Recent debates in contemporary feminist theory have been dominated by the relation between identity and politics. The aim of this article is to examine both the work of Judith Butler on gender performativity and examples of how Butler's writings have been appropriated by certain other writers. I explore three areas in particular: the relation between performance and performativity in the work of Butler and her `adherents'; the developmental changes in Butler's argument between Gender Trouble and Bodies That Matter; and the question of the effectiveness of the politics of parody. I argue that it is the ambiguities (...) in Butler's own several accounts of the distinction between performance and performativity that fuel the readings of the politics of performance as the province of the autonomous subject - a perspective at variance with Butler's own. In addition, I explore the deficiencies in Butler's account of politics, especially her denial of the significance of the context on the efficacy of political interventions. (shrink)

This paper will examine the violence of heteronormativity: the violence that constitutes and regulates bodies according to normative notions of sex, gender, and sexuality. This violence, I will argue, requires more than a focus on gendered or sexualized physical harms of the kinds normally examined when studying violence against sexual minorities or women. Rather, it necessitates focusing on the multiple modalities through which heteronormativity performs its violence on, through, and against bodies and persons, including through the production of certain bodies (...) and persons as inciting violence in their very being. To establish my argument, I explore the killing in 2002 of trans woman Gwen Araujo and the violence of the legal strategy (the trans panic defense) used in the legal trials that followed her killing. Both forms of violence, I suggest, operate in a similar way, albeit through different mechanisms, to maintain and extend the system of binary morphology that itself entails the perpetual violent materialization of sexed bodies. This book provides a welcome assessment of the wide-ranging impact of Michel Foucault's work upon a number of disciplines within the social sciences and humanities. It offers close textual readings of Foucault's work along with clear overviews of how his work has been taken up in subjects such as history, philosophy and international relations. It also offers original applications of his work to important topics within feminist theory, political theory, the sociology of race, and socio-legal studies.

How are we to understand hunger strikes and episodes of lip-sewing in immigration detention? Are they simply cases of self-destruction or bare life, as is often claimed, or is there scope to view these embodied acts of self-harm as having a political dimension and to see those engaged in them as resistant subjects exercising political agency? To explore these issues, I draw on recent feminist theoretical work on vulnerability. Received wisdom suggests that vulnerability is an impediment to political action. Rejecting (...) the idea that vulnerability equates exclusively to injurability and passivity, I contend, by contrast, that corporeal vulnerability can potentially prompt action, serve as a resource for collective acts of resistance, and enable the politicization of certain spaces. Since context matters to how vulnerability and resistance intersect, I illustrate my argument by exploring, in particular, the protests that took place at Woomera immigration detention centre in Australia in 2002. This article focuses on Jacques Rancière’s reflections on Alfredo Jaar’s The Rwanda Project in the context of wider discussions of the politics of naming the dead. Against the claim that his reflections reveal a depoliticizing, universalist commitment to naming all the dead, it contends that foregrounding the relation between naming and counting in this discussion shows Rancière’s focus to be the policing and politics of naming. In an original argument, it focuses specifically on how, for Rancière, in this context, individualized (...) proper names function politically and dissensually. To do so it explores Rancière’s analysis of the role of the mainstream media during the Rwandan genocide in perpetuating the police order which divided nameable individuals from anonymous masses, thereby constituting living and dead Rwandans as of little or no account, and his account of how Jaar’s art is able to disrupt the ‘partition of the sensible’ underpinning this count. The article concludes by considering how Rancière’s ideas about the relationship between naming and counting and between politics and police serve as a useful supplement to and extension of existing discussions of grievability. In his third and concluding volume, Lloyd P. Gerson presents an innovative account of Platonism, the central tradition in the history of philosophy, in conjunction with Naturalism, the "anti-Platonism" in antiquity and contemporary philosophy. In this broad and sweeping argument, Gerson contends that Platonism identifies philosophy with a distinct subject matter, namely, the intelligible world and seeks to show that the Naturalist rejection of Platonism entails the elimination of a distinct subject matter for philosophy. Thus, the possibility of philosophy (...) depends on the truth of Platonism. From Aristotle to Plotinus to Proclus, Gerson clearly links the construction of the Platonic system well beyond simply Plato's dialogues, providing strong evidence of the vast impact of Platonism on philosophy throughout history. Platonism and Naturalism concludes that attempts to seek rapprochement between Platonism and Naturalism are unstable and likely indefensible. (shrink)

The belief that some misfortunes are punishments sent from God has been affirmed by many different cultures and religions throughout human history. The belief has proved a pervasive one, and is still endorsed today by many adherents of the great western religions of the Judaeo-Christian tradition. Invariably, what is believed is that a present misfortune is divine punishment for a past sin. But could a present misfortune in fact be divine punishment for a future sin? That is, could God prepunish (...) people for their future transgressions? The aim of this paper will be to show that there are solid philosophical grounds for supposing that he could and would do so. (shrink)

Philosophical discussions of gentrification have tended to focus on residential displacement. However, the prevalence of residential displacement is fiercely contested, with many urban geographers regarding it as quite uncommon. This lends some urgency to the underexplored question of how one should evaluate other forms of gentrification. In this paper, I argue that one of the most important harms suffered by victims of displacement gentrification is loss of access to the goods conferred by membership in a thriving local community. Leveraging the (...) social scientific literature, I go on to argue that non-displacement gentrification also often damages local communities. One can hence extend existing philosophical critiques of displacement gentrification to argue that non-displacement gentrification likewise poses a threat to relational equality, and often violates certain basic occupancy rights. Focusing on the value that inheres in thriving local communities also suggests some new possibilities for critiquing gentrification. For instance, existing occupancy rights critiques focus on incumbent land users’ interests in stability. However, one can also argue in a Lockean mode that incumbent land users’ occupancy rights are at least partially grounded in their community having laboured together to create objects of value. An extension of Michael Walzer’s theory of justice to incorporate community goods as a separate ‘sphere’ might also have widespread appeal. Taken together, these arguments constitute a sustained and theoretically ecumenical case for the pro tanto moral objectionability of gentrification. (shrink)

We sley Salmon, in his influential and detailed book, Four Decades of Scientific Explanation, argues that the pragmatic approach to scientific explanation, “construed as the claim that scientific explanation can be explicated entirely in pragmatic terms” (1989, 185) is inadequate. The specific inadequacy ascribed to a pragmatic account is that objective relevance relations cannot be incorporated into such an account. Salmon relies on the arguments given in Kitcher and Salmon (1987) to ground this objection. He also suggests that Peter Railton’s (...) concepts of the ideal explanatory text and explanatory information (Railton 1981) can provide what the pragmatic approach lacks. This suggestion is not a conclusion of course; we read it as the promotion of part of a research program aimed at forging a greater consensus on scientific explanation-an admirable goal. However, we do not see the pragmatic approach as inadequate. We will show that a synthetic account inspired by Salmon’s adaptation of Railton would be equivalent to van Fraassen’s pragmatic account in three respects: accepting or rejecting requests for explanation; the practice of giving scientific explanations; and the evaluation of the goodness of explanations. We include all three under the general rubric of explanatory “practice.” Admittedly these are not the only three features by which an account of explanation might be evaluated. Roughly, we mean to show that a synthetic account cannot do a better job of accounting for the scientific practices which are of importance to the constructive empiricist, and therefore no argument can be presented to the constructive empiricist to convince her that by her own standards the synthetic account is superior. Previous research has focused on the relation between social class and prosocial behavior. However, this relation is yet unclear. In this work, we shed light on this issue by considering the effect of the level of empathy and the social class of the recipient of help on two types of prosociality, namely helping and caring. In one experimental study, we found that for high-class participants, empathy had a positive effect on helping, regardless of the recipient’s social class. However, empathy had (...) no effect for low-class participants. When it comes to caring, empathy had a positive effect for both high and low-class participants, but only when the recipient of help belonged to the same social class. This highlights that empathy by itself is not sufficient to promote cooperative relations and that the social class of the recipient of help should be taken into account to shed light on this issue. Este capítulo se separa en tres momentos: i) tematiza la tarea de la administración de justicia como salvaguardia del derecho; ii) caracteriza la cohesión narrativa de la administración de justicia al interior de la sociedad civil y su tensión con el concepto de Estado y, finalmente, (...) iii) la problemática de la personalización al interior del sistema de leyes y la interpelación de Marx. La hipótesis que aparece, entonces, es que Hegel intenta probar la necesidad de la codificación del derecho en virtud la defensa de la libertad personal y de la propiedad, pero la cual solo es posible mediante el poder o violencia judicial. This paper defends the claim that mere temporal proximity always and without exception strengthens certain moral duties, including the duty to save – call this view Robust Temporalism. Although almost all other moral philosophers dismiss Robust Temporalism out of hand, I argue that it is prima facie intuitively plausible, and that it is analogous to a view about special obligations that many philosophers already accept. I also defend Robust Temporalism against several common objections, and I highlight its relevance to a (...) number of practical policy debates, including longtermism. My conclusion is that Robust Temporalism is a moral live option, that deserves to be taken much more seriously in the future. (shrink)

This essay considers that issue with reference to the contrasts between the philosophies of Descartes and Spinoza, who offered radically different approaches to the conceptualization of human presence in Nature.

This chapter suggests that the state of nature is a continuum notion that lies in a segment along a larger continuum of the scope of private judgment, as does the continuum notion of civil authority. Jean Hampton saw Thomas Hobbes's state of nature as a “presocietal” condition of “isolated asocial individuals,” “stripped of their social connections.” There is plentiful evidence against Hampton's interpretation of the state of nature as an “asocial” condition in Hobbes's insistence across all his political writings that (...) men care deeply about their relative social standing and reputations, and that this is a major source of conflict in a state of nature. A potentially more promising way of understanding the state of nature is as a lawless condition. Societies exhibiting a high degree of consensus among private judgments may be able to tolerate incomplete removal from the mere state of nature, without threat to their stability. (shrink)

In this chapter, we explore the issue of assisted dying for individuals with dementia at the nexus of ethics and law. We set out the basic medical realities of dementia and the available data about the desire for the option of assisted dying in the face of dementia. We then describe law and practice with respect to voluntary euthanasia and assisted suicide in jurisdictions that permit at least some assisted dying. We conclude that, because of the peculiar ways in which (...) some of the features of dementia interact with specific legislative provisions, less access to assisted dying for persons with dementia can be realized through the legislation than might have been intended or expected. We then describe draft assisted dying legislation that is before the federal Parliament of Canada. We conclude that, because of the peculiar ways in which some of the features of dementia interact with specific legislative provisions, more access to assisted dying for persons with dementia would be realized, if the legislation was passed as drafted, than might be intended or expected. This exercise reveals that very careful attention needs to be paid to the features of dementia if drafting assisted dying legislation in order to actually achieve the desired law reform effect (whatever that might be). The interplay of common ethical rationales for permitting assisted dying (e.g., autonomy and alleviation of suffering) with common features of dementia (e.g., loss of competence before the terminal phase of the illness, loss of the capacity to communicate before the loss of the capacity to suffer) raises challenges for translating one’s ethical position on assisted dying for individuals with dementia into law.
