It is outstanding in its originality and brilliance, its force of argument, and the relevance of its diagnosis. It is also outstanding in the arbitrariness of its argumentation from history and in the partiality with which the central problem is posed and developed. Its over-all impression, at least upon this reader, is not unlike Spengler's: irritation over much that is obviously one-sided and false and admiration for a political thinker of the first order who has something important to say. It (...) should be noted in parenthesis that Professor Brogan's Preface and the excellent translator's footnotes and epigraph add nothing to the merits of the book. They only add to the irritation: the Preface in its pretentiousness is mere advertisement, the translator's contributions are partly superfluous, partly misleading, and partly obnoxious in their gloating exploitation of the author's grosser prejudices. The ideas of Hans Morgenthau dominated the study of international politics in the United States for many decades. He was the leading representative of Realist international relations theory in the last century and his work remains hugely influential in the field. In this engaging and accessible new study of his work, William E. Modern jurisprudence has typically been presented as a debate between legal positivism and natural law. Though the demise of legal positivism has been touted despite its pre-eminence in past decades, it is clear that there remains a vigorous debate surrounding this theory. It is noteworthy that Hans J. Morgenthau’s legal thought and critique of legal positivism have remained unexplored in the context of this debate. Largely forgotten, his legal thought answers questions that lie at the heart of the (...) natural law and legal positivist debate. It showcases his deeply nuanced understanding of legal and political theory and contains a powerful and insightful commentary on the fundamental problems faced by international law. Building on existing literature, this paper unearths Morgenthau’s critique of legal positivism. It does this by re-examining his works, which address the question of whether moral considerations are relevant to determining the content of the law in force. It brings his legal thought to light, which highlights the artificiality of the division between law and morality and offers a nuanced analysis of problems inherent in international law. Ultimately, the paper challenges the claim that the law can be determined without resorting to moral judgement and shows how Morgenthau’s insights remain relevant to legal positivism and natural law debates today. The article unveils the intellectual indebtedness of Hans J. Morgenthau's realist theory of international power politics to Freudian meta- and group psychology. It examines an unpublished Morgenthau essay about Freudian anthropology written in 1930, placing this work within the context of Morgenthau's magna opera, the 1946 Scientific Man vs. Power Politics and the 1948 Politics among Nations. The article concludes that Morgenthau's international theory is ultimately based on the early instinct theory of Sigmund Freud. Freud (...) is thus to be seen as one of Morgenthau's intellectual fathers. A second main argument refers to the theoretical tradition that Morgenthau has founded within International Relations (IR), namely: political realism. By investigating its core principles, it is argued that realism also may be rooted in Freudian thought. Throughout, the article calls upon IR, Morgenthau scholarship, and international-political theory to take Freud seriously. (shrink)

Hans Morgenthau was a founder of the modern discipline of International Relations, and his Politics among Nations was for decades the dominant textbook in the field. The character of his Realism has frequently been discussed in debates on methodology and the nature of theory in International Relations. Almost all of this discussion has mischaracterized his views. The clues given in his writings, as well as his biography, point directly to Max Weber’s methodological writings. Morgenthau, it is argued, (...) was a sophisticated user of Weber’s views who self-consciously applied them in the sphere of International Relations in such a way that Realism provided an ideal-typical model of the rational and responsible statesman. This interpretation both explains Morgenthau’s views and shows them to be a serious, complex, and compelling response to the issues which have animated the controversies over International Relations theory after Waltz’s presentation of the methodological basis for his neo-Realism.
