Discharges against medical advice (AMA) make up a significant number of hospital discharges in the United States, and often involve vulnerable patients who struggle to obtain adequate medical care. Unfortunately, much of the AMA discharge process focuses on absolving the medical center of liability for what happens to these patients once they leave the acute setting. Comparatively little attention is paid to the ethical obligations of the medical team once an informed decision to leave the acute care setting AMA has (...) been made. Via a case narrative, we offer an ethical framework that we believe can help guide an ethically defensible AMA discharge process. By emphasizing our duty to provide the best care possible under the circumstances, we contend, our ethical obligations to promote the patient's best interests can still be met despite their decision to leave the acute setting against medical advice. According to the JUSTIFIED FAIR COINS principle, if I know that a coin is fair, and I lack justification for believing that it won’t be flipped, then I lack justification for believing that it won’t land tails. What this principle says, in effect, is that the only way to have justification for believing that a fair coin won’t land tails, is by having justification for believing that it won’t be flipped at all. Although this seems a plausible and innocuous principle, (...) in a recent paper Dorr, Goodman and Hawthorne use it in devising an intriguing puzzle which places all justified beliefs about the future in jeopardy. They point out, further, that one very widespread theory of justification predicts that JUSTIFIED FAIR COINS is false, giving us additional reason to reject it. In this paper, I will attempt to turn this dialectic around. Dialog itu mulai dan berakhir dengan penukaran pandangan tentang topik dialog sendiri sebagaimana mereka usahakan. Latarnya adalah Argentina yang karena sejarahnya telah lupa akan seni untuk saling mendengarkan dan berbicara dengan satu sama lain. Di tengah kebuntuan (...) itu kedua tokoh agama ini mulai berjumpa dalam suatu seri percakapan yang terus berkembang. Atas usul Skorka, sejumlah dari percakapan mereka akhirnya dipublikasikan. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

The one-page 1978 informal proof of Goodman and Myhill is regimented in a weak constructive set theory in free logic. The decidability of identities in general (⁠|$a\!=\!b\vee\neg a\!=\!b$|⁠) is derived; then, of sentences in general (⁠|$\psi\vee\neg\psi$|⁠). Martin-Löf’s and Bell’s receptions of the latter result are discussed. Regimentation reveals the form of Choice used in deriving Excluded Middle. It also reveals an abstraction principle that the proof employs. The Tattvasaṃgraha, or Encyclopedia of Metaphysics, is the most influential and most frequently studied philosophical text from the late period of Indian Buddhism. This edition includes verses by Śāntarakṣita (c. 725-788 CE), which are clarified and expounded in the commentary of his student Kamalaśīla (c. 740-795 CE); both of these authors played crucial roles in founding the Buddhist tradition of Tibet. In the Tattvasaṃgraha, they explain, discuss and critique a vast range of views and arguments from across the whole South (...) Asian philosophical and religious spectrum. The work deals at length with ideas drawn from Buddhism, Jainism, and a variety of traditions now incorporated within Hinduism, including Mīmāṃsā, Nyāya-vaiśeṣika, and Sāṃkhya; it also includes the earliest discussion of Advaita Vedānta in any Buddhist text. The chapters selected for translation from Sanskrit and Tibetan deal with such fundamental philosophical issues as the existence or nonexistence of God and the soul; the nature of matter and of causal relationships; the connection between words and their referents; the rules of logic; the sources of our knowledge; and the compatibility of beliefs about karma with Buddhism's fundamental claim that there is no self. Closest-possible-world analyses of counterfactuals suffer from what has been called the ‘problem of counterpossibles’: some counterfactuals with metaphysically impossible antecedents seem plainly false, but the proposed analyses imply that they are all (vacuously) true. One alleged solution to this problem is the addition of impossible worlds. In this paper, I argue that the closest possible or impossible world analyses that have recently been suggested suffer from the ‘new problem of counterpossibles’: the proposed analyses imply that some plainly true counterpossibles (viz., (...) ‘counterlogicals’) are false. After motivating and presenting the ‘new problem’, I give reasons to think that the most plausible objection to my argument is not compelling. (shrink)

An original study of late Enlightenment aesthetics, poetics, and environmental medicine as overlapping ways of comprehending the dislocations of historical existence lodged in the movements of bodies and minds This book studies later eighteenth-century medicine, aesthetics, and poetics as overlapping forms of knowledge increasingly concerned about the relationship between the geographical movements of persons displaced from home and the physiological or nervous "motions" within their bodies and minds. Looking beyond familiar narratives about medicine and art's shared therapeutic and harmonizing ideals, (...) this book explores Enlightenment and Romantic-era aesthetics and poetics in relation to a central but less well known area of eighteenth-century environmental medicine: pathology. No mere system of diagnosis or classification, philosophical pathology was an art of interpretation, offering sophisticated ways of reading the multiple conditions and causes of disease, however absent from perception, in their palpable, embodied effects. For medical, anthropological, environmental, and literary authors alike, it helped to locate the dislocations of modern mobility when a full view of their causes and conditions remained imperfectly understood or still unfolding. Orthodox Judaism is one of the fastest-growing religious communities in contemporary American life. According to the 2013 Pew Center Survey on American religious life, Orthodox Judaism is poised to surpass all other denominations of Judaism in the United States by 2050. Anyone who wishes to understand more about Judaism in America will need to consider the tenets and practices of Orthodox Judaism: who its adherents are, what they believe in, what motivates them, and to whom they turn for moral, intellectual, (...) and spiritual guidance. Among those spiritual leaders none looms larger than Rabbi Joseph B. Soloveitchik, heir to the legendary Talmudic dynasty of Brisk and a teacher and ordainer of thousands of rabbis during his time as a Talmud teacher at Yeshiva University from the Second World War until the 1980s. Soloveitchik was not only a Talmudic authority but a scholar of Western philosophy. While many books and articles have been written about Soloveitchik's legacy and his influence on American Orthodoxy, few have looked carefully at his disciples in Torah and Talmud study, and even fewer at his Jewish thought and philosophy. Th ere is much controversy surrounding the nature of the relation between fictional individuals and possible individuals. Some have argued that no fictional individual is a possible individual; others have argued that (some) fictional individuals just are (merely) possible individuals. In this paper, I off er further grounds for believing the theory of fictional individuals defended by Amie Thomasson,viz., Artifactualism, by arguing that her view best allows one to make sense of this puzzling relation. More specifically, when we realize that (...) the view allows for an identification of merely possible individuals with fictional individuals, we seethat the utility, and hence the level of credence lent to Artifactualism, is increased. How Classification Works attempts to bridge the gap between philosophy and the social sciences using as a focus some of the work of Nelson Goodman. Throughout his long career Goodman has addressed the question: are some ways of conceptualizing more natural than others? In der Literatur der deutschen Romantik wird die jüdische Mystik auch von christlichen Autoren wie Novalis, F. Schlegel, Brentano, Arnim und E.T.A. Hoffmann entdeckt. Während die Kabbala bei Theologen und Philosophen der Romantik als religiöse Urlehre der Menschheit und als Brücke zwischen rabbinischer Tradition und Christentum galt, fasziniert sie die Literaten als esoterische jüdische Zauber- und Geheimlehre sowie als Trope einer die Rationalität und die Autorenintentionen übersteigenden, magischen Eigenmächtigkeit von Sprache und Schrift.

Influential work on proper names, most centrally associated with Kripke (1980), has had a significant influence in the literature on singular thought. The dominant position among contemporary singularists is that we can think singular thoughts about any object we can refer to by name and that, given the range of cases in which it is possible to refer using a name, name use in fact enables singular thought about a name's referent. I call this the extended name-based thought thesis (extended-NBT). (...) This chapter outlines the reasoning and presumptions of theorists who adopt extended NBT, and also outlines a set of reasons to resist it. The piece is distinctive in approaching the question of the relation between names and singular thought by focusing on the function of names and what this function entails (or doesn’t) about the kinds of thoughts (singular or descriptive) we have when we use names to communicate. In short, thinking about the function of names tells against the claim that name-use enables singular thought. (shrink)

A long-standing theme in discussion of perception and thought has been that our primary cognitive contact with individual objects and events in the world derives from our perceptual contact with them. When I look at a duck in front of me, I am not merely presented with the fact that there is at least one duck in the area, rather I seem to be presented withthisthing (as one might put it from my perspective) in front of me, which looks to (...) me to be a duck. Furthermore, such a perception would seem to put me in a position not merely to make the existential judgment that there is some duck or other present, but rather to make a singular, demonstrative judgment, that that is a duck. My grounds for an existential judgment in this case derives from my apprehension of the demonstrative thought and not vice versa. (shrink)

Anlasslich des 100. Todestages von Hermann Cohen und 100 Jahre nach Erscheinen seines Spatwerkes "Religion der Vernunft aus den Quellen des Judentums" behandelt dieser Band im Spannungsfeld von Philosophie und Religion die Frage des Nationalen, die im gegenwartigen Prozess der Radikalisierung und Politisierung der religiosen und philosophischen Grundfragen von Vernunft und Ethik zunehmend an Bedeutung gewinnt. Eine Bedingung fur das Verstandnis von Cohens Kantkritik ist in diesem Zusammenhang ein systematisches Zusammenlesen seiner erkenntnistheoretischen Werke mit seinen "Judischen Schriften". Um dem Judentum, (...) sowohl im Deutsch-Nationalen als auch in der "christlichen Kultur", einen Ort einzuraumen, bricht Cohen die Begriffe des Nationalismus und der Kultur als solche auf und idealisiert sie humanistisch-universal. Den ethischen Idealismus sah Cohen gleichermassen begrundet in der Religion der Propheten, der sich die doppelsinnige Einheit von Monotheismus und Messianismus, d.h. das Ziel der einen Menschheit am Ende der Tage, verdankt. Der ursachliche Zusammenhang zwischen Monotheismus, Wahrheit, Ethik und Jurisprudenz im Judentum fuhrt Cohen in seinem Spatwerk zu einer neuen Definition von Religion und Kultur. (shrink)

Is it OK to lie to Siri? Is it bad to mistreat a robot for our own pleasure? Under what condition should we grant a moral status to an artificial intelligence (AI) system? This paper looks at different arguments for granting moral status to an AI system: the idea of indirect duties, the relational argument, the argument from intelligence, the arguments from life and information, and the argument from sentience. In each but the last case, we find unresolved issues with (...) the particular argument, which leads us to move to a different one. We leave the idea of indirect duties aside since these duties do not imply considering an AI system for its own sake. The paper rejects the relational argument and the argument from intelligence. The argument from life may lead us to grant a moral status to an AI system, but only in a weak sense. Sentience, by contrast, is a strong argument for the moral status of an AI system—based, among other things, on the Aristotelian principle of equality: that same cases should be treated in the same way. The paper points out, however, that no AI system is sentient given the current level of technological development. (shrink)
