European political theorists have argued that contemporary imaginaries of climate change are symptomatic of a post-political condition. My aim in this essay is to consider what this analysis might mean for a feminist green politics and how those who believe in such a project might respond. Whereas much of the gender-focused scholarship on climate change is concerned with questions of differentiated vulnerabilities and gendered divisions of responsibility and risk, I want to interrogate the strategic, epistemological, and normative implications for ecological (...) feminism of a dominant, neoliberal climate change narrative that arguably has no political subject, casts Nature as a threat to be endured, and that replaces democratic public debate with expert administration and individual behavior change. What hope is there for counter-hegemonic political theories and social movements in times like these? I suggest that rather than give in and get on the crowded climate change bandwagon, an alternative response is to pursue a project of feminist ecological citizenship that blends resistance to hegemonic neoliberal discourses with a specifically feminist commitment to reclaiming democratic debate about social-environmental futures. This paper offers two possible readings of the Earth Charter that are informed by current scholarship in the field of environmental politics. The first reading finds much in the document to suggest congruence with emerging discourses of cosmopolitanism and global environmental citizenship. The second reading, a more sceptical one, identifies aspects of the Earth Charter that seem more resonant with depoliticizing United Nations-style light green globalism than with an inclusive ethical vision of environmentalism. After setting out these two readings, I (...) argue that, although potentially undermining of its endorsability, thinking critically about problematic aspects of the Earth Charter is an exercise that may point in the direction of a cosmopolitan environmentalism that is less banal and instrumental and more dialogically open, reflexive, and democratic. Brent Kious has recently attacked several arguments generally adduced to support anti-doping in sports, which are widely supported by the sports medicine fraternity, international sports federations, and international governments. We show that his attack does not succeed for a variety of reasons. First, it uses an overly inclusive definition of doping at odds with the WADA definition, which has global, if somewhat contentious, currency. Second, it seriously misconstrues the position it attacks, rendering the attack without force against a more balanced (...) construal of an anti-doping position. Third, it makes unwarranted appeals to matters Kious considers morally ‘clear’, while simultaneously attacking a position many others take to be equally morally ‘clear’, namely that of anti-doping. Such an inconsistency, attacking and appealing to the moral status quo as befits one’s argument, is not acceptable without further qualification. Fourth, his position suffers from a general methodological flaw of over-reliance upon argumentation by analogy. Moreover, it is argued that the analogies, being poorly selected and developed, fail to justify his conclusion that the anti-doping lobby lacks philosophical and moral authority for its stance. These issues are symptomatic of a more fundamental problem: any attempt at providing a blanket solution to the question of whether doping is morally acceptable or not is bound to run up against problems when applied to highly specific contexts. Thus, rather than reaching any particular conclusion for or against doping products or processes in this article, we conclude that an increased context-sensitivity will result in a more evenhanded appraisal of arguments on the matter. Over the past decade, a number of accounting and financial reporting frauds have led to lost stock wealth, destroyed public trust, and a worldwide recession that called for necessary reform. Regulatory responses and systemic reforms quickly followed, and we show that, while necessary, these reforms are insufficient. The purpose of this paper is to forward virtuous professionalism as a necessary path toward restoring financial reporting systems. We take the position of external observer and analyze the accounting profession over time to (...) assess what has transpired within our financial reporting systems. Our analysis reveals that the combined influence of commercialism and regulatory response has led to a systemic decline in accounting’s professional ideals and, as a result, an erosion of public trust. We then propose virtuous professionalism as a necessary process for restoring financial reporting systems based on sociological, professional, and philosophical theories. We argue that virtuous professionalism is necessary for restoring the public servant identity of the accounting professional. We conclude that efforts to restore financial reporting systems should begin with reforms that restore professional identity shaped by virtues. (shrink)

Recent discussions among lawyers, philosophers, policy researchers and athletes have focused on the potential threat to privacy posed by the World Anti-Doping Agency’s (WADA) whereabouts requirements. These requirements demand, among other things, that all elite athletes file their whereabouts information for the subsequent quarter on a quarterly basis and comprise data for one hour of each day when the athlete will be available and accessible for no advance notice testing at a specified location of their choosing. Failure to file one’s (...) whereabouts, or the non-availability for testing at said location on three occasions within any 18-month period constitutes an anti-doping rule violation that is equivalent to testing positive to a banned substance, and may lead to a suspension of the athlete for a time period of between one and two years. We critically explore the extent to which WADA’s whereabouts requirements are in tension with existing legislation on privacy, with respect to UK athletes, who are simultaneously protected by UK domestic and EU law. Both UK domestic and EU law are subject to the European Convention on Human Rights (ECHR) Article 8, which establishes a right to “respect for private and family life, home and correspondence”. We critically discuss the centrality of the whereabouts requirements in relation to WADA’s aims, and the adoption and implementation of its whereabouts rules. We conclude that as WADA’s whereabouts requirements appear to be in breach of an elite athlete’s rights under European workers’ rights, health & safety and data protection law they are also, therefore, in conflict with Article 8 of the ECHR and the UK Human Rights Act 1998. We call for specific amendments that cater for the exceptional case of elite sports labour if the WADA requirements are to be considered legitimate. (shrink)

We discuss how the approach taken by regulators to address financial reporting issues has a significant influence on tone at the top. While tone must ultimately be established internally, regulators are more likely to have a positive impact on the quality of financial reporting by addressing organizational tone. A strong tone at the top should ensure that the financial reports are characterized by greater transparency and complete disclosures, and a regulator’s response will depend upon their perspective as to what motivates (...) management. A compliance-based approach, rooted in agency theory’s assumption that managers act in their own best interests, seeks to mandate desirable behavior through elevated monitoring and reduced managerial discretion. Alternatively, an empowerment-based approach rooted in stewardship theory views managers as trustworthy guardians and grants them greater discretion without burdensome external monitoring. In practice, regulations fall on a continuum between these two approaches. To illustrate the continuum between compliance and empowerment, we present three cases in financial and tax reporting and examine the outcomes of these recent regulatory responses. We then provide conclusions regarding the effectiveness of each regulation by considering how tone was influenced within organizations. (shrink)

Whistle blowing programs have been central to numerous government, legislative, and regulatory reform efforts in recent years. To protect investors, corporate boards have instituted numerous measures to promote whistle blowing. Despite significant whistle blowing incentives, few individuals blow the whistle when presented with the opportunity. Instead, individuals often remain fallaciously silent and, in essence, become passive fraudsters themselves. Using the fraud triangle and models of moral behavior, we model and analyze fallacious silence and identify factors that may motivate an individual (...) to rationalize fallacious silence. We use a survey of graduate accounting students to test hypothesized factors that contribute to fallacious silence rationalizations in an academic setting. We find evidence that the ability to rationalize fallacious silence is related to community influences and personal traits such as awareness and moral competence. (shrink)

Bertolt Brecht’s poem “A Worker’s Speech to a Doctor” is frequently cited as a means to raise awareness among health workers of the health effects of living and working conditions. Less cited is his Call to Arms trilogy of poems, which calls for class-based action to transform the capitalist economic system that sickens and kills so many. In this article, we show how “A Worker’s Speech to a Doctor,” with its plea for empathy for the ill, contrasts with the more (...) activist and often militant tone of the Call to Arms trilogy: “Call to a Sick Communist,” “The Sick Communist’s Answer to the Comrades,” and “Call to the Doctors and Nurses.” We also show that, while “A Worker’s Speech to a Doctor” has been applied in the training of health workers, its accusatorial tone towards health workers’ complicity in the system the poem is critiquing risks alienating such workers. In contrast, the Call to Arms trilogy seeks common ground, inviting these same workers into the broader political and social fight against injustice. While we contend that the description of the sick worker as a “Communist” risks estranging these health workers, our analysis of the Call to Arms poems nevertheless indicates that their use can contribute to moving health workers’ educational discourse beyond a laudable but fleeting elicitation of empathy for the ill towards a structural critique and deeper systemic understanding in order to prompt action by health workers to reform or even replace the capitalist economic system that sickens and kills so many. Abstract:Despite a growing body of advocacy for the beneficial effects of music education upon individuals’ development and wellbeing, lived experiences in the music classroom are testament to a diversity of both positive and negative musical encounters. For some pupils, classroom music-making is characterized by opportunities, achievements, and friendships. But for others it is redolent of shortcomings, disappointments, and conflicts. This reveals an urgent need for researchers and practitioners to acknowledge pupils’ “musical vulnerability”: their inherent and situational openness to being affected (...) by the semantic and somatic properties of music. In this essay, I offer a detailed conceptualization of musical vulnerability and its place in music education. I outline Judith Butler’s seminal theory of linguistic vulnerability and evaluate how her conviction that language can cause hurt and harm may help redress the simplistic coupling of music and wellbeing lauded by music education advocacy. Drawing upon feminist vulnerability studies, I then reflect upon the distinctive experiences of inherent, situational, and pathogenic musical vulnerabilities in the classroom, and their relation to institutional, interpersonal, and individual responses to music’s particular semantic and somatic properties. I conclude by proposing how the conceptualization of musical vulnerability could transform music education through cultivating a renewed ethic of care. (shrink)

The Musical Emotion Discrimination Task (MEDT) is a short, non-adaptive test of the ability to discriminate emotions in music. Test-takers hear two performances of the same melody, both played by the same performer but each trying to communicate a different basic emotion, and are asked to determine which one is “happier”, for example. The goal of the current study was to construct a new version of the MEDT using a larger set of shorter, more diverse music clips and an adaptive (...) framework to expand the ability range for which the test can deliver measurements. The first study analysed responses from a large sample of participants (N = 624) to determine how musical features contributed to item difficulty, which resulted in a quantitative model of musical emotion discrimination ability rooted in Item Response Theory (IRT). This model informed the construction of the adaptive MEDT. A second study contributed preliminary evidence for the validity and reliability of the adaptive MEDT, and demonstrated that the new version of the test is suitable for a wider range of abilities. This paper therefore presents the first adaptive musical emotion discrimination test, a new resource for investigating emotion processing which is freely available for research use. (shrink)

Since the fiends who concoct these puzzles have carefully avoided passages likely to turn up in anthologies, having, in fact, ransacked their authors’ lesser-known works for texts innocent of such clues as proper names, dates, or allusions to historical events, the reader unwise enough to take a hand in the game has to rely on indications of the personality of the author.Not, obviously, the historical, biographical personality, but the literary personality: the characteristic attitudes and concerns, the rhythms, tones, and levels of discourse, the literary individuality that enables us to distinguish a paragraph of Jane Austen from one of Henry James, and either of them from one of Ernest Hemingway, or the epic blank verse of Milton from that of Keats or Tennyson.
