Much has been written about recidivist punishments, particularly within the area of criminology. However there is a notorious lack of penal philosophical reflection on this issue. This book attempts to fill that gap by presenting the philosopher’s view on this matter as a way of furthering the debate on recidivist punishments.

For elite athletes seeking a winning advantage, manipulation of their own genetic code has become a realistic possibility. In Genetic Technology and Sport, experts from sports science, genetics, philosophy, ethics, and international sports administration describe the potential applications of the new technology and debate the questions surrounding its use.

Recent developments within genetics are encouraging. Many ill people have already been treated with genetic therapy with positive results and virtually no negative side effects. Parallel to this positive prospect, worries have been expressed about the possible application of the new medical techniques for enhancement purposes. The use of genetic technology in the world of sports has been conceived of as especially problematic, since in some cases it might violate the present ban on gene doping. Gene therapy may be applied (...) to re‐engineer a sportperson's body thereby enhancing athletic performance. This chapter presents a brief account of current discussion on the enhancement of human physical capacities, particularly in (elite) sports. First the natural scientific picture is described, followed by a discussion of the ethical implications of enhancement technologies. (shrink)

Advances in genetic technology will enable us to intervene in human biological development to prevent and cure diseases, to restore individuals' functions and capacities back to a normal level after injury and even to enhance them beyond what has hitherto been considered as normal functioning for our species. Such a power to reshape and modify the human condition raises fundamental questions that touch upon the central core of morality. One of these questions is distributive justice. Will all people have equal (...) access to the beneficial effects of genetic technology in general and medical genetics in particular? Most of the new therapeutic and enhancement techniques will probably be quite expensive. That means that, probably during a long period of time after the new genetic technology enters medical practice, its use will be practically monopolized by the rich, to the detriment of all those who are not in a position to afford genetic treatments. In this paper, I argue that the health care inequality that inevitably will follow from the adoption of genetic technology, while posing a challenge to provide as long as possible for genetic interventions for all, is hardly a reason to reject the new technology. In that case, we would have to reject any new medicine or medical technique that cannot be made available to all people at once. Finally, I also argue that the ?enhanced new world? that would follow the introduction of genetic technology, even with the kind of inequality that might then arise, poses no serious threat either to elite sports or to society and should therefore be welcome. Professionalism and widespread sponsorship brought about for athletes the prospect of getting considerable rewards for their efforts. This, no doubt, puts them under great temptations. Illicit short cuts to victory, though obviously not providing excellence in a sport discipline, might nonetheless secure economic benefits as well as fame and respect, at least as long as the unfair strategy for victory is not uncovered. Doping is one of those short cuts. To many people, this indicates that the current development that professional, (...) elite sport is undergoing is unsound. In this article I will try to answer to this criticism sustaining that the doping ban is unjustified and should therefore be lifted. (shrink)

In this article I pursue two aims. First I advance an internal critique of hard-core retribution as it is usually advanced by victims of human rights violations. The focus of this penal approach on submitting all the military personnel guilty of human rights violations to harsh punishments risks jeopardizing the (clearly retributive) demand of punishing all those involved in the abuses. Particularly when extensive time has elapsed after the misdeeds, the most rational policy seems to be a negotiation model that (...) offers gross human rights abusers punishment reductions in exchange for valuable information about the facts. Defending such a penal negotiation model constitutes the second aim of this article. I conclude that in order to satisfy the (hard-core) retributive demand of punishing all those (both military and civilian) guilty of human rights abuses, it is required not to submit all military personal indicted to retributive punishments. Traditionally the doping debate has been dominated by those who want to see doping forbidden (the prohibitionist view) and those who want to see it permitted (the ban abolitionist view). In this article, the authors analyse a third position starting from the assertion that doping use is a symptom of the paradigm of highly competitive elite sports, in the same way as addictions reflect current social paradigms in wider society. Based upon a conceptual distinction between occasional use, habitual use and (...) addiction, and focusing on the physical and/or mental dependency caused by the addictive use of a certain drug, we argue that marihuana, stimulants and anabolic steroid abuse—the most frequently detected substances in doping tests—satisfies at least one, often both, of these conditions. A conclusion to be drawn from the authors' arguments is that the prohibitionist view is inappropriate for dealing with doping, as the severe sanctions attached to it will cut the doper off her/his social and professional environment, thereby risking reinforcing her/his addictive conduct. But the ban abolitionist view seems inappropriate as well. At first sight, it seems neither rational nor humane not to intervene when confronted with conduct which is highly harmful for the individual and upon which she has reduced or no control whatsoever. Instead the authors' proposal will be to contextualise dopers' conduct within sport healthcare and see it strictly in relation to each athlete's personal background. Developing preventive programmes—implemented through person-tailored counselling and eventually treatment, rather than severe sanctions or the mere lifting of the ban—seems to be a more reasonable, and probably more efficient, way of conducting ‘the war against doping’. According to estimates more than 400 biobanks currently operate across Europe. The term ‘biobank’ indicates a specific field of genetic study that has quietly developed without any significant critical reflection across European societies. Although scientists now routinely use this phrase, the wider public is still confused when the word ‘bank’ is being connected with the collection of their biological samples. There is a striking lack of knowledge of this field. In the recent Eurobarometer survey it was demonstrated that even in (...) 2010 two-thirds of the respondents had never even heard about biobanks. The term gives the impression that a systematic collection of biological samples can constitute a ‘bank’ of considerable financial worth, where the biological samples, which are insignificant in isolation but are valuable as a collection, can be preserved, analysed and put to ‘profitable use’. By studying the practices of the numerous already existing biobanks, the authors address the following questions: to what extent does the term ‘biobank’ reflect the normative concept of using biological samples for the purposes of biomedical research? Furthermore, is it in harmony with the so far agreed legal–ethical consensus in Europe or does it deliberately pull science to the territory of a new, ambiguous commercial field? In other words, do biobanks constitute a medico-legal fiction or are they substantively different from other biomedical research protocols on human tissues? (shrink)

When subjects view stimulation of a rubber hand while feeling congruent stimulation of their own hand, they may come to feel that the rubber hand is part of their own body. This illusion of body ownership is termed ‘Rubber Hand Illusion’ . We investigated sensitivity of RHI to spatial mismatches between visual and somatic experience. We compared the effects of spatial mismatch between the stimulation of the two hands, and equivalent mismatches between the postures of the two hands. We created (...) the mismatch either by adjusting stimulation or posture of the subject’s hand, or, in a separate group of subjects, by adjusting stimulation or posture of the rubber hand. The matching processes underlying body ownership were asymmetrical. The illusion survived small changes in the subject’s hand posture, but disappeared when the same posture transformations were applied to the rubber hand. Mismatch between the stimulation delivered to the subject’s hand and the rubber hand abolished the illusion. The combination of these two situations is of particular interest. When the subject’s hand posture was slightly different from the rubber hand posture, the RHI remained as long as stimulation of the two hands was congruent in a hand-centred spatial reference frame, even though the altered posture of the subject’s hand meant that stimulation was incongruent in external space. Conversely, the RHI was reduced when the stimulation was incongruent in hand-centred space but congruent in external space. We conclude that the visual–tactile correlation that causes the RHI is computed within a hand-centred frame of reference, which is updated with changes in body posture. Rapid advancements in human neuroscience and neurotechnology open unprecedented possibilities for accessing, collecting, sharing and manipulating information from the human brain. Such applications raise important challenges to human rights principles that need to be addressed to prevent unintended consequences. This paper assesses the implications of emerging neurotechnology applications in the context of the human rights framework and suggests that existing human rights may not be sufficient to respond to these emerging issues. After analysing the relationship between neuroscience and human rights, (...) we identify four new rights that may become of great relevance in the coming decades: the right to cognitive liberty, the right to mental privacy, the right to mental integrity, and the right to psychological continuity. The article argues that AI can enhance the measurement and implementation of democratic processes within political parties, known as Intra-Party Democracy (IPD). It identifies the limitations of traditional methods for measuring IPD, which often rely on formal parameters, self-reported data, and tools like surveys. Such limitations lead to the collection of partial data, rare updates, and significant demands on resources. To address these issues, the article suggests that specific data management and Machine Learning (ML) techniques, such as natural language processing (...) and sentiment analysis, can improve the measurement (ML about) and practice (ML for) of IPD. The article concludes by considering some of the principal risks of ML for IPD, including concerns over data privacy, the potential for manipulation, and the dangers of overreliance on technology. The increasing availability of brain data within and outside the biomedical field, combined with the application of artificial intelligence (AI) to brain data analysis, poses a challenge for ethics and governance. We identify distinctive ethical implications of brain data acquisition and processing, and outline a multi-level governance framework. This framework is aimed at maximizing the benefits of facilitated brain data collection and further processing for science and medicine whilst minimizing risks and preventing harmful use. The advent of Generative AI, particularly through Large Language Models (LLMs) like ChatGPT and its successors, marks a paradigm shift in the AI landscape. Advanced LLMs exhibit multimodality, handling diverse data formats, thereby broadening their application scope. However, the complexity and emergent autonomy of these models introduce challenges in predictability and legal compliance. This paper analyses the legal and regulatory implications of Generative AI and LLMs in the European Union context, focusing on liability, privacy, intellectual property, and cybersecurity. It examines (...) the adequacy of the existing and proposed EU legislation, including the Artificial Intelligence Act (AIA), in addressing the challenges posed by Generative AI in general and LLMs in particular. The paper identifies potential gaps and shortcomings in the EU legislative framework and proposes recommendations to ensure the safe and compliant deployment of generative models. (shrink)

Many elite athletes try to imitate the effects of high altitude training by using hypoxic air machines. These training devices are thought to boost the oxygen carrying capacity of the blood and the production of red blood cells which are believed to yield an important competitive advantage in endurance sports. Hypoxic air machines do not contravene current antidoping regulations. However, many sports practitioners and some officials have expressed a feeling of uneasiness towards this new training technique, comparing it with traditional (...) doping. And, indeed, the introduction of hypoxic air machines paves the way for allowing doping in a near future.All sports related arguments that have been advanced in defence of these machines also support traditional doping. For instance, some objectors argue that hypoxic air machines render “a chemical advantage” and should therefore be forbidden. A standard defence against this criticism is that “even if it becomes more effective, training is still necessary for users of hypoxic air machines”. The same answer, however, could be given by supporters of lifting the prohibition on doping. Brain–computer interfacing technologies are used as assistive technologies for patients as well as healthy subjects to control devices solely by brain activity. Yet the risks associated with the misuse of these technologies remain largely unexplored. Recent findings have shown that BCIs are potentially vulnerable to cybercriminality. This opens the prospect of “neurocrime”: extending the range of computer-crime to neural devices. This paper explores a type of neurocrime that we call brain-hacking as it aims at the illicit access to and manipulation (...) of neural information and computation. As neural computation underlies cognition, behavior and our self-determination as persons, a careful analysis of the emerging risks of malicious brain-hacking is paramount, and ethical safeguards against these risks should be considered early in design and regulation. This contribution is aimed at raising awareness of the emerging risk of malicious brain-hacking and takes a first step in developing an ethical and legal reflection on those risks. (shrink)

The use of Intelligent Assistive Technology in dementia care opens the prospects of reducing the global burden of dementia and enabling novel opportunities to improve the lives of dementia patients. However, with current adoption rates being reportedly low, the potential of IATs might remain under-expressed as long as the reasons for suboptimal adoption remain unaddressed. Among these, ethical and social considerations are critical. This article reviews the spectrum of IATs for dementia and investigates the prevalence of ethical considerations in the (...) design of current IATs. Our screening shows that a significant portion of current IATs is designed in the absence of explicit ethical considerations. These results suggest that the lack of ethical consideration might be a codeterminant of current structural limitations in the translation of IATs from designing labs to bedside. Based on these data, we call for a coordinated effort to proactively incorporate ethical considerations early in the design and development of new products. (shrink)

Epistemic limitations concerning prediction and explanation of the behaviour of robots that learn from experience are selectively examined by reference to machine learning methods and computational theories of supervised inductive learning. Moral responsibility and liability ascription problems concerning damages caused by learning robot actions are discussed in the light of these epistemic limitations. In shaping responsibility ascription policies one has to take into account the fact that robots and softbots - by combining learning with autonomy, pro-activity, reasoning, and planning - (...) can enter cognitive interactions that human beings have not experienced with any other non-human system. He reviews a number of theories and approaches to bettering society and advocates, in particular, the innovation of making the educational system more ethically and spiritually directed--more inner directed than devoted to sustaining current economic or cultural models for society.
