This collection of original essays by leading and emerging scholars in the field examines the history, conditions, organization, and strategies of pro bono lawyering. Private Lawyers and the Public Interest: The Evolving Role of Pro Bono in the Legal Profession traces the rise and impact of the American Bar Association's campaign to hold lawyers accountable for a commitment to public service and to encourage public service within law schools. Combining empirical legal research with reflections by practitioners and theorists about the (...) meaning and practice of pro bono legal work, this collection of essays interrogates the public service ideals that are inscribed within the legal profession and places these ideals within a broader social, economic, ideological, and normative context. Few figures of the Middle Ages command the attention of so many modern disciplines as Robert Grosseteste (c. 1170-1253). Theology, Philosophy, History, and Science are all areas which his life and thought continue to have significance and to inspire re-interpretation. Accompanied by a series of original commentaries, this new edition of Grosseteste's work, with English translation, draws together the perspectives of modern scientists and medieval specialists. Volume I of a six volume series, Knowing and Speaking presents two of the earliest (...) of Grosseteste's works, the treatises On the Liberal Arts and On the Generation of Sounds. These are accompanied by a significant Middle English treatise on the Seven Liberal Arts whose anonymous fifteenth-century author translated and excerpted passages from Grosseteste's treatises in a re-imagining of their structure and function.0Each work is treated separately within the volume, which is constructed in three parts. On the Liberal Arts sets Grosseteste's thoughts on the arts subjects and emphasises moral concerns about the purpose of learning. On the Generation of Sounds builds on the theories and statements of On the Liberal Arts in connection to the production of sound, elaborating the earlier position, relating the generation of sounds to human vocal and speech production. Behavioural evidence suggests that cephalopod molluscs may have a form of primary consciousness. First, the linkage of brain to behaviour seen in lateralization, sleep and through a developmental context is similar to that of mammals and birds. Second, cephalopods, especially octopuses, are heavily dependent on learning in response to both visual and tactile cues, and may have domain generality and form simple concepts. Third, these animals are aware of their position, both within themselves and in larger space, including having a (...) working memory of foraging areas in the recent past. Thus if using a ‘global workspace’ which evaluates memory input and focuses attention is the criterion, cephalopods appear to have primary consciousness. (shrink)

At the University of Sheffield during 2011 and 2012, a leading group of philosophers, psychologists, and others gathered to explore the nature and significance of implicit bias. The two volumes of Implicit Bias and Philosophy emerge from these workshops. Each volume philosophically examines core areas of psychological research on implicit bias as well as the ramifications of implicit bias for core areas of philosophy. Volume I: Metaphysics and Epistemology is comprised of two parts: “The Nature of Implicit Attitudes, Implicit Bias, (...) and Stereotype Threat,” and “Skepticism, Social Knowledge, and Rationality.” The first part contains chapters examining the relationship between implicit attitudes and “dual process” models of the mind; the role of affect in the formation and change of implicit associations; the unity (or disunity) of implicit attitudes; whether implicit biases are mental states at all; and whether performances on stereotype-relevant tasks are automatic and unconscious or intentional and strategic. The second part contains chapters examining implicit bias and skepticism; the effects of implicit bias on scientific research; the accessibility of social stereotypes in epistemic environments; the effects of implicit bias on the self-perception of members of stigmatized social groups as rational agents; the role of gender stereotypes in philosophy; and the role of heuristics in biased reasoning. Sethi (2020) attempts to show that even if we keep Price’s intuition: the claim that having an experience as of an F make us aware of an instance of Fness, we can still block the Argument from Hallucination, and so reject the conclusion that we are aware of mind-dependent rather than mind-independent items when we undergo successful perceptions. In an attempt to demonstrate this, she formulates the Argument from Hallucination so that it relies on the principle that if the existence (...) of a neural state is sufficient for the existence of a property-instance, that property-instance is mind-dependent. I show how to reformulate the argument to avoid reliance on this, thus demonstrating against Sethi that it is possible to argue from acceptance of Price’s intuition to the claim that the items we’re directly aware of in the successful perceptual case are mind-dependent. Previous findings indicate that negative arousal enhances bottom-up attention biases favouring perceptual salient stimuli over less salient stimuli. The current study tests whether those effects were driven by emotional arousal or by negative valence by comparing how well participants could identify visually presented letters after hearing either a negative arousing, positive arousing or neutral sound. On each trial, some letters were presented in a high contrast font and some in a low contrast font, creating a set of targets that differed (...) in perceptual salience. Sounds rated as more emotionally arousing led to more identification of highly salient letters but not of less salient letters, whereas sounds’ valence ratings did not impact salience biases. Thus, arousal, rather than valence, is a key factor enhancing visual processing of perceptually salient targets. (shrink)

Timely and practical, this book should be required reading for law students as well as students and scholars of law and society.

In this dissertation, I argue that no account of propositional attitude reporting which does not include a significant degree of context-sensitivity can succeed in accommodating our intuitions about the truth conditions of such reports. Next, I argue that there are two general problems to be faced by any context-sensitive theory of attitude ascription, whether semantic or pragmatic. First, any theory which preserves our intuitions about which inference schemas are valid will violate our intuitions about truth conditions of particular attitude reports. (...) Second, all theories which depend upon speaker intentions and audience interests to supply the contextually-determined element will yield incorrect truth conditions for what attitude reports convey . I propose an alternative source for contextually-supplied elements: speaker dispositions. Speaker dispositions, I argue, succeed in securing the right truth conditions for the cases that speaker intentions could not handle. However, I suggest, they also point to a very different way of thinking about the way that communication takes place. (shrink)

This book is devoted to the welfare of invertebrates, which make up 99% of animal species on earth. Addressing animal welfare, we do not often think of invertebrates; in fact we seldom consider them to be deserving of welfare evaluation. And yet we should. Welfare is a broad concern for any animal that we house, control or utilize – and we utilize invertebrates a lot. The Authors start with an emphasis on the values of non-vertebrate animals and discuss the need (...) for a book on the present topic. The following chapters focus on specific taxa, tackling questions that are most appropriate to each one. What is pain in crustaceans, and how might we prevent it? How do we ensure that octopuses are not bored? What do bees need to thrive, pollinate our plants and give us honey? Since invertebrates have distinct personalities and some social animals have group personalities, how do we consider this? And, as in the European Union’s application of welfare consideration to cephalopods, how do the practical regulatory issues play out? We have previously relegated invertebrates to the category ‘things’ and did not worry about their treatment. New research suggest that some invertebrates such as cephalopods and crustaceans can have pain and suffering, might also have consciousness and awareness. Also, good welfare is going to mean different things to spiders, bees, corals, etc. This book is taking animal welfare in a very different direction. Academics and students of animal welfare science, those who keep invertebrates for scientific research or in service to the goals of humans, as well as philosophers will find this work thought-provoking, instructive and informative. What mechanism implements the mutual exclusivity bias to map novel labels to objects without names? Prominent theoretical accounts of mutual exclusivity (e.g., Markman, 1989, 1990) propose that infants are guided by their knowledge of object names. However, the mutual exclusivity constraint could be implemented via monitoring of object novelty (see Merriman, Marazita, & Jarvis, 1995). We sought to discriminate between these contrasting explanations across two preferential looking experiments with 22-month-olds. In Experiment 1, infants viewed three objects: one name-known, two name-unknown. (...) Of the two name-unknown objects, one was novel, and the other had been previously familiarized. The infants responded to hearing a novel label by increasing attention only to the novel, name-unknown object. In a second experiment in which the name-known object was absent, a novel label increased infants’ attention to a novel object beyond baseline preference for novelty. The experiments provide clear evidence for a novelty-based mechanism. However, differences in the time course of disambiguation across experiments suggest that novelty processing may be influenced by contextual factors. (shrink)

Kensinger (2009) and Mather (2007) both argue that intrinsic features of emotional items are remembered better than intrinsic features of non-emotional items. However, Kensinger attributes these effects to negative valence whereas Mather attributes them to arousal. In this paper, we note several reasons why arousal may be the driving factor even when a study reveals more detailed memory for negative items than for positive items. We also reanalyze previous data (Mather & Nesmith, 2008) to show that although (...) both arousal and negative valence were correlated with memory accuracy, enhanced memory accuracy was accounted for by arousal rather than valence. Sider’s Writing the Book of the World gives an account of fundamentality in terms of his central ideological notion ‘structure’. Here I first argue against Sider’s claim that to be fundamental to a degree is to be structural to a degree. I argue there’s a pair of properties, P1 and P2, such that P1 is the more fundamental, but Sider is committed to counting P2 as the more structural. I then argue that if relative structure and relative fundamentality can come (...) apart in this way, then Sider is likely also wrong to identify being absolutely structural with being absolutely fundamental. A long-standing theme in discussion of perception and thought has been that our primary cognitive contact with individual objects and events in the world derives from our perceptual contact with them. When I look at a duck in front of me, I am not merely presented with the fact that there is at least one duck in the area, rather I seem to be presented withthisthing (as one might put it from my perspective) in front of me, which looks to (...) me to be a duck. Furthermore, such a perception would seem to put me in a position not merely to make the existential judgment that there is some duck or other present, but rather to make a singular, demonstrative judgment, that that is a duck. My grounds for an existential judgment in this case derives from my apprehension of the demonstrative thought and not vice versa. (shrink)

Across a series of four experiments with 3- to 4-year-olds we demonstrate how cognitive mechanisms supporting noun learning extend to the mapping of actions to objects. In Experiment 1 the demonstration of a novel action led children to select a novel, rather than a familiar object. In Experiment 2 children exhibited long-term retention of novel action-object mappings and extended these actions to other category members. In Experiment 3 we showed that children formed an accurate sensorimotor record of the novel action. (...) In Experiment 4 we demonstrate limits on the types of actions mapped to novel objects. Overall these data suggest that certain aspects of noun mapping share common processing with action mapping and support a domain-general account of word learning. (shrink)

Our paper contributes to Science, Technology and Society scholarship on the practices and technologies of containment. We build on existing work in STS that has analyzed containment as a performative sociotechnical system that generates and sustains new realities, new systems, and new relationships. Our contribution draws from the problem of containment in salmon aquaculture. The stakes for containing salmon are very high. Farmed salmon escapes are environmentally damaging to ecosystems and wild salmon populations, and they put additional pressure on an (...) industry that has a very poor environmental record. We consider in detail Newfoundland and Labrador’s “Code of Containment” that works to keep farmed salmon in cages and prevent them from escaping into the wild. Through our analysis of the Code, we argue that containment is not only about holding inside. It is also about holding together, an obsolete meaning of the term “to contain.” We add to STS scholarship by arguing that containment and its associated Code in Newfoundland holds together a large scale, industrial aquaculture sector that tolerates persistent farmed salmon escapes into the wild from ocean-based cages. We conclude by examining the broader implications of our analysis for STS scholarship on the practices and technologies of containment. (shrink)

This book defends antitheodicism, arguing that theodicies, seeking to excuse God for evil and suffering in the world, fail to ethically acknowledge the victims of suffering. The authors argue for this view using literary and philosophical resources, commencing with Immanuel Kant's 1791 "Theodicy Essay" and its reading of the Book of Job. Three important twentieth century antitheodicist positions are explored, including "Jewish" post-Holocaust ethical antitheodicism, Wittgensteinian antitheodicism exemplified by D.Z. Phillips and pragmatist antitheodicism defended by William James. The authors argue (...) that these approaches to evil and suffering are fundamentally Kantian. Literary works such as Franz Kafka'sThe Trial, Samuel Beckett's Waiting for Godot, and George Orwell's Nineteen Eighty-Four, are examined in order to crucially advance the philosophical case for antitheodicism. Widespread unethical corporate misconduct in an industry triggers industry-wide crises. This research investigates how industry misconduct affects consumers’ trust in the industry, by incorporating insights from a micro-level psychological aspect of institutions. The conceptual framework proposes that consumer legitimacy judgement lies at the core of industry trust, following an industry-wide crisis. The results demonstrate that perception of normalisation of misconduct affects industry trust through consumer legitimacy judgement. Moreover, the PNM-CLJ-industry trust relationship is stronger during industry-wide crises compared with crises that (...) involve only one firm, and this relationship is not dependent on the frequency of crises. This research contributes to the knowledge of product-harm crisis by deepening understanding of the trust erosion mechanism during industry-wide crises, with a focus on legitimacy judgement. The findings have implications for prevention of industry-wide crises and for boosting ethically desirable business activities. (shrink)
