This paper examines the use of connectionism (neural networks) in modelling legal reasoning. I discuss how the implementations of neural networks have failed to account for legal theoretical perspectives on adjudication. I criticise the use of neural networks in law, not because connectionism is inherently unsuitable in law, but rather because it has been done so poorly to date. The paper reviews a number of legal theories which provide a grounding for the use of neural networks in law. It then (...) examines some implementations undertaken in law and criticises their legal theoretical naïvete. It then presents a lessons from the implementations which researchers must bear in mind if they wish to build neural networks which are justified by legal theories. (shrink)

In this short note, we discuss several aspectsof “dimensions” and the related constructof “factors”. We concentrate on those aspectsthat are relevant to articles in this specialissue, especially those dealing with the analysisof the wild animal cases discussed inBerman and Hafner's 1993 ICAIL article. Developing original accounts of the many aspects of belief, On Believing puts the believer at the heart of the story. Developing a novel account of the normativity of belief, Hunter argues that the ethics of belief concern how a believer ought to be positioned in a world of possibilities.

This paper argues that it is possible to knowingly believe something while judging that one ought not to believe it and (so) viewing the belief as manifesting a sort of failure. I offer examples showing that such ‘alienated belief’ has several potential sources. I contrast alienated belief with self-deception, incontinent (or akratic) belief and half-belief. I argue that the possibility of alienated belief is compatible with the so-called ‘transparency’ of first-person reflection on belief, and that the descriptive and expressive difficulties (...) it involves stem from well-understood sources. I conclude by speculating that endorsed belief is in important respects like intentional action. Reflection on the possibility of alienated belief may thus help us to see one respect in which an agent can be responsible for her attitudes. (shrink)

In this essay, I draw out some implications of a position called “Wittgensteinian Quasi-Fideism” for the theory and practice of interreligious communication. After setting out the main tenets of that position, I articulate what its theoretical and practical implications in this area would be if it were true. I thereby sketch a new, Wittgensteinian model of interreligious communication, concluding with a number of suggestions as to some points of focus for further work in this area.

This enlightening text analyses the origins of Western complaints, prevalent in the late nineteenth century, that Japan was characterised at the time by exceptionally low standards of ‘commercial morality’, despite a major political and economic transformation. As Britain industrialised during the nineteenth century the issue of ‘commercial morality’ was increasingly debated. Concerns about standards of business ethics extended to other industrialising economies, such as the United States. Hunter examines the Japanese response to the charges levelled against Japan in this (...) context, arguing that this was shaped by a pragmatic recognition that Japan had little choice but to adapt itself to Western expectations if it was to establish its position in the global economy. The controversy and criticisms, which were at least in part stimulated by fear of Japanese competition, are important in the history of thinking on business ethics, and are of relevance for today’s industrialising economies as they attempt to establish themselves in international markets. ExcerptCarl Schmitt (1888–1985) is known as the most consequential German legal and political mind of the twentieth century.1 Many crimes of the Nazi regime found support in his conceptual justifications, and Schmitt is called the “Crown Jurist” of the Third Reich with good reason. Historians, political scientists, and sociologists must grapple with the author in order to understand the course of totalitarianism in modernity. Whether literary historians should do so is far less settled, though he was fascinated by their object (...) of study. His writings on literary topics are said to reveal much about Schmitt’s person, politics, and period, but little about literature itself.2 This explains why his “Don Quijote und das Publikum” (“Don Quixote and the Public”), published in the arts and cultural journal Die Rheinlande in 1912, was almost unknown in literary studies for a century.3 Schmitt’s text on the novel by Miguel de Cervantes has not been reprinted, and until recently it had not been translated from the original German. Size has a role too. At under two thousand words, the text has probably escaped notice due to its small scale.4 Recent English and Italian translations in major humanistic journals may signal the end of its obscurity though.5 “Don Quixote and the Public” is at the door of literary studies. This volume responds to calls in visual and material cultural studies to move beyond the visual and to explore the multi-sensory impact of the image, across a wide range of cultural and historical contexts. What does it mean to do art history after the material and sensory turns? What is an image, if it is not purely visual phenomenon, and how does it prompt non-visual sensory experiences? The multi-sensoriality of the image was a less challenging concept before the occularcentric modern (...) age, and so this volume brings together a global array of scholars from multiple disciplines to explore these questions in pre-modern or non-western contexts, ranging from Minoan palace frescoes, to Roman statues, early church sermons, tombs of Byzantine saints, museum displays of Islamic artefacts of scent, medieval depictions of the voice, and Stuart court masques. Each chapter presents a means of appreciating images beyond the visual, demonstrating the new information and understanding that can consequently be gleaned from their material. As a collection, these chapters offer the student and scholar of art history and visual culture an array of exciting new approaches that can be applied to appreciate the multi-sensoriality of images in any context, as well as prompts for reflection on future directions in the study of images and its application. Humans massively depend on communication with others, but this leaves them open to the risk of being accidentally or intentionally misinformed. To ensure that, despite this risk, communication remains advantageous, humans have, we claim, a suite of cognitive mechanisms for epistemic vigilance. Here we outline this claim and consider some of the ways in which epistemic vigilance works in mental and social life by surveying issues, research and theories in different domains of philosophy, linguistics, cognitive psychology and the social sciences.

In this paper, I plan to show that the use of a specific population concept—Millstein’s Causal Interactionist Population Concept (CIPC)—has interesting and counter-intuitive ramifications for discussions of the reality of biological race in human beings. These peculiar ramifications apply to human beings writ large and to individuals. While this in and of itself may not be problematic, I plan to show that the ramifications that follow from applying Millstein’s CIPC to human beings complicates specific biological racial realist accounts—naïve or otherwise. I conclude with the notion that even if biological races do exist—by fulfilling all of the criteria needed for Millstein’s population concept (which, given particular worries raised by Gannett (Synthese 177:363–385, 2010), and Winther and Kaplan (Theoria 60:54–80, 2013) may not)—the lower-bound limit for the scope of biological racial realism is at the level of populations, and as such they cannot say anything about whether or not individual organisms themselves have races. Ineffability—that which cannot be explained in words—lies at the heart of the Christian mystical tradition. It has also been part of every discussion of religious experience since the early twentieth century. Despite this centrality, ineffability is a concept that has largely been ignored by philosophers of religion. In this book, Bennett-Hunter builds on the recent work of David E. Cooper, who argues that the meaning of life can only be understood in terms of an ineffable source on which life (...) depends, and engages with the work of continental philosophers, such as Heidegger, Merleau-Ponty and Karl Jaspers. Presently, there is a movement in the UK research governance framework towards what is referred to as proportional ethical review. Proportional ethical review is the notion that the level of ethical review and scrutiny given to a research project ought to reflect the level of ethical risk represented by that project. Relatively innocuous research should receive relatively minimal review and relatively risky research should receive intense scrutiny. Although conceptually attractive, the notion of proportional review depends on the possibility of effectively (...) identifying the risks and ethical issues posed by an application with some process other than a full review by a properly constituted research ethics committee. In this paper, it is argued that this cannot be achieved and that the only appropriate means of identifying risks and ethical issues is consideration by a full committee. This implies that the suggested changes to the National Health Service research ethics system presently being consulted on should be strenuously resisted. (shrink)

The following is a reflection on the possibility of teaching by example, and especially as the idea of teaching by example is developed in the work of Jean-Jacques Rousseau. My thesis is that Rousseau created a literary version of himself in his writings as an embodiment of his philosophy, rather in the same way and with the same purpose that Plato created a version of Socrates. This figure of Rousseau—a sort of philosophical portrait of the man of nature—is represented as (...) an example for us to follow. This would appear to have been dangerous and destabilizing work, given the mental distress that it caused Rousseau in striving to live up to his fictional self. Rousseau's own ideas on the nature of teaching by example are presented in a discussion of the section in ‘Emile’ which Rousseau takes from an incident in his own life—the story of his meeting with a young Savoyard priest who befriended him and influenced him through the power of his example. Patient RB has a peculiar memory impairment wherein he experiences his memories in rich contextual detail, but claims to not own them. His memories do not feel as if they happened to him. In this paper, I provide an explanatory model of RB’s phenomenology, the self-attentional model. I draw upon recent work in neuroscience on self-attentional processing and global workspace models of conscious recollection to show that RB has a self-attentional deficit that inhibits self-bias processes in broadcasting the contents of (...) episodic memories to the global workspace. Typically, self-related contents enjoy a higher salience level than other-related contents. Elimination of bias toward self-related contents diminishes the salience of those contents to the level of other-related contents. Because the typical high salience of self-related content is necessary for the feeling of ownership, RB lacks the feeling of ownership. I also discuss potential applications of the self-attentional model to other psychopathological cases. (shrink)

Dan Zahavi engages with classical phenomenology, philosophy of mind, and a range of empirical disciplines to explore the nature of selfhood. He argues that the most fundamental level of selfhood is not socially constructed or dependent upon others, but accepts that certain dimensions of the self and types of self-experience are other-mediated.

Some embodied theories of concepts state that concepts are represented in a sensorimotor manner, typically via simulation in sensorimotor cortices. Fred Adams (2010) has advanced an empirical argument against embodied concepts reasoning as follows. If concepts are embodied, then patients with certain sensorimotor impairments should perform worse on categorization tasks involving those concepts. Adams cites a study with Moebius Syndrome patients that shows typical categorization performance in face-based emotion recognition. Adams concludes that their typical performance shows that embodiment is false. (...) Moebius patients must draw on amodal (non-embodied) emotion concepts. In this paper, I review face-based emotion recognition studies with Moebius patients yielding conflicting results and diagnose these conflicts as a difference in experimental design. When emotion labels are provided, patients have typical performance, but when labels are not provided patients are severely deficient. I then show how an embodied, psychological constructionist view of emotions predicts and explains these performance differences. The upshot is that embodied theories of concepts are vindicated. About 25 years ago, it came to light that a single combinatorial property determines both an important dividing line in model theory and machine learning. The following years saw a fruitful exchange of ideas between PAC-learning and the model theory of NIP structures. In this article, we point out a new and similar connection between model theory and machine learning, this time developing a correspondence between stability and learnability in various settings of online learning. In his recent book ‘Kant and the Mind’ Andrew Brook makes a distinction between two types of selfawareness. The first type, which he calls empirical self-awareness, is an awareness of particular psychological states such as perceptions, memories, desires, bodily sensations etc. One attains this type of self-awareness simply by having particular experiences and being aware of them. To be in possession of empirical self-awareness is, in short, simply to be conscious of one’s occurrent experience. The second type of self-awareness he (...) calls apperceptive self-awareness. This type of self-awareness entails an awareness of oneself as the subject of experience. For this type of self-awareness to obtain, it would not be enough merely to be conscious of, say, an occurrent perception of a chair, one would also have to be aware that it was oneself who was perceiving the chair. And as Brook adds, when I am self-aware in this way, I am not only aware of being the subject of a single experience, but also aware of myself as the common subject of other psychological states (Brook, 1994: 55-57). I find Brook’s distinction illuminating, but it raises a question which I would like to pursue in this paper. When we speak of self-awareness, do we then necessarily also speak of a self, is there so to speak always a self involved in self-awareness, or is it rather the case, as Brook’s notion of empirical selfawareness might suggest, that there are types of self-awareness which are ‘selfless’, or to use two other related terms ‘subjectless’ or ‘non-egological’? Is self-awareness always to be understood as an awareness of a self, or can it be understood simply as the awareness which a specific experience has of itself? Ultimately, I believe an answer to these questions are important, both when it comes to an understanding of what exactly self-awareness amounts to, and also when it comes to a proper understanding of what a self is.. We apply our general results to answer a question of Bhaskar [1] and give a slight improvement to a result of Malliaris and Terry [7]. We also prove a new Sauer-Shelah type lemma in the context of op-rank, a notion of Guingona and Hill [4].
