficient, and not formal, causation. Proving the existence of God was the stated aim of Descartes’ Third Meditation. Descartes’ response to Caterus is pretty simple: he (...) denies that efficient causation must be spread in time. Descartes’ surprising response to Caterus drew the attention of Antoine Arnauld, the author of the Fourth Set of Objections, and, at the time, a doctoral student of theology at the Sorbonne. The young Spinoza must have watched Descartes’ struggle with the notion of causa sui with great interest. (shrink)

The notion of divine love was essential to medieval Christian conceptions of God. Jewish thinkers, though, had a much more ambivalent attitude about this issue. While Maimonides was reluctant to ascribe love, or any other affect, to God, Gersonides and Crescas celebrated God’s love. Though Spinoza is clearly sympathetic to Maimonides’ rejection of divine love as anthropomorphism, he attributes love to God nevertheless, unfolding his notion of amor Dei intellectualis at the conclusion of his Ethics. But is this a legitimate (...) notion within his system? In the first part of this article, I will explain some of the problems surrounding this notion, and then turn, in the second part, to consider two unsatisfactory solutions. In the third part, I will attempt to rework Spinoza’s amor Dei intellectualis from his definitions of love and the other affects in part three of the Ethics. In the fourth part, I will examine closely how Spinoza tweaks his definition of love in order to allow for the possibility of divine intellectual love, and conclude by trying to explain what motivated this move. Like many of his contemporaries, Hegel considered Spinoza a modern reviver of ancient Eleatic monism, in whose system “all determinate content is swallowed up as radically null and void”. This characterization of Spinoza as denying the reality of the world of finite things had a lasting influence on the perception of Spinoza in the two centuries that followed. In this article, I take these claims of Hegel to task and evaluate their validity. Although Hegel’s official argument for the unreality of (...) modes in Spinoza’s system will turn out to be unsound, I do believe there is one crucial line in Spinoza’s system – Spinoza’s rather weak and functional conception of individuality – which provides some support for Hegel’s reading of Spinoza. Schopenhauer’s philosophical engagement with Spinoza spreads over many fronts, and an adequate – not to say, complete – treatment of the topic, should cover at least the following issues: Schopenhauer’s critique (and misunderstanding) of Spinoza’s pivotal concept of causa sui; Schopenhauer’s claim that Spinoza confused reason [ratio] and cause [causa]; the relationship between Schopenhauer’s and Spinoza’s monisms; the eminent role that both philosophers assign to causality; and finally, Schopenhauer’s view of the world as a macroanthropos, as opposed to Spinoza’s attack (...) on anthropomorphic thinking. An attempt to reconstruct a genuine philosophical dialogue between Schopenhauer and Spinoza should begin by setting the record straight and clarifying the former’s mis-readings of the latter (and there are quite a few of this kind ). We could also benefit from comparing Schopenhauer’s reception of Spinoza’s with that of Schopenhauer’s German contemporaries. Regrettably our space here is limited and so if we wish to treat any of the issues in any depth, we must restrict the scope of the current chapter. For this reason, I have decided to concentrate on two central issues: animal rights (Part I) and evil (Part II). These issues are, clearly, at least as important as the others listed above. (shrink)

Chapters 17 and 18 of the TTP constitute a textual unit in which Spinoza submits the case of the ancient Hebrew state to close examination. This is not the work of a historian, at least not in any sense that we, twenty-first century readers, would recognize as such. Many of Spinoza’s claims in these chapters are highly speculative, and seem to be poorly backed by historical evidence (Cf. Verbeek (2003), 126). Other claims are broad-brush, ahistorical generalizations: for example, in a (...) marginal note (to be discussed shortly), Spinoza refers to his Jewish contemporaries as if they were identical with the ancient Hebrews. Projections from Spinoza’s own experience of his Jewish and Dutch contemporaries are quite common, and the Erastian lesson that Spinoza attempts to draw from his “history” of the ancient Hebrew state is all too conspicuous. Even Spinoza’s philosophical arguments in these two chapters are not uniformly convincing, as I will attempt to show. Yet in spite of all these faults, the two chapters are a masterpiece of their own kind: a case study of the psychological foundations of politics and religion. The work that comes closest in my mind is Freud’s 1939 Der Mann Moses und die monotheistische Religion. The two works are similar not only in terms of their chronological subject matter – the Hebrews of Moses’s time – but also in their attempt to reconstruct the communal psyche of the Hebrews in order to demonstrate their respective social theories about the foundation of civilization. Needless to say, there are numerous differences between the two works, not the least of which are their distinct aims and the very different political contexts in which they were produced. (shrink)

In this book, Yitzhak Y. Melamed offers a new and systematic interpretation of the core of Spinoza’s metaphysics. In the first part of the book, he proposes a new reading of the metaphysics of substance in Spinoza. Against Curley's influential reading, he argues that for Spinoza modes both inhere in and are predicated of God. Using extensive textual evidence, he shows that Spinoza considered modes to be God's propria. Against the claim that it is a category mistake to consider (...) things as properties, he argues that the distinction between things and properties has been thoroughly undermined both in the early modern period and in contemporary metaphysics (in bundle theories, and some versions of trope theory). He goes on to clarify Spinoza’s understanding of infinity, mereological relations, infinite modes, and the flow of finite things from God’s essence. In the second part of the book, Melamed relies on this interpretation of the substance-mode relation and the nature of infinite modes and puts forward two interrelated theses about the structure of the attribute of Thought and its overarching role in Spinoza's metaphysics. First, he shows that Spinoza had not one, but two independent doctrines of parallelism. The Ideas-Things Parallelism stipulates an isomorphism between the order of ideas in the attribute of Thought and the order of things in nature. The Inter-Attributes Parallelism establishes an isomorphism among the order of modes in each of the infinitely many attributes. He shows that these two doctrines are independent of each other and that each has different implications. Relying on this clarification of the doctrines of parallelism, Melamed develops his final main thesis. Here he argues that, for Spinoza, ideas have a multifaceted (in fact, infinitely faceted) structure that allows one and the same idea to represent the infinitely many modes which are parallel to it in the infinitely many attributes. Thought turns out to be coextensive with the whole of nature. Spinoza cannot embrace an idealist reduction of Extension to Thought because of his commitment to the conceptual separation of the attributes. Yet, within Spinoza's metaphysics, Thought clearly has primacy over the other attributes insofar as it is the only attribute which is as elaborate, as complex, and, in some senses, as powerful as God. In a beautiful recent essay, the philosopher Walter Sinnott-Armstrong explains the reasons for his departure from evangelical Christianity, the religious culture in which he was brought up. Sinnot-Armstrong contrasts the interpretive methods used by good philosophers and fundamentalist believers: Good philosophers face objections and uncertainties. They follow where arguments lead, even when their conclusions are surprising and disturbing. Intellectual honesty is also required of scholars who interpret philosophical texts. If I had distorted Kant’s view to make him reach a conclusion (...) that I preferred, then my philosophy professor would have failed me. The contrast with religious reasoning is stark. My Christian friends seemed happy to hide serious problems in the Bible and in their arguments. They preferred comfort to intellectual honesty. I couldn’t. To what extent can we, historians of philosophy, claim the virtue of intellectual honesty? Speaking frankly, I do not find the practice criticized by Sinnot-Armstrong’s philosophy professor rare or unusual at all. We very frequently distort the views of past philosophers in order to reach the conclusions we prefer. We just call it “Charitable Interpretation.” In this essay, I discuss and criticize the logic behind so-called charitable interpretations in the history of philosophy. This phenomenon is ubiquitous and is not at all restricted to a particular philosophical strand or ideology. Analytic philosophers and post-modernists, Marxists, liberals, secularists, and fundamentalists, we all engage in the very same domestication project. Even more disturbing than the sheer ideological pervasiveness of this phenomenon is the fact that, on many occasions, superb philosophers and historians take part in this fairly childish endeavor. In the first part of this essay, I discuss the general logic of charitable interpretations in the history of philosophy, mostly by addressing discussions in metaphysics and epistemology. In the second part, I focus on the somewhat less noticed use of charitable interpretations in the study of political philosophy, and point out the quintessential role ideology plays in these discussions. In both parts, I concentrate mostly on the interpretation of Spinoza’s thought. I do so not because I have special fondness for Spinoza (“guilty as charged,” I admit), but because Spinoza is such a beast (and may I add, an enchanting beast) and attracts a disproportionate share of the domestication efforts from historians and philosophers of all creeds and persuasions. In the third and final part of the paper, I will begin to outline an alternative methodology, which suggests that past philosophers can be most relevant to our current philosophical discussion, to the extent that they provide us with well-motivated challenges to our common-sense beliefs. Such challenges have the invaluable virtue of being able to undermine our most fundamental and secure beliefs, and force us to engage with the most fundamental questions. ‘Substance’ (substantia, zelfstandigheid) is a key term of Spinoza’s philosophy. Like almost all of Spinoza’s philosophical vocabulary, Spinoza did not invent this term, which has a long history that can be traced back at least to Aristotle. Yet, Spinoza radicalized the traditional notion of substance and made a very powerful use of it by demonstrating – or at least attempting to demonstrate -- that there is only one, unique substance -- God (or Nature) -- and that all other things are (...) merely modes or states of God. Some of Spinoza’s readers understood these claims as committing him to the view that only God truly exists, and while this interpretation is not groundless, we will later see that this enticing and bold reading of Spinoza as an ‘acosmist’ comes at the expense of another audacious claim Spinoza advances, i.e., that God/Nature is absolutely and actually infinite. But before we reach this last conclusion, we have a long way to go. So, let me first provide an overview of our plan. In the first section of this paper we will examine Spinoza’s definitions of ‘substance’ and ‘God’ at the opening of his magnum opus, the Ethics. Following a preliminary clarification of these two terms and their relations to the other key terms defined at the beginning of the Ethics, we will briefly address the Aristotelian and Cartesian background of Spinoza’s discussion of substance. In the second section, we will study the properties of the fundamental binary relations pertaining to Spinoza’s substance: inherence, conception, and causation. The third section will be dedicated to a clarification of Spinoza’s claim that God, the unique substance, is absolutely infinite. This essential feature of Spinoza’s substance has been largely neglected in recent Anglo-American scholarship, a neglect which has brought about an unfortunate tendency to domesticate Spinoza’s metaphysics to more contemporary views. The fourth section will study the nature of Spinoza’s monism. It will discuss and criticize the interesting yet controversial views of the eminent Spinoza scholar, Martial Gueroult, about the plurality of substances in the beginning of the Ethics; address Spinoza’s claim in Letter 50 that, strictly speaking, it is improper to describe God as “one”; and, finally, evaluate Spinoza’s kind of monism against the distinction between existence and priority monism recently introduced into the contemporary philosophical literature. The fifth and final section will explain the nature, reality, and manner of existence of modes. We therefore have an ambitious plan; let’s get down to business. (shrink)

The first section of the chapter will address the philosophy of modality among Spinoza’s medieval Jewish predecessors, and, primarily, in Hasdai Crescas (1340-1410/11), a bold and original, anti-Aristotelian philosopher. This section should both complement the discussion of modality in medieval Christian and Islamic philosophy in the previous chapters of this volume and provide some lesser-known historical background to Spinoza’s own engagement with modal philosophy. Following a section on Spinoza’s definitions of his main modal concepts and his understanding of contingency, I (...) will turn, in the third section, to discuss the extent of Spinoza’s commitment to necessitarianism. The recent debate about whether Spinoza was a strict necessitarian has resulted in quite a few insights about Spinoza’s modal philosophy, but it has also detracted attention from some basic questions about Spinoza’s modal philosophy, and in the fourth and last section of the chapter, I will attempt to chart the foundational questions that still have been barely explored. The primary aim of this chapter it to provide a survey and outline of the chief elements of Spinoza’s modal philosophy. Still, beyond the mere overview of Spinoza’s arguments (and some major scholarly debates), I will also advance two original theses. First, I will show that Spinoza makes a distinction between two notions of contingency, and that once this important distinction is observed, Spinoza’s various assertions about contingency turn out to be consistent. Secondly, I will discuss the text (E2a1) which is commonly taken to be the strongest and most stubborn proof against the reading of Spinoza as strict necessitarianism; I will show that the basic meaning of this text has been widely misunderstood, and that E2a1 is perfectly compatible with strict necessitarianism. The two manuscripts of the Korte Verhanedling that were discovered in the mid-nineteenth century contain two appendices. These appendices are even more enigmatic than the KV itself, and it is the first appendix that is the subject of this study. Unfortunately, there are very few studies of this text, and its precise nature seems to be still in question after more than a century and a half of scholarship. It is commonly assumed that the appendices were written after the body (...) of the KV and I am not going to challenge this assumption. The first appendix is written in a geometric manner, and it contains seven axioms and four propositions. Strikingly, it does not include any definitions. This is in sharp contrast with Spinoza's Ethics and his 1663 book on Descartes' Principles of Philosophy, which are similarly written in a geometric manner but include both definitions and axioms. One could perhaps suspect that the text we currently have is merely a fragment from a more extensive work which included definitions. In my paper, I will show that this is not the case, and that the first appendix belongs to a genuine work of Spinoza that never contained definitions. I would further argue that the first appendix is most probably the earliest draft we currently have of Spinoza's magnum opus, the Ethics, but we have a long way to go before we reach that conclusion. Modality: A History provides readers a sweeping study of the history of philosophical work on modal concepts. Everyday discourse is saturated with appeals to what might be the case or to what must be true or to what cannot happen. Possibility, necessity, and impossibility are modal terms, and philosophers have long wondered how to best understand them. This volume traces the history of some of the most prominent and important contributions to our understanding of possibility and necessity over the past (...) two and half millennia of western philosophy, from ancient Greek philosophers through current debates in the 21st century. Over the course of nine chapters from prominent scholars, this volume traces a history of modal theorizing that begins with extended discussions of Aristotle and the Stoics. Several chapters discuss insights and disagreements among Latin, Arabic, and Jewish medieval scholastics, such as Al-Ghazâlî, Scotus, and Crescas. Three chapters center on early modern philosophers, whose modal views were deeply shaped by this conceptual inheritance but also departed from it in significant ways: Descartes, Malebranche, Locke, Spinoza, Leibniz, and Hume. Kant and Hegel's modal contributions are presented in their own chapter, and another chapter traces the legacy of Kant's account on early-to-mid 20th century modal views, including Husserl, Heidegger, Russell, and Quine. The revival of modal metaphysics in the more recent work of Kripke, Marcus, and Lewis has led to a new flourishing of modal theories, including in recent debates among neo-Aristotelians, as the final chapter illustrates. Although modal concepts are interesting and important on their own, theories of modality often intersect with other significant philosophical topics, such as time, freedom, and God. Modal concepts also extend beyond metaphysics. To illustrate the role of modality in other domains, several small-scale studies, or Reflections, are dispersed among these main chapters on modality in cosmology, religion, music, literature, and logic. Though Spinoza's definition of God at the beginning of the Ethics unequivocally asserts that God has infinitely many attributes, the reader of the Ethics will find only two of these attributes discussed in any detail in Parts Two through Five of the book. Addressing this intriguing gap between the infinity of attributes asserted in E1d6 and the discussion merely of the two attributes of Extension and Thought in the rest of the book, Jonathan Bennett writes: Spinoza seems to imply that (...) there are other [attributes] – he says indeed that God or Nature has “infinite attributes.” Surprising as it may seem, there are reasons to think that by this Spinoza did not mean anything entailing that there are more than two attributes. In this paper I will argue that Bennett’s claim is fundamentally wrong and deeply misleading. I do think, however, that addressing Bennett’s challenge will help us better understand Spinoza’s notion of infinity. I will begin by summarizing Bennett’s arguments. I will then turn to examine briefly the textual evidence for and against his reading. Then I will respond to each of Bennett’s arguments, and conclude by pointing out theoretical considerations which, I believe, simply refute his reading. (shrink)

This article seeks to examine how religious ideas that are not the focus of a particular halakhic question become the crux of the ruling, thereby molding it and dictating its bias. We will attempt to demonstrate this through a study of Jewish medical ethics, based on some of the rulings of one of the greatest halakhic decisors of the previous generation: Rabbi Eliezer Yehuda Waldenberg (1915–2006). Rabbi Waldenberg molds his rulings on the basis of a religious principle asserting that the (...) legitimacy of any medical procedure is qualified and limited. Rabbi Waldenberg rejects certain accepted medical practices, including plastic surgery, in vitro fertilization, and organ transplants. Even if these procedures are regarded by other halakhic decisors as being legitimate, for Rabbi Waldenberg they are ethically and religiously improper, and therefore they are halakhically forbidden. Ruth Chang denies a related claim: if A is Φ-er than B and C is not Φ-er than B, but is Φ to a certain degree, then A is Φ-er than C. There can be little doubt that without Spinoza, German Idealism would have been just as impossible as it would have been without Kant. Yet the precise nature of Spinoza's influence on the German Idealists has hardly been studied in detail. This article proposes an analysis of the doctrine of sufficiency. According to my reading, the doctrine's basic positive claim is ‘prioritarian’: benefiting x is of special moral importance where (and only where) x is badly off. Its negative claim is anti-egalitarian: most comparative facts expressed by statements of the type ‘x is worse off than y’ have no moral significance at all. This contradicts the ‘classical’ priority view according to which, although equality per se does not matter, whenever x is (...) worse off than y, at least some priority should be assigned to helping x. Section I elaborates and defends this reconstruction of the doctrine of sufficiency, and section II shows that the privileged utility level presumed within the sufficiency framework exists. (shrink)

Methods Young healthy heterosexual couples underwent sleep-lab-based polysomnography of two sleeping arrangements: individual sleep and co-sleep. Individual and dyadic sleep parameters (i.e., synchronization of sleep stages) were collected. The latter were assessed using cross-recurrence quantification analysis. Additionally, subjective sleep quality, relationship characteristics, and chronotype were monitored. Data were analyzed comparing co-sleep vs. individual sleep. Interaction effects of the sleeping arrangement with gender, chronotype, or relationship characteristics were moreover tested. Results As compared to sleeping individually, co-sleeping was associated with about 10% (...) more REM sleep, less fragmented REM sleep (p = 0.008), longer undisturbed REM fragments (p = 0.0006), and more limb movements (p = 0.007). None of the other sleep stages was significantly altered. Social support interacted with sleeping arrangement in a way that individuals with suboptimal social support showed the biggest impact of the sleeping arrangement on REM sleep. Sleep architectures were more synchronized between partners during co-sleep (p = 0.005) even if wake phases were excluded (p = 0.022). Moreover, sleep architectures are significantly coupled across a lag of ± 5min. Depth of relationship represented an additional significant main effect regarding synchronization, reflecting a positive association between the two. Neither REM sleep nor synchronization was influenced by gender, chronotype, or other relationship characteristics. Conclusion Depending on the sleeping arrangement, couple's sleep architecture and synchronization show alterations that are modified by relationship characteristics. We discuss that these alterations could be part of a self-enhancing feedback loop of REM sleep and sociality and a mechanism through which sociality prevents mental illness. (shrink)

CSR has become an important element in the business strategy of a growing number of companies worldwide. A large number of initiatives have been developed that aim to support companies in developing, implementing, and communicating about CSR. The Global Compact (GC), initiated by the United Nations, stands out. Since its launch in 2000, it has grown to about 2900 companies and 3800 members in total. The GC combines several mechanisms to support CSR strategies: normative principles, networks for learning and co-operation, (...) and communication and transparency about CSR activities. However, up to now only a few empirical evaluations of the contribution of the GC to CSR strategies have been conducted that however have not differentiated between different types of companies (regarding type of industry or regarding the maturity of CSR). This paper aims to partly fill this knowledge gap by a case study examination of three frontrunner companies in the telecommunications industry. The results show that the GC is only one of the many initiatives that these companies employ in shaping, implementing, and reporting about their CSR strategies, and that its role is at most modest. There are two important reasons. One is that many of the CSR issues that these companies deal with are industry specific and are hence addressed in specific networks. The second reason is that the GC principles are perceived as minimum requirements that do not provide many incentives to the three case study companies to perform better. A differentiation of norms for GC members is expected to enhance the contribution of the GC to CSR strategy employment, not only for frontrunner companies but as well for other categories of companies. Yitzhak Benbaji and Daniel Statman present a new theory on the ethics of war which shows that wars can be morally justified at both the ad bellum level and the in bello level.

Yitzhak Melamed here offers a new and systematic interpretation of the core of Spinoza's metaphysics. In the first part of the book, he proposes a new reading of the metaphysics of substance in Spinoza: he argues that for Spinoza modes both inhere in and are predicated of God. Using extensive textual evidence, he shows that Spinoza considered modes to be God's propria. He goes on to clarify Spinoza's understanding of infinity, mereological relations, infinite modes, and the flow of finite (...) things from God's essence. In the second part of the book, Melamed relies on this interpretation of the substance-mode relation and the nature of infinite modes and puts forward two interrelated theses about the structure of the attribute of Thought and its overarching role in Spinoza's metaphysics. First, he shows that Spinoza had not one, but two independent doctrines of parallelism. Then, in his final main thesis, Melamed argues that, for Spinoza, ideas have a multifaceted structure that allows one and the same idea to represent the infinitely many modes which are parallel to it in the infinitely many attributes. Thought turns out to be coextensive with the whole of nature. Spinoza cannot embrace an idealist reduction of Extension to Thought because of his commitment to the conceptual separation of the attributes. Yet, within Spinoza's metaphysics, Thought clearly has primacy over the other attributes insofar as it is the only attribute which is as elaborate, as complex, and, in some senses, as powerful as God. This comment on Kocyba's article discusses both his economic and moral assumptions, arguing that the shift from industrial capitalism towards a 'new spirit' of more autonomous forms of work is not captured by Kocyba's comparison between producing things alone and creating services together. Consequently, the main problem is not, as Kocyba believes, the determination of an individual's share in the (intangible) product, but the competitive mindset of this new spirit, which has many undesired consequences. Concerning the 'moral presuppositions' it is (...) argued that the questionable self-restriction to 'immanent norms' induces a strong affirmative tendency which is at odds with Kocyba's critical aspirations. The idea that critical theory can only refer to norms which are already institutionalized needs to be dropped in order to revive the critical dimension. It is argued that Kocyba is already half way there and needs to make this break more explicit. (shrink)

Recent welfare reform has resulted in new work requirements for welfare recipients. These measures need to be justified, as they impair recipients’ freedom. This paper first repudiates economic justifications for these developments and argues that the dominant justification is perfectionist. But unlike workfare, perfectionism is not necessarily paternalistic. The second part of the paper outlines a liberal perfectionism which allows only for autonomy-enhancing politics. Though even such autonomy-enhancing politics cannot be made obligatory. The last section concludes that workfare’s paternalism cannot (...) be attributed to perfectionist justifications, but rather stems from the narrow philosophy of work that is applied. The idea that enforced wage labour is a reliable tool for inducing autonomy is refuted. In the end, workfare needs to be rejected, as it is based on assumptions that are mistaken both normatively and empirically. (shrink)

Der Band versammelt Beiträge des Deutsch-Japanischen Rechtsdialogs in Augsburg. Mit dem Generalthema «Straftheorie und Strafgerechtigkeit» werden Grundfragen des Straf- und Strafprozessrechtes aufgegriffen. Warum bestrafen wir? Wie sind Strafen und wie ist der Strafprozess angemessen auszugestalten, um Gerechtigkeit und Rechtsfrieden zu erreichen? Wie können Bürgerrechte hinreichend geschützt werden? Diese Fragen werden vor dem Hintergrund eines wachsenden Sicherheitsbedürfnisses in den Gesellschaften Japans und Deutschlands erörtert.

Als Theorie des Guten fordert der Perfektionismus eine gelingende menschliche Entwicklung; als politische Philosophie stellt er Institutionen die Aufgabe, die Entfaltung der Individuen zu ermöglichen. Eine solche Politik steht heute allerdings unter liberalem Generalverdacht. Christoph Henning stellt die Debatten um den Perfektionismus erstmals umfassend dar und zeigt im Rückgriff auf radikale Denker von Jean-Jacques Rousseau bis Thomas Hurka, dass der Perfektionismus als zentraler Bestandteil des Projektes von Freiheit und Gleichheit zu begreifen ist.
