Although the body has become of increasing importance throughout the social sciences, it has been neglected by the discipline of social policy. The aim of this article is to rectify that neglect. It argues that the connections which some have begun to make between social welfare and the body can be strengthened by reference to the figure of the cyborg. The article develops a model that can be used to explain the cyborgization of social identity. This process of cyborgization is (...) then related to contemporary trends in social welfare: the individualization of rights and the collectivization of duties which is occurring via the prevalence of surveillance technologies and the ideology of productivism. This article brings interconnects three debates to show what this might imply for the ‘redemocratisation’ of UK society and for pedagogical reform. One debate concerns deliberative types of democratic reform, arguing in favour of a ‘creative agnosticism’ towards the two philosophical frameworks which dominate this literature. This leads into a discussion of education and critical rationality, arguing for an aptitude-based account of moral agency, one which relates to the sociocultural resources we inherit from the past. The final debate therefore concerns (...) social memory. I do not offer a theory of social memory but critique various commentators in arguing for what I call a ‘multipolar analysis’. This both describes the analytical method adopted in this article and the skills and capacities which a system based upon ‘education for discourse’ would need to facilitate. The article therefore proposes that democracy, education and memory—deliberativeness, critical rationality and social remembering—be brought closer together for the mutual benefit of each debate. It has been common for researchers and commentators within the discipline of Social and Public Policy to evoke Rawlsian theories of justice. Yet some now argue that the contractualist tradition cannot adequately incorporate, or account for, relations of care, respect and interdependency. Though contractualism has its flaws this article proposes that we should not reject it. Through a critique of one of its most esteemed critics, Martha Nussbaum, it proposes that contractualism can be defended against the capabilities approach she prefers. (...) The article concludes by suggesting how and why the moral philosophy of Thomas Scanlon offers a basis for reconciling the strengths of a contractualist, egalitarian liberalism with those of Nussbaum’s capabilities approach. We would like to respond by picking up on some of the points they make, although we do not address all the issues raised.Our general aims in the (...) paper are less immediately pragmatic than are the central concerns of Grisso and Appelbaum. Our interest is primarily in a number of ethical, and related conceptual, issues that arise from empirical data. In the long run, of course, we believe that these ethical and conceptual issues are important to the care of people with mental disorders, but our focus is philosophical.Our central interest is what justifies overriding treatment refusal. We are unhappy with a "status" approach according to which, for example, the mere fact that a person suffers a mental disorder provides grounds for overriding her wishes. Such an approach, it seems to us, fails to identify reasons, and discriminates against those with mental disorder, a view shared by the Law Commission (The Law Commission 1995). We are, on the other hand, attracted by the approach that grounds any overriding of treatment refusal on lack of capacity (or competence) to make treatment decisions. The concept of capacity has been well developed through legal cases and conceptual analysis, not least by Grisso and Appelbaum themselves. We were struck, however, first through clinical experience, and subsequently from the pilot study reported in our paper, that many patients with anorexia nervosa who refuse treatment do not necessarily lack capacity, using the current criteria, and yet show features or give reasons that raise serious doubts as to whether it is right to respect their refusal of treatment.To avoid reliance on a "status" approach, the issue with which we are grappling is whether the concept of capacity (and therefore lack of capacity) can be developed to encompass some of our findings, and whether it is ethically right to do so. Charland makes the important point that the concept of competence, or capacity, has both a descriptive and a prescriptive component. It is for this reason that the question of whether, for example, we should extend the criteria for capacity is part of the question of when it is morally right to override treatment refusal.Grisso and Appelbaum suggest that our work advances "our thinking about appreciation, rather than requiring that we add new elements" (2006, 297). From our perspective, and at this stage, it is a secondary issue whether we are suggesting a development of appreciation, or a new element (e.g., "pathological values"). This paper considers John Doris, Stephen Stich, Alexandra Plakias, and colleagues’ recent attempts to utilize empirical studies of cross-cultural variation in moral judgment to support a version of the argument from disagreement against moral realism. Crucially, Doris et al. claim that the moral disagreements highlighted by these studies are not susceptible to the standard ‘diffusing’ explanations realists have developed in response to earlier versions of the argument. I argue that plausible hypotheses about the cognitive processes underlying ordinary moral judgment and (...) the acquisition of moral norms, when combined with a popular philosophical account of moral inquiry—the method of reflective equilibrium—undercut the anti-realist force of the moral disagreements that Doris et al. describe. I also show that Stich's recent attempt to provide further theoretical support for Doris et al.'s case is unsuccessful. (shrink)

A broadly liberal politics requires political compassion; not simply in the sense of compassion for the victims of injustice, but also for opponents confronted through political protest and (more broadly) dissent. There are times when, out of a sense of compassion, a just cause should not be pressed. There are times when we need to accommodate the dreadfulness of loss for opponents, even when the cause for which they fight is unjust. We may also have to come to terms with (...) the irreversibility of historic injustice and reconcile. Political compassion of this sort carries risks. Pushed too far, it may weaken our commitment to justice through too great a sympathy for those on the other side. It would be convenient if such compassion could be constrained by a clear set of political principles. But principles run the quite different risk of promoting an 'ossified dissent', unable to respond to change. In this book, Tony Milligan argues that principles are only a limited guide to dissent in unique, contingent circumstances. They will not tell us how to deal with the truly difficult cases such as the following: Should the Lakota celebrate Thanksgiving? When is the crossing of a picket-line justified? What kind of toleration must animal rights advocates cultivate to make progress within a broadly liberal political domain? And how should we respond to the entangling of aspiration towards social justice with anger and prejudice (such as the 'anti-Zionist' discourse)? We may be tempted to answer these questions by presupposing that alignment (the business of choosing sides) is ultimately more important than compassion, but sometimes political compassion trumps alignment. The sources that we have conveying information about the early Greek philosophers are far removed from the original texts. Manuscripts from the era were disseminated by scribes, making copies of a text. The text that formed the basis for the scribe was more likely than not a copy of a copy of a copy. Scribes are imperfect conduits of information. In addition to the challenges faced in ascertaining accuracy of the base text, there are errors that often occur in transcription (...) of the base text. There are errors of omission: Homeoteleuton occurs when a transcription skips words because a subsequent word has the same or a similar ending. Homeoarchy occurs when the transcriber skips lines, because of the similarity of the beginning of the lines. Haplography occurs when the transcriber copies once a term that appears twice in the base text. There are errors of addition. Dittography occurs when the transcriber writes a term twice that appeared once in the base text. Contamination occurs when a transcriber inserts text that was not in the base text. There are errors of transposition. Metathesis occurs when a transcriber reverses letters, words, or phrases from the base text. Finally, but not exhaustively, there are errors of alteration. These errors occur when a transcriber attempts, deliberately or not, to make sense of the base text in the transcription. (shrink)

To address the underrepresentation of women in philosophy effectively, we must understand the causes of the early loss of women. In this paper we challenge one of the few explanations that has focused on why women might leave philosophy at early stages. Wesley Buckwalter and Stephen Stich offer some evidence that women have different intuitions than men about philosophical thought experiments. We present some concerns about their evidence and we discuss our own study, in which we attempted to replicate their (...) results for 23 different responses to 14 scenarios . We also conducted a literature search to see if other philosophers or psychologists have tested for gender differences in philosophical intuitions. Based on our findings, we argue that that it is unlikely that gender differences in intuitions play a significant role in driving women from philosophy. (shrink)

The aesthetic exception theorises anew the relation between art and politics. It challenges critical trends that discount the role of aesthetic autonomy, to impulsively reassert art as an effective form of social engagement. But it equally challenges those on the flipside of the efficacy debate, who insist that art's politics is limited to a recondite space of 'autonomous resistance'. The book shows how each side of the efficacy debate overlooks art's exceptional status and its social mediations. Mobilising philosophy and cultural (...) theory, and employing examples from visual art, performance, and theatre, it proposes four alternative tests to 'effect' to offer a nuanced account of art's political character. A lesson from cognitive behavior therapy (CBT) is that it is possible for people to change their beliefs and attitudes in ways that enhance mood. This chapter discusses mainly how the ideas from positive psychology combined with the therapeutic methods developed in CBT might provide ways of helping individuals to enhance their mood and increase happiness. The best single perspective from which to gain an understanding of positive psychology is that of evolutionary psychology, even though it is underdeveloped and contentious. (...) This paper explores the ethical and conceptual implications of the findings from an empirical study (reported elsewhere) of decision-making capacity in anorexia nervosa. In the study, ten female patients aged thirteen to twenty-one years with a diagnosis of anorexia nervosa, and eight sets of parents, took part in semistructured interviews. The purpose of the interviews was to identify aspects of thinking that might be relevant to the issue of competence to refuse treatment. All the patient-participants were also tested using the (...) MacArthur Competence Assessment Tool—Treatment test of competence. This is a formalized, structured, interviewer-administered test of competence, which is a widely accepted clinical tool for determining capacity. The young women also completed five brief, self-administered questionnaires to assess their levels of psychopathology. The issues identified from the interviews are described under two headings: difficulties with thought processing and changes in values. The results suggest that competence to refuse treatment may be compromised in people with anorexia nervosa in ways that are not captured by traditional legal approaches. (shrink)

Real living wages (RLWs) are an important ethical and moral policy to ensure that employees earn enough to live on. In providing ‘a fair day's pay for a fair day's work’, they set an ethical foundation for liveability. This article explores the ethics and moral economy of the RLW for lower-paid staff in the overlooked economy context of UK professional football, illustrated by a qualitative case study of Luton Town Football Club (LTFC). The article provides theoretical insights grounded in moral (...) economy concepts about how a RLW contributes to a broader common good means of enabling fuller human participation in decent working and living conditions. Applying these concepts using a multi-disciplinary moral economy interpretation offers deeper theoretical contributions than economistic interpretations restricted to mainly technocratic economic distributive issues. LTFC are evidently ethically embedded in a moral economy as a local community club paying a RLW, and part of the overlooked economy. The research also contributes to contemporary debates on ‘Common Good’ HRM regarding the role of living wages in addressing grand common good challenges like inequality and quality of working lives.
