  2. The Power of Feminist Judgments?Rosemary Hunter - 2012 - Feminist Legal Studies 20 (2):135-148.
Recent years have seen the advent of two feminist judgment-writing projects, the Women’s Court of Canada, and the Feminist Judgments Project in England. This article analyses these projects in light of Carol Smart’s feminist critique of law and legal reform and her proposed feminist strategies in Feminism and the Power of Law (1989). At the same time, it reflects on Smart’s arguments 20 years after their first publication and considers the extent to which feminist judgment-writing projects may reinforce or trouble (...)

Thinking about law: perspectives on the history, philosophy, and sociology of law.Rosemary C. Hunter, Richard Ingleby & Richard Johnstone (eds.) - 1995 - St. Leonards, NSW, Australia: Allen & Unwin.
There is more to law than rules, robes and precedents. Rather, law is an integral part of social practices and policies, as diverse and complex as society itself. Thinking About Law offers a comprehensive introduction to the ways in which law has been presented and represented. It explores historical, sociological, economic and philosophical perspectives on the major legal and political debates in Australia today. The contributors examine the position of Aborigines in the Australian legal system and the impact of the (...)

The ‘child’s best interests’ as an argumentative resource in family mediation sessions.Jan Ewing, Rosemary Hunter, Anne Barlow & Janet Smithson - 2015 - Discourse Studies 17 (5):609-623.
We used Discursive Psychology to study the claims and arguments which occur when ‘the child’s best interests’ is produced as a resource in family mediation settings. Analysis draws on data from three pairs of separated or separating parents attempting to resolve child contact or residency disputes through mediation. Our analysis focuses on the tendency of claims to the abstract notion of the child’s best interests to exacerbate conflict, especially as parents drew on conflicting research in this area. Changing expectations of (...)

The papers in the following section arose from a roundtable discussion organised by the AHRC Research Centre for Law, Gender and Sexuality, titled ‘Law, Gender and Sexuality: The Making of a Field’. Participants in the roundtable were asked to reflect on the challenges confronting law, gender and sexuality (LGS) as an area of research and scholarship, and to ask what benefits, possibilities, risks and dangers accompany the establishment of a research terrain. The papers address such questions as ‘what is a (...)

This article examines the phenomenon of women barristers' denials of the existence of discrimination against women at the Bar, against a backdrop of widespread evidence of sex discrimination and gender bias in this branch of the legal profession. Using interview transcripts from a research study of the status of women at one of the independent Bars in Australia, the article analyses the various stories told by senior women barristers to the interviewers about their gender and experiences at the Bar. It (...)

On Believing: Being Right in a World of Possibilities.David A. Hunter - 2022 - Oxford: Oxford University Press.
Developing original accounts of the many aspects of belief, On Believing puts the believer at the heart of the story. Developing a novel account of the normativity of belief, Hunter argues that the ethics of belief concern how a believer ought to be positioned in a world of possibilities.
  20. Alienated Belief.David Hunter - 2011 - Dialectica 65 (2):221-240.
This paper argues that it is possible to knowingly believe something while judging that one ought not to believe it and (so) viewing the belief as manifesting a sort of failure. I offer examples showing that such ‘alienated belief’ has several potential sources. I contrast alienated belief with self-deception, incontinent (or akratic) belief and half-belief. I argue that the possibility of alienated belief is compatible with the so-called ‘transparency’ of first-person reflection on belief, and that the descriptive and expressive difficulties (...)

Wittgensteinian Quasi-Fideism and Interreligious Communication.Guy Bennett-Hunter - 2019 - In Gorazd Andrejč & Daniel H. Weiss (eds.), Interpreting Interreligious Relations with Wittgenstein: Philosophy, Theology, and Religious Studies. Leiden: Brill. pp. 157–173.
In this essay, I draw out some implications of a position called “Wittgensteinian Quasi-Fideism” for the theory and practice of interreligious communication. After setting out the main tenets of that position, I articulate what its theoretical and practical implications in this area would be if it were true. I thereby sketch a new, Wittgensteinian model of interreligious communication, concluding with a number of suggestions as to some points of focus for further work in this area.

'Deficient in commercial morality'?: Japan in global debates on business ethics in the late nineteenth and early twentieth centuries.Janet Hunter - 2016 - London: Palgrave-Macmillan.
This enlightening text analyses the origins of Western complaints, prevalent in the late nineteenth century, that Japan was characterised at the time by exceptionally low standards of ‘commercial morality’, despite a major political and economic transformation. As Britain industrialised during the nineteenth century the issue of ‘commercial morality’ was increasingly debated. Concerns about standards of business ethics extended to other industrialising economies, such as the United States. Hunter examines the Japanese response to the charges levelled against Japan in this (...)

Free marketeers or good citizens? Educational policy and lay participation in the administration of schools.Rosemary Deem - 1994 - British Journal of Educational Studies 42 (1):23-37.
This paper examines what can be learnt from analysing attempts to give lay people more involvement in the administration of state schools. Although devolving more responsibility to schools and lay governors has been an important feature of school reform in several countries, it is not immediately apparent if this shift is the product of globally similar social and political forces or nationally specific cultural, ideological and economic factors. In considering this issue, the paper describes recent changes in school governance in (...)

Teaching for complex systems thinking.Rosemary Hipkins - 2021 - Wellington, New Zealand: NZCER Press.
What do a short car trip, a pandemic, the wood-wide fungal web, a challenging learning experience, a storm, transport logistics, and the language(s) we speak have in common? All of them are systems, or multiple sets of systems within systems. What happens in any set of circumstances will depend on a mix of initial conditions, complexity dynamics, and the odd wild card (e.g., a chance event). While it is possible to model and predict what might or perhaps should happen, it (...)

    Pure time preference.Rosemary Lowry & Martin Peterson - 2011 - Pacific Philosophical Quarterly 92 (4):490-508.
Pure time preference is a preference for something to come at one point in time rather than another merely because of when it occurs in time. In opposition to Sidgwick, Ramsey, Rawls, and Parfit we argue that it is not always irrational to be guided by pure time preferences. We argue that even if the mere difference of location in time is not a rational ground for a preference, time may nevertheless be a normatively neutral ground for a preference, and (...)

  37. A Pragmatist Conception of Certainty: Wittgenstein and Santayana.Guy Andrew Bennett-Hunter - 2012 - European Journal of Pragmatism and American Philosophy 4 (2):146-157.
The ways in which Wittgenstein was directly influenced by William James (by his early psychological work as well his later philosophy) have been thoroughly explored and charted by Russell B. Goodman. In particular, Goodman has drawn attention to the pragmatist resonances of the Wittgensteinian notion of hinge propositions as developedand articulated in the posthumously edited and published work, On Certainty. This paper attempts to extend Goodman’s observation, moving beyond his focus on James (specifically, James’s Pragmatism) as his pragmatist reference point. (...)

The purpose of this study was to determine the development of moral judgement in first-year and senior baccalaureate nursing students. These students were enrolled in three separate nursing programmes, each of which differed significantly in ethical content. The sample totalled 180 students enrolled in three New England programmes. Programme A included an ethics course taught by a professor of ethics. Programme B integrated ethical issues into all nursing theory courses. Programme C did not include ethical content in theory courses. The (...)

Recovering the Logic of Double Effect for Business: Intentions, Proportionality, and Impermissible Harms.Rosemarie Monge & Nien-hê Hsieh - 2020 - Business Ethics Quarterly 30 (3):361-387.
ABSTRACTBusiness actors often act in ways that may harm other parties. While the law aims to restrict harmful behavior and to provide remedies, legal systems do not anticipate all contingencies and legal regulations are not always well-enforced. This article argues that the logic of double effect, which has been developed and deployed in other areas of practical ethics, can be useful in helping business actors decide whether or not to pursue potentially harmful activities in commonplace business activity. The article illustrates (...)

Institutionally Driven Moral Conflicts and Managerial Action: Dirty Hands or Permissible Complicity?Rosemarie Monge - 2015 - Journal of Business Ethics 129 (1):161-175.
This paper examines what managers ought to do when confronted with apparent moral conflicts between their managerial responsibilities and the general requirements of morality, specifically when those conflicts are driven by the institutional environment. I examine Google’s decision to enter the Chinese search engine market as an example of such a conflict. I consider the view that Google’s managers engaged in justifiable moral compromise in making the choice to engage in self-censorship and show how this view depends on the idea (...)

This volume responds to calls in visual and material cultural studies to move beyond the visual and to explore the multi-sensory impact of the image, across a wide range of cultural and historical contexts. What does it mean to do art history after the material and sensory turns? What is an image, if it is not purely visual phenomenon, and how does it prompt non-visual sensory experiences? The multi-sensoriality of the image was a less challenging concept before the occularcentric modern (...)
