In Section 1, I outline the history of natural law theory, covering Plato, Aristotle, the Stoics and Aquinas. In Section 2, I explore two alternative traditions of natural law, and explain why these constitute rivals to the Aristotelian tradition. In Section 3, I go on to elaborate a via negativa along which natural law norms can be discovered. On this basis, I unpack what I call three 'experiments in being', each of which illustrates the cogency of this method. In Section (...) 4, I investigate and rebut two seminal challenges to natural law methodology, namely, the fact/value distinction in metaethics and Darwinian evolutionary biology. I argue that the theory of happiness now dominant among philosophers embraces a flawed, technicizing model that represents happiness as a set of mental states produced by actions and events. This view contrasts with Aristotle’s conception, according to which happiness is not produced by (but is tantamount to) long-term activity and incorporates (but is not reducible to) a set of mental states. I then go on to criticize the skill model of happiness on three main grounds. First, unlike the Aristotelian (...) model, it necessarily instrumentalizes activity while setting no principled limit to the manipulation of human action and experience. Second, and again contra Aristotle, it privileges an efficient (rather than formal) conception of causation while obscuring the way in which happiness is inextricably grounded in its conditions, which in turn has various deleterious upshots. Third and finally, the skill model yields a highly questionable notion of happiness as measurable. (shrink)

In this paper, I tackle Aquinas’s notion of ‘natural inclinations’, specifically as it occurs in his seminal elaboration of the natural law in Summa Theologiae I-II. Question 94. Article 2. Maintaining that it constitutes a departure from Aristotle’s terminology, and is hence puzzling, I go on to investigate a raft of modern, mainly Anglophone, interpretations of the concept. Beginning with Jacques Maritain, I move through the broadly chronological sequence of John Finnis, Jean Porter, Steven Jensen, Justin Matchulat and Stephen Brock. (...) In each case, I argue that – despite these scholars’ philosophical ingenuity and textual facility – there are crucial problems with their respective approaches and construals. I end the paper by outlining my own construal of ‘natural inclinations’, which, even if not bolstered by heavy textual scholarship, is at least coherent and, moreover, avoids the philosophical pitfalls of the above interpretations. I begin by detailing the semantic range of the English terms ‘work’ and ‘labour’, in comparison with that of their closest Greek equivalents. Narrowing matters down to work in the sense of ‘occupation’, what is striking about Aristotle, I maintain, is his willingness to sort occupations into a hierarchy. This hierarchy is fourfold. At the bottom we have servile work, which is directed at life’s ‘necessities’, and is founded on mere habit. Then we have technē or skilled work, which typically (...) produces material objects, and requires expertise. Further up the hierarchy we have praxis or morally-informed activity, which reaches its apogee in the life of the politikos or ruler. At the summit of Aristotle’s hierarchy is theōria or intellectual contemplation, which supposedly approximates divine activity. After documenting the resilience of this hierarchy in the Western tradition, I outline three grounds for it – social, metaphysical and psychological – which are manifestly weak. I then elaborate other grounds for it – found both within and outside Aristotle’s texts – which, I argue, are manifestly strong, and thus deserve our endorsement even today. (shrink)

In this paper I systematically criticise Feldman’s and Haybron’s theories of happiness as subjective well-being [SWB]. Having elaborated their trichotomy between SWB, welfare and virtue, I then outline Aristotle’s rival ethical schema, which construes these as aspects within an inextricable, organic whole, viz. eudaimonia. In order to vindicate this rival schema, I begin with four thought-experiments: Feldman’s Bertha, the indoctrinated housewife, Haybron’s ‘happy slave’, and two of my own. I argue that these demonstrate – contra Feldman and Haybron, but in (...) line with Aristotle – that happiness is essentially conditioned by objective welfare-goods. I then move on to how such goods are essentially conditioned, in turn, by the virtues. It follows that happiness itself is both logically and ontologically conditioned by the practice of the virtues. Although this Aristotelian conclusion faces charges of being moralistic and counter-evidential, it can overcome these, thereby securing – pace Feldman and Haybron – an authentic, sustainable conception of happiness. I argue that, in analysing the structure and development of moral traditions, MacIntyre relies primarily on Kuhn's model of scientific tradition, rather than on Lakatos' model. I unpack three foci of Kuhn's conception of the sciences, namely: the ‘crisis’ conception of scientific development, what I call the ‘systematic conception’ of scientific paradigms, and the view that successive paradigms are incommensurable. I then show that these three foci are integrated into MacIntyre's account of the development of moral traditions with a surprising (...) degree of faithfulness to Kuhn. And crucially, I argue against the overall cogency of his account, given the disparities I pinpoint between scientific and moral traditions. My overall critique is, however, fundamentally friendly, since nothing I have to say invalidates the very notion of a moral tradition, and all I am calling for are less problematic construals of that notion. In this chapter, I argue that Plato and Aristotle provide analyses of virtue and practical reason that are strongly shaped by the structure of the technai. Socrates assimilates virtue to skill, while Aristotle assimilates practical reason to a means-end technique. While both philosophers are sensitive to the problems these technē models generate, and try either to escape or to remedy them, they nonetheless remain under the impress of those models. To understand Self-Representationalism you need to understand its family. Self-Representationalism is a branch of the Meta-Representationalist family, and according to theories in this family what distinguishes conscious mental representations from unconscious mental representations is that conscious ones are themselves the target of a mental meta¬-representational state. A mental state M1 is thus phenomenally conscious in virtue of being suitably represented by some mental state M2. What distinguishes the Self-Representationalist branch of the family is the claim that M1 and M2 must (...) be the same token mental state, so a mental state is phenomenally conscious in virtue of suitably representing itself. This Self-Representationalist branch of the family divides into further branches, giving us specific implementations of the Self-Representationalist approach. But before asking whether we should adopt Self-Representationalism, and in what form, we should reflect on why Meta-Representationalism is an attractive family in the first place. After all, Self-Representationalist theories trade on their family name, claiming to deliver on the promises that drive the Meta-Representationalist approach. The two most important promises of Meta-Representationalism are: a) the promise of capturing the transitivity of consciousness and; b) the promise of rendering consciousness naturalisable. If we were to connect two individuals’ brains together, how would this affect the individuals’ conscious experiences? In particular, it is possible for two people to share any of their conscious experiences; to simultaneously enjoy some token experiences while remaining distinct subjects? The case of the Hogan twins—craniopagus conjoined twins whose brains are connected at the thalamus—seems to show that this can happen. I argue that while practical empirical methods cannot tell us directly whether or not the twins share conscious (...) experiences, considerations about the locality of content processing in the brain entails that they most likely do so. Abstract Temporal Externalism is the view that future events can contribute to determining the present content of our thoughts and utterances. Two objections to Temporal Externalism are discussed and rejected. The first is that Temporal Externalism has implausible consequences for the epistemology of biology and other taxonomic sciences (Brown, 2000). The second is that it is committed to implausible claims about dispositions.

It is an important feature of creatures like us that our various motivations compete for control over our behaviour, including mental behaviour such as imagining and attending. In large part, this competition is adjudicated by the stimulation of affect — the intrinsically pleasant or unpleasant aspects of experience. In this paper I argue that the motivation-affect system controls a sub-type of attention called 'alerting attention' to bring various goals and stimuli to consciousness and thereby prioritize those contents for action. This (...) view allows me to flesh out the global workspace theory of consciousness, as well as some of the phenomenal characteristics of conscious experience. (shrink)

The answer is seriously wrong when the liar's actual profession would be a deal breaker for the victim of the deception: this deception vitiates the victim's sexual consent, and it is seriously wrong to have sex with someone while lacking his or her consent.
