As we become technically more adept at detaching elements of human bodies and making use of them for others, it seems as if more and more things-from motherhood to gametes to kidneys to our very DNA-can be borrowed, rented, bought, and sold. Other (...) technology allows us unprecedented influence over the characteristics of our offspring (unprecedented, that is, if we ignore the many cultures in which children were and are routinely discarded because they are the wrong sex, disabled, or the product of multiple births). It is common, for example, for writers to worry that the availability of pre-implantation genetic diagnosis will seduce parents into thinking of their children as commodities, to be ordered in much the same way as automobiles, with the inevitable concomitant that they will want to "return" children who do not measure up to their specifications.Unfortunately, a great deal of the talk about "commodification" has been clumsy and sloppy. The term has been used as a magic bullet, as if saying "But that's commodification!" is the same as having made an argument. In fact, commodification of human persons, human bodies, human labor, human relationships, is a complex matter. In many human dealings, commodified and noncommodified understandings of the same thing, or the same transaction, exist more or less comfortably together. Most Westerners condemn commercial sex, for example, while at the same time knowing that in most times and places in the world, marriage was and is thought of as primarily an economic relationship. The common use of "cheap" in post-World War II American slang to describe a teenage woman who is more sexually available than her peers perfectly captures the market rhetoric inherent in respectable American sexual mores.Given this complexity, it is not surprising that many writers in bioethics have gravitated to the work of Margaret Jane Radin. In her two books, Contested Commodities (Harvard University Press, 1996) and Reinterpreting Property (University of Chicago Press, 1993), and many articles, [End Page 219] Radin has taken on the problem of commodification without falling into either sentimentality or cynicism. She is a careful thinker and a careful (and demanding!) writer. We have long valued her work as we have sought to grapple with the many ways in which the problem of commodification arises in bioethics. In this issue of the Kennedy Institute of Ethics Journal, entitled "Who's Afraid of Commodification?," we have asked three colleagues to join us in reflecting on aspects of the problem of commodification in bioethics. We are especially delighted that Radin agreed to respond to our efforts in this direction.Lisa Sowle Cahill takes the discussion of commodification to a new level, as she focuses on global ethics, especially genetic research and the marketing and accessibility of pharmaceuticals. Dena S. Davis explores the debates over refusal of treatment and rational suicide and concludes that to put a value on particular pieces of one's lifespan does not necessarily lead to negative aspects of commodification. Ronald M. Green analyzes Radin's use of Kant. Suzanne Holland addresses commodification of body parts, from gametes to cadaveric tissue, and concludes with some specific recommendations. Thomas A. Shannon takes a fresh look at the problem of whether we should allow the sale of organs; he shares with Holland a special concern for the rhetoric of commodification. Elaborating decolonial and intersectional methods, aesthetics has developed rich tools for tackling power differences. A philosophical question arises about the nature of gendered embodied experience and materiality: How to comprehend the cultural field if it is at once a site of heinous expropriation and violence and one of vital social and political possibility? This essay explores this question through a reading of Claudia Llosa's film The Milk of Sorrow ( La teta asustada ) (2009). The film, we show, reworks racial, (...) gendered, and colonial logics and supplants a model of transculturation, magical realism, and syncretism and its attendant figuration of resistance by a cultural vision of a web of multivalent, pluri-directional aesthetic promises and threats. Thus it presents a young Indigenous woman as a contemporary decolonial actor who, in encounter with popular culture and the global marketplace, renders memory livable and opens up unforeseen futures for her young town and country. We signal the implications for the positioning of the decolonial feminist spectator or culture maker and for a decolonial aesthetics. Aesthetic existence at the intersection of oppression and liberation, although impure and troubled, functions as a bountiful font of feminist energy and sustenance and a site of communal caring and imagination. The point of Pragmatic Bioethics is to view bioethics through the lens of American pragmatism. The book is in three parts. The papers in part one look at the “pragmatic method” and bioethics in general; those in part two are intended to suggest that bioethical debates can be informed by parts of the canon of classical American pragmatism; those in part three apply aspects of pragmatism to specific bioethical issues more overtly. This structure is odd in two related respects: the (...) difference between the papers in parts two and three is unclear, and papers dealing in similar ways with similar bioethical issues are placed in each of these parts.My view of how philosophy does, and should, apply to bioethics is at odds with that implied by Pragmatic Bioethics. I think bioethics can be informed by philosophy in two ways. Firstly, specific bioethical problems can be elucidated by substantive philosophical data . Secondly, and more pervasively, bioethics would benefit from acquiring certain intellectual habits distinctive of philosophy . The different view taken in this book is that bioethics might look to the methodology implied by American pragmatism, and specific bioethical issues might be addressed by reference to American pragmatist writings. Situational strength is considered one of the most important situational forces at work because it can attenuate the personality–performance relationship. Although organizational scholars have studied the consequences of situational strength, they have paid little attention to its antecedents. To address this gap, the current study focused on situational strength cues from different social sources as antecedents of overall situational strength at work. Specifically, we examined how employees combine situational strength cues emanating from three social sources (i.e., coworkers, the immediate supervisor, (...) and top management). Based on field theory, we hypothesized that the effect of situational strength from coworkers and immediate supervisors (i.e., proximal sources of situational strength) on employees’ perceptions of overall situational strength on the job would be greater than the effect of situational strength from the top management (i.e., the distal source of situational strength). We also hypothesized that the effect of situational strength from the distal source would be mediated by the effects of situational strength from the proximal sources. Data from 363 full-time employees were collected at two time points with a cross-lagged panel design. The first hypothesis was supported for one of the two situational strength facets studied. This article is a reflection on the use of case study material in the teaching of ethics to nursing students. Given the main aims of a course in ethics for nurses and the limited effectiveness of formal moral theory, it seems inevitable that the mainstay of nursing ethics courses will continue to be case study material. This approach has recently been criticized on a number of grounds. The author suggests here that disquiet over teaching ethics in this way should motivate (...) a concern not with whether, but how, teaching by cases is to be undertaken. (shrink)

It is sometimes held that rules of inference determine the meaning of the logical constants: the meaning of, say, conjunction is fully determined by either its introduction or its elimination rules, or both; similarly for the other connectives. In a recent paper, Panu Raatikainen argues that this view—call it logical inferentialism—is undermined by some “very little known” considerations by Carnap (1943) to the effect that “in a definite sense, it is not true that the standard rules of inference” themselves suffice (...) to “determine the meanings of [the] logical constants” (p. 2). In a nutshell, Carnap showed that the rules allow for non-normal interpretations of negation and disjunction. Raatikainen concludes that “no ordinary formalization of logic [... ] is sufficient to ‘fully formalize’ all the essential properties of the logical constants” (ibid.). We suggest that this is a mistake. Pace Raatikainen, intuitionists like Dummett and Prawitz need not worry about Carnap’s problem. And although bilateral solutions for classical inferentialists—as proposed by Timothy Smiley and Ian Rumfitt—seem inadequate, it is not excluded that classical inferentialists may be in a position to address the problem too. I don't think the statement was meant to imply anything about the patient; if anything, it may have been included for context to prepare me for (...) the patient's intermittent absence. But, reading this, I felt a familiar sense of annoyance rising in my chest. Every few months, I take care of a patient who seems to never be in his room. The patient is consistently out smoking, in the cafeteria, or in another unknown location, seemingly doing an undisclosed activity. This is frustrating because it means I have to work around the patient's schedule of smoke breaks and jaunts to the cafeteria to evaluate the patient on a daily basis. The thoughts inevitably cross my mind: Does this patient even want care in the hospital if he's never in his room? Is he actually sick enough to need to be in the hospital if he's able to spend so much time outside of the hospital? Why is he leaving so frequently—is he doing drugs?This particular patient had been in perfect health until two months before I met him when he was shot multiple times during an encounter at a gas station. One of the bullets had lodged in his back, shattering a vertebra. Another had decimated the bones in his right upper arm, which were now held in place by screws and plates. Several had landed in his abdomen, necessitating the removal of part of his bowel. Finally, a bullet had sliced through the lower part of his right kidney, shredding his ureter and mandating surgical reconstruction of his urinary system. After over a month in the intensive care unit with multiple reparative surgeries, he was discharged to a rehabilitation facility. But he started having fevers and fast heart rates; ultimately, he was admitted to the hospital again for multiple infected fluid collections that had formed at the sites of his surgeries. He left the hospital prior to getting treated for these infections, purportedly "against medical [End Page 12] advice." And now, several weeks later, he was here in the hospital for the same reason.The first time I went to see Mr. H, he was, of course, not in his room. I went to the nursing station to ask if the clerk knew where he was. She knowingly said, "Oh yeah, he goes out a lot. I can give him a call to let him know the doctor is here to see him if you'd like." I assented, thanked the clerk for calling him, and proceeded, annoyed, in seeing the rest of my patients. I considered how I would address Mr. H's behavior when I was finally able to talk to him. I had seen others take many different approaches—negotiation about the timing and frequency of these extramural expeditions, ultimatums about getting discharged, mandating urine drug screens upon return, and silent, frustrated tolerance. I resolved to wait to speak to him to determine which approach might be most suitable. An hour later, I received a call from the clerk that Mr. H had returned to his room to see me.The first time I met Mr. H, he informed me he had taken the bus to midtown to make a run to the grocery store. I was internally incredulous. He felt well enough to go to the grocery store? Why was he in the hospital then? At that moment, I opted not to discuss his frequent departures yet, as I was frustrated and realized I wouldn't be able to identify the best way to address them. The phrase 'beyond historicism' is usually associated with Bielefeld historians like Hans Ulrich Wehler and Jürgen Kocka, who attempted to turn the study of history into a social science, but a better candidate would be the sociologist Niklas Luhmann, who happened to teach as well in Bielefeld during the 1970's and 1980's. Luhmann had little affinity with the project of his colleagues from the history department. He took the opposite view that the social sciences suffered from a naive enlightenment view (...) and should become more history minded. Like the historicists of the early nineteenth century Luhmann was indirectly inspired by the philosophy of Leibniz. Although Luhmann's theory of social systems may seem miles away from the daily interests of most historians, it can be interpreted as an Aufhebung of historicism. This will be demonstrated for two important concepts, the autopoietic system which incorporates the historicist notion of individuality and the concept of second order observation which can be read as an abstract redescription of what historicists meant by the historical method. Hermann Cohen (1842-1918) was a leading figure in the Neo- Kantian philosophical movement that dominated European thought before 1918. He was also an inaugural figure in modern Jewish philosophy in the twentieth and twenty-first centuries. This book explores Cohen's striking claim that ethics is rooted in law - a claim developed both in his philosophical ethics and his philosophy of Judaism, in particular in his writings on "love-of-neighbor," up to and including his well-known Religion of Reason. Dana Hollander proposes that (...) neither Cohen's systematic philosophy nor his "Jewish" philosophy should be seen as the dominant framework for his oeuvre as a whole, but that his understanding of key philosophical questions take shape in the passages between both corpuses, a trait that could be seen as paradigmatic for modern Jewish philosophy. Ethics Out of Law taps into one of the prime topics of current interest in the field of Jewish philosophy: the nature of Jewish political existence and the changing configurations of "law" that this entails. Adopting a view of utilitarian ethics in which motivation in the public interest takes on greater weight than is generally appreciated, this book explores the extent to which the philosophy of Immanuel Kant is consistent with this nuanced version of utilitarianism. Kant's requirement that full ethical merit needs an agent to act purely 'from duty' to forward 'the universal end of happiness' rather than from a personal inclination to achieve that end clearly distinguishes his position from the version of utilitarian (...) ethics adopted here. But this book also argues that Kant's approval of a secondary category of conduct - conduct 'in conformity with' duty - entailing other-regarding or 'sympathetic' motivation to advance general happiness, differs from the utilitarian position only in its meriting a qualified degree of ethical credit. After comparing Kant's position with those of eighteenth-century utilitarian writers from Locke to Bentham, the book evaluates reactions to Kant by J.S. Mill and Karl Marx and proposes Michel de Montaigne (1533-1592) as a 'precursor' for maintaining a 'Kantian' doctrine of conduct 'from duty' and for other shared features. In terms of public policy, the work demonstrates Kant's justification of poor relief and reduced inequality, his proposal for a state education plan, and his opposition to paternalism. This book provides essential reading for academic specialists and students concerned with the interface of political economy and ethics, as well as the history of economic thought, political economy, history of ethics, history of political thought and intellectual history. The eight pieces constituting this Meeting Report are summaries of presentations made during a panel session at the 2011 Association for Practical and Professional Ethics (APPE) annual meeting held between March 3rd and 6th in Cincinnati. Lisa Newton organized the session and served as chair. The panel of eight consisted both of pioneers in the field and more recent arrivals. It covered a range of topics from how the field has developed to where it should be going, from identification of (...) issues needing further study to problems of training the next generation of engineers and engineering-ethics scholars. This article considers Hugo Grotius’s ideas on a specific topic of commercial law, analysing his position and potential contributions to early modern Dutch insolvency legislation. It might be questioned how ‘Hollandic’ Grotius’s interpretations of legal solutions for insolvency as presented in the Inleidinge tot de Hollandsche Rechts-Geleerdheid actually were. Grotius’s treatment of cessie van goede is relatively strict, whereas compositions are hardly mentioned. A rather different image rises from his later work. Here, Grotius displays a more radical view, in specific (...) cases allowing the sovereign to interfere in private property rights and to restructure debts for the common good. It is an intriguing question if and to what extent these ideas can be related to contemporary Dutch insolvency practices. (shrink)

Christopher Cherry's article in the January 1973 issue of this journal has on its first page the sentence ‘And when a philosopher writes that “no clear idea is available to us of what moral scepticism amounts to”, that moral scepticism would, if it were possible at all, have to be a “specially cooked-up affair” by contrast with other varieties of scepticism, it is hard not to accuse him of just such a vice.’ He means the vice of disingenuousness and the (...) person to whom he attributes it is me. I did not write what he says I wrote and neither of his quotations is accurate. On the next page Cherry claims again to be summarizing a view of mine when he says that ‘An “intellectual moral scepticism” would, if it were anything, have to be a peculiarly cooked-up affair, and so by implication different from other forms of intellectual philosophical scepticism. The destruction of the temple in Jerusalem by the Romans in AD 70 was an unquestionably traumatic event in the history of the Jewish people. By all accounts it was a social, political, and theological disaster. As such, contemporary Jewish figures wrestled with the meaning of the event. This article analyses the efforts by two figures in this internal Jewish dialogue to provide this meaning, namely, the historian Josephus and Jesus of Nazareth. We will see that in both cases the (...) meaning of the destruction was rooted in the firm conviction of the God of Israel’s existence and his self-revelation in Scripture. The temple was destroyed not apart from God or in spite of God, but in full accordance with his will. This will, moreover, was judged to be accessible through Scripture, both in terms of its prophetic value and its establishment of a metanarrative – redemptive history – that provided a framework for historical events. In addition, the reason for the destruction was judged by both to be the sins of (certain) people. The major difference between them lay rather in the question of which sins exactly were judged to be responsible. (shrink)

When sharing a task with another person that requires turn taking, as in doubles games of table tennis, performance on the shared task is similar to performing the whole task alone. This has been taken to indicate that humans co-represent their partner’s task share, as if it were their own. Task co-representation allows prediction of the other’s responses when it is the other’s turn, and leads to response conflict in joint interference tasks. However, data from our lab cast doubt on (...) the view that task co-representation and resulting response conflict are the only or even primary source of effects observed in task sharing. Recent findings furthermore suggest another potential source of interference in joint task performance that has been neglected so far: Self-other discrimination and conflict related to agent identification (i.e., determining whether it is “my” or the other’s turn). Based on these findings we propose that participants might not always co-represent what their partner is supposed to do, but instead co-represent that another agent is responsible for part of the task, and when it is his turn. We call this account the actor co-representation account. (shrink)

Jakob von Uexküll’s (1864-1944) account of Umwelt has been proposed as a mediating concept to bridge the gap between ecological psychology’s realism about environmental information and enactivism’s emphasis on the organism’s active role in constructing the meaningful world it inhabits. If successful, this move would constitute a significant step towards establishing a single ecological-enactive framework for cognitive science. However, Uexküll’s thought itself contains different perspectives that are in tension with each other, and the concept of Umwelt is developed in representationalist (...) terms that conflict with the commitments of both enactivism and ecological psychology. One central issue shared by all these approaches is the problem of how a living being experiences its environment. In this paper, we will look at Uexküll’s reception in French philosophy and highlight the different ways in which the concept of Umwelt functions in the work of Georges Canguilhem, Maurice Merleau-Ponty, and Gilles Deleuze. This analysis helps clarify different aspects of Uexküll’s thought and the deeper philosophical implications of importing his concepts into embodied cognitive science. This paper is part of a recent trend in which enactivism engages with continental philosophy in a way that both deepens and transcends the traditional links to phenomenology, including most recently the thought of Georg W. F. Hegel and Gilbert Simondon. However, no more than a brief outline and introduction to the potentials and challenges of this complex conceptual intersection can be given here. Our hope is that it serves to make more explicit the philosophical issues that are at stake for cognitive science in the question of experienced environments, while charting a useful course for future research. It is argued that awareness of the distinction between dynamical and variational symmetries is crucial to understanding the significance of Noether's 1918 work. Specific attention is paid, by way of a number of striking examples, to Noether's first theorem, which establishes a correlation between dynamical symmetries and conservation principles.
