Kant entwickelt in der „Kritik der Urteilskraft“ eine philosophische Ästhetik, eine Theorie der organischen Natur. Die beiden scheinbar heterogenen Gegenstandsbereiche sind durch das Prinzip der reflektierenden Urteilskraft, die Idee der Zweckmäßigkeit, verbunden, die der Mensch sowohl bei der Reflexion über die schönen Gegenstände der Natur und der Kunst als auch bei seiner Erforschung der organischen Natur zugrunde legt. Da sich alle Zwecke zuletzt auf den Endzweck des Menschen als moralisches Wesen beziehen, übersteigt die dritte „Kritik“ schließlich die Bereiche von Kunst (...) und Natur und berührt Fragen der Moralphilosophie und der Moraltheologie. Zusätzlich entdeckt Kant im subjektiven Vermögen der Urteilskraft jenes Bindeglied unter den menschlichen Gemütskräften, das einen architektonischen Übergang zwischen den Naturbegriffen des Verstandes in der ersten und dem Freiheitsbegriff der Vernunft in der zweiten „Kritik“ ermöglicht und die theoretische und die praktische Philosophie in einem einzigen philosophischen System vereinigt. Kants Kritik der praktischen Vernunft (1788) steht zu Unrecht oft im Schatten der Kritik der reinen Vernunft und der Grundlegung zur Metaphysik der Sitten. Tatsächlich sind die Grundelemente der Kantischen Moralphilosophie im Gegensatz zu vielen Thesen der ersten Kritik bis heute weitgehend anerkannt, und erst der Nachweis der zweiten Kritik, dass Freiheit wirklich ist, macht "den Schlussstein von dem ganzen Gebäude eines Systems der reinen, selbst der spekulativen Vernunft aus". Entlang der Stichworte reiner Wille, gesetzgebende Form der Maxime, transzendentale Freiheit, (...) Autonomie und Faktum der Vernunft zeigt Kant in der "Analytik", dass reine Vernunft "für sich" praktisch sein, nämlich den Willen bestimmen kann. Die "Dialektik" sichert den Ideen von der Existenz Gottes und der Unsterblichkeit der Seele objektive Realität und untersucht das Verhältnis von theoretischer und praktischer Vernunft. Die "Methodenlehre" schließlich skizziert eine Theorie moralischer Erziehung, die für den heutigen Ethikunterricht noch aktuell ist. Die zwölf Beiträge dieses kooperativen Kommentars, der anlässlich des 300. Jubiläums Immanuel Kants in einer 3., überarbeiteten Auflage erscheint, rekonstruieren die Argumente eines Schlüsseltextes der Moralphilosophie und prüfen die sachliche Überzeugungskraft. A teoria da justiça política, segundo Hóffe, fundamentada na justiça comutativa, sustenta que a fundamentação das reivindicações normativas da sociedade na comunidade discursiva, como o fazem Apel e Habermas em sua ética do discurso, é apenas uma fundamentação derivada, pois a comunidade discursiva necessariamente pressupõe direitos humanos. Por sua vez, a ética do discurso argumenta que os direitos humanos só podem ser legitimados através do discurso. Este artigo mostra que o pressuposto normativo tanto para a comunidade discursiva quanto para o (...) princípio da justiça comutativa é que todos os seres humanos são autorizados a uma partilha do mundo. Somente através desta premissa de uma justiça distributiva pode haver parceiros capazes de exercer reciprocidade e participantes do discurso que também tenham algo sobre o que tenham de decidir juntos. O presente trabalho apresenta uma nova perspectiva de interpretação da Crítica darazão pura. O autor empreende uma leitura cosmo-politica da obra principal de Kant, não apenas por sua primeira Crítica conter referências políticas explícitas, mas, sobretudo, pelo fato de o filósofo de Kônigsberg apresentar nela umarazão que não é solipsista, mas sim republicana.

In the last years of its history, the Ukrainian ethnic group faced numerous external and internal challenges, which, to a large extent, were the result of its previous genesis and profound transformations in public consciousness. At the same time, one of the central stereotypes of the domestic political and legal mentality is the idea of truth and justice as a basic social ideal and the basis of the legal order. Analysis of research and publications. The problem of mentality and the (...) formation of behavioral stereotypes has been of interest to domestic and foreign scientists for a long time. The concept of «mentality» is most widespread in the writings of the French historical school «Annals». The scientific work of M. Blok, F. Braudel, M. Vovel, J. Le Hoff, J. Lefebvre, L. Fevre, R. Mandr and other scientists reveals the content of mentality and its structures, as well as the peculiarities of their influence on everyday life and activities of individuals who lived in different historical eras. The purpose and objectives of the article. In this article, the authors aim to analyze the idea of truth-justice as a tool for transforming the legal mentality of the Ukrainian ethnic group and to show its influence on the content of its behavioral stereotypes. Research methodology. The methodology of this research has a complex nature and is based on a socio-philosophical and philosophical-legal analysis of the behavioral guidelines of Ukrainians in the field of legal understanding. The results. The social ideology, developed on the basis of ancient social ideas and stereotypes of the national legal mentality, should become a tool for correcting such destructive phenomena in the state-building discourse as legal nihilism, anarchism, civic passivity, corruption, nepotism, etc. At the same time, the concepts of truth-justice, will-freedom and fraternity-equality are key in Ukrainian legal culture. Discussion. The interpretation of this idea in scientific opinion is not unambiguous. This idea clearly manifests itself in the context of the opposition between Truth and Evil in the national culture. Truth is inseparable from human existence and daily activities. The idea of truth is closely related to the idea of justice, which, according to many researchers, is a later, more rational and clearly defined phenomenon derived from truth. Justice as a socio-philosophical phenomenon is intended to act as a kind of moral measure of relations between individuals in society. It is considered as an authoritative criterion for establishing the correspondence between the nature of human activity and its assessment by the social community. Conclusions. Destructive behavioral stereotypes of the Ukrainian ethnic group that were formed, among other things, under the influence of factors of stressogenesis can be corrected with the help of the legal ideology of state building, which should be based on the content of the idea of truth and justice. The developed ideology should be based on the most stable constructive guidelines of the national legal mentality, organically complementing and ideologically justifying them. (shrink)

Esse texto tem por objetivo apresentar em linhas gerais a proposta de Otfried Höffe sobre a república mundial. Para tanto, iniciar-se-á com o ponto de partida de Höffe, a saber, o fenômeno da globalização, de onde são apontadas as principais atividades e problemas da república mundial. Em seguida, passa-se a analisar os dois níveis da proposta, o nível nacional e o nível internacional ou global da república mundial. Por fim, concluir-se-á com uma tentativa de comparação da proposta de Höffe com (...) a ideia de uma federação de Estados livres apresentada por Immanuel Kant em À paz perpétua. (shrink)

Um dos grandes problemas postos pelo tema dos direitos humanos à filosofia é, entre outros, o de sua fundamentação filosófica. No pano de fundo deste debate, surgem questões específicas: como se pode fundamentar/justificar filosoficamente a exigência de reconhecimento aos direitos humanos? Neste estudo, procuro abordar, de modo direto, o núcleo argumentativo sobre o qual está estruturada da proposta de Höffe. Para ele, os direitos humanos têm uma profunda relação com a noção de justiça. O conceito de justiça, na sua concepção, (...) deve ser entendido fundamentalmente como troca. Embora o conceito pareça demasiado simples, ele oferece uma série de dificuldades no que se refere à sua fundamentação. (shrink)

Este artigo discute um dos pontos fundamentais da Ética de Otíried Hifi: a questão da troca transcendental. O autor, após a reconstrução da argumentação de Höffe no tocante à fundamentação dos direitos humanos, procura relacionar essa questão com o debate sobre o comunitarismo. Sustenta a tese de que nem o liberalismo nem o comunitanismo servem de base para a fundamentação de tais direitos.

Drawing from a variety of Hegel’s writings, Shannon Hoff articulates a theory of justice that requires answering simultaneously to three irreducibly different demands: those of community, universality, and individuality. The domains of “ethicality,” “legality,” and “morality” correspond to these essential dimensions of human experience, and a political system that fails to give adequate recognition to any one of these will become oppressive. The commitment to legality emphasized in modern and contemporary political life, Hoff argues, systematically precludes adequate recognition of the (...) formative cultural contexts that Hegel identifies under the name of “ethical life” and of singular experiences of moral duty, or conscience. Countering the perception of Hegel as a conservative political thinker and engaging broadly with contemporary work in liberalism, critical theory, and feminism, Hoff focuses on these themes of ethicality and conscience to consider how modern liberal politics must be transformed if it is to accommodate these essential dimensions of human life.
