According to the order ethics approach to business ethics, moral rules must be im-plemented by institutions that provide incentives for following the rules. As a minimal (normative) condition, these institutions must be able to motivate the homo eco-nomicus. But even if an institution passes this test, it will only motivate actual people (i.e. the homo psychologicus) to follow moral rules, if they have the relevant compe-tences and self-efficacy beliefs. Consequently, good institutional design includes com-prehensive change management. At this point applied (...) order ethics can draw on find-ings of psychology and experimental economics. It turns out, that role models can support self-efficacy beliefs and are thus more important for order ethics than has traditionally been assumed. (shrink)

Interessenbasierte Vertragstheorien sollten moralische Gefühle als Sanktionen betrachten und sich der Frage ihrer Rechtfertigung widmen. Als moralische Sanktionen gelten nach einer üblichen Auffassung Instanzen von selbst etablierten und zuverlässigen Reaktionsmustern einer Gemeinschaft, die einen Regelbruch unvorteilhaft machen. Nur weil sie nicht naturgegeben sind, stellt sich die Frage ihrer Rechtfertigung. Ich argumentiere dafür, dass moralische Gefühle eine Art von Wahrnehmungen sind und sich daher in genau dem Sinn kontrollieren lassen, der für Sanktionen wesentlich ist. Wir erlernen sie im Prozess der Sozialisation (...) und passen sie im Normalfall langfristig so an, dass sie im Einklang mit der gesellschaftlichen Meinung stehen. Daher sind sie durch die Gemeinschaft selbst etabliert. Aber kurzfristig gesehen treten sie in bestimmten Situationen automatisch ein und liefern so zuverlässige Anreize für regelkonformes Verhalten. Ich wende mich damit explizit gegen eine These Peter Stemmers, der moralischen Gefühlen den Status von Sanktionen abspricht, weil sie nicht hinreichend unter unserer Kontrolle seien. (shrink)

One can justify moral rules on the basis of their advantageousness without equating morality and advantage.

Much recent research on moral judgment making has focused on quick one-shot judgments. Explicit reasoning has been shown to play a minor role in these cases. However, these results do not generalize to real moral conduct that often includes the iterative adaptation of long-term behavioral strategies. I suggest using school bullying as an ecologically valid model for moral conduct and refer to studies that show that moral reasoning competence is negatively correlated to immoral aggressive behavior. Taken together, these results suggest (...) a rather strict division of labor between reasoning on the one hand and automatic processes on the other hand. I suggest that moral reasoning is part of a long-term learning process, which sets the parameters for quick intuitive deci- sion making. Philosophical ethics can play an important role by systematizing and reflecting this learning process. (shrink)

To examine whether high moral reasoning competence of adolescents is associated with low levels of bullying, and to understand whether moral disengagement mediates or moderates this relationship, 925 German children ranging from 11 to 17 years of age (M = 14.18, S = 1.21) completed questionnaires on moral reasoning competence and moral disengagement in surveys at three different schools. The children were classified according to their bullying role, based on a peer- nomination procedure. Multinomial logistic regression analyses showed that moral (...) reasoning competence negatively predicted whether a student took an aggressive role. Moral disengagement partially mediated this relationship. Corresponding effects for defenders and outsiders were not found. These results extend previous findings about the effect of moral reasoning on bullying in primary school. The implications for the prevention of bullying are discussed. (shrink)

Michael von Brück arbeitet ihn in diesem bahnbrechenden Werk über die Verbindung von Religion und Poesie heraus. Er zeigt, dass Rilke, der von der Gestalt des Buddha zutiefst berührt war, in seiner Poesie eine (...) In small-scale societies, punishment of adults is infrequent and employed when the anticipated cost-to-benefit ratio is low, such as when punishment is collectively justified and administered. In addition, benefits may exceed costs when punishers have relatively greater physical and social capital and gain more from cooperation. We provide examples from the Tsimane horticulturalists of Bolivia to support our claims.

Mit Blick auf die sich hieraus ergebenen Handlungsoptionen und -zwänge stellt der verantwortliche Umgang mit Energie sicher einen der zentralen Bereiche dar. Unsere ethische Verantwortung betrifft dabei beides: Erzeugung und Verbrauch von Energie gleichermaßen. Der vorliegende Band verfolgt zwei Ziele: Erstens soll ein interdisziplinärer Dialog ermöglicht und die dafür notwendigen fachlichen Reflexionen angestoßen werden. Children may be viewed as public goods whereby both parents receive equal genetic benefits yet one parent often invests more heavily than the other. We introduce a microeconomic framework for understanding household investment decisions to address questions concerning conflicts of interest over types and amount of work effort among married men and women. Although gains and costs of marriage may not be spread equally among marriage partners, marriage is still a favorable, efficient outcome under a wide range of conditions. This (...) bioeconomic framework subsumes both cooperative and conflictive views on the sexual division of labor. We test hypotheses concerning marriage markets, assortative mating, and men’s labor motivations among Tsimane forager-horticulturalists of Bolivia and find that: (1) men and women both value work effort in marital partners, (2) marital labor contributions are complementary, (3) work effort is correlated between spouses, (4) total production is correlated with total reproduction, and (5) better hunters have higher fitness gains within marital unions. Since the early Gestaltists there has been a strong interest in the question of how problem solvers get stuck in a mental impasse. A key idea is that the repeated activation of a successful strategy from the past results in a mental set (‘Einstellung’) which determines and constrains the option space to solve a problem. We propose that this phenomenon, which mostly was tested by fairly restricted experiments in the lab, could also be applied to more complex problem constellations and (...) naturalistic decision making. We aim at scrutinizing and reconstructing how a mental set determines the misinterpretation of facts in the field of political decision making and leads in consequence to wrong expectations and an ill-defined problem representation. We will exemplify this psychological mechanism considering a historical example, namely the unexpected stabilization of the Franco regime at the end of World War II and its survival thereafter. A specific focus will be drawn to the significant observation that erroneous expectations were taken as the basis for decisions. This is congruent with the notion that in case of discrepancy between preconceived notions and new information, the former prevails over the new findings. Based on these findings, we suggest a theoretical model for expectation violation in political decision making and develop novel approaches for cognitive empirical research on the mechanisms of expectation violation and its maintenance in political decision making processes. Swedish hunters sometimes appeal to an inviolate ‘right to exist’ for wolves, apparently rejecting NIMBY. Nevertheless, the conditions existence hunters impose on wolves in practice fundamentally contradict their use of right to exist language. Hunters appeal to this language hoping to gain uptake in a conservation and management discourse demanding appropriately objective ecological language. However, their contradictory use of ‘right to exist' opens them up to the charge that they are being deceptive – indeed, right to exist is a 'disguised (...) NIMBY!' We address this situation by distinguishing hunters’ criticisms of wolves from the procedures for reaching objective policy decisions. (shrink)

An alternative to the negative rights slant in animal rights, focusing on abolition and hands-off approaches, has now surfaced within critical animal studies. Indeed, Relational Animal Rights Theory lays a foundation for positive relations of care, mutuality and dependence between species. In so doing, the theory is sensitive to the multitude of ways in which human and non-human animals interact across shared territories. Rewilding is positioned as ‘post’-conservation through its emphasis on unleashing the autonomy of natural processes. In this paper, we argue that the autonomy of nature rhetoric in rewilding is challenged by human interventions. Instead of joining critique toward the ‘managed wilderness’ approach of rewilding, however, we examine the injustices this entails for keystone species. Reintroduction case studies demonstrate how arbitrary standards for wildness are imposed on these animals as they do their assigned duty to rehabilitate ecosystems. These ‘Goldilocks’ standards are (...) predicated on aesthetic values that sanction interventions inconsistent with the premise of animal sovereignty. These include culling, relocations and sterilizations of animals that demonstrate the kind of autonomy championed in rewilding rhetoric. Drawing from Donaldson and Kymlicka’s framework for political animal categories, we conclude by arguing that rewilding needs to re-position itself in one of two ways. Either it should align itself more closely to mainstream conservation and embrace full animal sovereignty without Goldilocks conditions, or it should commit to taking full responsibility for reintroduced animals, including supplementary feeding and care. This reality is symbolized in different ways depending on religious experience and cultural conditioning. Underlying all concepts and ethics of justice is a dimension of basic insight that is beyond rational quantifying analysis.The semantics of (...) concepts of justice is different in various contexts and meaning systems, that is, in more general political and social contexts and in the rational discourse of philosophy. The general political term for justice is more confusing than helpful for a clear conceptualization; it might be treated more as a symbol in a mythological framework than a concept. In this context justice is defined in terms of what it is not, or metaphorically in differing categories, for example, justice as impartiality, equality. Thus, many programmatic formulae, such as "International Movement for a Just World,"1 express a utopia against the frustration with regard to social, economic, and political conditions and call for action to establish a "just world" without defining what the standard of this action must be in order to qualify as just and what exactly the notion of a "just world" actually might mean conceptually. Certain political actions are condemned from a particular standpoint, but the very foundation of any standpoint remains controversial. "Just" or "unjust" are actions that are determined according to the two standards of an Aristotelian suum cuique and the principle of treating equal cases in equal ways. Here, actions and their results as well as human freedom of action and the respective responsibility are a matter of debate. The problem is how to establish criteria for what is regarded as being "equal."2I suggest that justice can be discussed in two ways: (1) as an agreement or result of negotiation and better insight that is worked out between partners in social processes, and/or (2) as a reflection of the cosmic order, the divine will, or any pre-established harmony that is not negotiable by human beings. Whereas the first assumption is reflected in the theories of Aristotle, Rousseau, John Rawls,3 and others, the second one seems to be one of the basic contents of any religious worldview. Rawls actually constructs his idea of justice as fairness in the line of the familiar theory [End Page 61] of the social contract, following Locke, Rousseau, and Kant. Accordingly, justice is the basic assumption that generates the condition for any further discourse in societies. It is an "original position," an "initial status," the "symmetry of everyone's relations to each other," which, of course, is neither an actual state of historical affairs nor a primitive condition of culture, but a purely hypothetical situation.4 For Rawls, to think justice requires the task to acknowledge interdependencies and mutual dependence of the different factors and actors in societies on the basis of reflexive reason. In religions, however, it is the dharma, the commandment of God, the Tao, or the cosmic harmony or "symmetry" of forces that is the root cause for justice in human relations.In this essay I will not argue any of these positions mentioned above as such but maintain only that any particular discourse depends on communication processes, that is, language and actors. Actors have interests that are mediated through claims. These claims may be compatible or not. However, in both cases they are part of the communication processes itself. And it is in communication that discourses materialize. Therefore, dialogue is the framework for any theory of justice, which may be inclined more to the first or the second position outlined above. Because today, due to economic, political, and cultural circumstances, all discourses are linked to each other, it is in cross-cultural communication and dialogue that a theory of justice has to be worked out. In conjunction with Iranian dualism this expectation was interpreted metaphysically: After the collapse of (...) the existing order God would create a messianic kingdom of peace and justice, that is, a kingdom under the direct rule of God. This was not “political progress” in the modern sense of the term, for the subject of these final events was God himself or God alone. Human beings might participate in accelerating or slowing down these divine actions by lawful or unlawful behavior—measured according to the Mosaic Law, but human historical acting itself would not lead to a betterment in this sense. Nevertheless, this form of thought gave history a direction, and this is what inspired later Jewish and Christian intentionality. Early Christianity was shaped by the expectation of the coming end of time in the immediate future; however, at the same time it added a remarkable tension to the traditional apocalyptic idea: the tension of fulfillment of time, which had happened already in the advent of Jesus as the Christ (messiah) and an expectation of the imminent completion of time (the return of Christ, which would finally end history and start the new kingdom). Since the second century ad this myth of future time became ontologized or platonized—that is, the future was transferred into an “other world.” This means that the new quality would not be a dimension of the future (only) but graspable in the ecclesiastical mediation of the sacraments. The eucharist was the pharmakon athanasias (medicine of immortality). At the same time there was a mystical dimension that holds that in a specific spiritual experience this dimension might be experienced by any person who would be prepared to receive it as divine grace. The paradigm of early Christianity failed: Christ did not return. There was no new kingdom that would have ended known history. In order to cope with this disappointment, two forms of life emerged that shaped the [End Page 159] spirit of Christianity throughout the Middle Ages, so to speak, until the end of the eighteenth century: ecclesiastical mediation of the saving reality and mystical participation in a transtemporal Beyondness.Utopia develops on the basis of difference between imagination and reality. At least structurally utopian thinking can be found in all cultures; usually it is expressed in the power of myths. This marks a difference between utopia and apocalyptics. There are three different types of utopian thinking: spatial, temporal, and in terms of different states of consciousness. Spatial utopia expects the final accomplishment or climax of history, that is, the essence of hope, in spatial terms, in different regions of the world, faraway, behind oceans or mountains (Atlantis, the country flowing with milk and honey, El Dorado, Shambhala, the islands of the blessed, etc.). These spaces lost their power of inspiring imagination because there are no more white spots on the map, and that is why this utopia had to emigrate into extraterrestrial spaces of the universe (the contemporary myths of ET, Star Wars, etc.)Temporal utopia transfers the field of expectation to the beginning of the world (paradise, Golden Age) or to the end of history (millennialistic thought, communistic utopia). These temporal expectations lost their power of inspiring imagination because the fulfillment was heralded time and again but never happened.Utopia in terms of a different state of consciousness transfers the catastrophe (the turning point of time and history) into the consciousness of human beings (the prophets of Israel, Buddha, Jesus, in a certain way Confucius, modern New Age movements, etc.). This article examines the current problems and tension that characterize the idea of the right to have rights, considered as a cornerstone of the European Union's project. The systemic deficit matter is discussed as the main problematic to achieve the entirety of the previous concept, and some systemic deficit profile are identified. Moreover through the example of the Greek experience the article shows a possible way of common action to solve the systemic deficit. In this paper, we determine whether illegal hunting should be construed as a crime of dissent. Using the Nordic countries as a case study where protest-driven, illegal hunting of protected wolves is on the rise, we reconsider the crime using principles of civil disobedience. We invoke the conditions of intentionality, nonevasion, dialogic effort, non-violence and appeal to parameters of reasonable disagreement about justice and situate the Nordic illegal hunting phenomenon at a nexus between conscientious objection, assisted disobedience and everyday resistance. (...) This examination leads us to contend that the crime has heretofore received an inadequate response limited to punishment and deterrence. This contention finds support in the worsening predicaments of illegal hunting following harsh sanctions and stigmatization. Although hunters publicize injustices through their crimes, we find that killing wolves as a means to deliberative ends disqualifies hunters’ dissent as legitimate disobedience, creating an obligation of deliberative uptake on the part of society. Nonetheless, in a critical contribution to the field of criminal justice, we argue that it is instead the conditions of deliberative suboptimality experienced by hunters that create this obligation of uptake. Hence, in order to fulfill this obligation, we contend that the burden falls on regulatory agencies to better articulate the justifications for the policies that coerce hunters. We also advocate creating novel institutions to provide hunters with effective opportunities for contesting wildlife conservation directives. (shrink)
