In Mortal Imitations of Divine Life, Diamond offers an interpretation of De Anima, which explains how and why Aristotle places souls in a hierarchy of value. Aristotle’s central intention in De Anima is to discover the nature and essence of soul—the prin­ciple of living beings. He does so by identifying the common structures underlying every living activity, whether it be eating, perceiving, thinking, or moving through space. As Diamond demonstrates through close readings of De Anima, the nature of (...) the soul is most clearly seen in its divine life, while the embodied soul’s other activi­ties are progressively clearer approximations of this principle. This interpretation shows how Aristotle’s psychology and biology cannot be properly understood apart from his theological conception of God as life, and offers a new explanation of De Anima’s unity of purpose and structure. Aristotle’s chapter on productive mind (De Anima III.5) and its comparison of this mind to light are best understood as a careful revision to Plato’s Sun-Good analogy from Republic VI. Through a rigorous juxtaposed reading of De Anima II.7 on vision and III.5 on thinking, one can see how Aristotle is almost wholeheartedly taking up Plato’s analogy between vision and thought. When one accounts for all the detail of Aristotle’s explanation of light and vision in II.7 by seeing that chapter (...) as anticipating III.5, an interpretation of productive intellect emerges which reconciles the main opposing views on the question that have long divided interpreters: whether the productive intellect discussed in De Anima III.5 is human or divine. This paper explores Sean Kirkland’s thesis that relation is the fundamental concept in Aristotelian political philosophy. While substance is prior to relation in Aristotle’s metaphysics, Kirkland argues that since the human exists only in the context of a city which is defined by the essential diversity of views on the human good, relation precedes substantial unity in politics. I argue that the priority of the substantial unity of the city should not be seen to threaten the importance of political relations. (...) Already in his theoretical ontology, Aristotle sees relation as absolutely essential and integral to the identity and existence of any mortal individual. Because of the essentially dynamic and relational activity of any mortal substance, the city as political substance must include and preserve deep diversity and difference within itself. This essay argues that there is an important analogy between the hierarchically ordered divisions of the divided line in Republic Book VI and the hierarchy of constitutions described in Books VIII-IX. Imagination corresponds to tyranny, belief to democracy, mathematical understanding to oligarchy, and dialectical reason to timocracy. The unhypothetical principle disclosed through the activity of dialectic, the idea of the Good itself, corresponds to the aristocratic rule of philosopher kings.

This volume is a scholarly tribute to Fackenheim’s memory. It covers a wide spectrum of Fackenheim’s work including biographical, philosophical, and theological aspects of his thought that have not been addressed adequately in the past. Elie Wiesel, a close personal friend to Fackenheim for over 30 years, has provided the Foreword for the volume.

This paper is a response to a certain sort of argument defending the rights of animals. Part I is a brief explanation of the background and of the sort of argument I want to reject; Part II is an attempt to characterize those arguments: they contain fundamental confusions about moral relations between people and people and between people and animals. And Part III is an indication of what I think can still be said on—as it were–the animals' side.

Reading Wittgenstein with Anscombe, Going On To Ethics is a collection of seven essays, divided into three parts. The essays bring out connections between Wittgenstein's thinking and questions of continuing interest in the philosophy of language, logic, and ethics. A dialogue with Anscombe runs through the essays, which take up questions about how we should respond to thinking that has miscarried or gone off the rails. The main issues discussed in this book concern how we are to understand thoughts, forms (...) of words, and uses of language that seem crucially important to our understanding or self-understanding, but cannot fit in the template we instinctively bring to bear on questions about how language and thought are related to reality. The book presents Wittgenstein as a responsive philosopher, and it does this through a continuing dialogue with Anscombe. (shrink)

Wittgensteinian ethics, it may be thought, is committed to detailed examination of realistically described cases, and hence to eschewing the abstract hypothetical cases, many of them quite bizarre, found in much contemporary moral theorizing. I argue that bizarre cases may be helpful in thinking about ethics, and that there is nothing in Wittgenstein's approach to philosophy that would go against this. I examine the case of the ring of Gyges from the Republic; and I consider also some contemporary arguments about (...) thought-experiments in philosophy. (shrink)

In this paper, I plan to show that the use of a specific population concept—Millstein’s Causal Interactionist Population Concept (CIPC)—has interesting and counter-intuitive ramifications for discussions of the reality of biological race in human beings. These peculiar ramifications apply to human beings writ large and to individuals. While this in and of itself may not be problematic, I plan to show that the ramifications that follow from applying Millstein’s CIPC to human beings complicates specific biological racial realist accounts—naïve or otherwise. I conclude with the notion that even if biological races do exist—by fulfilling all of the criteria needed for Millstein’s population concept (which, given particular worries raised by Gannett (Synthese 177:363–385, 2010), and Winther and Kaplan (Theoria 60:54–80, 2013) may not)—the lower-bound limit for the scope of biological racial realism is at the level of populations, and as such they cannot say anything about whether or not individual organisms themselves have races. Scientists often diverge widely when choosing between research programs. This can seem to be rooted in disagreements about which of several theories, competing to address shared questions or phenomena, is currently the most epistemically or explanatorily valuable—i.e. most successful. But many such cases are actually more directly rooted in differing judgments of pursuit-worthiness, concerning which theory will be best down the line, or which addresses the most significant data or questions. Using case studies from 16th-century astronomy and 20th-century geology and (...) biology, I argue that divergent theory choice is thus often driven by considerations of scientific process, even where direct epistemic or explanatory evaluation of its final products appears more relevant. Broadly following Kuhn’s analysis of theoretical virtues, I suggest that widely shared criteria for pursuit-worthiness function as imprecise, mutually-conflicting values. However, even Kuhn and others sensitive to pragmatic dimensions of theory ‘acceptance’, including the virtue of fruitfulness, still commonly understate the role of pursuit-worthiness—especially by exaggerating the impact of more present-oriented virtues, or failing to stress how ‘competing’ theories excel at addressing different questions or data. This framework clarifies the nature of the choice and competition involved in theory choice, and the role of alternative theoretical virtues. (shrink)

Legal norms serve as practical standards for individuals and officials. While this ‘normative aspect’ of law is widely acknowledged, its significance for theories of law remains contested. In this paper, I examine three views on the matter. First, that we should explain legal norms as reason-giving. Second, that we should explain legal discourse as being about reasons for action. Third, that we should explain law as capable of being reason-giving. I survey some challenges associated with each of these views. What (...) they have in common is an implicit assumption about the form that normative explanation must take: that it must be a linear, non-reductive explanation. There is an alternative model for normative explanation available, however. That model explains normative notions in terms of the practices and attitudes involved in recognizing, offering, and demanding them. I highlight the potentials, and limitations, of this practice-centered alternative. (shrink)

Every work on Jewish thought and law since the twelfth century bears the imprint of Maimonides. A.N. Whitehead's famous dictum that the entire European philosophical tradition 'consists of a series of footnotes to Plato' could equally characterize Maimonides' place in the Jewish tradition. The critical studies in this volume explore how Orthodox rabbis of different orientations--Shlomo Aviner, Naftali Zvi Yehudah Berlin (Netziv), Kalonymus Kalman Shapira, Joseph Kafih, Abraham Isaac Kook, Aaron Kotler, Joseph Soloveitchik, and Elhanan Wasserman--have read and provided footnotes (...) to Maimonides in the long twentieth century. How well did they really understand Maimonides? And where do their arguments fit in the mainstream debates about him and his works? Each of the seven core chapters examines a particular approach. Some rabbis have tried to liberate themselves from the influence of his ideas. Others have sought to build on those ideas or expand them in ways which Maimonides himself did not pursue, and which he may well not have agreed with. Still others advance patently non-Maimonidean positions, while attributing them to none other than Maimonides. Above all, the essays published here demonstrate that his legacy remains vibrantly alive today. (shrink)

Eli Friedlander’s reappraisal emphasizes the internal connection of judgment and meaning, showing how the pleasure in judging is intimately related to our capacity to draw meaning from our encounter with beauty.

In this book, Eli Hirsch focuses on identity through time, first with respect to ordinary bodies, then underlying matter, and eventually persons.

Eli Friedlander reads Rousseau's autobiography, Reveries of the Solitary Walker, as philosophy. Reading this work against Descartes's Meditations, Friedlander shows how Rousseau's memorable transformation of experience through writing opens up the possibility of affirming even the most dejected state of being and allows the emergence of the innocence of nature out of the ruins of all social attachments. In tracing the re-creation of a human subject in reverie, Friedlander is alive to the very form of the experience of reading the (...) Reveries by showing the ways this work needs to--and in effect does--generate a reader, without betraying Rousseau's utter solitude. Friedlander's book provides an afterlife for the Reveries in modern philosophy. It constitutes an alternative to the analytic tradition's revival of Rousseau, primarily through Rawls's influential vision of the social contract. It also counters the fate of Rousseau's writings in the continental tradition, determined by and large by Derrida's deconstruction. Friedlander's reading of the Reveries, a work that has fascinated generations of readers, is an incomparable introduction to one of the greatest thinkers in Western culture. (shrink)

According to the Counterfactual Comparative Account of harm and benefit, an event is overall harmful for a subject to the extent that this subject would have been better off if it had not occurred. In this paper we present a challenge for the Counterfactual Comparative Account. We argue that if physical processes are chancy in the manner suggested by our best physical theories, then CCA faces a dilemma: If it is developed in line with the standard approach to counterfactuals, then (...) it delivers that the value of any event for a subject is indeterminate to the extreme, ranging from terribly harmful to highly beneficial. This problem can only be avoided by developing CCA in line with theories of counterfactuals that allow us to ignore a-typical scenarios. Doing this generates a different problem: when the actual world is itself a-typical we will sometimes get the result that the counterfactual nonoccurrence of an actual benefit is itself a benefit. An account of overall harm bearing either of these two implications is deficient. Given the general aspiration to account for deprivational harms and the dominance of the Counterfactual Comparative Account in this respect, theorists of harm and benefit face a deadlock. (shrink)
