Different ideas of the normative relevance of autonomy can give rise to profoundly different action-guiding principles in healthcare. If autonomy is seen as a value rather than as a right, it can be argued that patients’ decisions should sometimes be overruled in order to protect or promote their own autonomy. We refer to this as paternalism in the name of autonomy. In this paper, we discuss different elements of autonomy (decision-making capacity, efficiency, and authenticity) and arguments in favor of paternalism (...) for the sake of autonomy that have been proposed in the bioethical debate. We argue that if autonomy is valuable, then paternalism for the sake of autonomy may be justified. However, policies allowing paternalism in the name of autonomy may be self-defeating. (shrink)

BackgroundInvoluntary treatment is a key issue in healthcare ethics. In this study, ethical issues relating to involuntary psychiatric treatment are investigated through interviews with Swedish psychiatrists.MethodsIn-depth interviews were conducted with eight Swedish psychiatrists, focusing on their experiences of and views on compulsory treatment. In relation to this, issues about patient autonomy were also discussed. The interviews were analysed using a descriptive qualitative approach.ResultsThe answers focus on two main aspects of compulsory treatment. Firstly, deliberations about when and why it was justifiable (...) to make a decision on involuntary treatment in a specific case. Here the cons and pros of ordering compulsory treatment were discussed, with particular emphasis on the consequences of providing treatment vs. refraining from ordering treatment. Secondly, a number of issues relating to background factors affecting decisions for or against involuntary treatment were also discussed. These included issues about the Swedish Mental Care Act, healthcare organisation and the care environment.ConclusionsInvoluntary treatment was generally seen as an unwanted exception to standard care. The respondents’ judgments about involuntary treatment were typically in line with Swedish law on the subject. However, it was also argued that the law leaves room for individual judgments when making decisions about involuntary treatment. Much of the reasoning focused on the consequences of ordering involuntary treatment, where risk of harm to the therapeutic alliance was weighed against the assumed good consequences of ensuring that patients received needed treatment. Cases concerning suicidal patients and psychotic patients who did not realise their need for care were typically held as paradigmatic examples of justified involuntary care. However, there was an ambivalence regarding the issue of suicide as it was also argued that risk of suicide in itself might not be sufficient for justified involuntary care. It was moreover argued that organisational factors sometimes led to decisions about compulsory treatment that could have been avoided, given a more patient-oriented healthcare organisation. (shrink)

Decision-making capacity is a key concept in contemporary healthcare ethics. Previous research has mainly focused on philosophical, conceptual issues or on evaluation of different tools for assessing patients’ capacity. The aim of the present study is to investigate how the concept and its normative role are understood in Swedish psychiatric care. Of special interest for present purposes are the relationships between decisional capacity and psychiatric disorders and between health law and practical ethics.

Respect for autonomy is typically considered a key reason for allowing physician assisted suicide and euthanasia. However, several recent papers have claimed this to be grounded in a misconception of the normative relevance of autonomy. It has been argued that autonomy is properly conceived of as a value, and that this makes assisted suicide as well as euthanasia wrong, since they destroy the autonomy of the patient. This paper evaluates this line of reasoning by investigating the conception of valuable autonomy. (...) Starting off from the current debate in end-of-life care, two different interpretations of how autonomy is valuable is discussed. According to one interpretation, autonomy is a personal prudential value, which may provide a reason why euthanasia and assisted suicide might be against a patient’s best interests. According to a second interpretation, inspired by Kantian ethics, being autonomous is unconditionally valuable, which may imply a duty to preserve autonomy. We argue that both lines of reasoning have limitations when it comes to situations relevant for end-of life care. It is concluded that neither way of reasoning can be used to show that assisted suicide or euthanasia always is impermissible. (shrink)

A theoretical model for farm succession is developed in which identity-related variables such as preferences for working autonomously or with animals influence occupational choice at the outset of the process, while environmental factors such as farm size and income prospects gain in importance during the latter stages of succession. A survey of 14-to-34-year-old potential farm successors in Switzerland is carried out to test the model. While female respondents focus on identity-related factors when making occupational choices, the model can be verified (...) for several influencing variables for male successors, such as continuing the family tradition and the potential conversion of farmland to building land. In assessing the welfare of dairy cows and laying hens, longevity has recently been introduced as an indicator. This paper presents recent attempts to transfer the normative power of longevity to non-human animals and evaluates this choice systematically. It first shows that the normative power of longevity can be justified by utilitarianism but not by rights-based approaches. The case of the ban to kill day-old chicks in Germany is then used to show that public opinion leans neither to the utilitarian (...) approach nor to the rights-based one but draws a firm line between killing animals before and after reaching an adult age. This may be not so much a desire for longevity among farmed animals but a first sign of empathy that may transform our relationship with farmed animals. (shrink)

Given the increasing potential of automation in the primary and industrial sectors of the economy, it is helpful to take a mesoeconomic, i. e. sectoral, look at the concept of a basic income. We present a thought experiment centred on societies in which labour takes place only in the service sector. We identify service sectors like prostitution in which it may be advantageous to shift away from the market and sectors like health services where public involvement is indispensable. Introducing a (...) basic income may also generate social capital, which usually accompanies service provision in the sphere of cooperation. (shrink)

Ethological farm programs as they exist in Switzerland are compared with environmental farm programs in respect of demand and supply. Because animal welfare is not a public good but rather a relation that causes psychological externalities, the demand for animal welfare has a different standing in economic theory than the demand for a clean environment. The supply of animal welfare by farmers, however, largely follows the patterns known from the delivery of environmental goods. Farm size, age and education, and also (...) family size and capital intensity are influencing variables. The paper concludes that the design of ethological farm programs should be based on broad public discussions as described by deliberation theorists rather than willingness-to-pay studies. (shrink)

The paper tests the hypothesis that cultural and social background is far more influential to form preferences about policy than the level of fact-based knowledge a person possesses. The data for the case study stem from a web-based survey among a representative sample of the adult population in Norway. The degree of knowledge of agriculture in this paper is operationalized through questions on five key characteristics of Norwegian agriculture that frequently arise in the public discussion. The results show that the (...) amount of fact-based knowledge of agriculture to a very little extent explains differences within the sample. The cultural background of respondents is much more suited to explain agricultural policy preferences. Knowledge, however, shifts the attention from food price issues towards the delivery of public goods. The results allow us to hint at hot cognition as a possible explanation for such findings. Objective Hermeneutics is a qualitative method that focuses on few sequences of texts, which helps understand single cases. It is used to explore how consumers cope with the contradiction between their enjoyment for meat and their empathy for animals without using frameworks drafted by social scientists. Five cases are analysed, which range from strong references towards the societal norm of meat eating to a feeling of uncertainty in the face of the animals’ death. None of the cases, however, sees the (...) necessity to find a rationale for their own meat consumption. The study concludes by raising the question about the persistence of a societal consensus for meat consumption. (shrink)

The choice between organic and conventional agriculture for farmers is modeled as an ethical decision. Farmers are either loyal to one of the systems or they optimize between systems. This model is empirically validated through a survey among Swiss farmers. A cluster analysis separates farmers into loyal organic, loyal conventional, and optimizing farmers. However, the three resulting clusters bore some, but not all the necessary characteristics of optimizers and loyals. A probit analysis shows that loyal farmers have larger farms than (...) optimizers. Loyal organic farmers receive less direct payments than optimizers, which confirms the utility-maximizing pattern of the latter group. (shrink)

Der Beitrag thematisiert Rosenkranz als jungen Verleger und Bewunderer Stefan Zweigs. Er entwirft auf Grundlage der Archivüberlieferung einen neuen Blick auf die Geschichte des Unternehmens und kommentiert das damit verbundene literarische Programm: Welche wichtigen verlegerischen Projekte wurden in jener kurzen Zeit unternommen? Welche Rolle hatte Stefan Zweig (...) für das Zustandekommen einiger Titel und besonders in den letzten Wochen der Verlagsexistenz? Inwiefern lässt sich Programmgestaltung und ökonomische Entwicklung von J. M. Spaeth als paradigmatisch für jüdische Verlage in der Weimarer Republik verstehen? But Thomas Mann's understanding of this concept does not at all coincide with the definition established by Armin Mohler, mainly in that it is not Nietzschean. Nor do the ties with the George circle furnish grounds for assigning Mann to the 'Conservative Revol ution', any more than to the 'aesthetic fundamentalism' which was cul tivated there. BackgroundDecisions about limitations of life sustaining treatments are made for end-of-life patients in intensive care units. The aim of this research was to explore the professional and ethical attitudes and experiences of medical professionals on treatment of end-of-life patients in ICUs in the Republic of Croatia.MethodsA cross-sectional study was conducted among physicians and nurses working in surgical, medical, neurological, and multidisciplinary ICUs in the total of 9 hospitals throughout Croatia using a questionnaire with closed and open type questions. Exploratory factor (...) analysis was conducted to reduce data to a smaller set of summary variables. Mann–Whitney U test was used to analyse the differences between two groups and Kruskal–Wallis tests were used to analyse the differences between more than two groups.ResultsLess than third of participants stated they were included in the decision-making process, and physicians are much more included than nurses. Sixty two percent of participants stated that the decision-making process took place between physicians. Eighteen percent of participants stated that ‘do-not-attempt cardiopulmonary resuscitations’ orders were frequently made in their ICUs. A decision to withdraw inotropes and antibiotics was frequently made as stated by 22.4% and 19.9% of participants, respectively. Withholding/withdrawing of LST were ethically acceptable to 64.2% of participants. Thirty seven percent of participants thought there was a significant difference between withholding and withdrawing LST from an ethical standpoint. Seventy-nine percent of participants stated that a verbal or written decision made by a capable patient should be respected. Physicians were more inclined to respect patient’s wishes then nurses with high school education. Nurses were more included in the decision-making process in neurological than in surgical, medical, or multidisciplinary ICUs. Male participants in comparison to female, and physicians in comparison to nurses with high school and college education displayed more liberal attitudes about LST limitation.ConclusionsDNACPR orders are not commonly made in Croatian ICUs, even though limitations of LST were found ethically acceptable by most of the participants. Attitudes of paternalistic and conservative nature were expected considering Croatia’s geographical location in Southern Europe. (shrink)

In November 2022, OpenAI released ChatGPT, an incredibly sophisticated chatbot. Its capability is astonishing: as well as conversing with human interlocutors, it can answer questions about history, explain almost anything you might think to ask it, and write poetry. This level of achievement has provoked interest in questions about whether a chatbot might have something similar to human intelligence or even consciousness. Given that the function of a chatbot is to process linguistic input and produce linguistic output, we consider the (...) question whether a sophisticated chatbot might have inner speech. That is: Might it talk to itself, internally? We explored this via a conversation with ‘Playground’, a chatbot which is very similar to ChatGPT but more flexible in certain respects. We asked it questions which, plausibly, can only be answered if one first produces some inner speech. Here, we present our findings and discuss their philosophical significance. (shrink)

In this chapter we deal with the challenge to the existence of free will and moral responsibility that is raised by the threat of determinism from a Wittgensteinian perspective. Our argument starts by briefly recapitulating Wittgenstein’s analysis of the practice of doubt in On Certainty. We subsequently turn to the problem of free will. We argue that the existence of free will is a basic certainty and that the thesis of determinism fails to cast doubt on it. We thereby make (...) use of – but also try to go beyond – Wittgenstein’s own remarks in his “Lectures on Freedom of the Will”. In the final section we focus more explicitly on moral responsibility. Inspired by P.F. Strawson’s work on free will and moral responsibility, which we take to be deeply Wittgensteinian, we argue that our practices of holding each other responsible manifest basic human certainties which cannot be meaningfully challenged by invoking the thesis of determinism. Users of sociotechnical systems often have no way to independently verify whether the system output which they use to make decisions is correct; they are epistemically dependent on the system. We argue that this leads to problems when the system is wrong, namely to bad decisions and violations of the norm of practical reasoning. To prevent this from occurring we suggest the implementation of defeaters: information that a system is unreliable in a specific case (undercutting defeat) or independent information that (...) the output is wrong (rebutting defeat). Practically, we suggest to design defeaters based on the different ways in which a system might produce erroneous outputs, and analyse this suggestion with a case study of the risk classification algorithm used by the Dutch tax agency. Recent advances in medical and information technologies, the availability of new types of medical data, the requirement of increasing numbers of study participants, as well as difficulties in recruitment and retention, all present serious problems for traditional models of specific and informed consent to medical research. However, these advances also enable novel ways to securely share and analyse data. This paper introduces one of these advances—blockchain technologies—and argues that they can be used to share medical data in a secure and (...) auditable fashion. In addition, some aspects of consent and data collection, as well as data access management and analysis, can be automated using blockchain-based smart contracts. This paper demonstrates how blockchain technologies can be used to further all three of the bioethical principles underlying consent requirements: the autonomy of patients, by giving them much greater control over their data; beneficence, by greatly facilitating medical research efficiency and by reducing biases and opportunities for errors; and justice, by enabling patients with rare or under-researched conditions to pseudonymously aggregate their data for analysis. Finally, we coin and describe the novel concept of prosent, by which we mean the blockchain-enabled ability of all stakeholders in the research process to pseudonymously and proactively consent to data release or exchange under specific conditions, such as trial completion. Drugs used to provide improvement of cognitive functioning have been shown to be effective in healthy individuals. It is sometimes assumed that the use of these drugs constitutes cheating in an academic context. We examine whether this assumption is ethically sound. Beyond providing the most up-to-date discussion of modafinil use in an academic context, this contribution includes an overview of the safety of modafinil use in greater depth than previous studies addressing the issue of cheating. In order to explain that sentences containing empty definite descriptions are nevertheless true or false, Russell famously analyzes sentences of the form ‘The F is G’ as ‘There is exactly one F and it is G’. Against this it has been objected that Russell’s analysis provides the wrong truth-conditions when it comes to non-doxastic attitude ascriptions. For example, according to Heim, Kripke, and Elbourne (HKE), there are circumstances in which (1) is true and (2) is false. Hans wants the ghost (...) in his attic to be quiet tonight.Hans wants there to be exactly one ghost in his attic and for it to be quiet tonight. After all, the argument goes, unlike (2), (1) can be true without Hans wanting there to be exactly one ghost in his attic. Kaplan and Neale famously reply that the HKE objection presupposes that non-doxastic attitudes are closed under entailment, which they are not. For Rostworowski, on the other hand, the problematic principle used by the HKE objection is a substitutivity principle for non-doxastic attitude ascriptions. This is further supported by the fact that, as Elbourne points out, Russell’s analysis already leads to a problem similar to the HKE objection together with substitutivity alone. By questioning substitutivity for non-doxastic attitude ascriptions, Rostworowski tries to block both the HKE objection and Elbourne’s variant of the HKE objection. In this paper, I will argue that Russell’s analysis of definite descriptions leads to a variant of the HKE objection even in the context of doxastic attitude ascriptions. Since, as we will see, doxastic attitude ascriptions do not seem to suffer from the substitutivity problems discussed by Rostworowski in the context of non-doxastic attitude ascriptions, this will further exacerbate the problem for Russell’s analysis. I will then discuss the possibility to reject substitutivity for doxastic attitude ascriptions using a contextualist analysis of attitude ascriptions. However, we will see that, independent of whether we accept substitutivity for doxastic attitude ascriptions, a complete solution of the doxastic problem has to reject Russell’s analysis of the truth-conditions of sentences of the form ‘The F is G’. Concluding, I will show that, unlike Russell’s analysis, the Frege–Strawson analysis of definite descriptions, according to which a sentence of the form ‘The F is G’ presupposes that there is exactly one F, rather than asserting it, provides an explanation of the HKE objection, Elbourne’s variant of the HKE objection, and the doxastic problem presented in this paper. This will speak not only in favor of a Fregean analysis of definite descriptions, but also of a Fregean conception of propositions. (shrink)

Klingner entwickelt die Option einer Kulturphilosophie als Theorie technischer Vernunft mit Bezug auf den kantischen Kulturbegriff und auf seinen Philosophiebegriff. Damit erweist sich zugleich, dass eine kantische Kulturphilosophie rekonstruierbar und in ihrem Gehalt auch heute noch diskussionswürdig ist.

Emmanuel Lévinas (1906-1995) zählt nicht nur zu den wichtigsten Ethikern im 20. Jahrhundert. Vor allem entwirft er einen anderen Anfang der Ethik, die nicht auf der gesellschaftlichen Ebene oder als grosse Idee und Erzählung entsteht. Ethik entspringt vielmehr in der konkreten Zwischenmenschlichkeit, wenn man vom Anderen in die Verantwortung gerufen wird - und zwar durch die Verletzlichkeit seines nackten Gesichtes wie durch die Anrede. Die ethische Beziehung verdankt sich dabei nicht etwa der Gleichheit, der Nähe oder der Geschwisterlichkeit, sondern der (...) Andersheit des Anderen, seiner Ferne und vor allem seiner Fremdheit, die sich nicht hintergehen lassen. Damit gründet Lévinas die Gesellschaft nicht nur auf die Zwischenmenschlichkeit, sondern auch auf die Pluralität. So wenig wie die Ethik universelle Ansprüche erheben kann, lässt sich Gerechtigkeit als ein allgemeines Prinzip entwerfen. Vielmehr muss sie den Individuen in deren unendlicher Andersheit gerecht werden. In dieser Unendlichkeit blitzt im nackten Gesicht das Antlitz Gottes auf, denkt Lévinas aus der jüdischen Tradition heraus. Das lässt sich auch rein säkular verstehen, dass alle Menschen anders sind. Sie als Gleiche zu behandeln, unterwirft sie totalen politischen Ansprüchen, macht sie zu gehorsamen Untertanen. In Auseinandersetzung mit Sartre entwickelt Lévinas eine individualistische Ethik der Verantwortung, die jeden Menschen betrifft, indem sie aus der Zwischenmenschlichkeit heraus die Mündigkeit konstituiert. So verfolgt der Einzelne nicht primär seine Interessen, sondern übernimmt Verantwortung für den Anderen: Die Wende der Ethik im 20. Jahrhundert - von Sartre, de Beauvoir und Lacan inspiriert, von Derrida und Butler fortgeschrieben, bestehen zudem Parallelen zu Arendt und Foucault. (shrink)
