In this article the Reformer Martin Luther is to be situated against the backdrop of his medieval theological context – considering especially Bernard of Clairvaux. It is well-known that he held in great esteem Bernard and the theology he represented. First of all, Luther's relationship to Bernard is to be investigated by way of a historiographic review of the research that was done in the past 150 years. How did one consider Luther’s attitude toward Bernard, and how did Luther research (...) specifically value this attitude? In this research, denominational positions appear to have played a important role. Secondly, the attempt is made here to sketch Bernard’s place in Luther’s own tradition. Next to the medieval scholastic theology, there were diverse other influences that became important for the young Luther. Bernard’s specific place within the complexity of medieval traditions is to be determined. This is being explained by presenting seven significant texts mainly from Luther’s works, which are added to this article. Finally, the attempt is made to determine more closely Bernard’s place in Luther’s theology between Scholasticism and Mysticism. If one wants to do justice to Bernard in Luther's works, one must take into consideration the way in which Luther has perceived him, namely as a theologian of the Scriptures, a theologian of experience and a preacher of Christ par excellence along the lines of monastic theology. This paper considers the economic effect of the Christian practice of forgiveness. In particular, the argument is that the gift of divine forgiveness in Christ, as articulated by Anselm, interrupts `economy' (with its logic of scarcity, debt, and finally death) and puts in place an aneconomic order (with its theo-logic of abundance, ceaseless generosity, and resurrection) that is full of the promise of deliverance from the affliction of capitalism. Also addressed here is the way that the human reception of (...) divine forgiveness takes shape in the Works of Mercy, how these works are not rightly understood as `mere charity' at home within `economy' but in fact constitute the appearance of an order that heralds the end of economy, and, finally, how this practice of forgiveness redeems/ reconfigures what is commonly called `economic justice'. A trenchant defense of hierarchy in different spheres of our lives, from the personal to the political All complex and large-scale societies are organized along certain hierarchies, but the concept of hierarchy has become almost taboo in the modern world. Just Hierarchy contends that this stigma is a mistake. In fact, as Daniel Bell and Wang Pei show, it is neither possible nor advisable to do away with social hierarchies. Drawing their arguments from Chinese thought and culture as well (...) as other philosophies and traditions, Bell and Wang ask which forms of hierarchy are justified and how these can serve morally desirable goals. They look at ways of promoting just forms of hierarchy while minimizing the influence of unjust ones, such as those based on race, sex, or caste. Which hierarchical relations are morally justified and why? Bell and Wang argue that it depends on the nature of the social relation and context. Different hierarchical principles ought to govern different kinds of social relations: what justifies hierarchy among intimates is different from what justifies hierarchy among citizens, countries, humans and animals, and humans and intelligent machines. Morally justified hierarchies can and should govern different spheres of our social lives, though these will be very different from the unjust hierarchies that have governed us in the past. Fueled by ever-growing amounts of (digital) data and advances in artificial intelligence, decision-making in contemporary societies is increasingly delegated to automated processes. Drawing from social science theories and from the emerging body of research about algorithmic appreciation and algorithmic perceptions, the current study explores the extent to which personal characteristics can be linked to perceptions of automated decision-making by AI, and the boundary conditions of these perceptions, namely the extent to which such perceptions differ across media, (public) health, and judicial (...) contexts. Data from a scenario-based survey experiment with a national sample (N = 958) show that people are by and large concerned about risks and have mixed opinions about fairness and usefulness of automated decision-making at a societal level, with general attitudes influenced by individual characteristics. Interestingly, decisions taken automatically by AI were often evaluated on par or even better than human experts for specific decisions. Theoretical and societal implications about these findings are discussed. (shrink)

Early discussions of ?climate justice? have been dominated by economists rather than political philosophers. More recently, analytical liberal political philosophers have joined the debate. However, the philosophical discussion of climate justice remains in its early stages. This paper considers one promising approach based on human rights, which has been advocated recently by several theorists, including Simon Caney, Henry Shue and Tim Hayward. A basic argument supporting the claim that anthropogenic climate change violates human rights is presented. Four objections to this (...) argument are examined: the ?future persons? objection; the ?risk? objection; the ?collective causation? objection; and the ?demandingness? objection. This critical examination leads to a more detailed specification and defence of the claim that anthropogenic climate change violates human rights. (shrink)

Examples of hypotheses about the number of planets are frequently used to introduce the topic of (actual) truthlikeness but never analyzed in detail. In this paper we first deal with the truthlikeness of singular quantity hypotheses, with reference to several ‘the number of planets’ examples, such as ‘The number of planets is 10 _versus_ 10 billion (instead of 8).’ For the relevant ratio scale of quantities we will propose two, strongly related, normalized metrics, the proportional metric and the (simplest and (...) hence favorite) fractional metric, to express e.g. the distance from a hypothetical number to the true number of planets, i.e. the distance between quantities. We argue that they are, in view of the examples and plausible conditions of adequacy, much more appropriate, than the standardly suggested, normalized absolute difference, metric. Next we deal with disjunctive hypotheses, such as ‘The number of planets is between 7 and 10 inclusive is much more truthlike than between 1 and 10 billion inclusive.’ We compare three (clusters of) general ways of dealing with such hypotheses, one from Ilkka Niiniluoto, one from Pavel Tichý and Graham Oddie, and a trio of ways from Theo Kuipers. Using primarily the fractional metric, we conclude that all five measures can be used for expressing the distance of disjunctive hypotheses from the actual truth, that all of them have their strong and weak points, but that (the combined) one of the trio is, in view of principle and practical considerations, the most plausible measure. Liberalism and ecologism are widely regarded as incompatible. Liberalism and (anthropocentric) environmentalism might be compatible but liberalism and (non-anthropocentric) ecologism are not. A liberal state cannot promote policies for ecological or ecocentric reasons. An individual cannot be both a liberal and a committed advocate of ecologism. This paper challenges these claims. It is argued that Rawls’s ‘political liberalism’ is compatible with ecologism and, in particular, the idea of ‘ecological justice’. A Rawlsian state can promote ecological justice. A committed political liberal (...) can also be a committed advocate of ecological justice. The argument is developed through a close textual examination of Rawls’s brief discussion of our duties to ‘animals and the rest of nature’. Rawls leaves far more scope for liberal ecologism than his critics have suggested. The proposed version of liberal ecologism is defended against charges of substantive and procedural bias toward humans and against nonhuman nature. Liberal ecologism may not be enough for some ecologists-especially ‘ecological constitutionalists’ seeking constitutional protection for nonhuman nature-but it is a serious and defensible political and moral theory. This issue of Philosophical Papers assembles eight essays that are part of the larger conversation on African philosophy and the analytic tradition. Several leading philosophers have contributed to this issue with provocative remarks, beginning with a three-way debate on the nature of philosophy itself as understood and practiced in the African context. It continues with essays on consensual democracy, authoritarianism, race and cultural identity, the cosmopolitan ideal, and belief and witchcraft.

Communitarian thinkers have argued that liberalism devalues community in modern societies. This essay assesses the three main strands of the contemporary debate betweeen communitarianism and liberalism: (1) the communitarian critique of the liberal universalism, (2) the communitarian critique of liberal individualism, and (3) the communitarian critique of liberal politics. In each case, it is argued that the debate has moved from fairly abstract philosophical controversies to more concrete engagement with political disputes in Western as well as East Asian societies.

The chapter revisits the relationship between restorative justice and punishment through the eyes of Classical Greek philosophy and tragedy, the School of Collectivists, and contemporary thinkers. The extant literature sees restorative justice either as alternative punishment or an alternative to punishment. This chapter puts forward the notion of restorative punishment by deconstructing the concept of pain, and by reconstructing a new vision through the notion of catharsis. O objetivo do presente artigo é mostrar a relevância das reflexões de Hannah Arendt sobre a possibilidade de encontrar uma fonte de autoridade na política que não se remeta a algo que esteja acima dessa esfera. Em um primeiro momento, buscaremos definir autoridade e sua importância. Em segundo momento, será investigada a tentativa de Arendt de localizar a fonte da autoridade na esfera imanente, com os exemplos das revoluções modernas francesa e americana. Por fim, será apontado a organização política espontânea (...) dos conselhos como uma tentativa de resolução da questão da autoridade, na medida em que busca conciliá-la com a igualdade. English summary: The blooming of ancient thought throughout the Renaissance and the Early Modern Age took place mainly in the shape of late antique philosophy. Many of its characteristic main features have influenced modern thought in a defining manner. In the present book, Theo Kobusch addresses those features which still determine our thinking today. Although this intellectual heritage, both in its ancient and modern forms, has largely been forgotten, it is however worth remembering that modern thought is indebted to (...) an intellectual transformation on a large scale.
