Certain works in the most recent Polish constitutional law literature suggest that there is acceptance of the principle or the concept of autonomous interpretation of a constitution (autonomy of interpretation of constitutional terms). The Constitutional Tribunal also makes reference to this in numerous rulings. Paradoxically, however, that concept is not very popular in legal theory. It might seem that Polish legal theoreticians and philosophers do not appreciate the concept of interpretation of a constitution devised through practice with the support of (...) constitutional law doctrine. It might, however, mean that opinions on autonomous interpretation of Polish Constitution are nothing more than rhetorical arguments formulated ad hoc not a coherent concept or a theory. Building on our diverse research traditions in the study of reasoning, language and communication, the Polish School of Argumentation integrates various disciplines and institutions across Poland in which scholars are dedicated to understanding the phenomenon of the force of argument. Our primary goal is to craft a methodological programme and establish organisational infrastructure: this is the first key step in facilitating and fostering our research movement, which joins people with a common research focus, complementary skills and an enthusiasm to work (...) together. David Lewis’s latest theory of causation defines the causal link in terms of the relation of influence between events. It turns out, however, that one event’s influencing another is neither a necessary nor sufficient condition for its being a cause of that event. In the article one particular case of causality without influence is presented and developed. This case not only serves as a counterexample to Lewis’s influence theory, but also threatens earlier counterfactual analyses of causation by admitting a particularly (...) troublesome type of preemption. The conclusion of the article is that Lewis’s influence method of solving the preemption problem fails, and that we need a new and fresh approach to the cases of redundant causation if we want to hold on to the counterfactual analysis of causation. In the late 2010s, various international committees, expert groups, and national strategy boards have voiced the demand to ‘open’ the algorithmic black box, to audit, expound, and demystify artificial intelligence. The opening of the algorithmic black box, however, cannot be seen only as an engineering challenge. In this article, I argue that only the sort of transparency that arises from critique—a method of theoretical examination that, by revealing pre-existing power structures, aims to challenge them—can help us produce technological systems that (...) are less deceptive and more just. I relate the question of AI transparency to the broader challenge of responsible making, contending that future action must aim to systematically reconcile design—as a way of concealing—with critique—as a manner of revealing. Anthropologists often have fieldwork experiences that are not explicitly analysed in their writings, though they nevertheless contribute to and shape their ethnographic understandings, and can resonate throughout their work for many years. The task of this volume is precisely to uncover these layers of anthropological knowledge-making. Contributors take on the challenge of reconstructing the ways in which they originally entered the worlds of research subjects - their anthropological Others - by focusing on pre-textual and deeply phenomenological processes of perceiving, noting, (...) listening and sensing. Drawing on a wide range of research experiences - with the Dogon in Mali, immigrant football players in Spain, the Inuit of the Far North, Filipino transnational families, miners in Poland and students in Scotland - this book goes beyond an exploration of the development of increased ethnographic sensitivity towards words or actions. It also commences the foundational project of developing a new language for building anthropological works, one stemming from recurring acts of participation, and rooted primarily in the pre-textual worlds of the tacit, often non-visible, and intense experiences that exceed the limitations of conventional textual accounts. The book _Metaphysics in Contemporary Physics_ offers various perspectives on the relation and mutual influence between modern physical theories and analytic metaphysics.

It is part of the phenomenology of perceptual experiences that objects seem to be presented to us. The first guide to objects is their perceptual presence. Further reflection shows that we take the objects of our perceptual experiences to be among the causes of our experiences. However, not all causes of the experience are also objects of the experience. This raises the question indicated in the title of this paper. We argue that taking phenomenal presence as the guide to the (...) objects of perception, we can see that at least in two sensory modalities, smell and touch, there is no uniform answer to this question. The objects of olfactory and tactile experiences can move along the causal chain. Accordingly, the content of olfactory and tactile experience may vary. (shrink)

One can often hear that intuitions are standardly “appealed to”, “relied on”, “accounted for”, or “used as evidence” in ethics. How should we interpret these claims? I argue that the typical understanding is what Bernard Molyneux calls “descriptive evidentialism”: the idea that intuition-states are treated as evidence of their propositional contents in the context of justification. I then argue that descriptive evidentialism is false- on any account of what intuitions are. That said, I admit that ethicists frequently rely on intuitions (...) to clarify, persuade, discover, or to support things other than the intuitions’ contents. The contents of intuitions are also commonly used as starting premises of philosophical arguments. However claims about these practices need to be sharply distinguished from the prevalent dogma. The article discusses the issue of the departure from examining real behaviours in a real environment, a trend in social psychology which has been observed going back several years, and the impact of this phenomenon for social psychology as a scientific discipline. The article presents two studies on the well-known and explored “bystander effect”. This phenomenon is examined in two ways – once by way of a “traditional” field experiment conducted in natural conditions, and once through a survey. As it (...) turned out, the results generated by the two studies were diametrically opposite, and only in the field experiment were we able to achieve a pattern of results consistent with those in the original studies. Corruption is an actual threat to democracy as it impairs the citizens’ trust towards the state. Therefore, it is necessary to undertake any actions that would prevent it; actions that would promote the formation of ethical structure in all departments of administration, as well as would build an ethical awareness among local government employees and city councilors. Ethical behaviour is dependent on clear procedures, good regulations and their proper interpretation. The principal objective should be to increase the citizens’ trust towards (...) public administration and to improve administrative work. That is why one of the most obvious techniques (but not the only one) of raising ethical standards is to implement an adequate system of choice and selection of employees. In Poland, when the moral standard of a candidate for a post in public administration comes under close scrutiny, any doubts are quite often eliminated by the assumption that, if the candidate is patronized by a third party, its authority is a warrant of his or her adequate ethical standard. Of course, it’s a wrong point of view. The above-mentioned examples indicate that the rules of ethics should be introduced to public administration work because they guarantee that the quality of services will be good, they will neutralize corruption and, if followed, they will enable preparing public administration officers and local government representatives to assume responsibility for their actions. Local government is not free from dilemmas arising from ethical but illegal actions as well as legal, however, unethical ones. This breeds situations in which officials must decide whether to be loyal to the government authorities or citizens, whom they are obliged to serve. For instance, they must decide whether to accept the policy imposed by the district council making them change their clerical rules of conduct which, in their opinion, will be less favourably inclined to citizens. Consequently, they will (...) be obliged either to take or refrain from taking certain actions, which stems from the inner imperative. At the root of this dilemma frequently lies a discord between law and ethics. The choice to be made leads to a moral dilemma. What is associated with this matter indeed is the question of revealing the truth about unethical, illegal, immoral or unlawful behaviour in the government that occurs with the employer’s silent approval. The so-called whistleblowing is the means to achieve it. The process is based on informing people or organizations who have the power to influence actions of the criticized individuals or organizations. This creates situations in which officials can no longer take advantage of two values and are made to choose only one of them. (shrink)

Ownership, as a basic value of a legal state is the subject to special protection guaranteed by a basic law. However, in certain situations acting for the benefit of public interest is, according to a legislator, takes priority over private ownership. Thus, in cases when public interest is at stake limitation of ownership title to property can be permitted by regulations. Expropriation of private property for the sake of public good is the solution used for many years in Poland and (...) in other countries. Basic preconditions for expropriation are described in art. 21 section 2 of The Constitution of the Republic of Poland. Private ownership in art. 21 of Polish Constitution was defined in a very general context without defining the subject. Thus, all the ownership is the subject to state protection without specifying the principles of this protection, which are regulated by ordinary acts. Guaranteeing right to private ownership does not mean the right is inviolable. Constitution allows for property expropriation for the benefit of public purposes after a just compensation. However, it must be emphasized that regulations relating to the rules of property expropriation as a special form of depriving ownership right by means of authoritarian state act, which is the exception from general civil and legal principles of transferring ownership title, must be applied literally, excluding admissibility of extensive interpretation. Provisions of the constitution are defined in the regulations of the Real Estate Management Act from 21st August 1997. (shrink)

The fundamental rules which should be followed by Notary Public are: honesty, reliability, detachment and impartiality, as well as keeping the professional secret. As a crucial participant in creating and carrying into effect legal structures of free market, Notary Public performs public functions. Therefore, he or she is authorized to give an official character to declarations of persons being their clients. In view of the foregoing, the notary should secure such documents in trading abiding by the rules and regulations of (...) the governing law and ethics. With a view to a special role of the profession in question in economic trade, The National Notary Board passed a Notary Public Code of Professional Ethics, by virtue whereof a Notary shall with their attitude and actions give a good character to their profession and mind its dignity and honor. Any breach of the above – mentioned rules results in the Notary’s liability. Notary Public, as a person whose functions play a crucial role in legal trade and who is trusted by the parties, is responsible for correctness and precision of their activities. Their liability as clients’ confidant may result in civil, legal, disciplinary and tax liability. (shrink)

The presented analyses are focusing on three predominant theoretical approaches in the philosophy of science and technology: technoscience (STS), technology assessment (TA) and converging technologies (NBIC). On this base are extrapolated the coordinates of the heuristics of technosciences.

Consider how we evaluate how normal an object is. On the dual-nature hypothesis, a normality evaluation depends on the object’s goodness and frequency. On the single-nature hypothesis, the evaluation depends solely on either frequency or goodness. To assess these hypotheses, I ran four experiments. Study 1 shows that normality evaluations vary with both the goodness and the frequency assessment of the object. Study 2 shows that manipulating the goodness and the frequency dimension changes the normality evaluation. Yet, neither experiment rules (...) out that some people evaluate normality solely based on frequency, and the rest evaluate normality solely based on goodness. Whence two more experiments. Study 3 reveals that when scenarios are contrasted—presented one after another—only frequency matters. But, as study 4 shows, when scenarios are evaluated alone, both frequency and goodness influence normality evaluations in a single person, although the more a person is sensitive to one dimension, the less she’s sensitive to the other. The dual-nature hypothesis seems thus true of uncontrasted applications of the concept of normality, whereas the single-nature hypothesis seems true of contrasted applications. (shrink)

In this paper we investigate Boolean connexive logics in a language with modal operators: □, ◊. In such logics, negation, conjunction, and disjunction behave in a classical, Boolean way. Only implication is non-classical. We construct these logics by mixing relating semantics with possible worlds. This way, we obtain connexive counterparts of basic normal modal logics. However, most of their traditional axioms formulated in terms of modalities and implication do not hold anymore without additional constraints, since our implication is weaker than (...) the material one. In the final section, we present a tableau approach to the discussed modal logics. (shrink)

Standard deontic logic (SDL) is defined on the basis of possible world semantics and is a logic of alethic-deontic modalities rather than deontic modalities alone. The interpretation of the concepts of obligation and permission comes down exclusively to the logical value that a sentence adopts for the accessible deontic alternatives. Here, we set forth a different approach, this being a logic which additionally takes into consideration whether sentences stand in relation to the normative system or to the system of values (...) under which we predicate the deontic qualifications. By taking this aspect into account, we arrive at a logical system which preserves laws proper to a deontic logic but where the standard paradoxes of deontic logic do not arise. W artykule podjęta jest próba intuicyjnej syntetycznej interpretacji sokratejskiej maieutyki w duchu psychologii homeryckiej. Bazując na tej interpretacji, opracowano ćwiczenie uświadomionego mówienia, które zostało włączone do zajęć akademickich: „Jak praktycznie wykorzystać własną głupotę? – doradztwo filozoficzne w warsztacie psychologa”, prowadzonych na Uniwersytecie Warszawskim i w Szkole Wyższej Psychologii Społecznej w latach 2004–2012. Na gruncie akademickim były to pierwsze w Polsce seminaria poświęcone doradztwu filozoficznemu. Podczas ćwiczeń studenci byli proszeni o zapisywanie swoich obserwacji. Niektóre ćwiczenia były filmowane. W ten sposób został (...) zebrany bardzo ciekawy materiał, który może być podstawą do dalszych poszukiwań teoretycznych i empirycznych. W artykule krótko przedstawiam, czym jest uświadomione mówienie, prezentuję zapiski z ćwiczeń studentów oraz wskazuję na krótki materiał filmowy. (shrink)
