Confidentiality of health information is increasingly relevant in the era of electronic medical records. We discuss the case of a hospitalized patient who requested a neurology consultation for an episode he described as an “LSD-like” flashback. The patient expressed concern that the episode was a residual effect of past drug use, but subsequently requested that his drug use not be documented. Involved in a custody battle, he feared that if his records were released to the court he could lose custody (...) of his children. Ethical concerns arose with regards to the physician’s competing obligations with a duty to record information accurately and honestly, respect patient autonomy, and maintain patient confidentiality. We discuss the decision of the team to document the patient’s drug use by arguing that the obligation to maintain confidentiality did not supersede the primary role of the medical record as a complete and accurate account, which cannot be altered at a patient’s behest. As the above quote clearly highlights, it is the responsibility of researchers and research supervisors to be certain that their research staff and students assistants are very familiar with all of the ethical principles and current standards relevant to the research they are conducting. Indeed, they must take an active role in being certain that their research staff and students complete appropriate training in these ethical principles and standards, and how they apply them to the research context in which they (...) are working. This is especially important in areas in which there may be physical harm such as chronic pain research. During the past decade, there has been a great increase in research of chronic pain, with breakthroughs in better understanding its etiology, assessment, and treatment (1,2). Obviously, much of this research was conducted using humans and animals as subjects. As a consequence, there were a number of ethical issues that investigators have to be cognizant of when conducting their studies. In this chapter, we will discuss such ethical issues in three major areas: (i) laboratory research with human subjects; (ii) laboratory research with animals; and (iii) translating these laboratory research ndings to ‘‘real world’’ applications in the clinical treatment arena. In our society, some aspects of life are off-limits to commerce. We prohibit the selling of children and the buying of wives, juries, and kidneys. Tainted blood is an inevitable consequence of paying blood donors; even sophisticated laboratory tests cannot supplant the gift-giving relationship as a safeguard of the purity of blood. Like blood, health care is too precious, intimate, and corruptible to entrust to the market.The hospice movement in the United States is approximately 40 years old. During these past (...) four decades, the concept of holistic, multidisciplinary care for patients who are suffering from a terminal illness has evolved from a modest, grassroots constellation of primarily volunteer-run and community-governed endeavors to a multimillion dollar industry where the surviving nonprofits compete with for-profit providers, often publicly traded, managed by M.B.A.-trained executives, and governed by corporate boards. The relatively recent emergence of for-profit hospice reflects an increasing commercialization of health care in the United States, the potentially adverse impact of which has been well documented. This article critically questions the commercialization of hospice care and the ethical concerns associated with the industry's movement toward “market-driven medicine” at the end of life. For example, the article examines issues raised by an influx of for-profit hospice providers whose business model appears at its core to have an ethical conflict of interest between shareholders doing well and terminal patients dying well. Yet, empirical data analyzing the experience of patients across the hospice industry are limited, and general claims that (...) end-of-life patient care is inferior among for-profit providers or even that their business practices are somehow unseemly when compared to nonprofit providers cannot be substantiated. In fact, non-profit providers are not immune to potentially conflicting concerns regarding financial viability (i.e., “no margin, no mission”). Given the limitations of existing empirical data and contrasting ideological commitments of for-profit versus non-profit providers, the questions raised by this article highlight important areas for reflection and further study. Policymakers and regulators are cautioned to keep ethical concerns in the fore as an increasingly commercialized hospice industry continues to emerge as a dominant component of the U.S. health care system. Both practitioners and researchers are encouraged to expand their efforts to better understand how business practices and commercial interests may compromise the death process of the patient and patient's family — a process premised upon a philosophy and ethical tradition that earlier generations of hospice providers and proponents established as a trusted, end-of-life alternative. The 1998 Good Friday Agreement (GFA) brought an end to conflict in Northern Ireland (NI). However, the peace process has not brought about the reconciliation which many had hoped for. The purpose of this article is to consider the role of ‘peace education’ and ‘integrated education’ in fostering reconciliation in Northern Ireland. My research contains the views of primary school and secondary school principals and head teachers to ‘peace education’ and ‘integrated education’ in Northern Ireland. The research is positioned in (...) the tradition of previous research literature and contemporary concerns relating to integrated education and the Shared Education Bill that was passed by the Northern Ireland Assembly on the 8th March 2016. My research adds to the emerging knowledge in the area and offers an insight on the attitudes of educators in Northern Ireland to ‘peace education’ and ‘integrated education’. It also engages with ‘interventionist research’. This paper is written from the point of view that genuine and effective ‘peace education’ requires ‘integrated education’ where children from diverse backgrounds are educated together every day in the same classrooms. After a historic agreement was reached, between the Democratic Unionist Party (DUP) and Sinn Fein (SF), Power-sharing government resumed in Northern Ireland in 2007. Both political parties committed themselves to peaceful, democratic and consensual self-government in Northern Ireland. This was the first time that Northern Ireland was to be run by a government in which all the main nationalist (nationalists want Northern Ireland to be reunited with the rest of Ireland) and unionist (unionists want Northern Ireland to remain part of (...) the United Kingdom) parties were to agree to serve together. Forty years of civil strife and conflict are over. There is now political stability; nonetheless, the peace process has not brought about the positive changes which many had expected. This article looks at the pressing issue of reconciliation in Northern Ireland; it is not the intention of this article to solely blame one ideological tradition, community, or political party. John Perry has recently developed a form of Compatibilism that respects the Principle of Alternatives (PA), according to which free agency requires having the ability to do more than one thing. Eschewing so-called Frankfurt counterexamples to this intuitively plausible principle, long the bête noire of those who would like to believe in free agency and Determinism, Perry argues that there is an important sense in which we can act differently than we do. It signifies the “natural” property of (...) possessing a latent ability, a notion free of the mysteriousness surrounding accounts of the freedom to do otherwise based on religious or even philosophical considerations, yet sufficient to conceptually ground our assignments of praise and blame. Perry goes on to advise his readers to abandon all such unscientific accounts in favor of his common sense approach. -/- I argue that Perry’s Compatibilism (PC) leads to the same objection as other Humean versions thereof, as well as fails to explain certain intuitions regarding self-control and initiative. I conclude with an assessment of the prospects for his proposed revision of PC, written in light of these concerns. (shrink)

This study of American intellectual histories sketches their development from colonial chronicles to today's professional scholarship. It concentrates upon the writings of a dozen or more major historians between the late 1800's and the middle 1900's who have contributed to the study of the history of ideas in America, including Moses Coit Tyler, Edward Eggleston, Charles Beard, Carl Becker, Vernon Farrington, Merle Curti, Perry Miller, and Ralph Gabriel. The various histories are analyzed partly from the perspective of a developing (...) scholarly discipline and partly from the perspective of the "climate of opinion" in which the histories were written. The methods employed by the historians in studying ideas, as well as the substantive interpretations expressed in the histories, are analyzed in relation to the "world-views" or "ideological positions" of the historians themselves. Originally published in 1966. Postscripts have been added to a number of the essays discussing criticisms by authors such as Gareth Evans and Robert Stalnaker. Included with such well-known essays as "Frege on Demonstratives," "The Problem of the Essential Indexical," "From Worlds to Situations," and "The (...) Prince and the Phone Booth" are a number of important essays that have been less accessible and that discuss important aspects of Perry's views, referred to as "Critical Referentialism," on the philosophy of language and the philosophy of mind. No word in English is shorter than the word I.' And yet no word is more important in philosophy. When Descartes said I think therefore I am' he produced something that was both about himself and a universal formula. The word I' is called an indexical' because its meaning always depends on who says it. Other examples of indexicals are you,' here,' this' and now.' John Perry discusses how these kinds of words work, and why they express important philosophical (...) thoughts. He shows that indexicals pose a challenge to traditional assumptions about language and thought. The paper discusses in detail John Perry's important article “Davidson's Sentences and Wittgenstein's Builders“. Perry argues, on the basis of Wittgenstein's famous block/slab language, that words make direct metasemantic contact with the world. The present paper urges that, while Perry's conclusions are correct and important, the arguments provided for them, in his 1994 article, ignore essential features of genuine words in natural language. A more empirically-oriented alternative tactic for supporting the same philosophical conclusions is then provided, and (...) its advantages and disadvantages are weighed. (shrink)

It is often supposed that Marxist philosophy and Wittgensteinian philosophy are not just very different but that they are opposed to each other. Wittgenstein was notoriously against theorizing in philosophy whereas Marx tried to give a scientific account of human society and culture. Marx famously said that ‘[t]he philosophers have only interpreted the world, in various ways; the point is to change it’, while Wittgenstein was concerned with conceptual considerations and had very little to say about workers' struggles. My aim (...) in this paper is to show that these apparent differences dissolve once one realizes that Marx and Wittgenstein thought differently about the nature of philosophy. In the course of coming to this conclusion I will look at misinterpretations of Wittgenstein's philosophy from Perry Anderson and Alex Callinicos as well as at Wittgensteinian criticisms of Marxist philosophers such as Leon Trotsky, John Rees and Slavoj Žižek. I will conclude that Marxist philosophers stand to gain from a clearer understanding of Wittgenstein's philosophy and that Wittgensteinians can similarly gain from an appreciation of the kind of analysis of economics, society and politics offered by Marxists. A frequent criticism of Richard Vallee’s “pluri-propositionalism” is that it multiplies propositions beyond necessity. I argue that this criticism, recently voiced by Robert Stanton and Arthur Sullivan, is based in misconceptions about propositions are and how they help us classify utterances and the mental states and events that lead to them, relying for the most part on extended discussions of examples.

Though he has worked almost exclusively in collaborative mediums like radio and film, Orson Welles has always tended to think of himself as an individual author. "Any production in any medium is a one-man production," he said to me. On the question of sharing creative responsibility for the works that bear his name, he is deeply ambivalent. His insistence on multiple billings for himself is legendary. As I can well testify, the very mention of the term collaboration at a wrong (...) moment can be enough to send him into a rage. The controversy over who scripted Citizen Kane initiated by Pauline Kael hurt him very deeply. That the wound still festers to this day is evident in the rancor with which he speaks of former associates like John Houseman. Yet in quieter moments he will fully concede how indispensable his principal collaborators have been to him and will openly discuss the nature and extent of their contributions. He is especially full of praise for cinematographers with whom he has worked over the years, such as Gregg Toland, Russell Metty, and, more recently, Gary Graver. On Citizen Kane, he singles out four individuals whom he thinks deserve special recognition: writer Herman Mankiewicz, art director Perry Ferguson, composer Bernard Herrmann, and Toland. Of these, he says, Toland's contribution to the film was the greatest, second in importance only to his own. In this essay I deal with the history and nature of Welles' collaboration with Toland on Citizen Kane—what brought them together, their working relationship, and the characteristics and rationale of the visual plan they created for the film. As we shall see, Toland brought a largely pre-conceived visual plan to Citizen Kanewhich he had been working out in his previous films. Welles accepted Toland's plan so readily because he recognized how dramatically appropriate it was to the story material. Toland's cinematography for Citizen Kane also left a major legacy to Hollywood films of the 1940s.Robert L. This article formulates a progressive conception of communitarian democracy which rests upon the distinction between deliberative and dedicated conceptions of community. Deliberative communities seek fallibilistic change through a non-Enlightenment conception of practical reason. According to this pragmatist conception of practical reason, members of deliberative communities jointly attempt to formulate political truth independently of any a priori or non-deliberative standards of the right and the good. By contrast, dedicated communities seek what they regard as the truth about reality and insist upon (...) adhering to those cultural and social givens of their society which express this truth. The distinction between deliberative and dedicated communities is relevant to the debate between liberalism and communitarianism. Rather than viewing this debate as one between those who value community and those who do not, it is better understood as a controversy over the appropriate kind of community. Typically, liberals seek deliberative communities, while communitarians seek dedicated ones. However, a person committed to deliberativism as the method of social change can also regard deliberativism as defining a certain conception of community and the conception of the persons who are its members. Consequently, in this view, almost every serious person is a communitarian, but some people are deliberative communitarians while others are dedicated communitarians. Communitarian democracy is an attempt to describe a deliberative community. Communitarian democrats seek freedom, equality, and solidarity for the purpose of devising joint solutions to social problems. In order to achieve this, communitarian democrats devise a civic discourse shorn of dedicated features, which values each citizen equally as a member of the community. This has implication for at least three conflicts in political and constitutional affairs. Since no irreducibly dedicated premises are possible in this civic discourse, dedicated arguments are impossible without translation into deliberative terms. This implies a particular conclusion to the debate about religion in the public square, namely, that dedicated religious discourse must be translated into its deliberative counterpart, if it has one, before its proponents may use it in public justification. Similarly, concerning multicultural conceptions of the right and the good, communitarian democrats can accept only those multicultural conceptions translatable into deliberative discourse. And, finally, communitarian democrats must guard against constitutional atrophy, the process by which initially deliberative structures become dedicated through lack of vigilance, criticism, and challenge. In a communitarian democracy, atrophied deliberative structures may be just as inefficient and unfair as some decidedly dedicated structures and must be similarly avoided. (shrink)

The proper role and influence of religion in the public sphere continues to be contested and has important implications for civic education in a liberal democracy. Paul Weithman and Michael Perry argue that religion makes valuable contributions to civic participation and that religiously grounded beliefs should be fully welcome in political decision-making. In response, this paper strives for a middle ground of preparing citizens to engage thoughtfully with a wide range of moral perspectives, religious and otherwise, while promoting a (...) civic virtue that still honours a commitment to public reason.
