La singularité du droit pénal, selon Durkheim tient au fait que l'adage « nul n'est censé ignorer la loi»s'y applique sans fiction. Cette connaissance toujours déjà assurée des sujets sociaux que le droit pénal suppose, quel statut lui donner? Et quelle forme particulière de sanction s'en trouve par là déterminée? En étudiant les transformations de la réflexion sociologique sur ce sujet, de Durkheim à Fauconnet, on voudrait poser les jalons d'une conceptualisation du droit pénal qui, sans quitter le plan proprement (...) juridique et sans le réduire à n'être que le reflet ou l'instrument de motivations extérieures, s'efforce de saisir le type de prise qu'il exerce sur les événements et les corps, la façon dont il les dissocie et les réarticule, le découpage qu'il opère dans la réalité avec une précision et une exactitude qui n'ont rien d'absolu, puisqu'au fond, elles ne relèvent que de lui. Ce volume reprend le problème sociologique de l'Etat pour le reformuler dans des termes au croisement des développements récents d'une philosophie politique soucieuse d'intégrer l'apport des sciences sociales et d'une sociologie politique prête, à partir de ses enquêtes, à questionner ses propres catégories. Deux traductions, tirées de conjonctures qui ont rendu particulièrement saillant le problème sociologique de l'Etat, constituent le point de départ de la réflexion. Celle-ci se poursuit dans une série de contributions, philosophiques et sociologiques, voulant découvrir un concept (...) d'Etat propre à une science sociale du politique. L'enjeu de ce volume n'est pas seulement d'interroger la nécessité de l'Etat pour les formes modernes - entendons démocratiques - de l'organisation politique. Il est de contribuer à spécifier l'Etat dans ce qui le rend socialement nécessaire. The essay moves from the tension between society and humanity, between nationalism and cosmopolitism, in order to discuss the sociological concept of the State according to Emile Durkheim. The author criticizes Pierre Bourdieu who maintains that the Durkheimian State was only the expression of the French republican society at the end of the 19th century. The State should be instead for Durkheim the organized expression of the authority existing in every society. Unlike what happens in modern political theory, in particular (...) in Hobbes and Rousseau, the sociological State is not the sum of the forces, but rather the result of a mental process that links individuals to their state organization. Precisely for this reason the state is «the organ of social thought», which allows subsequent deliberations through the mediation between rulers and ruled, without presupposing individuals but producing continuously the environment of their action. Nous avons voulu déplacer complètement la question en prenant à la lettre la comparaison audacieuse que risque Lévi-Strauss, en quelques pages, où le marxisme comparaît comme ce qui, en Occident, fait écho à un processus de transformation du monde social dont l’Orient, en son propre sein, a inscrit par avance la possibilité. Ainsi, c’est une différence interne à l’Orient qui sert, en bonne méthode structurale, à penser une différence significative, mais inaperçue, dans notre propre culture. Et la pensée marxiste, inscrite sous le signe d’une volonté de transformation du monde plutôt que d’interprétation, est replacée dans un cadre qui la modalise, en même temps qu’elle en révèle la portée réellement critique. Résumé La philosophie de Bruno Latour se traduit dans son dernier livre comme une Enquête sur les modes d’existence. Une lecture de ce dernier livre permet de jeter un regard rétrospectif sur l’ensemble de l’œuvre sociologique et anthropologique de l’auteur, et de la présenter comme une philosophie de l’attention. Cette attention s’aiguise en se portant sur l’ensemble de ces modes, sur leurs différences ontologiques et les bifurcations qu’ils introduisent dans le registre de l’expérience. La question centrale, en se déterminant (...) progressivement comme une question cosmologique et éthique – à quel monde tenons-nous? – infléchit la pratique des sciences sociales en direction d’une philosophie qui soit à la hauteur de ce qu’exige la condition des Modernes. La distinction entre pouvoir et autorité, couramment admise et illustrée en sciences sociales, est plus rarement interrogée dans ses présupposés. En particulier, de quelle vision culturelle une telle distinction est-elle l’expression? À partir de la réflexion de Peterson sur la nature et le statut de la théologie, cet essai se propose d’éclairer la forme chrétienne d’une parole d’autorité, d’en dégager la structure générale et les implications en termes de conduite de vie. Il se concentre sur la définition de la dogmatique (...) chrétienne. À partir de ce point, une frontière précise peut être tracée entre politique et religion. Mais c’est sous la seule condition qu’un espace juridique se détermine dans la seconde comme lieu de formation de jugements théologiques. Ces considérations permettent de revenir sur le débat entre Schmitt et Peterson du point de vue, non de la possibilité ou de l’impossibilité d’une théologie politique chrétienne comme on le fait d’ordinaire, mais du point de vue de la facture juridique des concepts théologiques. The courses by Michel Foucault recently published invite us to approach the question of the State, and more generally that of politics, from the point of view of governing and “governmentality”. Through such concepts surfaces a constant methodological urge to approach things from the outside, to study multiplicities, “connexions with the heterogeneous”, historical configurations where disparate elements interact while remaining disparate. The same approach structures the understanding of this form of governmentality known as liberalism. In order to understand its nature, (...) a long detour was needed into the realm of the Christian pastorate, and into the connection of the heterogeneous in politics that was thus brought about in the West. Résumé Placée sous le signe d’une restauration de la science politique pour l’époque moderne, la pensée de Voegelin tourne autour du concept de représentation, dont elle renouvelle complètement le sens en le reconduisant aux conditions d’existence d’une société politique. On peut estimer que la confrontation avec la théorie hobbesienne de la personne civile en est l’épicentre. Cet essai s’efforce de restituer cette confrontation, en faisant ressortir l’ambivalence sur laquelle elle repose : le double visage de Hobbes, jugé d’un côté responsable (...) de la théorie abstraite de la représentation qui triomphe depuis le xvii e siècle, de l’autre résistant héroïque au déclin spirituel de la modernité, s’efforçant de forger un nouveau corpus mysticum dans un contexte où l’institution ecclésiale ne joue plus le rôle de garant. Plus radicalement, à travers la lecture voegelinienne de Hobbes, c’est le sens de ce que le christianisme fait subir à l’ épistémé politiké classique qui est soumis à l’examen. En reconstituant cette lecture, on fait apparaître pour finir les difficultés sur lesquelles Voegelin vient buter, dans la tâche restauratrice qu’il assigne à la pensée moderne tout entière. Cet essai analyse le sens que donne Leo Strauss à l’argument de l’élection des juifs, et tente à partir de là de comprendre sa position à l’égard des différentes options qui s’offrent aux juifs modernes (le retour à la tradition, l’assimilation, le sionisme politique). Le sens politique que Strauss confère à l’élection dans son diagnostic de la modernité et de la place que les juifs y occupent n’exclut pas, mais au contraire éclaire d’une manière nouvelle l’acception théologique du terme. Ce (...) sens s’éclaire par la reprise de la formule talmudique « Si je ne me bats pas pour moi, que suis-je? ». Les sciences sociales, depuis le structuralisme, se sont développées en France sur fond d'ignorance ou de rejet déclaré de la philosophie de type phénoménologique. De son côté, celle-ci a pris un tour qui l'a de plus en plus éloignée des sciences positives en général et des sciences humaines en particulier. Pourtant, lorsque la sociologie, comme c'est le cas aujourd'hui, cherche à cerner la figure de l'acteur social et à interroger les conditions de sa subjectivation - de sa constitution comme sujet (...) social - une confrontation avec cette philosophie pourrait s'avérer fructueuse. Et pour une phénoménologie qui n'a que trop tendance à se confondre avec la forme actuelle de la métaphysique, un retour sur l'inscription sociale de ce qu'elle décrit, et une mise à l'épreuve de la critique sociologique, pourrait en retour être salutaire. C'est dans cet esprit que les auteurs de ce collectif ont tenté de construire des liens, dans une réflexion croisée sur le caractère immédiatement social de la subjectivité et sur la nécessité de penser les conditions d'appropriation de l'espace social par des sujets. The emergence of modern sciences in the seventeenth century profoundly renewed our understanding of Nature. For the last three centuries new ideas of Nature have been continuously developed by theology, politics, economics, and science, especially the sciences of the material world. The situation is even more unstable today, now that we have entered an ecological mutation of unprecedented scale. Some call it the Anthropocene, but it is best described as a new climatic regime. And a new regime it certainly is, (...) since the many unexpected connections between human activity and the natural world oblige every one of us to reopen the earlier notions of Nature and redistribute what had been packed inside. So the question now arises: what will replace the old ways of looking at Nature? This book explores a potential candidate proposed by James Lovelock when he chose the name "Gaia" for the fragile, complex system through which living phenomena modify the Earth. The fact that he was immediately misunderstood proves simply that his readers have tried to fit this new notion into an older frame, transforming Gaia into a single organism, a kind of giant thermostat, some sort of New Age goddess, or even divine Providence. In this series of lectures on "natural religion", Bruno Latour argues that the complex and ambiguous figure of Gaia offers, on the contrary, an ideal way to disentangle the ethical, political, theological, and scientific aspects of the now obsolete notion of Nature. He lays the groundwork for a future collaboration among scientists, theologians, activists, and artists as they, and we, begin to adjust to the new climatic regime. (shrink)

Ontological pluralism is the view that there are different ways to exist. It is a position with deep roots in the history of philosophy, and in which there has been a recent resurgence of interest. In contemporary presentations, it is stated in terms of fundamental languages: as the view that such languages contain more than one quantifier. For example, one ranging over abstract objects, and another over concrete ones. A natural worry, however, is that the languages proposed by the pluralist (...) are mere notational variants of those proposed by the monist, in which case the debate between the two positions would not seem to be substantive. Jason Turner has given an ingenious response to this worry, in terms of a principle that he calls ‘logical realism’. This paper offers a counter-response on behalf of the ‘notationalist’. I argue that, properly applied, the principle of logical realism is no threat to the claim that the languages in question are notational variants. Indeed, there seems to be every reason to think that they are. (shrink)

This chapter challenges Cantor’s notion of the ‘power’, or ‘cardinality’, of an infinite set. According to Cantor, two infinite sets have the same cardinality if and only if there is a one-to-one correspondence between them. Cantor showed that there are infinite sets that do not have the same cardinality in this sense. Further, he took this result to show that there are infinite sets of different sizes. This has become the standard understanding of the result. The chapter challenges this, arguing (...) that we have no reason to think there are infinite sets of different sizes. It begins with an initial argument against Cantor’s claim that there are infinite sets of different sizes and then proceeds, by way of an analogy between Cantor’s mathematical result and Russell’s paradox, to a more direct argument. First, the approaches of 'Diskursethik' (Discourse ethics) and of Modern Political Economy are described. While the latter investigates political decision processes, the former is concerned with the discourse process which takes place before a decision is made. This is shown by using referenda as an example. The discourse which takes place before referenda obviously does not conform to the ideal conditions defined in Diskursethik, but discourse and decisions in the context of referenda come nearer to the intentions of Diskursethik and (...) Political Economy than other decision procedures which are used in representative democracies. (shrink)

In the last years, a theological turn had a pervasive influence in the reception of Carl Schmitt’s writings. According to this view, his thought has a strong, substantial religious foundation. With regards to understanding not only Schmitt’s position but also his current influence in authoritarian countries, this essay argues that this interpretation is misleading and proposes a different and comprehensive analysis of Schmitt’s concept of political theology that replaces it in a political-legal framework. Against the theological reading, it argues that (...) Schmitt’s concept of “political theology” refers to his own conception of legal theory as an attempt to relegitimize authority in a secular context. As “political theology,” this legal theory is designed to overcome normativism and parliamentarism by “substantializing” the legal form. Using Schmitt’s post-1933 works as an example, the essay shows that, as theology translates faith into a written doctrine, legal theory must, according to Schmitt, substantialize the legal form by translating the political idea into jurisprudence. Hence, this article concludes that Schmitt’s theory might be described as “political theology” but only in a formal, ideological sense. It is part of an authoritarian theory that is not religious but uses theology to revive an appearance of absolute legitimacy. (shrink)

Since international trade leads to prosperity, most economics are in favor of globalization. This basic conviction is shared in this paper. Several standard arguments brought forward by critics of globalization - e.g. the claims that globalization increases poverty, destroys jobs, undermines the welfare state, enables international corporations to seize power and leads to environmental degradation and uniform culture - are shown to be invalid. Nevertheless, compared to orthodox economists, a more critical view of globalization is proposed in this paper, and (...) several shortcomings of globalization are discussed. These shortcomings are the unidirectional trade liberalization at the expense of developing countries, international organizations, like the IMF of World Bank, representing narrow economic interests and, above all, the lack of 'global governance'. Therefore, the implementation of functional overlapping competing jurisdiction is put forward. It is argued that the alternative proposition of a world government is dangerous, and global solidarity ineffective. (shrink)

In Intuition et idéalités: Phénoménologie des objets mathématiques (2020), Dominique Pradelle questioned the nature of mathematical knowledge–the status of math.

General-elimination harmony articulates Gentzen’s idea that the elimination-rules are justified if they infer from an assertion no more than can already be inferred from the grounds for making it. Dummett described the rules as not only harmonious but stable if the E-rules allow one to infer no more and no less than the I-rules justify. Pfenning and Davies call the rules locally complete if the E-rules are strong enough to allow one to infer the original judgement. A method is given (...) of generating harmonious general-elimination rules from a collection of I-rules. We show that the general-elimination rules satisfy Pfenning and Davies’ test for local completeness, but question whether that is enough to show that they are stable. Alternative conditions for stability are considered, including equivalence between the introduction- and elimination-meanings of a connective, and recovery of the grounds for assertion, finally generalizing the notion of local completeness to capture Dummett’s notion of stability satisfactorily. We show that the general-elimination rules meet the last of these conditions, and so are indeed not only harmonious but also stable. (shrink)

Democracies find it difficult, and sometimes impossible to get through projects desired by a large share of the population because these are strongly opposed by local residents (NIMBY: Not In My BackYard). As a solution for these conflicts, economists proposed offering (monetary) compensation to the citizens of the host community. Experiences with many different projects and countries reveal, however, that monetary payments are incapable of solving the NIMBY-problem. A monetary offer to accept an otherwise undesired project undermines civic virtue. This (...) crowding-out effect is empirically demonstrated using the search for a nuclear repository in Switzerland. A satisfactory strategy to overcome the NIMBY-problem takes into account the procedure, the time sequence, as well as the type of compensation offered. (shrink)

Strong forces lead to a withering of academia as it exists today. The major causal forces are the rankings mania, increased division of labor in research, intense publication pressure, academic fraud, dilution of the concept of ‘university’, and inadequate organizational forms for modern research. Academia, in a broader sense understood as ‘the locus of seeking truth and learning through methodological inquiry’, will subsist in different forms. The conclusion is therefore pessimistic with respect to the academic system as it presently exists (...) but not to scholarly endeavour as such.
