Legal reasoning requires identification through search of authoritative legal texts that apply to a given legal question. In this paper, using a network representation of US Supreme Court opinions that integrates citation connectivity and topical similarity, we model the activity of law search as an organizing principle in the evolution of the corpus of legal texts. The network model and probabilistic search behavior generates a Pagerank-style ranking of the texts that in turn gives rise to a natural geometry of the (...) opinion corpus. This enables us to then measure the ways in which new judicial opinions affect the topography of the network and its future evolution. While we deploy it here on the US Supreme Court opinion corpus, there are obvious extensions to large evolving bodies of legal text. The model is a proxy for the way in which new opinions influence the search behavior of litigants and judges and thus affect the law. This type of “legal search effect” is a new legal consequence of research practice that has not been previously identified in jurisprudential thought and has never before been subject to empirical analysis. We quantitatively estimate the extent of this effect and find significant relationships between search-related network structures and propensity of future citation. This finding indicates that “search influence” is a pathway through which judicial opinions can affect future legal development. (shrink)

Many enzymes are inhibited by their own substrates, leading to velocity curves that rise to a maximum and then descend as the substrate concentration increases. Substrate inhibition is often regarded as a biochemical oddity and experimental annoyance. We show, using several case studies, that substrate inhibition often has important biological functions. In each case we discuss, the biological significance is different. Substrate inhibition of tyrosine hydroxylase results in a steady synthesis of dopamine despite large fluctuations in tyrosine due to meals. (...) Substrate inhibition of acetylcholinesterase enhances the neural signal and allows rapid signal termination. Substrate inhibition of phosphofructokinase ensures that resources are not devoted to manufacturing ATP when it is plentiful. In folate metabolism, substrate inhibition maintains reactions rates in the face of substantial folate deprivation. Substrate inhibition of DNA methyltransferase serves to faithfully copy DNA methylation patterns when cells divide while preventing de novo methylation of methyl‐free promoter regions. (shrink)

First, he concedes that epistemically circular beliefs cannot answer a subject's doubts about her cognitive faculties. But, he argues, (...) subjects don't have such doubts, so epistemically circular beliefs are rarely called upon to play this role. Second, following Thomas Reid, Bergmann argues that we have noninferential, though epistemically circular, knowledge that our faculties are reliable. I argue, however, that Bergmann's view is undermined by doubts a subject should have and that there is no plausible explanation for how we can have noninferential knowledge that our faculties are reliable. When one depends on a belief source in sustaining a belief that that very belief source is trustworthy, then that belief is an epistemically circular belief. A number of philosophers have objected to externalism in epistemology on the grounds that it commits one to thinking EC-beliefs can be justified, something they view as an unhappy consequence for externalism. In my 2004, I defend externalism against this sort of charge by explaining why this consequence needn’t be an unhappy one. In the (...) course of doing so, I appeal to what Thomas Reid calls ‘common sense’—a faculty or belief source by which we know noninferentially such things as that our faculties are trustworthy. In his 2006, Baron Reed raises what he takes to be serious objections to what I say about both epistemic circularity and common sense. In what follows, I’ll respond to his objections, explaining why I side with Reid against Reed. (shrink)

This article draws on the conceptual link between power and causality to develop an account of the relational, discursive, and performative dimensions of power. Each proposed dimension of power is grounded in a different understanding of social causes: relational-realist, discursive-hermeneutic, and performative-pragmatic. For the purposes of empirical analysis, this dimensional schema crosscuts the classic sources of power typology developed by Michael Mann and others, thus rendering the conceptual apparatus for pursuing sociological research on power more complex and explanatorily effective. (...) The schema is illustrated by an example from comparative-historical sociology: explaining the storming of the Bastille and its effects. A series of research questions for investigating the relative autonomy of performative power is proposed. Michael Philips’ ‘Racist Acts and Racist Humor’ attempts to analyze the ethics of racism. At the heart of his discussion is the view that… “racist” is used in its logically primary sense when it is attributed to actions. All other uses of “racist” … must be understood directly or indirectly in relation to this one. Accordingly, racist beliefs are beliefs about an ethnic group used to “justify” racist acts, racist feelings are feelings about an ethnic group that typically give (...) rise to such acts, and racist epithets are the stings and arrows by means of which certain such acts are carried out. Marshall and O’Leary’s thoughtful response to our article suggests that dismissal policies are ethically justifiable because they might induce parents to immunize their children. This outcome is conceivable, but we have only anecdotes about how often it occurs. Such evidence became the thin reed on which the American Academy of Pediatrics rested its new policy of tolerating the practice of dismissing vaccine-hesitant parents. It seems likely that relatively few parents would agree to vaccinate because they were threatened with dismissal. (...) Other heavy-handed interventions have failed to move most such parents. When Washington state made nonmedical exemptions more difficult to obtain, nearly two-thirds of vaccine refusers were unmoved and their children remained unvaccinated. Even if dismissal threats led some parents to accept vaccines, this alone would not justify a dismissal policy. The benefits would still have to be weighed against the risks of dismissing those families who do not change their minds. (shrink)

Gandhi’s example has inspired countless political struggles worldwide over the past century. We might then ask how his thought has been transferred and translated when taken out of the particular historical and geographic context in which he lived. How have Gandhi’s ideas been changed or altered when adopted in different contexts? Which aspects of Gandhi’s thinking remain most relevant to struggles for social and environmental justice today? These are just a few of the questions that were discussed at the “Perspectives (...) on Gandhi’s Significance Workshop” hosted by Reed College in Portland Oregon, on April 16th, 2016. (shrink)

David Stove's sarcastic dismissal of sociobiology rests on a false dilemma. Cuckoos lay their eggs in reed-warbler nests, and the large gape of cuckoo chicks so readily triggers the feeding reflex of the adult warbler that the warbler chicks go underfed. However, argues Stove, the cuckoos are ‘manipulating’ the warblers, getting them to feed cuckoo chicks, only if the cuckoos consciously intend their behaviour to have this effect: ‘The moon causally influences the tides, but it cannot manipulate them…. [C]ausal (...) influence plus resulting advantage are not enough to constitute manipulation. The causal influence must also be purposeful and intended.’. (shrink)

I am grateful to Philip Reed for his article ‘Expressivism at the Beginning and End of Life’. His piece compellingly demonstrates the import of expanding analyses concerning the expressivist thesis beyond the reproductive sphere to the end-of-life sphere. I hope that his intervention spurns further work on this connection. In what follows, I want to focus on what I take to be moments of slippage in his use of the concept of disability, a slippage to which many disability theorists (...) succumb. In short, I argue that there are crucial moments in his argument where Reed runs together cases of disability that should be kept distinct—at minimum for the context in which he discusses them. Namely, forms of disability the suffering of which justice can eliminate versus those that ‘no amount of accessibility and social justice could eliminate’.1 Disability studies scholars and philosophers of disability have long noted that certain types of disability are often ‘left …. How should we think about synthetic biology—about the potential benefits and risks of these applications as well as the very idea of designed, extensively genetically modi­fied organisms? The lead article in this report sets out our thinking, but the article is rounded out with nine commentaries that sometimes expand on and sometimes argue with our perspective. Jonathan Wolff, a philosopher at the University College of London and a member of the Nuffield Council on Bioethics, and Mark Bedau, a philosopher at (...) Reed College and a participant in several projects aimed at de­veloping artificial cells, discuss the potential consequences of synthetic biology and suggest some reasons for a precau­tionary approach to deliberating about the consequences. Jane Calvert, reader in science, technology, and innovation studies at the University of Edinburgh and a member of the Nuffield Council on Bioethics working party on emerging biotechnologies, recommends, however, that deliberation about the governance of emerging technologies focus less on consequences than on aims and purposes.Gigi Gronvall, senior associate at the Center for Health Security in the University of Pittsburgh Medical Center, and David Relman, a microbiologist and immunologist at the Stanford School of Medicine, offer contrasting per­spectives about a question we raise concerning “the eth­ics of knowledge”—the values at stake in generating and disseminating potentially dangerous information. Gaymon Bennett offers some ruminations on the questions we raise about how synthetic biology might change the human re­lationship to nature in morally significant ways. He argues, too, that we can think about the ethics of synthetic biology more effectively by getting “upstream” in another way—by sitting next to the bioengineers doing the work and study­ing their “everyday practice” rather than by paying attention only to what is thought and said about their work. Colleen Grogan, professor at the University of Chicago's School of Social Administration and an expert on democratic partici­patory processes in governance, builds on our comments about the challenge of creating a meaningful public dialog about synthetic biology. Jim Thomas, a researcher with the ETC Group, challenges our view of how the public debate about synthetic biology is trending. And Sarah Carter, a policy analyst with the J. Everyone interested in modern literature and the western cultural heritage should read it. Ziolkowski does much more than tell us about Virgil and his influence on modern authors and readers; he traces the Latin poet’s appeal from (...) the nineteenth century forward, focusing on different national trends and responses to the Roman past. His book is a veritable education in modern literature and cultural history.In the introductory chapter Ziolkowski situates Virgil in the twentieth century, with references to the Virgilian epigraph on the title page of Freud’s The Interpretation of Dreams (1900) and the Virgilian motto to the first volume of Toynbee’s A Study of History (1934). Ziolkowski concentrates attention, in fact, on the appeal to Roman history in many early twentieth-century historians, and he explores the various European and American reactions to the bimillennial celebrations in 1930 of Virgil’s birth. Like the Bible, the Roman past seems to speak directly to a great variety of points of view: “Roman history, properly comprehended in its broad outlines, is and remains the best teacher not only for today, but indeed for all times”; thus opined the author of Mein Kampf.Ziolkowski’s second chapter, “The Ideological Lives,” begins by observing that “every biography is ideological” and quoting Duane Reed Stuart’s comment that “Every age has tended to fashion a Virgil after its own image.” Ziolkowski tests this proposition against the many “modern” biographies of Virgil that appeared in the nineteenth and twentieth centuries, especially during the bimillennial celebrations. In Italy he finds Virgil described as “a Latin nationalist with conservative messages for the present on government and agriculture”; in France he discovers “a protofascist emerging from the bohemian life of the rive gauche of ancient Rome”; in Germany he encounters “an agrarian anima naturaliter christiana destined to become Father of the West in opposition to the rise of Nazism”; and in Latin America he sees that Virgil has become “an apostle of peace among the pagans with the providential mission to serve the generations as a pedagogue for Christ.”In the five chapters that follow, Ziolkowski shows that these various versions of Virgil’s life and influence resulted in a similar diversity of literary manifestations. In Europe, each country found a Virgil suited to its own preoccupations and prejudices. A rich and indeed overwhelming curriculum in modern literature could be constructed from the authors and texts Ziolkowski discusses in these brief surveys of works influenced by Virgil’s poetry. But although he is a deft literary critic, Ziolkowski goes further, to trace biographical and cultural influences. Kant’s 3rd Critique claims that the concept of purposiveness bridges the chasm between nature and freedom. This concept derives from the reflecting power of judgment’s demand for a system of particular laws. The published Introduction represents this system as grounded on the Idea of a divine understanding. According to Tuschling, this divinity is the intuitive understanding of §§76-77. According to Allison, this divinity is discursive and purposive and, thus, numerically distinct from §§76-77’s intuitive understanding. I argue that this debate between (...) Tuschling and Allison fails to appreciate the varied ways in which Kant predicates divine attributes. The 3rd Critique refers to a single God but does so in various ways. First, Kant literally ascribes an intuitive understanding to God on analytic grounds. Second, Kant analogically ascribes a discursive, purposive mind to this same God. Finally, Kant ascribes moral predicates to this analogical representation of God on practical grounds. (shrink)

The development of atomic bombs under the auspices of the U.S. Army's Manhattan Project during World War II is considered to be the outstanding news story of the twentieth century. In this book, a physicist and expert on the history of the Project presents a comprehensive overview of this momentous achievement. The first three chapters cover the history of nuclear physics from the discovery of radioactivity to the discovery of fission, and would be ideal for instructors of a sophomore-level "Modern (...) Physics" course. Student-level exercises at the ends of the chapters are accompanied by answers. Chapter 7 covers the physics of first-generation fission weapons at a similar level, again accompanied by exercises and answers. For the interested layman and for non-science students and instructors, the book includes extensive qualitative material on the history, organization, implementation, and results of the Manhattan Project and the Hiroshima and Nagasaki bombing missions. The reader also learns about the legacy of the Project as reflected in the current world stockpiles of nuclear weapons. This second edition contains important revisions and additions, including a new chapter on the German atomic bomb program and new sections on British and Canadian contributions to the Manhattan project and on feed materials. Several other sections have been expanded; reader feedback has been helpful in introducing minor corrections and improved explanations; and, last but not least, the second edition includes a detailed index. This volume frames the question of responsibility as a problem of agency in relation to the systems and structures of globalization. According to Ricoeur responsibility is a “shattered concept” when considered too narrowly as a problem of act, agency and individual freedom. To examine this Esther Reed develops a short genealogy of modern liberal and post-liberal concepts of responsibility in order to understand better the relationship dominant modern framings of the meanings of responsibility. Reed engages with writings by (...) major modern (Schleiermacher, Hegel, Marx, Weber) and post-liberal (Buber, Levinas, Derrida, Badiou, Butler, Young, Critchley) theorists to illustrate the shift from an ethnic responsibility built on notions of accountability and attributions to an ethic responsibility that starts variously from the 'other'. Reed sees Dietrich Bonhoeffer as the most promising partner of this theological dialogue, as his learning of responsibility from the risen Christ present now in the (global) church is a welcome provocation to new thinking about the meaning of responsibility learned from land, distant neighbour, (global) church and the bible. Bonhoeffer's reflections on the centre, boundaries and limits of responsibility remain helpful to Christian people struggling with an increasingly exhausted concept of accountability. (shrink)

Challenging clich's of Japanism as a feminine taste, Bachelor Japanists argues that Japanese aesthetics were central to contests over the meanings of masculinity in the West. Christopher Reed draws attention to the queerness of Japanist communities of writers, collectors, curators, and artists in the tumultuous century between the 1860s and the 1960s. Reed combines extensive archival research; analysis of art, architecture, and literature; the insights of queer theory; and an appreciation of irony to explore the East-West encounter through (...) three revealing artistic milieus: the Goncourt brothers and other japonistes of late-nineteenth-century Paris; collectors and curators in turn-of-the-century Boston; and the mid-twentieth-century circles of artists associated with Seattle's Mark Tobey. The result is a groundbreaking integration of well-known and forgotten episodes and personalities that illuminates how Japanese aesthetics were used to challenge Western gender conventions. These disruptive effects are sustained in Reed's analysis, which undermines conventional scholarly investments in the heroism of avant-garde accomplishment and ideals of cultural authenticity. In this paper, we present a survey of the development of the technique of argument diagramming covering not only the fields in which it originated - informal logic, argumentation theory, evidence law and legal reasoning – but also more recent work in applying and developing it in computer science and artificial intelligence. Beginning with a simple example of an everyday argument, we present an analysis of it visualised as an argument diagram constructed using a software tool. In the context of (...) a brief history of the development of diagramming, it is then shown how argument diagrams have been used to analyze and work with argumentation in law, philosophy and artificial intelligence. This essay argues that a restatement of Thomistic natural law reasoning is increasingly necessary in jurisprudential debate about international law. Mindful of Pope John Paul II's call for a renewal of international law, the essay engages with the present-day tension between Morgenthau-type realism and neo-Kantian discourse-oriented cosmopolitanism. The essay addresses whether the former is sufficiently realistic in our global 21st century context, and whether the latter is adequately cosmopolitan. Attention is drawn to Aquinas's understanding of the relation between custom, consent (...) and political authority in order to expose some of the limits of present-day statism, and to suggest that Thomistic natural law reasoning is, potentially at least, better able to cope with the intractable disagreement that characterises 21st century global relations than some forms of neo-Kantian jurisprudence. This book defends a form of ethical intuitionism, according to which (i) there are objective moral truths; (ii) we know some of these truths through a kind of immediate, intellectual awareness, or "intuition"; and (iii) our knowledge of moral truths gives us reasons for action independent of our desires. The author rebuts all the major objections to this theory and shows that the alternative theories about the nature of ethics all face grave difficulties.
