On 26 February 2020, the Federal Constitutional Court of Germany pronounced a judgement that the prohibition of assisted suicide services set out in § 217 of the Criminal Code is void. It thereby reestablished the legal state that had obtained before 2015. Furthermore, it defined the right to die as an autonomy-based right, thereby dissociating the right to take one???s life from states of extreme suffering caused by illness. The judgement implies that one can, in principle, resort to assistance for (...) suicide even in the absence of illness and suffering. In this contribution, I deal with the problems that arise as a consequence of dissociating legitimate assisted suicide from states of illness. I analyze Bettina Schöne-Seifert???s suggestion to regard an understandable (,,nachvollziehbar“) wish to die as a wish that is protected by the right to autonomy. It turns out that the criterion of understandability is deficient: it either commits us to regarding every wish to die as understable or it undermines the anti-paternalistic requirement of respecting the patient???s autonomy. In seinem Buch Pazifismus. Eine Verteidigung verteidigt Olaf Müller einen relativ strikten Pazifismus, der im Ukrainekrieg keine militärische Hilfe an die Ukraine erlaubt ‐ trotz der Anerkennung, dass es sich um einen verbrecherischen Angriffskrieg handelt. Müller kritisiert die beiden üblichen Begründungen für solch eine Position, den gesinnungsethischen und den verantwortungsethischen Pazifismus, und entwickelt seine eigene Version, den pragmatistischen Pazifismus.Der vorliegende Beitrag diskutiert Müllers Pazifismus kritisch und gibt einen Ausblick auf eine bessere ethische Alternative, nämlich die wohlfahrtsethische begrenzte Optimierung. Müllers Anliegen (...) ist zutiefst human. Seine Begründung ist differenziert, aber langwierig, verwickelt und unklar. Ein Teil dieses Beitrags besteht darin, diese Begründung zu rekonstruieren und auf das Wesentliche zu reduzieren, um dann die essentiellen Elemente gezielter kritisch diskutieren zu k??nnen. There is a significant convergence between some contemporary panpsychist theories and idealism. Traditional phenomenal, macro idealism has been widely criticised for its implausible account of physical facts. This paper examines three idealism friendly contemporary panpsychist philosophies and suggests that with some revisions a plausible realist and physical idealism can be articulated. Taking from information-theoretic models of consciousness and metaphysical arguments for the ontological primacy of mind, it is suggested via a Schelling inspired perspective that aspects of consciousness??? intrinsic nature provide (...) a promising approach to the decomposition problem which is currently a significant challenge to pan/cosmopsychist theories. W??hrend Susanne Burri mit meiner Grundthese sympathisiert und mir in deren Rahmen zwei knifflige Probleme vorlegt, die sich konstruktiv bearbeiten lassen, geht Christoph Lumers Kritik ans Eingemachte: Im Rahmen des von ihm bevorzugten philosophischen Ansatzes stellt sich meine Herangehensweise als haltlos dar, weil ihr jede Rationalität abgeht.

The phenomenon of envy has mostly been analyzed as a special form of a subject???s emotion or feeling. However, its rational structure and moral-psychological dimension have rarely been analyzed in detail. In this paper I argue that envy is not only an unpleasant complex emotion but rather a highly interesting attitude and strategy, which consists in finding reasons for denying another person the recognition she actually deserves. Envious people systematically confuse envy with justified moral resentment. This rationalizing denial of recognition (...) is due to a form of rational self-deception by the envious person. I will analyze this strategy of envy in more detail by referring to John Rawls???s conception of justice and Immanuel Kant???s concept of rationalizing. I shall conclude by arguing that envy is characterized by a paradoxical structure, which consists in the fact that we never consciously and willingly envy, so that the speech act “I envy you” implies a performative contradiction. Naturalistic understandings of the mind face certain hurdles. Many authors believe that some such hurdles are even insurmountable. A frequently used but rarely developed and tested argumentative move claims that, because they are made from the so-called observer perspective, naturalization efforts inevitably fail for reasons connected to our first-person perspective. We are not convinced. However, this article primarily attempts to gain a better understanding of the point and scope of this move by discussing an argument by Holm Tetens from which (...) the basic incompleteness of the observer perspective is supposed to follow. Depending on how one interprets the incompleteness in question, one gets different readings of the argument: ontological, semantic, epistemic, or explanatory. First, we will develop two ontological readings of this argument in more detail ‐ mainly because they are the most obvious challenges to naturalism. We will then systematically explore the prospects of the alternative readings. These considerations lead to a more fundamental discussion about the requirements for naturalistic explanations. As it turns out, to defend such an incompleteness argument, you face some inconvenient hurdles yourself. (shrink)

In this paper, I will investigate the problem of transparent white, as is it formulated by Ludwig Wittgenstein in Remarks on Colour. I will do so by gathering transparency requirements from RC paragraphs to develop a clear definition of transparency. The impossibility of a transparent white will be explained by pointing to the fact that white conflicts with such a definition. Furthermore, based on Paul Gilbert's and Jonathan Westphal's discussion of the problem of transparent white, I will investigate the problem (...) of transparent black. Although neither transparent white nor transparent black is possible, the impossibility of each is grounded on conflicts with different elements of the definition of transparency. (shrink)

In his book Meinungsverschiedenheiten (engl.: Disagreement) Marc Andree Weber defends a probability based conception of epistemic peerhood. Starting from this conception he proves the equal weight thesis, which prescribes that one should allocate the same weight to the beliefs of epistemic peers as to one's own beliefs. – In the present article I provide a much shorter proof. For that purpose I first formalize Weber's definition and thesis and I close the argumentative gap between the two of them by making (...) relatively few additions. Toward the end, I will document the differences between Weber's proof and my proof and indicate the relevance of a second proof. No judgmental assessment will be sought. (shrink)

In the present paper, it is shown that Kant in his theory of fine art from the Critique of Aes thetic Judgment proves to be a proponent of aesthetic cognitivism, according to which art is, first, a source of non-trivial knowledge and, second, this knowledge also has aesthetic relevance. This issue has been raised several times in the recent research literature, but has not been substantiated, or only briefly. Central to this is Kant's conception of aesthetic ideas, with which fine (...) art symbolizes intellectual ideas of various genesis and with which his theory of art acquires a content-aesthetic dimension. Discussing recent research literature, an interpretation for the conception of aesthetic ideas and the accompanying expressive dimension of fine art is offered in a first part. Based on this, it will be shown in a second part that Kant hereby proves to be a representative of aesthetic cognitivism; this is shown by the fact that his theory of art confirms both criteria of aesthetic cognitivism. Merleau-Ponty's philosophy of the body is often highlighted primarily for its emphasis on the conscious dimension of embodiment. What tends to be over-looked, however, is Merleau-Ponty's attempt to overcome the threat of a bifurcation of the body that this emphasis brings with it. In view of this, I show how Merleau-Ponty develops his theory of the human being as a mind-body-unity and how he aims to bridge the gap between the bodily and the conscious by way of the notion of (...) being-in-the-world.
