In 1989, Thomas Donaldson requested the California courts to allow physicians to hasten his death. Donaldson had been diagnosed with brain cancer, and he desired to die in order to cryonically preserve his brain, so as to stop its further deterioration. This case elicits an important question: is this a case of euthanasia? In this article, we examine the traditional criteria of death, and contrast it with the information-theoretic criterion. If this criterion is accepted, we posit that Donaldson’s case would (...) have been cryocide, but not euthanasia. We then examine if cryocide is an ethically feasible alternative to euthanasia. To do so, we rely on the ethical doctrine of double effect. (shrink)

Following the declaration of the COVID-19 outbreak as a global pandemic in March 2020, a state of alarm was decreed in Spain. In this situation, healthcare workers experienced high levels of stress, anxiety and depression due to the heavy workload and working conditions. Although Spain experienced a progressive decline in the number of COVID-19 cases until the last week of May and the work overload among health workers was substantially reduced, several studies have shown that this work overload is associated (...) with the later emergence of psychological symptoms induced by stress. The aim of the present study was to evaluate the levels of stress, anxiety, depression, post-traumatic stress and compassionate fatigue in health professionals. The sample consisted of 973 health professionals 16.5% men, 82.9% women, and one non-binary person. The data were collected through an online questionnaire sent to the participants by e-mail. DASS-21 was used to measure anxiety, stress and depression, PCL-C to measure post-traumatic stress and ProQOL -vIV to measure compassion fatigue. In addition, other descriptive variables that could be related to these levels of psychological symptomatology were evaluated. The results reveal that after the work overload experienced during the COVID-19 pandemic, healthcare workers report psychological symptoms, post-traumatic stress and compassion fatigue. It is therefore recommended that these professionals be provided with psychological help in order to reduce the emotional impact of COVID-19, and consequently improve their mental health. (shrink)

IntroductionThe prefrontal cortex plays a crucial role in cognition, particularly in executive functions. Cortical reactivity measured with Transcranial Magnetic Stimulation combined with Electroencephalography is altered in pathological conditions, and it may also be a marker of cognitive status in middle-aged adults. In this study, we investigated the associations between cognitive measures and TMS evoked EEG reactivity and explored whether the effects of this relationship were related to neurofilament light chain levels, a marker of neuroaxonal damage.MethodsFifty two healthy middle-aged adults from (...) the Barcelona Brain Health Initiative cohort underwent TMS-EEG, a comprehensive neuropsychological assessment, and a blood test for NfL levels. Global and Local Mean-Field Power, two measures of cortical reactivity, were quantified after left prefrontal cortex stimulation, and cognition was set as the outcome of the regression analysis. The left inferior parietal lobe was used as a control stimulation condition.ResultsLocal reactivity was significantly associated with working memory and reasoning only after L-PFC stimulation. No associations were found between NfL and cognition. These specific associations were independent of the status of neuroaxonal damage indexed by the NfL biomarker and remained after adjusting for age, biological sex, and education.ConclusionOur results demonstrate that TMS evoked EEG reactivity at the L-PFC, but not the L-IPL, is related to the cognitive status of middle-aged individuals and independent of NfL levels, and may become a valuable biomarker of frontal lobe-associated cognitive function. The first part of this work analyses the universalist and the particularist conceptions of reasons. The second part projects this analysis to the legal domain. The author stresses that universalism and particularism regarding reasons are mutually exclusive theories linked to incompatible conceptions of norms, i.e. norms as strict universal conditionals and norms as defeasible conditionals. In giving an account of this tenet, different meanings of universality and defeasibility are explored. A parallel debate regarding reasons can be found in the legal (...) domain, where two contrasting categories of norms are usually distinguished: rules and principles. On this issue the author argues that the conception of legal reasons depends on the way in which this contrast between different kinds of legal norms is shaped. (shrink)

Incest taboos are universal, but it is questionable whether consensual incest should continue to be illegal. The most common argument in favor of the illegalization of consensual incest appeals to genetic risks and the harm to potential offspring. In this article, we examine whether public health concern is a sufficient reason to illegalize consensual incest. We posit that indeed, incest represents a risk, but this is not reason enough to illegalize incest. For, other circumstances of sexual intercourse may lead to (...) similar risks, and yet, such practices are not illegal. While those practices may represent an added risk to public health, to forbid them as a way to improve the genetic pool would be akin to eugenic program, and that is morally objectionable. This does not imply that consensual incest ought to be legal, for there may be other good reasons to illegalize it. But they do not relate to public health and genetic risks, and consequently, medical practitioners and public health officials ought to avoid using their medical authority as a platform to make moral pronouncements. En este trabajo analizo la concepción de Eugenio Bulygin respecto de aquellos enunciados jurídicos que afirman que una cierta acción es jurídicamente obligatoria, prohibida o permitida. Conforme a Bulygin, estos enunciados son ambiguos. Ellos pueden ser enunciados empíricos externos que afirman la existencia o validez de una norma, o pueden ser enunciados normativos internos que expresan una norma, o una actitud moral absoluta. En el trabajo sostengo que, para una concepción positivista, si el derecho es concebido como un conjunto de (...) normas, los enunciados bajo análisis no enuncian un hecho empírico, pero tampoco expresan una actitud moral absoluta. Ellos ciertamente enuncian un hecho normativo: la validez o existencia jurídica de una entidad normativa, que es relativa a un determinado tiempo y lugar. En mi opinión, la dificultad de Bulygin para admitir este tipo de enunciados se debe fundamentalmente a la presuposición de una falsa dicotomía entre dos modos en los que una entidad puede existir: uno empírico y otro normativo. Con el fin de criticar esta aparente dicotomía presento brevemente una concepción constructivista de la existencia de normas. Si mi razonamiento es correcto, esta concepción es adecuada para explicar, desde una perspectiva teórica positivista, aquellos enunciados que expresan el hecho normativo de la existencia o validez jurídica de una norma. In this paper I analyze Bulygin's conception of those legal statements asserting that a certain action is legally obligatory, prohibited or permitted. According to Bulygin, these statements are ambiguous. They can be external, empirical statements expressing the existence or validity of a legal norm, but they can also be internal, normative statements expressing a norm or an absolute, moral attitude. In the paper I attempt to defend that for a positivist theory, if law is conceived as a set of norms, this kind of statements do not report an empirical fact, but do not express an absolute moral attitude either. They surely assert a normative fact: the legal existence or validity of a normative entity, which is relative to a certain time and place. In my view, Bulygin's failure to see this point is fundamentally due to the assumption of a false dichotomy between two ways in which an entity can exist: one empirical, the other normative. In order to criticize this apparent dichotomy, I briefly sketch a constructivist conception in which we can say that legal norms exist. If my reasoning is correct, this conception is apt to explain those statements expressing the normative fact that a norm exists or is legally valid. (shrink)

As it has historically been the case with many pandemics, the Covid-19 experience will induce many philosophers to reconsider the value of medical practice. This should be a good opportunity to critically scrutinize the way medical research and medical interventions are carried out. For much of its history, medicine has been very inefficient. But, even in its contemporary forms, a review of common protocols in medical research and medical interventions reveal many shortcomings, especially related to methodological flaws, and more importantly, (...) conflicts of interests due to profit incentives. In the face of these problems, we propose a program of “gentle medicine”. This term, originally formulated by philosopher Jacob Stegenga, describes a form of medicine in which physicians intervene less than they currently do. As part of this general program, we advance a series of reform recommendations that could be enacted both by medical staff in their everyday practice, but also by public health officials and policymakers. La primera parte de este artículo se refiere a las reglas que definen la autoridad legislativa suprema de un orden jurídico. En esta primera parte, además, el artículo se ocupa de algunas distinciones: entre normas y meta-normas, entre reglas legisladas y reglas consuetudinarias, y entre reglas constitutivas y reglas regulativas; todo ello con el objetivo de determinar a cuál de estas categorías pertenecen las reglas que definen la autoridad legislativa suprema de un orden jurídico. La conclusión es que las reglas (...) básicas que definen las autoridades legislativas supremas de cada orden jurídico existente, son necesariamente meta-normas constitutivas con naturaleza consuetudinaria. En la segunda parte de este artículo se toman en consideración los diferentes contenidos posibles de las reglas últimas que definen la autoridad legislativa. Sobre esta base, se distinguen cuatro modelos de sistema jurídico y autoridad legislativa: los que se corresponden con la autoridad absoluta y con la autoridad moral, y los que se corresponden con el estado de derecho y con el estado constitucional. En este sentido, se ofrecen algunas consideraciones: por un lado, para hacer referencia a la específica noción de autoridad que opera dentro del estado constitucional; y, por otro lado, para formular una puntual crítica a la distinción teórica entre autoridad constituyente y autoridad constituida. Según el análisis provisto en este artículo, cada autoridad es una autoridad constituida. IntroductionExcitability of the primary motor cortex measured with TMS has been associated with cognitive dysfunctions in patient populations. However, only a few studies have explored this relationship in healthy adults, and even fewer have considered the role of biological sex.MethodsNinety-seven healthy middle-aged adults completed a TMS protocol and a neuropsychological assessment. Resting Motor Threshold and Long-Interval Intracortical Inhibition were assessed in the left motor cortex and related to attention, episodic memory, working memory, reasoning, and global cognition composite scores to evaluate (...) the relationship between cortical excitability and cognitive functioning.ResultsIn the whole sample, there was a significant association between LICI and cognition; specifically, higher motor inhibition was related to better working memory performance. When the sample was broken down by biological sex, LICI was only associated with working memory, reasoning, and global cognition in men. No associations were found between RMT and cognitive functions.ConclusionGreater intracortical inhibition, measured by LICI, could be a possible marker of working memory in healthy middle-aged adults, and biological sex plays a critical role in this association. RESUMEN: Los cambios en la nueva concepción del Estado Democrático de Derecho que surgen a partir de la toma de conciencia de la existencia de determinados derechos que se consideran como fundamentales por la comunidad internacional, influyen de modo directo en el diseño de políticas públicas, de creación de normas jurídicas y en el modo de resolver los casos judiciales. Es así que se presenta a la Teoría Neoconstitucional como una nueva teoría del derecho que permite integrar los derechos con (...) sus respectivas garantías, y que se ocupa tanto de las normas como de los principios y los valores de Derechos Humanos y de su internalización en los ordenamientos de los Estados, es decir, se ocupa del fenómeno de mundialización de estos derechos. Dentro de los derechos fundamentales encontramos los que poseen las mujeres en lo que concierne a vivir una vida libre de toda violencia en la que se respete su dignidad y autonomía de la voluntad, amén de que los índices de violencia contra ellas aumentan día a día en todos los países del mundo. De este modo los Estados deberán cumplimentar con las medidas de acciones positivas tendientes a garantizar el efectivo goce de los derechos reconocidos por los Pactos internacionales de Derechos Humanos.ABSTRACT: The changes in the new conception of the Democratic State of Law that arise from the awareness of the existence of certain rights that are considered fundamental by the international community, have a direct influence on the design of public policies, the creation of legal norms and how to solve judicial cases. This is how the Neoconstitutional Theory is presented as a new theory of law that allows integrating rights with their respective guarantees, and that deals with both the norms and the principles and values of Human Rights and their internalization in the legal systems. of the States, that is, deals with the phenomenon of globalization of these rights. Within the fundamental rights we find those that women possess in what concerns to live a life free of all violence in which their dignity and autonomy of the will is respected, in addition to that the indices of violence against them increase every day in all the countries of the world. En el presente artículo se analizan cinco modos de entender el ideal de completitud de los sistemas jurídicos, teniendo como punto de referencia las ideas de Carlos Alchourrón. En este trabajo se propone distinguir los criterios de identificación de los textos jurídicamente relevantes; los métodos o reglas que permiten pasar de un contenido C a un contenido C1, y los criterios de validez o pertenencia de normas al sistema. En la concepción predominante entre los teóricos del derecho, las reglas lógicas (...) sirven para justificar el paso de un contenido a otro, sin embargo, no se admiten como criterios de pertenencia de normas al sistema jurídico. Esto significa que el derecho no es concebido como un sistema deductivo y que un ideal de completitud absoluta es lógicamente posible. En el trabajo se llega a la conclusión de que hay sólo dos formas no banales de entender el ideal de completitud absoluta de los sistemas jurídicos. O bien, en un espíritu formalista, mediante la introducción de reglas residuales de clausura o bien, en un espíritu moralista, aceptando que la moral crítica funcione como criterio de pertenencia al derecho. This paper analyses five different ways of understanding completeness as an ideal of legal systems. In doing so it essentially relies on the thesis discussed by Carlos Alchourrón regarding this subject. The paper stresses the need to distinguish the criteria for the identification of the legally relevant texts, the methods or rules that justify the passage from a content C to another content C1 and, the criteria for the identification of valid norms belonging to the system. According to the dominant conception in legal theory, the rules of logic justify the passage from a content to another; such rules, however, are not accepted as membership criteria. This means that the notion of system that legal theorists use to organize the law is not the notion of a deductive system. In this conception the ideal of absolute completeness is a logically possible ideal. The conclusion reached in the article is that there are only two ways of understanding the ideal of "plenitude" or absolute completeness of a legal system: in a formalist view, through the introduction of residual rules of closure, or, in a moralistic view, by accepting critical morality as a criterium for legal validity. This article is primarily focused on two interconnected discussions presented by John Gardner in Law as a Leap of Faith. The first one is related to the thesis which, according to Gardner, all positivists agree on; the second one is referred to the positivist’s position regarding the connection between law and morality. In order to address these issues I rely on the distinction between two kinds of criteria: the conceptual criteria and the validity criteria. On this basis, and against what (...) Gardner asserts, I try to defend two main ideas. Firstly, that the thesis on which all positivists agree is not one about the validity criteria that norms must satisfy in order to belong to a legal system, but rather one concerning the conceptual criteria delimiting the concept of law. By the same token, I argue that, according to the positivist understanding of the concept of law, there is no necessary connection between law and morality. (shrink)

The effects of time and the longitudinal course of the children’s internalizing symptoms following Intimate Partner Violence Exposure are still of great interest today. This study aimed to analyze the effect of the frequency of IPVE, adverse experiences after the cessation of the IPVE and the time elapsed since the termination of the violent relation on the prevalence of anxiety and depression among children. Participants were 107 children and their mothers who had been victims of IPV and had existing judicial (...) protection and restraining orders. Hierarchical logistic regression models were estimated to analyze children’s adjustment, considering the effect of the time elapsed since the termination, frequency of IPVE, experiences of revictimization, maternal pathology, and anxious anticipation of the mother at the prospect of future harm. Exposure to multiple events of violence at the hands of multiple ex-partners and higher scores in the mother’s anxious anticipation were significant predictors of children’s pathological depression and anxiety. Our results emphasize the need for early psychological evaluation of women and children’s victims of IPV to provide timely interventions that avoid symptoms from becoming chronic. Strategies to bring support and emotional security to the victims after the end of the violent relationship are desirable. (shrink)

BackgroundScientific literature on posttraumatic growth after terrorist attacks has primarily focused on persons who had not been directly exposed to terrorist attacks or persons who had been directly exposed to them, but who were assessed few months or years after the attacks.MethodsWe examined long-term PTG in 210 adults directly exposed to terrorist attacks in Spain a mean of 29.6 years after the attacks. The participants had been injured by a terrorist attack or were first-degree relatives of people who had been (...) killed or injured by a terrorist attack. They completed diagnostic measures of emotional disorders and measures of PTSD and depression symptomatology, optimism, and PTG.ResultsMultiple regression analyses revealed gender differences and a positive linear relationship between PTG and cumulative trauma after the terrorist attack. Some PTG dimensions were significantly associated with PTSD symptomatology, these associations being linear, not curvilinear. However, PTG was not associated with depression symptomatology, diagnosis of emotional disorders, age, elapsed time since the attack, or optimism. In comparison with survivors assessed 18 years after the 1995 Oklahoma City bombing, Spanish victims of terrorism showed higher levels of appreciation of life, but lower levels of relating to others and spiritual change.ConclusionThe findings underscore the influence of gender on PTG and provide support to the hypothesis that some emotional distress may be a necessary condition of PTG. Future studies on PTG after terrorist attacks should take into consideration the characteristics of the terrorist attack itself and the contexts of violence and threat in which it occurred. The political, social, and cultural characteristics of the community affected by it and the profile and characteristics of other traumatic events suffered after the attack should also be taken into account in further research. En "Legal Reasons, Sources and Gaps", Raz señala que las lagunas jurídicas existen sólo cuando el derecho habla con voz incierta o cuando habla con muchas voces, pero que no hay lagunas cuando el derecho guarda silencio. En este último caso habría reglas de clausura, analíticamente verdaderas, que impiden la ocurrencia de esas lagunas. Según Raz, si hay una laguna en un sistema jurídico, entonces no es verdadero ni falso que exista una razón concluyente para ejecutar cierta acción. Así, una (...) de las contribuciones más importantes de Raz a la solución del problema de las lagunas jurídicas es subrayar que el discurso jurídico no está completamente controlado por la bivalencia. Sin embargo, a menudo se sostiene que el rechazo de la bivalencia conduce a contradicciones. Si esta afirmación fuese verdadera, entonces la solución de Raz al problema de las lagunas jurídicas se vería seriamente amenazada. En este artículo mostramos, con ayuda de una herramienta analítica sofisticada, i.e., la lógica de la verdad de G.H. von Wright, que el rechazo de la bivalencia sólo nos compromete a aceptar la conclusión trivial de que puede haber proposiciones que no son verdaderas ni falsas. Por esta razón, el trabajo de Raz todavía puede ser considerado un buen punto de partida para analizar las relaciones entre normas, razonamiento práctico y lagunas jurídicas. Sin embargo, también mostramos que para admitir proposiciones que no son verdaderas ni falsas, las tesis de Raz deben ser reformuladas. De otra manera, la tesis de que no existen lagunas cuando el derecho guarda silencio no sería compatible con el rechazo de la bivalencia. /// In his paper "Legal Reasons, Sources and Gaps", Raz says that legal gaps only exist when law speaks with uncertain voice or when it speaks with many voices, but there are no gaps when law is silent. In this later case, rules of closure, which are analytically true, prevent from the occurrence of gaps. According to Raz, if there is a gap in a legal system, then both the claim that there is a conclusive legal reason to perform a certain action, and its negation are neither true nor false. Therefore, one of the Raz's most important contributions to the solution of the problem of legal gaps is to remark that legal discourse is not altogether governed by the principie of bivalence. However, philosophers often claim that the denial of bivalence leads to a logical inconsistency. If this claim were true, then Raz's solution to the problem of gaps would be seriously threatened. In this paper we show--with the aid of a sophisticated analytical tool, i.e., von Wright's truth-logic--that the rejection of bivalence only commits us to accept the trivial conclusion that propositions can lack truth-values. For this reason, Raz's paper can still be regarded as a good starting-point for analyzing the relationships between norms, practical reasoning and legal gaps. However, we also show that in order to admit propositions which are neither true nor false, Raz's theses must be reformulated. Otherwise, the claim that there is no gap when law is silent would not be compatible with the rejection of bivalence. (shrink)

Este artículo analiza el prólogo de 1812 a la Ciencia de la lógica (WdL) y responde a los planteos: ¿de qué trata esta obra?, ¿qué hay de lógico en la expresión “lógica”?, ¿es ”lógica” un nombre sustituto para “metafísica” o, más bien, la WdL es la inauguración de una disciplina completamente nueva y que dista de la metafísica en el sentido tradicional? Concluyo que la lógica es aquí el desarrollo del concepto expresada como libertad social.

We propose a semiotic framework to underpin a posthumanist philosophy of education, as contrasted to technological determinism. A recent approach to educational processes as semiotic phenomena lends itself as a philosophy to understand the current interplay between education and technology. This view is aligned with the transhumanist movement to defend techno-scientific progress as fundamental to human development. Particularly, we adopt a semiotic approach to education to tackle certain tensions in current debates on the human. Transhumanism scholars share the optimistic belief (...) that there is no limit to how the ethical use of technology can help alleviate suffering and increase our health and wisdom. From this perspective, it appears possible to acquire capacities that require rethinking the notion of human altogether. For others, this undermining of essentialist concepts of humanity entails serious risks, especially related to ethical egalitarianism. We adopte the perspective of edusemiotics, a framework that brings together semiotics, educational theory and philosophy of education. As a theoretical-practical framework, edusemiotics affords a hermeneutic and semiotic method for our approach. Peirce’s logic of signs is used to analyze socio- educational interactions as environmental. We observe two lines of thought. On the one hand, technological transhumanism enhances Cartesian mind–body dualism. On the other hand, philosophical posthumanism seeks to overcome this dichotomy. The former proposal construes human transformation as an artifactualization derived from techno-scientific enhancements. The latter position proposes an integrative posthumanism, capable not only to include edusemiotic theory but also to rethink the concept of learning as mutual to that of human. (shrink)

A través de un ciberpunk —con “i” latina—, el universo Underguater reflexiona sobre el pasado, el presente y el futuro (...) distópicos de la isla caribeña y se pone como ejemplo de las propuestas de muchos otros escritores del fantástico caribeño del siglo xxi. En el siguiente artículo se muestran los resultados de una investigación sobre el uso de técnicas plásticas en los programas educativos de los museos de la ciudad de Bolonia. Para ello se ha diseñado una herramienta específica para la recogida de datos sobre el uso de técnicas plásticas en los diseños educativos en los museos de la ciudad, siguiendo con los principios de investigación de corte cualitativo. Tras el análisis de los datos obtenidos los principales resultados que arroja el estudio (...) se pueden observar cómo los museos incorporan las técnicas plásticas en sus diseños, pero principalmente técnicas tradicionales y con un sentido lúdico. Human nature has always been a foundational issue for philosophy. What does it mean to have a human nature? Is the concept the relic of a bygone age? What is the use of such a concept? What are the epistemic and ontological commitments people make when they use the concept? In What’s Left of Human Nature? Maria Kronfeldner offers a philosophical account of human nature that defends the concept against contemporary criticism. In particular, she takes on challenges related to social (...) misuse of the concept that dehumanizes those regarded as lacking human nature (the dehumanization challenge); the conflict between Darwinian thinking and essentialist concepts of human nature (the Darwinian challenge); and the consensus that evolution, heredity, and ontogenetic development results from nurture and nature. After answering each of these challenges, Kronfeldner presents a revisionist account of human nature that minimizes dehumanization and does not fall back on outdated biological ideas. Her account is post-essentialist because it eliminates the concept of an essence of being human; pluralist in that it argues that there are different things in the world that correspond to three different post-essentialist concepts of human nature; and interactive because it understands nature and nurture as interacting at the developmental, epigenetic, and evolutionary levels. On the basis of this, she introduces a dialectical concept of an ever-changing and “looping” human nature. Finally, noting the essentially contested character of the concept and the ambiguity and redundancy of the terminology, she wonders if we should simply eliminate the term “human nature” altogether. Sustainable labels are considered the best way for consumers to identify brands with environmental or social attributes on the shelves, and therefore promoted as a means to develop the so-called “ethical markets”. However, little is known about how consumers use these brands. This paper tries to offer complementary theoretical insights on the determinants of sustainable label use by drawing on the economic model of information search; in particular, it examines the influence of two factors on the purchase of such labels: (...) motivation and knowledge. Information was gathered through a structured questionnaire in personal interviews with 289 primary buyers. The study found that education influences directly knowledge, while Motivation influences Label use both directly and indirectly, via Label knowledge. This study concludes that Motivation is the most powerful factor to explain Label use; knowledge is a necessary but not sufficient condition. Even more, consumers may not have a good understanding of sustainable labels and still use them in their purchasing decisions. This suggests that there is a dual processing mode of sustainable labels, both systematic and heuristic. (shrink)

Fichte’s hostility towards Napoleon, as expressed in his lectures of 1813 on the theory of the state, has its origin at the level of principles, and his always very strong admiration for the figure of Napoleon is at the same time so negatively loaded, that Napoleon becomes for Fichte something like an arch-enemy, the enemy par excellence. Napoleon has turned the old European political world upside down in favor of a re-structuration of this order according to the principles of the (...) French Revolution. This is, at least, how Napoleon was seen by the traditional powers that he had caused to fall or that he had shaken them with lasting political and historical consequences. Goethe, Hegel and Fichte have seen him in this perspective with very different attitudes. In this context, Fichte’s hostility towards Napoleon can be considered, at least partially, as a hostility towards the principles of the Revolution. But if these principles represent something like the normative self-understanding of political modernity at all, then the political philosophy of Fichte can be understood as strongly critical to these principles, if not simply as reactionary. It is worthwhile to consider why such a critical and even reactionary position can be derived in a completely consistent way from this philosophy, which has as its center a radicalized concept of freedom, and which at the beginning had even welcomed the outbreak of the Revolution.Die Feindschaft Fichtes gegen Napoleon, so wie sie später in seinen Vorlesungen von 1813 über die Staatslehre Ausdruck findet ist eine Feindschaft, die ihren Ursprung auf der Ebene von Grundsätzen hat, und die die immer sehr starke Bewunderung Fichtes für die Figur von Napoleon so negativ belastet, dass dieser am Ende zwar zu einem tief bewunderten, aber auch zu einem prinzipiellen Erzfeind wird. Nun hat Napoleon die alte europäische politische Welt auf den Kopf gestellt zugunsten einer Umstrukturierung dieser Ordnung nach den Prinzipien der französischen Revolution. So wenigstens ist Napoleon von den traditionellen Mächten, mit denen er sich auseinandergesetzt und die er zum Sturz oder ins Schwanken gebracht hat, empfunden worden. Und so haben Hegel, Goethe und auch Fichte ihn gesehen. Die Feindschaft Fichtes gegen Napoleon muss sich also zumindest teilweise als eine Feindschaft gegen die Prinzipien der Revolution verstehen lassen. Wenn aber diese Prinzipien so etwas wie die normative Selbstauffassung der politischen Moderne überhaupt bestimmen, dann ist die politische Philosophie Fichtes sehr kritisch zu dieser Selbstauffassung oder einfach reaktionär. Und es lohnt sich zu prüfen, warum gerade aus dieser Philosophie, in deren Mittelpunkt ein radikalisierter Begriff von Freiheit steht und die am Anfang den Aufbruch der Revolution sogar begrüßt hat, eine so kritische oder gar reaktionäre Einstellung, und zwar auf eine sehr konsequente Weise sich ergibt. This paper addresses whether the often-bemoaned loss of unity of knowledge about humans, which results from the disciplinary fragmentation of science, is something to be overcome. The fragmentation of being human rests on a couple of distinctions, such as the nature-culture divide. Since antiquity the distinction between nature (roughly, what we inherit biologically) and culture (roughly, what is acquired by social interaction) has been a commonplace in science and society. Recently, the nature/culture divide has come under attack in various ways, (...) in philosophy as well as in cultural anthropology. Regarding the latter, for instance, the divide was quintessential in its beginnings as an academic dis-cipline, when Alfred L. Kroeber, one of the first professional anthropologists in the US, rallied for (what I call) the right to ignore—in his case, human nature—by adopting a separationist epistemic stance. A separationist stance will be understood as an epistemic research heuristic that defends the right to ignore a specif-ic phenomenon (e.g., human nature) or a specific causal factor in an explanation typical for a disciplinary field. I will use Kroeber’s case as an example for making a general point against a bias towards integration (synthesis bias, as I call it) that is exemplified, for instance, by defenders of evolutionary psychology. I will claim that, in principle, a separationist stance is as good as an integrationist stance since both can be equally fruitful. With this argument from fruitful sepa-ration in place, not just the separationist stance but also the nature/culture di-vide can be defended against its critics. (shrink)

Este texto analiza el modelo de masculinidad transferido por las narrativas icónicas de los libros de texto de Ciencias Sociales de 5º de E. Primaria. Partiendo de la coeducación como herramienta transformadora de los patrones masculinos hegemónicos tradicionales asociados a la agresividad, la competitividad y la violencia, se abordan los estudios de género sobre la historia escolar, a fin de realizar un diagnóstico sobre la situación actual en torno a las investigaciones de las masculinidades en la Didáctica de las Ciencias (...) Sociales. Se ha creado una ficha multivariable, fácil y sencilla, a fin de que pueda ser aplicada por el propio alumnado de Primaria en sus propios libros de texto, los cuales pasan de ser instrumentos transcriptores de relatos históricos construidos, a ser herramientas de discusión y reflexión crítica sobre género en el pasado y el presente. This paper argues that indexical reference is a species of discourse reference, just like anaphora. Both varieties of discourse reference involve not only context dependence, but also context change. The act of speaking up focuses attention and thereby makes this very speech event available for discourse reference by indexicals. Mentioning something likewise focuses attention, making the mentioned entity available for subsequent discourse reference by anaphors. Empirical evidence is presented from grammatical centering in Kalaallisut and "shifty indexicals" in Slave attitude reports.
