¿Existe tensión entre la democracia y el nacionalismo? Quizá deberíamos empezar por hacernos la pregunta. Los críticos del nacionalismo, desde luego, han puesto especial énfasis en la existencia de esa tensión, denunciando que el nacionalismo es incompatible con la democracia. Y la historia parece ofrecerles un amplio respaldo, pues no pocos de los peores acontecimientos del siglo pasado, de las dos guerras mundiales a la violencia interétnica en la antigua Yugoslavia, han dado una pésima reputación al nacionalismo, asociándolo con toda (...) clase de injusticias y atrocidades. Pero tal posición ha sido puesta en cuestión por quienes consideran que es injusto extender esas acusaciones a todo nacionalismo y sus simpatizantes alegan la existencia de discursos y políticas nacionalistas que se desarrollan dentro de los cauces y requisitos democráticos. In this paper I will examine the relationship between constitutionalism and democracy as the alleged tensions between them appear in diagnoses about the crisis of liberal democracy. The issue is approached through the arguments of the German jurist Martin Kriele, who holds the thesis that there can be no sovereign in the constitutional State. I will begin by explaining this thesis as well as the justification offered by Kriele. According to him, the guarantee of rights and freedoms is only possible (...) within the framework of the constitutional State. Hence, he advances a second related thesis, that democracy can only be developed in the constitutional State, that is, as constitutional democracy. However, this second thesis seems in contradiction with the first if the democratic principle implies popular sovereignty. To resolve this apparent antinomy, I will distinguish with Kriele two rival conceptions of democracy in order to point out the danger of misinterpreting the meaning of constitutional democracy. -/- En este trabajo examino la relación entre constitucionalismo y democracia, puesto que las supuestas tensiones entre ambos aparecen en los diagnósticos sobre la crisis de la democracia liberal. La cuestión se aborda a través de los argumentos del jurista alemán Martin Kriele, quien defiende la tesis de que no puede haber soberano en el Estado constitucional. Empezaré por explicar dicha tesis así como la justificación de ella que ofrece Kriele, para quien la garantía de los derechos y libertades sólo es posible en el marco del Estado constitucional. De ahí que avance una segunda tesis relacionada, cuando sostiene que la democracia sólo puede desarrollarse en dicho Estado constitucional, esto es, como democracia constitucional. Sin embargo, esta segunda tesis parece contradictoria con la primera si identificamos el principio democrático con la soberanía popular. Para resolver esa aparente antinomia, se distinguiré con Kriele dos concepciones rivales de la democracia, a fin de señalar el peligro de malinterpretar el sentido de la democracia constitucional. In this paper I argue that the idea of human dignity has a precise and philosophically relevant sense. Following recent works,we can find some important clues in the long history of the term.Traditionally, dignity conveys the idea of a high and honourable position in a hierarchical order, either in society or in nature. At first glance, nothing may seem more contrary to the contemporary conception of human dignity, especially in regard to human rights.However,an account of dignity as high rank provides (...) an illuminating perspective on the role it plays in the egalitarian discourse of human rights. In order to preserve that relational sense regarding human dignity, we can use the notion of moral status, towhich somemoral philosophers have paid attention in recent years.I explore the possibilities of the idea of moral status to better understand the idea of human dignity and its close relationship with human rights. The COVID-19 global health emergency has greatly impacted the educational field. Faced with unprecedented stress situations, professors, students, and families have employed various coping and resilience strategies throughout the confinement period. High and persistent stress levels are associated with other pathologies; hence, their detection and prevention are needed. Consequently, this study aimed to design a predictive model of stress in the educational field based on artificial intelligence that included certain sociodemographic variables, coping strategies, and resilience capacity, and to study the (...) relationship between them. The non-probabilistic snowball sampling method was used, involving 337 people from the university education community in south-eastern Spain. The Perceived Stress Scale, Stress Management Questionnaire, and Brief Resilience Scale were administered. The Statistical Package for the Social Sciences was used to design the architecture of artificial neural networks. The results found that stress levels could be predicted by the synaptic weights of coping strategies and timing of the epidemic, with a predictive capacity of over 80% found in the neural network model. Additionally, direct and significant associations were identified between the use of certain coping strategies, stress levels, and resilience. The conclusions of this research are essential for effective stress detection, and therefore, early intervention in the field of educational psychology, by discussing the influence of resilience or lack thereof on the prediction of stress levels. Identifying the variables that maintain a greater predictive power in stress levels is an effective strategy to design more adjusted prevention programs and to anticipate the needs of the community. Stephen May (2011) holds that language rights have been insufficiently recognized, or just rejected as problematic, in human rights theory and practice. Defending the “human rights approach to language rights”, he claims that language rights should be accorded the status of fundamental human rights, recognized as such by states and international organizations. This article argues that the notion of language rights is far from clear. According to May, one key reason for rejecting the claim that language rights should be considered (...) as human rights is the widespread belief that language rights are collective rights. In order to address this kind of objection, the collective character attributed to language rights must be carefully assessed, distinguishing two different views of what a collective right is. While tolerance is acclaimed almost unanimously as an indispensable value in pluralistic and democratic societies, the meaning of this virtue is in fact far from obvious. There are good reasons to believe that the inflationary expectations addressed to it tend to cover up its specific difficulty. The A. therefore offers a conceptual analysis of the conditions of tolerance, placing particular emphasis on the conflict of reasons internal to the tolerating person, and pointing to the reflective structure of practical reason. In (...) this formal characterization, tolerance appears as a kind of permission grounded in the principle of exclusion of certain reasons for acting. If indeed tolerance presupposes such a complex balance of reasons, its moral value can never be taken for granted since it depends entirely on the quality of the reasons on the balance sheet. A lo largo de su obra Ronald Dworkin ha planteado una cuestión crucial acerca de la libertad de expresión: ¿es un derecho tan importante que su protección exige permitir formas de expresión que consideramos despreciables, ofensivas o socialmente dañinas? En este trabajo me gustaría analizar la reflexión del filósofo en torno a tal cuestión, centrándonos en la pornografía y los discursos del odio. Estas formas de expresión constituyen un desafío para los defensores de esa libertad, pues nos obligan a revisar (...) los argumentos tradicionales empleados en su defensa. Para ello, consideraré en primer lugar la cuestión de si existe un derecho a la pornografía y cómo se podría justificar. Después revisaré su polémica con autoras feministas como Catharine MacKinnon a propósito de la prohibición de la pornografía, pues varias de las cuestiones son pertinentes en relación con los discursos del odio. Para concluir examinaré el modo en que R. Dworkin replantea la defensa de la libertad de expresión, pues tiene relevancia en el contexto de la discusión sobre la penalización de los discursos del odio. (shrink)

El derecho a la privacidad está en el centro de muchos de los debates públicos actuales. Sin embargo, a pesar de la extensa literatura filosófica y jurídica sobre el tema, no contamos con una explicación adecuada del sentido y del valor de la privacidad. Esta falta de acuerdo sobre cuestiones conceptuales y normativas ha llevado a algún autor a hablar del ‘caos de la privacidad’. Este artículo se centra en la exploración conceptual de la privacidad. Para ello, en primer lugar, (...) consideraré cómo el derecho a la privacidad fue formulado por primera vez en el célebre artículo de Warren y Brandeis. Segundo, en la medida en que el derecho a la privacidad es sistemáticamente traducido en español como ‘derecho a la intimidad’, resulta crucial analizar con cuidado la confusa relación entre intimidad y privacidad. Con este fin, en las dos últimas secciones del trabajo discutiré algunas explicaciones de cómo trazar la distinción entre ambas nociones y cómo entender su intrincada relación. (shrink)

Recent debates on linguistic diversity inevitably raise questions about the value of languages. This paper deals with two descriptions of language’s value that play a prominent role in those debates: language considered as a means of communication and a cultural heritage. Its purpose is explanatory, providing an account of how languages are assessed in each of these descriptions. Moreover, the paper will also pay attention to the rhetorical uses of such value descriptions in the discourses on linguistic diversity, considering the (...) intrinsic value given to language as a cultural heritage. El presente trabajo investiga las tesis sobre el poder civil de Alonso de la Veracruz que buscan incorporar en la comunidad política española a los habitantes autóctonos del Nuevo Mundo, tesis que suelen relacionarse con F. de Vitoria y el tomismo español, y que últimamente son consideradas parte del republicanismo novohispano elaborado desde la periferia americana. Se busca demostrar que su propósito era aplicar una teoría de derechos naturales, sin que ello implique participación política de los indios americanos. The paper explores Alonso de la Veracruz's theses on civil power, which sought to integrate the native inhabitants of the New World into the Spanish political community. These theses, which have usually been associated with F. de Vitoria and Spanish Thomism, have recently come to be considered part of a Novohispanic republicanism developed in the American periphery. The article seeks to show that the purpose of such theses was to apply a theory of natural rights that did not entail the political participation of the indigenous population, as well as to analyze Veracruz's position regarding cultural diversity and the war against the indigenous peoples. The purpose of this paper is to analyze some of the philosophical problems that derived of the Spanish conquest of America in the perspective of the Spanish Dominican Francisco de Vitoria. Specifically this paper will try to prove that Vitoria considered the Indian commonwealths in the New World, or least some of them, as genuine political entities with the same rights to exercise dominium of their lands and goods as their Europeans counterparts. To justify this, it will be necessary to (...) analyzed key concepts in Vitoria’s thought such as dominium, natural law, and the origins of the civil society. Nevertheless, at the end, it will be examined in which ways Vitoria considers Indian commonwealths inferior to the Europeans, in order to justify the Spanish conquista of the New World. (shrink)

The objective of this work is to analyze the relation between active life, nobility and liberty in Thomas More s Utopia. In Quentin Skinners interpretation, Moro argues that the true nobility should not be understood as abundance of wealth, but as willingness to provide good services for the commonwealth. In first place, this paper will show some classical interpretations in favor and against of active and contemplative life. Second, it will contrast the propositions of two strands of Humanism found in (...) The Utopia; one closer to Plato and Greek philosophy, the other inspired in Roman civic philosophy. Third, I will show the relation between active life and nobilitas in Mores Utopia. Finally, I will try to link these concepts with the notion of liberty developed by Skinner and More. O objetivo deste trabalho é re-analisar, a partir da interpretação de Quentin Skinner, a relação entre vida ativa, nobreza e liberdade em A Utopia de Tomás Moro. Para o pensante inglês, o conceito de nobilitas de Moro não se entende como a abundância de riquezas, mas como a disposição a sacrificar-se pelo bem comum. Em primeiro lugar, se mostrarão diversas interpretações a favor e contra da vida contemplativa e a vida ativa na tradição política clássica. Em segundo lugar, se mostrará como são contrastadas duas correntes humanistas dentro do contexto de A Utopia; uma de tendencia platónica e outra relacionada com o humanismo cívico de inspiração romana. Terceiro, se tratará de mostrar o vínculo entre vida ativa e nobilitas em A Utopia de Moro. Por último, se buscará a relação entre esta noção de nobreza com a concepção de liberdade que propõem Skinner e Moro. El objetivo de este trabajo es reanalizar, a partir de la interpretación de Quentin Skinner, la relación entre vida activa, nobleza y libertad en La Utopía de Tomás Moro. Para el pensador inglés, el concepto de nobilitas de Moro no se entiende como la abundancia de riquezas, sino como la disposición a sacrificarse por el bien común. En primer lugar, se mostrarán diversas interpretaciones a favor y en contra de la vida contemplativa y la vida activa en la tradición política clásica. En segundo lugar, se verá como son contrastadas dos corrientes del humanismo dentro del contexto de La Utopía. Una de corte platónico y otra relacionada con el humanismo cívico de inspiración romana. Tercero, se tratará de mostrar el vínculo entre vida activa y nobilitas. Por último, se buscará la relación entre esta noción de nobleza con la concepción de libertad que proponen Skinner y Moro. The objective of this works in to analyze the conditions of transference of sovereignty and the concept of natural liberty in William of Ockham. Firstly, I briefly explain some antecedents of the conflict of ‘investidures’. Secondly, I will show that Ockham advanced the existence of a set of natural rights hold by the community. This permitted to argue against the Papal interference in the secular sphere, but also to set limits to the emperor himself and grant the individual with natural (...) rights. Thirdly, I explain the differences between ius fori and ius poli and I suggest that Ockham did not provide point of contact between these laws, excepting in the case of liberty. 8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. Running marathons is an increasingly popular activity with an ever-increasing number of events and participants. Many participants declare that they pursue a variety of goals by running, namely, the maintenance of good health, the development of strength and improvement of fitness, the management of emotions, and the achievement of resilience and psychological wellbeing. The research has examined marathon running, like many other sports, and has studied various factors that reduce athletic performance, such as the experience of anxiety, and that enhance (...) such performance, such as an increase in general wellbeing. This article reports the results of a study on the experience of competitive anxiety among 238 male marathon runners who participated in Seville’s 26th Marathon race on February 23, 2020, and investigates the relationship between anxiety and key dimensions of wellbeing as measured by the Spanish-adapted 20-item PWB Scale. We hypothesized that participating athletes who rated high on the dimensions of PWB would experience lower levels of competitive anxiety with respect to this race. We also proposed that PWB would function as a mediating factor with respect to the experience of anxiety. The results show, as hypothesized, that marathon running enhances wellbeing and reduces anxiety. The data showed significant negative correlations between four of five wellbeing dimensions and the three types of anxiety measured, namely, somatic anxiety, worry, and concentration-impairing anxiety. Other findings supported our hypothesis that wellbeing, as measured, functions as a mediating factor for the moderation of competitive anxiety. Generalization of these findings is limited by the fact that the low number of female participants recruited did not permit valid statistical analyses in this respect. It is known that both anxiety and wellbeing are subjects to variation by gender. The future inclusion of male and female subjects in equivalent studies will undoubtedly add valuable information concerning the dynamics of anxiety and wellbeing. The implications of these findings and the limitations of the study will be discussed. (shrink)

Artificial intelligence is a useful predictive tool for a wide variety of fields of knowledge. Despite this, the educational field is still an environment that lacks a variety of studies that use this type of predictive tools. In parallel, it is postulated that the levels of self-esteem in the university environment may be related to the strategies implemented to solve problems. For these reasons, the aim of this study was to analyze the levels of self-esteem presented by teaching staff and (...) students at university and to design an algorithm capable of predicting these levels on the basis of their coping strategies, resilience, and sociodemographic variables. For this purpose, the Rosenberg Self-Esteem Scale, the Perceived Stress Scale, and the Brief Resilience Scale were administered. The results showed a relevant role of resilience and stress perceived in predicting participants’ self-esteem levels. The findings highlight the usefulness of artificial neural networks for predicting psychological variables in education. (shrink)

El caso Mendez v. Westminster es de suma trascendencia en el desarrollo del derecho a la igualdad y la supresión de la segregación racial. El caso propició la modificación de las leyes del Estado de California, aumentando el acceso igualitario de los niños a la educación. Pero sin duda su mayor influencia fue sobre la sentencia del caso Brown v. Board of Education, cuyas directrices se cimentaron en las consideraciones y alcances del caso Mendez.

Las tres novelas escogidas responden a la decadencia económica de Valparaíso a mediados del siglo XX al representar el espacio y la sociedad, así como los afectos predominantes: Valparaíso, puerto de nostalgia de Salvador Reyes, se sitúa en el Plan de la ciudad y fluctúa entre la idealización nostálgica de la burguesía inglesa y la bohemia del presente; Hijo de ladrón de Manuel Rojas y El mundo herido de Armando Méndez Carrasco, privilegian, en cambio, el espacio de los (...) cerros y transitan hacia un período de duelo frente al tiempo perdido, actualizando, respectivamente, los valores ilustrados y la comunidad tradicional.
