The Oscar Wilde trials (1895) have usually been interpreted either as a historical document which gives insight into the regulation of sexuality in the late nineteenth century, or as literary biography explicating the playwright's life and works. Taking its cue from recent scholarship in ‘law and literature’, and also from Wilde's own conception of the relationship between art and life, this article proposes a reading of the trials which blurs the distinction between legal history and literary criticism by considering them (...) as a form of literature. It argues that the trial transcripts enact and reflect Wilde's vision of what literature is and how it should be read, and as such should be given a place amongst his literary works, alongside such aesthetic manifestos as ‘The Decay of Lying’ and ‘The Critic as Artist’. This article brings together feminist literary theory and law by approaching a number of U.S. Federal cases on sex equality in light of the work of the renowned feminist literary critic Naomi Schor, and shows that literary theory constitutes an under-explored resource for feminist legal critique. Schor’s writings constitute a sustained rumination on the relationship between reading and feminism. Drawing on writings on language and the body by key French feminist theorists, Schor advances a method of interpretation which she terms, (...) provocatively, ‘clitoral reading’, and which focuses on the place of details relating to women’s bodies and desires within literary and cultural discourses. In the course of her career, she analysed texts from domains as diverse as literature, philosophy, visual art, the history of fashion, and photography. I will demonstrate that her work can make a valuable contribution to legal studies by using it as an interpretative lens to re-examine U.S. Federal court judgments. (shrink)

This article draws on the ‘visual turn’ in legal studies to argue for the centrality of visibility in the analysis of the regulation of gay and lesbian identities, with a specific focus on Hong Kong. Part I gives an overview of the ways in which gay visibility operates within the cityscape of Hong Kong. Parts II and III then focus on the case of Cho Man Kit v. This paper takes a bottom-up approach to empirically investigate how people construct the meaning of obscenity, and offers an experientialist, cognitive linguistic account to explain why the term appears to defy definition and makes a problematic legal concept. To study the contextual dependence of the term, we examined the extent to which various item characteristics (such as genre, context, and the race or celebrity status of the people portrayed) and individual variables (such as gender, religion, sexual orientation and previous personal (...) and cultural experiences) influence our perception of seemingly obscene materials. We report correlations that have not been previously shown. The data support the thesis that the meaning of obscenity emerges in a cognitive-affective response that arises during a dynamic process of interpretation, and thus allows for extralegal factors to influence judgment. The results challenge the assumption that obscenity is a symbolic representation of objectively existing reality and argue that community standard of obscenity is a legal fiction. (shrink)

This study examines the influences of individual behaviour and organizational commitment towards the enhancement of Islamic Work Ethics at the Royal Malaysian Air Force. It involved 312 respondents of different backgrounds and the data were analysed using descriptive analysis and structural equation modelling analysis. The results show that both individual behaviour and organizational commitment have significantly correlated with the enhancement of IWE. The findings could help managers especially of multinational corporations operating in Muslim countries to enhance the company performances by (...) instituting elements of IWE in their organizations. This can be done by promoting the understanding of IWE and providing a conducive environment to practice it. (shrink)

This is the problem raised by Plato, which still today is the subject of lively philosophical disputes. This book traces the history of the problem, from its origins to its contemporary treatment. It discusses the answers given by Aristotle, Proclus and Kant, through Frege's and Russell's versions of logicism, Hilbert's formalism, Gödel's platonism, up to the the current debate on (...) Benacerraf's dilemma and the indispensability argument. Through the considerations of themes in the philosophy of language, ontology, and the philosophy of science, the book aims at offering an historically-informed introduction to the philosophy of mathematics, approached through the lenses of its most fundamental problem. The classification of medical interventions as either invasive or non-invasive is commonly regarded to be morally important. On the most commonly endorsed account of invasiveness, a medical intervention is invasive if and only if it involves either breaking the skin (‘incision’) or inserting an object into the body (‘insertion’). Building on recent discussions of the concept of invasiveness, we show that this standard account fails to capture three aspects of existing usage of the concept of invasiveness in relation to medical (...) interventions—namely, (1) usage implying that invasiveness comes in degrees, (2) that the invasiveness of an intervention can depend on the characteristics of the salient alternative interventions, and (3) that medical interventions can be invasive in non-physical ways. We then offer the beginnings of a revised account that, we argue, is able to capture a wider range of existing usage. Central to our account is a distinction between two properties: basic invasiveness and threshold invasiveness. We end by assessing what the standard account gets right, and what more needs to be done to complete our schematic account. (shrink)

In the Shuowen, one of the earliest comprehensive character dictionaries of ancient China, when discussing where the Chinese characters derive their structural components, Xu Shen proposed the dual constitutive principle of “adopting proximally from the human body, and distally from things around.” This dual emphasis of “body” and “things around” corresponds largely to the phenomenological issues of body or corporeality on the one hand, and lifeworld on the other. If we borrow Heidegger’s definition of Dasein as Being-in-the world, we can (...) easily arrive at a reformulation of Xu Shen’s constitutive principle of the Chinese script as one that concerns “bodily Dasein.” By looking into various examples of script tokens we can further elaborate on how the Chinese make use not only of the body in general but various body parts, and how they differentiate their life world into material nature, living things, and a multifaceted world of equipment in forming a core basis of Chinese characters/components, upon which further symbolic manipulation such as “indication”, “phonetic borrowing”, semantic combination, and “annotative derivation”, etc. can be based. Finally, examples will be cited to show how in the Chinese scripts the human body might interact with other’s bodies or with “things around” in various ways to cover the social, environmental, ritual, technical, economical, and even intellectual aspects of human experience. Bodily Dasein, so to speak, provides us with a new perspective of understanding and appreciating the entire scope of the Chinese script. (shrink)

AI-based technologies are increasingly pervasive in a number of contexts. Our affective and emotional life makes no exception. In this article, we analyze one way in which AI-based technologies can affect them. In particular, our investigation will focus on affective artificial agents, namely AI-powered software or robotic agents designed to interact with us in affectively salient ways. We build upon the existing literature on affective artifacts with the aim of providing an original analysis of affective artificial agents and their distinctive (...) features. We argue that, unlike comparatively low-tech affective artifacts, affective artificial agents display a specific form of agency, which prevents them from being perceived by their users as extensions of their selves. In addition to this, we claim that their functioning crucially depends on the simulation of human-like emotion-driven behavior and requires a distinctive form of transparency—we call it emotional transparency—that might give rise to ethical and normative tensions. Neurofeedback is a complex learning scenario, as the task consists of trying out mental strategies while processing a feedback signal that signifies activation in the brain area to be self-regulated and acts as a potential reward signal. In an attempt to dissect these subcomponents, we obtained whole-brain networks associated with efficient self-regulation in two paradigms: parallel, where the task was performed concurrently, combining feedback with strategy execution; and serial, where the task was performed consecutively, separating feedback processing from strategy execution. Twenty participants attempted to control their anterior midcingulate cortex using functional magnetic resonance imaging NF in 18 sessions over 2 weeks, using cognitive and emotional mental strategies. We analyzed whole-brain fMRI activations in the NF training runs with the largest aMCC activation for the serial and parallel paradigms. The equal length of the strategy execution and the feedback processing periods in the serial paradigm allows a description of the two task subcomponents with equal power. The resulting activation maps were spatially correlated with functionally annotated intrinsic connectivity brain maps. Brain activation in the parallel condition correlates with the basal ganglia network, the cingulo-opercular network, and the frontoparietal control network ; brain activation in the serial strategy execution condition with the default mode network, the FPCN, and the visual processing network; while brain activation in the serial feedback processing condition predominantly with the CON, the DMN, and the FPCN. Additional comparisons indicate that BG activation is characteristic to the parallel paradigm, while supramarginal gyrus and superior temporal gyrus activations are characteristic to the serial paradigm. The multifaceted view of the subcomponents allows describing the cognitive processes associated with strategy execution and feedback processing independently in the serial feedback task and as combined processes in the multitasking scenario of the conventional parallel feedback task. Because of the rising labor costs and the trade impact after joining the World Trade Organization, the textile industry in Taiwan has encountered many operational and production problems and obstacles. In addition, the lack of knowledge and resources for the digital transformation required to improve business performance has led to poor production and decision-making efficiency, and stagnant R&D for textile product innovation. In order to improve business operations, enhance customer satisfaction and experience, increase efficiency and reduce manual error, this study (...) was conducted with senior executives and company managers in Taiwan’s textile industry as the target population. The knowledge, technological resources, and competitive pressure of digital transformation are the independent variables. The organizational innovation atmosphere is the moderating variable. The study analyzes the impact of digital transformation on the intention of enterprises. The results of the study show that the knowledge of digital transformation, technological resources, and the competitive pressure of the textile industry positively and significantly affect their perceived benefits of digital transformation. Digital transformation knowledge, technological resources, and competitive pressure will negatively and significantly affect the perceived risk of digital transformation. The perceived benefits and risks of digital transformation are related to the intention of digital transformation of enterprises. The organizational innovation atmosphere of the textile industry positively moderates the influence of perceived benefits on digital transformation intention. Finally, based on the research findings, this study provides practical recommendations to senior executives and company managers in the textile industry. It is also recommended to promote the digital transformation of related software and hardware vendors and government agencies, as well as the subsequent related research reference. (shrink)

The objective of this research is to investigate the effects of corporate governance scores and environmental, social, and governance scores (ESG) on firms’ cost of capital in emerging countries. The sample consists of 800 firm-year observations collected from Thomson Reuters. We analyze the data using panel-corrected standard errors (PCSE) regressions, which correct for heteroskedasticity issues and contemporaneous errors in the data. When moderated with emerging market variable, our findings indicate that in the financial sector, corporate governance and ESG score is (...) negatively associated with cost of capital. Nonetheless, in the nonfinancial sector, no evidence is found on the effect of corporate governance and ESG on cost of capital. Our findings indicate that emerging countries, different institutional, ownership, and legal structural has an effect on corporate governance and ESG implementation. (shrink)

I discuss Clark’s predictive processing/extended mind hybrid, diagnosing a problem: Clark’s hybrid suggests that, when we use them, we pay attention to mind-extending external resources. This clashes with a commonly accepted necessary condition of cognitive extension; namely, that mind-extending resources must be phenomenally transparent when used. I then propose a solution to this problem claiming that the phenomenal transparency condition should be rejected. To do so, I put forth a parity argument to the effect that phenomenal transparency cannot be a (...) necessary condition on cognitive extension: roughly, since internal cognitive resources can fail to be transparent when used, by parity, external resources can fail to be phenomenally transparent too. Further, I argue that phenomenal transparency is not even a reliable indicator of cognitive extension; hence its absence should not be considered a problem for Clark’s extended mind-predictive processing hybrid. Lastly, I consider and allay a number of worries my proposal might raise, and conclude the paper. (shrink)

In this study, the levels of knowledge, awareness, and acceptance of research misconduct were investigated among the Pharmacy academics and students in Malaysia. A cross-sectional study using an online questionnaire was carried out. A total of 393 pharmacy academics and students in Malaysia were involved. Perceived research misconduct, as defined in this study as the perception of any research misconduct performed or observed by the respondents at their institution, was captured and further analyzed. The data was analysed using PLS-SEM to (...) assess the hypotheses which were formulated prior to the survey. The findings show that there is a statistically significant positive relationship between the awareness of terminologies regarding research misconduct and perceived research misconduct in the workplace of respondents. However, the acceptance of unethical practices in research demonstrates a negative correlation with perceived research misconduct. Knowledge and awareness regarding research misconduct have no statistically significant relationship with perceived research misconduct in this study. Both awareness of terminologies and acceptance of unethical practices explained a 10.8% variance in perceived research misconduct. Therefore, our study indicates that the awareness, knowledge, and acceptance of research misconduct might not be the main predictors of questionable conduct of research among pharmacy academics and students. Future study on the relationship between other factors which might contribute to research misconduct is highly recommended to investigate the significant contributing factors of irresponsible conduct of research among the Pharmacy academics and students in Malaysia. : Whilst the recent electoral performance of Parti Islam seMalaysia and Pertubuhan Kebangsaan Melayu Bersatu in Terengganuhas generated much interest, there are lack of studies over the involvementand motivations of the most committed party players; the grassrootsparty activists. PAS and UMNO are strongly supported by committed andextraordinary party members at the grassroots level who devote their time,money, effort, and energy to ensure the party they support wins elections andremains relevant. Unlike other professions, they are working for the party on afull-time (...) basis yet receive no specific income from the party. Their uniquenesshas directed this study to examine the factors which influence them to becomepolitical party activists. This study interviewed thirty-two party activists whowere selected using the purposive sampling technique, and the data was thenthematically analyzed through the content analysis method. Combining theCivic Voluntarism Model and the General Incentives Model into a frameworkto understand factors that motivate informants’ political party activism. Thisstudy discovered five major factors which include the ideology of the party,religious beliefs, defending ethnic supremacy, parental influence, significantpolitical events and educational institutions. This study also academicallydefies the common perception that party activists enjoy material rewards byvirtue of their party activism. (shrink)

In the last decades it has become clear that medicine must find some way to combine its scientific and humanistic sides. In other words, an adequate notion of medicine requires an integrative position that mediates between the analytic-reductionist and the normative-holistic tendencies we find therein. This is especially important as these different styles of reasoning separate “illness” (something perceived and managed by the whole individual in concert with their environment) and “disease” (a “mechanical failure” of a biological element within the (...) body). While the demand for an integrative view has typically been motivated by ethical concerns, we claim that it is also motivated, perhaps even more fundamentally, by epistemological and methodological reasons. Evidence-based bio-medicine employs experimental and statistical techniques which eliminate important differences in the ways that conscious humans evaluate, live with, and react to disease and illness. However, it is precisely these experiences that underpin the concepts and norms of bio-medicine. Humanistic disciplines, on the other hand, have the resources to investigate these experiences in an intersubjectively testable way. Medicine, therefore, cannot afford to ignore its nature as a human science; it must be concerned not only with disease and illness, but also with the ways in which patients as persons respond to malady. Insofar as attitudes and expectations influence the criteria of illness and disease, they must be studied as part of the genuine subject matter of medicine as a human science. In general, we urge that this is a necessary step to overcome today's trend to split evidence-based and clinical medicine. (shrink)

We prove that the opposite of the category of coalgebras for the Vietoris endofunctor on the category of compact Hausdorff spaces is monadic over $\mathsf {Set}$. We deliver an analogous result for the upper, lower, and convex Vietoris endofunctors acting on the category of stably compact spaces. We provide axiomatizations of the associated (infinitary) varieties. This can be seen as a version of Jónsson–Tarski duality for modal algebras beyond the zero-dimensional setting.

The paper presents and discusses the Hubble tension with respect to recent results in cosmology. I shall argue that the measurements from the James Webb Space Telescope and TRGB stars calibrations allow us to infer that the estimates of H0 with late universe methods are robust. Building on from robustness analysis, I conclude that the resolution of the tension cannot be expected to come from new systematics, but rather from new physics.

Munch-Jurisic’s book thoroughly describes several cases of severe distresses reported and expressed by perpetrators of tremendous acts such as mass murders. Arguing against a simplistic reading according to which these signs of distress are straightforward manifestations of some innate moral nature, and against the optimistic reading according to which they will lead to prosocial behaviors, Munch-Jursic offers compelling reasons to adopt a more complex theory of emotion. In this commentary, I aim to stress the implications of her book for the (...) debate on moral enhancement and for emotion theory in general. However, while I concur with Munch-Jurisic that emotion theory must make room for complexity and indeterminacy, I challenge her claim that motivational theories of emotion are ill-equipped to face the challenges she poses. We investigated motor resonance in children using a priming paradigm. Participants were asked to judge the weight of an object shortly primed by a hand in an action-related posture or a non action-related one . The hand prime could belong to a child or to an adult. We found faster response times when the object was preceded by a grasp hand posture . More crucially, participants were faster when the prime was a child’s hand, suggesting that it could belong to (...) their body schema, particularly when the child’s hand was followed by a light object . A control experiment helped us to clarify the role of the hand prime. To our knowledge this is the first behavioral evidence of motor simulation and motor resonance in children. Implications of the results for the development of the sense of body ownership and for conceptual development are discussed. (shrink)

This chapter provides the biography of Friedrich Wilhelm Joseph Schelling and describes his particular thoughts on musical philosophy. Schelling was born in Leonberg on January 27, 1775. In his final years, he continued to lecture at the Prussian Academy of Sciences. Schelling divided art into real and ideal, according to whether they manifested the objective, physical aspect or the subjective, spiritual aspect. His ideas about music as a formative art became influential only after the posthumous publication of Philosophy of Art. (...) The contradiction between the ideal and the real was the basic pattern of Philosophy of Art. Schelling's music-aesthetical reflections can be comprehended as the attempt to do away with music's lack of aesthetic legitimacy. His Philosophy of Art attracted little notice among a broader public that had already turned its attention toward an aesthetic that was more strongly indebted to positivism. (shrink)
