Digital photography is contributing to the renegotiation of the public and private divide and to the transformation of privacy and intimacy, especially with the convergence of digital cameras, mobile phones, and web sites. This convergence contributes to the redefinition of public and private and to the transformation of their boundaries, which have always been subject to historical and geographical change. Taking pictures or filming videos of strangers in public places and showing them in webs like Flickr or YouTube, or making (...) self-portraits available to strangers in instant messenger, social network sites, or photo blogs are becoming a current practice for a growing number of Internet users. Both are examples of the intertwining of online and offline practices, experiences, and meanings that challenge the traditional concepts of the public and the private. Uses of digital images play a role in the way people perform being a stranger and in the way they relate to strangers, online and offline. The mere claims about the privatization of the public space or the public disclosure of intimacy do not account for all these practices, situations, and attitudes, as they are not a simple translation of behaviors and codes from one realm to the other. The descriptive viewpoint in rational choice has generated an important Standard Rational Choice Theory revision. This viewpoint has meant the introduction of relevant psychological considerations that Rational Choice Theory tied to the neoclassical economics is unable to heed In this paper I suggest a way to expand the descriptive viewpoint by theorizing how some factors, coming from the social and cultural environment, operate within rational choice. That troublesome issue concerning the overall validity of economic laws is also a question here; (...) specifically, if these descriptive proposals expand the explanation of the disturbing causes of economic laws, or if they actually call into question their fundamental principles, encouraging consideration of some economic issues in a quite new, different manner. En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. Epistemology had to come to terms with “the social” on two different occasions. The first was represented by the dispute about the epistemological status of the “social” sciences, and in this case the already well established epistemology of the natural sciences seemed to have the right to dictate the conditions for a discipline to be a science. But the social sciences could successfully vindicate the legitimacy of their specific criteria for scientificity. More recently, the impact of social factors on the (...) construction of our knowledge (including scientific knowledge) has reversed, in a certain sense, the old position and promoted social inquiry to the role of a criterion for evaluating the purport of cognitive (including scientific) statements. But this has undermined the traditional characteristics of objectivity and rigor that seem constitutive of science. Moreover, in order to establish the real extent to which social conditionings have an impact on scientific knowledge one must credit sociology with a sound ground of reliability, and this is not possible without a preliminary “epistemological” assessment. El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

En este capítulo se estudia la facultad a prevención contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Al respecto, en este ejercicio de reflexión es posible ver cómo la figura aparte de estar diseñada por fuera (...) de la teoría general del acto administrativo, también posee particularidades que la hacen única dentro del ordenamiento jurídico colombiano. The thesis that in social sciences causal explanations are possible only in terms o mechanisms due to the lack of genuine laws has been increasingly popular among social scientist and philosophers. In this article it is examined whether the explanation by mechanism is necessarily an explanation without laws or, on the contrary, it can involve some kind o laws. To this end it is argued, firstly, that mechanisms are not always the antonym of law insofar as they express propensities and (...) so tendencies; secondly, that these tendencies ar causal and entail capacities and dispositions; thirdly, that capacities and dispositions involve in human behaviour have to face the problem of free will; and finally, reasons are offered i favor of considering causal tendencies as authentic laws. The ultimate aim of this article is to demonstrate that explanation of social facts can involve well-established laws in its explanans although they are not universal laws. (shrink)

En este artículo se examina la propuesta de R. Axelrod acerca de cómo emerge y se hace estable la cooperación en un modelo de Dilema del Prisionero reiterado, con la estrategia Toma y Daca y con jugadores egoístas racionales. Se demuestra que esta estrategia es efectiva para la cooperación si los jugadores ganan, o al menos si no pierden con su cooperación. Esto tiene como consecuencia una alteración del orden de pagos típico del Dilema del Prisionero, por lo que se (...) mantiene que la cooperación entre egoístas racionales en términos de Toma y Daca es posible porque los jugadores no están en un Dilema del Prisionero. Justo antes de la pandemia por COVID-19, la Organización Mundial de la Salud definió unas prioridades de trabajo para la década 2020-2030. Un grupo interdisciplinario de profesionales de la salud reflexiona sobre estas prioridades, determinando unas categorías de análisis y, desde una perspectiva bioética, analiza cada una de ellas, ve su pertinencia, algunos eventos causales, las implicaciones que pueden tener si no son enfrentadas adecuadamente y hace sugerencias sobre la forma de llevarlas a cabo. En esta primera entrega se analiza (...) el primer grupo de prioridades estratégicas: “poblaciones más sanas”. En las conclusiones se destaca la conveniencia de acometer cada una de ellas de una manera colaborativa, gubernamental y privada; de reestructurar el sector salud con base en estas prioridades, aprovechando la experiencia obtenida en la lucha contra el COVID-19. La relación del ser humano con el medio ambiente también debe cambiar, apelando a la responsabilidad humana por el cuidado del planeta. (shrink)

Background: Serious games have shown positive results in increasing motivation, adherence to treatment and strengthening the therapeutic alliance in multiple psychiatric disorders. In particular, patients with impulse control disorders and other disorders in which the patient suffers from inhibitory control deficits have been shown to benefit from serious games.Aim: The aim of this study was to describe the characteristics and to evaluate the usability of a new serious videogame, e-Estesia. This serious videogame was designed to improve emotion regulation in patients (...) with gambling disorder. Preliminary results from a pilot sample are also reported.Method: A pilot sample of 26 patients undergoing treatment for GD was recruited. Participants used e-Estesia on a tablet, which was connected to a thoracic band that sent heart rate and heart rate variability data to the videogame platform in order to provide biofeedback. The System Usability Scale was completed by patients to determine the usability of e-Estesia.Results and Discussion: e-Estesia performed comparatively well for all the explored groups. Around 84.6% of the patients endorsed that it was easy to use. Female patients with GD presented higher HRV during the use of the serious videogame compared to men. (shrink)

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. La asociación entre arte y literatura puede rastrearse con facilidad en la cultura occidental desde la Antigüedad grecolatina. En un contexto literario muy marcado por la retórica, Luciano de Samosata apela a menudo, en obras de distinto registro e intención, al arte y a sus representantes como metáfora y referente de la tarea del literato, orador, sofista o escritor. El objetivo de este trabajo es revisar algunos de esos textos en los que Luciano, al amparo de símiles y metáforas (...) artísticas, reflexiona sobre la técnica necesaria en la creación literaria, pero, ante todo, sobre la debida aplicación del arte de la palabra; y, también, observar cómo la técnica retórica que preside su producción y utiliza para describir imágenes pintadas, también guía su destreza compositiva sea en piezas narrativas o dialógicas. Despite recent efforts by the Artificial Intelligence (AI) community to move towards standardised procedures for documenting models, methods, systems or datasets, there is currently no methodology focused on use cases aligned with the risk-based approach of the European AI Act (AI Act). In this paper, we propose a new framework for the documentation of use cases that we call use case cards, based on the use case modelling included in the Unified Markup Language (UML) standard. Unlike other documentation methodologies, we (...) focus on the intended purpose and operational use of an AI system. It consists of two main parts: firstly, a UML-based template, tailored to allow implicitly assessing the risk level of the AI system and defining relevant requirements, and secondly, a supporting UML diagram designed to provide information about the system-user interactions and relationships. The proposed framework is the result of a co-design process involving a relevant team of EU policy experts and scientists. We have validated our proposal with 11 experts with different backgrounds and a reasonable knowledge of the AI Act as a prerequisite. We provide the 5 use case cards used in the co-design and validation process. Use case cards allows framing and contextualising use cases in an effective way, and we hope this methodology can be a useful tool for policy makers and providers for documenting use cases, assessing the risk level, adapting the different requirements and building a catalogue of existing usages of AI. El presente artículo tiene lugar a partir de un estudio de caso autoetnográfico basado en experiencia de acoso laboral de la autora en una universidad española. El objetivo central del trabajo es examinar, desde un abordaje de ética aplicada, la compleja trama de poder en la que emergen y se desarrollan prácticas de violencia y acoso laboral en instituciones académicas y universitarias. Frente a los dispositivos que facilitan la perpetuación de estas prácticas de violencia y exclusión, así como su naturalización, (...) el artículo propone revisitarlas a la luz de los criterios de las éticas organizacionales y los liderazgos morales, en aras de enriquecer las herramientas ya existentes en distintas universidades para detectar acoso y promover éticas colectivas. El artículo argumenta la necesidad de potenciar las estrategias multimodales contra el acoso laboral en la academia, a fin de que realmente sean efectivas y no parte de protocolos meramente formales. Finalmente, se propone apelar a una profunda crítica desde la ética filosófica en torno a los discursos y prácticas de acoso laboral académico y universitario, para erradicar las violencias no sólo en estas instituciones sino en cualquier ámbito de la vida social. ABSTRACT This article arises from an autoethnographic case study based on the author’s experience of harassment at work in a Spanish university. The main objective is to examine from an approach of applied ethics, the complex web of power in which emerge and develop practices of violence and harassment in academic and university institutions. Against the dispositive that facilitate the perpetuation of these practices of violence and exclusion, as well as their naturalization; the article proposes to revisit them in the light of the criteria of organizational ethics and moral leaderships, to enrich the tools already existing in different universities to detect mobbing and promote collective ethics of others. The article shows and argues the need to strengthen and radicalize the multimodal strategies to eradicate mobbing in the academy and the university so that they are effective and not part of merely formal protocols. Finally, it proposes to appeal to a deep criticism from the philosophy and ethics around the speeches and practices of academic and university mobbing to eradicate violence not only in these institutions but in any area of social life. I defend the hypothesis that the semantic paradoxes, the paradoxes about collections, and the sorites paradoxes, are all paradoxes of reference fixing: they show that certain conventionally adopted and otherwise functional reference-fixing principles cannot provide consistent assignments of reference to certain relevant expressions in paradoxical cases. I note that the hypothesis has interesting implications concerning the idea of a unified account of the semantic, collection and sorites paradoxes, as well as about the explanation of their “recalcitrance”. I also note that (...) it does not necessarily imply that one should not expect the sometimes hoped for “unique” solution to a paradox of these kinds. (shrink)

Vico no sólo reabre en la modernidad la contienda por la verdad, sino que emerge de nuevo en el discurso actual de la posmodernidad recordándonos la muerte del precario concepto insular del hombre centrado en la razón científica, de una racionalidad incompleta. Existe una deuda de la modernidad hacia la epistemología genética y la hermenéutica de la Scienza Nuova: que considera la poesia un modo de acceso a la verdad y aprecia en las ficciones poéticas el caracter de verdades. Esta (...) cuestión resulta determinante para apreciar la polérnica abierta entre modernidad y posmodernidad centrada en un replanteamiento dilucidador de la razón. En la búsqueda de una fundarnentación de la razón desde ella misma, la razón poética abre nuevas perspectivas y reconocidas posibilidades.Vico does not only reopen in the Modernity the dispute for the truth, but emerges again in today's discourse of the Postmodernism, reminding us of the dearth of the precarious insular concept of man centered in the scientific reason, of an incomplete rationality. There is a debt of Modernity towards the genetic epistemology and the hermeneutic of the New science that considers poetry a way of access to the truth and recognizes in poetical fictions the nature of truths. This subject becomes decisive to appreciate the open controversy betwen Modernity and Postmodernism, centered in an explanatory restatement of the reason. In the search of a foundation of the reason from itself the poetical reason opens new perspectlves and acknowledged possibilities. (shrink)

We propose a semiotic framework to underpin a posthumanist philosophy of education, as contrasted to technological determinism. A recent approach to educational processes as semiotic phenomena lends itself as a philosophy to understand the current interplay between education and technology. This view is aligned with the transhumanist movement to defend techno-scientific progress as fundamental to human development. Particularly, we adopt a semiotic approach to education to tackle certain tensions in current debates on the human. Transhumanism scholars share the optimistic belief (...) that there is no limit to how the ethical use of technology can help alleviate suffering and increase our health and wisdom. From this perspective, it appears possible to acquire capacities that require rethinking the notion of human altogether. For others, this undermining of essentialist concepts of humanity entails serious risks, especially related to ethical egalitarianism. We adopte the perspective of edusemiotics, a framework that brings together semiotics, educational theory and philosophy of education. As a theoretical-practical framework, edusemiotics affords a hermeneutic and semiotic method for our approach. Peirce’s logic of signs is used to analyze socio- educational interactions as environmental. We observe two lines of thought. On the one hand, technological transhumanism enhances Cartesian mind–body dualism. On the other hand, philosophical posthumanism seeks to overcome this dichotomy. The former proposal construes human transformation as an artifactualization derived from techno-scientific enhancements. The latter position proposes an integrative posthumanism, capable not only to include edusemiotic theory but also to rethink the concept of learning as mutual to that of human. (shrink)

In this concise and accessible introductory text, Gómez-Lobo and Keown introduce a "human goods" approach to bioethics as an alternative to the dominant principle-based method in the field (best illustrated by Beauchamp and Childress, Principles of Biomedical Ethics, OUP). Following Aristotle and the natural law tradition, the authors demonstrate how an emphasis on human goods--such as health, life, family, friendship, work and play, the experience of beauty, knowledge, and integrity--provides a necessary context for medical decisions and can help us understand (...) critical issues at the beginning and end of life. The manuscript includes two parts: Foundations and Issues. In the Foundations section the authors explain how one can think about bioethics, offering definitions of ethics and ontology (the study of being) and prudential reasoning. In the Issues section they address genetics, abortion, infanticide, suicide and physician-assisted suicide, nutrition and hydration, and transplantation ethics. The book includes appendices featuring personal statements by Gómez-Lobo on the status of the human embryo and criteria for the determination of death. (shrink)
