The endangered species Tokudaia osimensis has the unique chromosome constitution of 2n = 25, with an XO/XO sex chromosome configuration (2n = 25; XO). There is urgency to preserve this species and to elucidate the regulator(s) that can discriminate the males and females arising from the indistinguishable sex chromosome constitution. However, it is not realistic to examine this rare animal species by sacrificing individuals. Recently, true naïve induced pluripotent stem cells were successfully generated from a female T. osimensis, and the (...) sexual plasticity of its germ cells was elucidated. This achievement constitutes the basis of an attractive research area, including embryonic fate determination, sex determination, and factor(s) that can replace the Y chromosome. In his early essay, “Must We Mean What We Say”, Cavell argues that the claims of ordinary language philosophers regarding “what we say when” are not empirical generalizations about a given group of speakers but are rather to be understood as measuring the limits of what counts as a coherent act of thinking and speaking. Cavell’s charge against the skeptic about the external world is that he seeks to think and speak beyond these limits. In this paper I compare Cavell’s (...) response to the skeptic to Davidson’s. Both base their responses on a broadly Kantian approach that appeals to the conditions under which thinking or speaking about objects is possible. On this approach the skeptic isn’t giving a false answer to an intelligible question, but rather, the question to which the skeptic is giving an answer is shown to be in some way unintelligible. But while Davidson’s critique of the skeptic is based on the conditions of ascribing meaning to one’s words, and contents to one’s beliefs, Cavell’s critique is based on the failure of the skeptic to mean the words he uses in the way that he needs. This difference expresses an underlying disagreement about the meaning of “meaning”: for Davidson the world comes into view through the meaning of our words and concepts, through the contents of our beliefs; for Cavell, the world comes into view through the agreement in “criteria” that are a condition of applying words and concepts to the world. This difference illuminates what Cavell calls “the truth of skepticism”: the idea that “my relation to the world and to others in general is not one of knowing”. (shrink)

Since Japan adopted the concept of informed consent from the West, its inappropriate acquisition from patients in the Japanese clinical setting has continued, due in part to cultural aspects. Here, we discuss the current status of and contemporary issues surrounding informed consent in Japan, and how these are influenced by Japanese culture.

Background A baby hatch called the “Stork’s Cradle” has been in place at Jikei Hospital in Kumamoto City, Japan, since May 10, 2007. Babyklappes were first established in Germany in 2000, and there are currently more than 90 locations. Attitudes regarding baby hatches are divided in Japan and neither opinions for nor against baby hatches have thus far been overwhelming. To consider the appropriateness of baby hatches, we present and examine the validity of each major objection to establishing baby hatches. (...) Discussion There are various objections to baby hatches as follows: It violates a child’s right to know the identity of his or her biological parents by allowing anonymous birth; it neglects fulfillment of the biological parents’ basic obligation to raise their child and its very availability induces abandonment of infants; some people abuse it for very selfish reasons; it cannot save babies’ lives; the rights of one parent can be ignored if the other surrenders a child without his or her consent; it puts a baby in medical jeopardy; and it has no clear legal basis. The authors would argue that there are many plausible refutations for each objection mainly based on priority of child’s right to life, pregnant women’s vulnerability and necessity of anonymity, social responsibility to protect and raise children, differences between dropping a child off at a baby hatch and child neglect, limited function of social childcare center, inevitability of abuse by a minority of people, necessary distinction between outcomes that occur only because baby hatches exist and those that occur regardless of their existence, important local direct and upmost measures for women in trouble, and difference between ambiguous legality and illegality. Summary We argue that a certain number of baby hatches should continue to be established as a last resort, in a form that can maintain anonymity if the parent dropping the child off so desires. It should be supported if it is initiated with good intentions; if the maximum possible effort is made at said facility to protect the interests, rights, and safety of the child; and if no clear evidence of harm exists. In the present super-aging society, issues concerning what treatment should be given for incapacitated patients have become more important than ever before. This paper discusses whether or not an incapacitated patient’s refusal of treatment should be respected. The authors present a complete hypothetical scenario involving a 75-year-old moderately demented man suffering from malignant lymphoma. Of primary importance are the respect for patient dignity and the protection of human rights. Acts such as coercion, disregard, restriction, and surveillance can be unethical in (...) many situations. The effectiveness of chemotherapy for malignant lymphoma and its adverse outcomes could offset each other, leaving no net benefits for the patient. The patient is vulnerable and this very vulnerability requires the utmost protection and care. However, protection must be sensitive and comprehensive and the protection of his life at the expense of many other valuable factors is not justifiable. Coercing unwanted treatment would be intrusion, not protection, because of the physical and psychological suffering. When the refusal is explicit, consistent, and stable enough, it should to be viewed as true and current desire. Due to moderate dementia, the patient has lost his rational capacity, but his emotional capacity remains. If the remaining portion of his personality is rooted in his feelings, these feelings should be respected as much as possible. Those involved in the care of the patients who refuse treatment should not force them to undergo it simply on the grounds that it may be an established standard in their own country. What must be asked first is whether or not forced treatment would promote the patient’s subjective well-being. Additionally, treatment decisions should not be distorted due to the selfishness or discriminatory feelings of those involved in his care. In situations in which patients lack decisionmaking capacities, overriding the patients’ refusals of treatment should be regarded as an exception, rather than a standard course of action. Even in patients who are incapacitated, treatment refusal could stem from the feelings of the individual. Their subjective wellbeing would not be improved through close observation, restraint, denial, and coercion, the purpose of which they does not understand. (shrink)

In recent years, a number of news stories were reported worldwide involving brain-dead pregnant women. Debates over providing life support to braindead pregnant women and delivery of their children have been around for some decades. Maintaining a woman’s life solely for fetal viability has become a major controversial social issue. Opposing opinions exist where one side supports the woman and her child should be left to die in dignity and the other side claims to protect the unborn child’s right to (...) live. Each group has strong beliefs. This paper addresses main aspects when considering the continuation of somatic support to the brain-dead pregnant woman for the purpose of fetus delivery including; human death, dignity of the woman, rights of the fetus, proportionality of acts, and the woman’s donor status, and independence of mother and fetus. Then, the authors present several diverse opinions and positions concerning the legitimacy of life support for brain-dead women based on them and critically evaluate them. We show that each and every claim can be ethically refuted. This paper also approaches to those claims from three different points of views, which are that of the brain-dead woman, her fetus and her family. We believe that the brain-dead woman’s wish and dignity, the child’s predicted wellbeing after birth, and the family’s beliefs and welfare should all be counted equally when making the final decision. In conclusion, we argue that the decision can be ethically justified only when the interests of all parties are appropriately taken into consideration and protected. (shrink)

This article explores what enables a space to become festive. We start by reviewing how the festive has been deeply connected with play, to the point of being considered a type of play, or more generally, a type of interaction. What enables the festive is the ability to interact with the substance on which participants feast. The question we will then explore in more detail is: given a subject matter from which to build a festive occasion or space, how do (...) we go about making it happen? How do we model the festive space? It is impossible to show that there is only one way of going about enacting the festive. For this reason, it is more productive to propose a model of how to achieve such task. The model that emerges in this article proposes that dismembering the festive substance, in a participatory way, facilitates its enactment. We then examine two cases of festive enactment in different mediums: the textual feast of Julio Cortázar’s novel Hopscotch that turns the printed page into a festive space, and the making of festive theatre, including the creation of the festive play Fire ’Scapes. This article examines how narratives mediate human interactions with environments to create a sense of place and identity. We begin with a review of the Greek poem Phaenomena to see how constellations brought a human dimension to the cosmos as well as a sense of predictability. A review of Jean-Paul Sartre’s Nausea illustrates the conception of indifferent space that erases the human presence, and how the imagination comes into play to fill the void. We examine how narratives work to model (...) aspects of environments and draw out meaning where before there was raw substance. Two seminal poems of Baudelaire then present a more subjective modeling of the environment. Pablo Neruda let his poetic vision be reflected in his three homes as protective playgrounds for his imagination. The article concludes that the models we examined are sheltering niches that help us feel at home in the world. As environments turn out to be more interactive, fragile, and complex than previously thought, our narratives also have to reflect on their impact on the sense of home they propose. (shrink)

Substantial evidence supports the perspective that the people of Ancient Greece had a language for and some use for drugs, both for the purpose of medicine and poison; however, the question remains whether Ancient Greek civilization held a concept approximating what we today call drug addiction. This article explores the textual evidence for the use of two drugs, nepenthes and cannabis, in Ancient Greece. While the existence of nepenthes remains in doubt, the use of cannabis is well documented. Either drug (...) or both drugs may have been used in the rites of the Bacchic and Orphic mysteries, which might explain why there are so few references to these drugs in the Ancient Greek literature.
