The most widely repeated retributivist argument against the utilitarian theory of punishment is that utilitarianism permits punishment of the innocent. While defenders of utilitarianism have shown that a publicly announced policy of punishing the innocent is unlikely to serve utility, critics have insisted that utilitarianism morally obliges officials to deceive the public by framing the innocent. Yet philosophers and legal scholars have heretofore failed to test this claim against the writings of the theory's originators. We directly examine the writings of (...) Jeremy Bentham and other eighteenth and nineteenth century utilitarians and demonstrate that the originators of utilitarian penology clearly opposed both punishment of the innocent and deception of the public. We argue that utilitarianism originated as a legal theory that emphasized several institutional conditions for the public pursuit of utility, including security of person and property, legality, legislative supremacy, democratic accountability, publicity and transparency. These institutional conditions would preclude both systematic and ad hoc framing of the innocent. We show that the original utilitarians considered individuals incompetent to determine and pursue the public welfare, and that the contemporary conception of utilitarianism as an ethical standard governing individuals is a modern innovation. Bentham's theory of punishment did not derive from any general ethical theory. Bentham, like his chief forebears Hume, Helvetius and Beccaria, thought of public utility as a standard of value for public action, such as legislation. He assumed that private action was ruled by self-interest (i.e. private utility) so that there was little point in directing arguments about the general welfare to individual ethical actors. In assessing public action, Bentham was far less concerned about consequences than has generally been supposed and far more concerned about process. He identified utility with security of expectations and the rule of law. As a consequence, he endorsed public actions that could be seen to have emerged from a rational and well-informed debate about their consequences for the public welfare. Utility was not a definition of the good or a guide to conscience, but a standard designed for use in public, deliberative debate. Utilitarianism was not so much a philosophical theory as a rhetorical practice, understood as a transparent language of analysis and argument for use in political deliberation.We elaborate the procedural conditions presupposed by utilitarian discourse, beginning with Bentham's commitment to a conception of legality involving legislative promulgation of formal rules faithfully applied by rigidly constrained bureaucrats and judges. Next, we demonstrate Bentham's commitment to democratic representation of the public in devising legislation. Finally, we emphasize Bentham's commitment to publicity in government decisionmaking. Utilitarian policy required public scrutiny of all decisions and the information and reasons considered in making them. In sum, Bentham's utilitarianism was primarily concerned with the problem of how to design government so that it could accurately identify and faithfully pursue the public good while being openly seen to do so. It follows that Bentham's utility principle does not require him to endorse deceiving the public and framing an innocent person. (shrink)

A wide-ranging history of the intellectual developments that produced the modern idea of the algorithm. Bringing together the histories of mathematics, computer science, and linguistic thought, Language and the Rise of the Algorithm reveals how recent developments in artificial intelligence are reopening an issue that troubled mathematicians long before the computer age. How do you draw the line between computational rules and the complexities of making systems comprehensible to people? Here Jeffrey M. Binder offers a compelling tour of four (...) visions of universal computation that addressed this issue in very different ways: G. W. Leibniz's calculus ratiocinator; a universal algebra scheme Nicolas de Condorcet designed during the French Revolution; George Boole's nineteenth-century logic system; and the early programming language ALGOL, whose name is short for algorithmic language. These episodes show that symbolic computation has repeatedly become entangled in debates about the nature of communication. To what extent can meaning be controlled by individuals, like the values of a and b in algebra, and to what extent is meaning inevitably social? By attending to this long-neglected question, we come to see that the modern idea of the algorithm is implicated in a long history of attempts to maintain a disciplinary boundary separating technical knowledge from the languages people speak day to day. Machine learning, in its increasing dependence on words, now places this boundary in jeopardy, making its stakes all the more urgent to understand. This essay examines how Ngugi wa Thiong'o, East Africa's most prominent writer, treats the landscape as a fundamental social phenomenon in two of his most important novels, A Grain of Wheat and Petals of Blood. Basing his ideas in an ecological theory of landscape aesthetics resembling one recently developed in America, Ngugi understands that ability to control and manipulate a landscape defines a society. Nostalgia for the landscape lost to colonialism and to the corrupting and alienating influences of international capitalism (...) needs to be replaced by its progressive evaluation as it is reshaped by collective action for a new future. Alienation from, and loss of responsibility for, the land may be a major factor contributing to Africa's environmental problems. Ngugi 's position casts doubt on professional land management's ultimate ability to influence the shape of the landscape in the face of the collective social will. (shrink)

While seeking novel food sources to feed the increasing population of the globe, several alternatives have been discussed, including algae, fungi or in vitro meat. The increasingly propagated usage of farmed insects for human nutrition raises issues regarding food safety, consumer information and animal protection. In line with law, insects like any other animals must not be reared or manipulated in a way that inflicts unnecessary pain, distress or harm on them. Currently, there is a great need for research in (...) the area of insect welfare, especially regarding species-specific needs, health, farming systems and humane methods of killing. Recent results from neurophysiological, neuroanatomical and behavioral sciences prompt caution when denying consciousness and therefore the likelihood of presence of pain and suffering or something closely related to it to insects. From an animal protection point of view, these issues should be satisfyingly solved before propagating and establishing intensive husbandry systems for insects as a new type of mini-livestock factory farming. Our aim with this descriptive phenomenological study was to identify and describe the essential meaning structure in the experience of postpartum depression . We interviewed four women diagnosed with major depression and analyzed the data with Giorgi’s descriptive phenomenological method. Our analysis revealed two essential meaning structures of PPD. The first structure describes the mother as thrown into a looming, dangerous world, coupled with a restricted, heavy body that hindered her attunement to her baby. Tormented by anxiety, guilt and shame, (...) she tried to deal with her pain by analytical reflection and social isolation. The second structure describes sudden lapses into intense feelings of alienation from the self, the baby, and from the social and material world. With a distorted primordial self-awareness, the mother no longer felt that she existed as herself in the world. We reflect on these findings using the insights of Fuchs, Van den Berg, Heidegger and Merleau-Ponty. (shrink)

The notion of antifragility, an attribute of systems that makes them thrive under variable conditions, has recently been proposed by Nassim Taleb in a business context. This idea requires the ability of such systems to ‘tinker’, i.e., to creatively respond to changes in their environment. A fairly obvious example of this is natural selection-driven evolution. In this ubiquitous process, an original entity, challenged by an ever-changing environment, creates variants that evolve into novel entities. Analyzing functions that are essential during stationary-state (...) life yield examples of entities that may be antifragile. One such example is proteins with flexible regions that can undergo functional alteration of their side residues or backbone and thus implement the tinkering that leads to antifragility. This in-built property of the cell chassis must be taken into account when considering construction of cell factories driven by engineering principles. (shrink)

For more than 20 years, research has proven the beneficial effect of natural frequencies when it comes to solving Bayesian reasoning tasks (Gigerenzer & Hoffrage, 1995). In a recent meta-analysis, McDowell & Jacobs (2017) showed that presenting a task in natural frequency format increases performance rates to 24% compared to only 4% when the same task is presented in probability format. Nevertheless, on average three quarters of participants in their meta-analysis failed to obtain the correct solution for such a task (...) in frequency format. In this paper, we present an empirical study on what participants typically do wrong when confronted with natural frequencies. We found that many of them did not actually use natural frequencies for their calculations, but translated them back into complicated probabilities instead. This switch from the intuitive presentation format to a less intuitive calculation format will be discussed within the framework of psychological theories (e.g., the Einstellung effect). (shrink)

In the present paper we empirically investigate the psychometric properties of some of the most famous statistical and logical cognitive illusions from the “heuristics and biases” research program by Daniel Kahneman and Amos Tversky, who nearly 50 years ago introduced fascinating brain teasers such as the famous Linda problem, the Wason card selection task, and so-called Bayesian reasoning problems (e.g., the mammography task). In the meantime, a great number of articles has been published that empirically examine single cognitive illusions, theoretically (...) explaining people’s faulty thinking, or proposing and experimentally implementing measures to foster insight and to make these problems accessible to the human mind. Yet these problems have thus far usually been empirically analyzed on an individual-item level only (e.g., by experimentally comparing participants’ performance on various versions of one of these problems). In this paper, by contrast, we examine these illusions as a group and look at the ability to solve them as a psychological construct. Based on an sample ofN= 2,643 Luxembourgian school students of age 16–18 we investigate the internal psychometric structure of these illusions (i.e., Are they substantially correlated? Do they form a reflexive or a formative construct?), their connection to related constructs (e.g., Are they distinguishable from intelligence or mathematical competence in a confirmatory factor analysis?), and the question of which of a person’s abilities can predict the correct solution of these brain teasers (by means of a regression analysis). This study investigated the effects of the 6 Minutes Journal, a commercial diary combining several positive psychology interventions, including gratitude, goal-setting, and self-affirmation exercises, on several mental health outcome measures. In a randomized controlled trial, university students were randomly assigned to one of two groups: 6MT and a wait list control group. Participants in the intervention group were instructed to follow the instructions of the 6MT for 4 weeks. Participants in both groups completed measures of perceived stress, positive and negative (...) affect, self-efficacy and resilience at baseline, after 2, and 4 weeks. We used path-analyses with autoregressive and cross-lagged effects to test our hypotheses of the effects of the 6MT. Participants in the intervention group reported decreased levels of perceived stress and negative affect, as well as increased levels of resilience and self-efficacy compared to the control group. Positive affect was not statistically significantly influenced. The data showed a statistically significant increased levels of self-efficacy and resilience only after 4 weeks, suggesting that changing these constructs needs more time. The 6-minute diary does not appear to make individuals fundamentally more positive. However, the intervention may have a protective function against negative influences on well-being. (shrink)

Women are twice as likely to be diagnosed with a depressive disorder as men. Before trying to explain this difference, we must first understand how women experience depression. We explore the phenomenon of depression through women’s experiences, using Giorgi’s descriptive phenomenological method. An essential meaning structure describes the development of depression: The women find themselves entrapped in a personal mission which had backfired. Motivated by shame and guilt from the past, they overinvest in work or others’ emotions to relieve internal (...) pain. They feel deeply sensitive to, and responsible for, other persons’ distress while ignoring their own feelings and needs. Gradually their emotional body grows awry and acts in increasingly alienating and threatening ways. Ultimately they feel forced to submerge in their emotional body; they succumb to depression. We reflect on this structure on the basis of Minkowski, Scheler, Sartre and Merleau-Ponty, and in relation to contemporary research on depression. (shrink)

In this book, Binder shows that at the heart of the most prominent arguments in favour of value-neutral approaches to overall freedom lies the value freedom has for human agency and development. Far from leading to the adoption of a value-neutral approach, however, ascribing importance to freedom’s agency value requires one to adopt a refined value-based approach. Binder employs an axiomatic framework in order to develop such an approach. She shows that a focus on freedom’s agency value has (...) far reaching consequences for existing results in the freedom ranking literature: it requires one to move beyond a person’s given all-things-considered preferences to the values underlying a person’s preference formation. Furthermore, it requires, as Binder argues, one to account for those differences between choice options which really matter to people. Binder illustrates the implications of her analysis for the evaluation of public policy and human development with the capability approach: only if sufficient importance is ascribed to freedom’s agency value can the capability approach keep its promises. ​. Das vorliegende Werk ist ein weiteres Zeugnis von Brentanos lebenslanger Auseinandersetzung mit Aristoteles, seinem philosophischen Lehrer par excellence. Auch die literarische Fehde mit dem bedeutenden Berliner Philosophiehistoriker Eduard Zeller (1814-1908) währte Jahrzehnte, ja über den Tod Zellers hinaus. In dieser Kontroverse ging es zunächst um Brentanos These vom Kreatianismus des Aristoteles, in der er Zellers Ansicht, der menschliche nous sei Teil des absoluten Denkens der aristotelischen Gottheit und somit ewig, zurückweist und darzulegen versucht, das der nous poietikos von dieser unmittelbar (...) erschaffen wird und somit nicht präexistieren kann. In dieser Auseinandersetzung kommen aber auch ganz unterschiedliche Ansichten über das Wesen der Philosophie und ihrer Geschichte zum Ausdruck. In den Augen Brentanos war Zellers Vorgehensweise ein verkehrter Historismus, während für ihn selbst die Geschichte der Philosophie nur dann eine Berechtigung hat, wenn sie in den Dienst der sachlichen Forschung tritt. This paper examines the existential context of physical and mental health. Hans Georg Gadamer and The World Health Organization’s conceptualizations are discussed, and current medicalized and idealized views on health are critically examined. The existential dimension of health is explored in the light of theories of selfhood consisting of different parts, Irvin Yalom’s approach to “ultimate concerns” and Martin Heidegger’s conceptualization of “existentials.” We often become aware of health as an existential concern during times of illness, and health and illness (...) can co-exist. The paper discusses how existential suffering in Western culture is described, to an increasing degree, as disorders or psychological deficits, and perfectionistic health goals easily can become a problem. We seek to avoid suffering rather than relate to it, with all the tension that may create. The paper argues that suffering is an unavoidable aspect of people’s experience of their lives, and actively relating to suffering must be regarded as a fundamental aspect of health. The need and usefulness of a concept of “existential health” is discussed. (shrink)

In teaching statistics in secondary schools and at university, two visualizations are primarily used when situations with two dichotomous characteristics are represented: 2×2 tables and tree diagrams. Both visualizations can be depicted either with probabilities or with frequencies. Visualizations with frequencies have been shown to help students significantly more in Bayesian reasoning problems than probability visualizations do. Because tree diagrams or double-trees (which are largely unknown in school) are node-branch-structures, these two visualizations (compared to the 2×2 table) can even simultaneously (...) display probabilities on branches and frequencies inside the nodes. This is a teaching advantage as it allows the frequency concept to be used to better understand probabilities. However, 2×2 tables and (double-) trees have a decisive disadvantage: While joint probabilities (e.g., P(AB)) are represented in 2×2 tables but no conditional probabilities (e.g., P(A|B)), it is exactly the other way around with (double-) trees. Therefore, a visualization that is equally suitable for the representation of joint probabilities and conditional probabilities is desirable. In this article, we present a new visualization—the frequency net—in which all absolute frequencies and all types of probabilities can be depicted. In addition to a detailed theoretical analysis of the frequency net, we report the results of a study with 249 university students that shows that “net diagrams” can improve reasoning without previous instruction to a similar extent as 2×2 tables and double-trees. Regarding questions about conditional probabilities, frequency visualizations (2×2 table, double-tree, or net diagram with natural frequencies) are consistently superior to probability visualizations. The frequency net performs as well as the frequency double-tree. Only the 2×2 table with frequencies—the only visualization that participants were already familiar with —led to higher performance rates. If, on the other hand, a question about a joint probability had to be answered, all implemented visualizations clearly supported participants’ performance, and no uniform format effect becomes visible. Participants reached the highest performance in the versions with probability 2×2 tables and probability net diagrams. Furthermore, after conducting a detailed error analysis, we report interesting error shifts between the two information formats and the different visualizations and give recommendations for teaching probability. Franz Brentano gilt als einer der einflussreichsten Philosophen an der Wende vom 19. zum 20. Jahrhundert. Dennoch sind die Philosophiehistoriker noch zu keinem endgültigen Urteil über seine Bedeutung gelangt. Der Grund hierfür ist vor allem darin zu suchen, dass Brentanos Werk bis heute nur unzureichend zugänglich ist, was vor allem daran liegt, dass der größte Teil davon nur in handschriftlicher Form existiert: Nach seinem unvollendet gebliebenen Hauptwerk, der Psychologie vom empirischen Standpunkt, hat Brentano keine größere Arbeit mehr veröffentlicht. Im ersten (...) Teil analysiert Binder die Gründe für Brentanos zurückhaltende Publikationstätigkeit, wobei einerseits der konfliktbehaftete biographische Hintergrund und die komplexe Persönlichkeit des Philosophen, andererseits theoretische Probleme, eine psychologische Einheitswissenschaft zu formulieren, die ihn an der Fertigstellung seines Hauptwerks scheitern ließen, im Vordergrund stehen. Im zweiten Teil verfolgt der Autor die wechselhafte Geschichte von Brentanos philosophischem Nachlass, die ihrerseits die Rezeption seiner philosophischen Theorien stark behindert hat. (shrink)

"Aristoteles und seine Weltanschauung" ist Franz Brentanos letztes Wort in seiner lebenslänglichen Auseinandersetzung mit seinem ersten und größten philosophischen Lehrer. Indem er sich auf die aristotelische Metaphysik und hier vor allem auf die Gotteslehre konzentriert, versucht er einerseits zu zeigen, dass die oft als dunkel und widersprüchlich hingestellten Lehren des Aristoteles sich konsistent rekonstruieren lassen, und dass Aristoteles andererseits als ein Vertreter des metaphysischen Optimismus, als ein "antiker Leibniz" also, betrachtet werden kann.
