A prolific philosopher who also held Rome's highest political office, Cicero was uniquely qualified to write on political philosophy. In this book Professor Atkins provides a fresh interpretation of Cicero's central political dialogues - the Republic and Laws. Devoting careful attention to form as well as philosophy, Atkins argues that these dialogues together probe the limits of reason in political affairs and explore the resources available to the statesman given these limitations. ABSTRACTThis paper assesses to what extent the neo-Republican accounts of Quentin Skinner and Philip Pettit adequately capture the nature of political liberty at Rome by focusing on Cicero's analysis of the libera res publica. Cicero's analysis in De Republica suggests that the rule of law and a modest menu of individual citizens’ rights guard against citizens being controlled by a master's arbitrary will, thereby ensuring the status of non-domination that constitutes freedom according to the neo-Republican view. He also shows the (...) difficulty of anchoring an argument for citizens’ full political participation in the value of non-domination. While Cicero believed such full participation was essential for a libera res publica, he, like other elite Romans, argued for participation on the basis of liberty conceived as the space to contend for and enhance one's social status. The sufficiency of the rule of law and citizens’ rights for securing a status of non-domination taken together with their insufficiency for ensuring a libera res publica suggests that neo-Republican accounts of liberty do not fully capture the idea as articulated in Cicero's Republicanism. The past decade has seen a vigorous debate in medical ethics over whether and under what conditions physicians can refuse requests from patients for medical interventions that the physician believes are morally inappropriate to perform. The debate has typically been framed in terms of "conscientious refusal": when, if ever, is the physician justified in refusing an intervention when the reasons of refusal have to do with the convictions of the physician's conscience? Tertullian first coined the phrase ‘the freedom of religion’. This article considers what this entails. I argue that Tertullian’s discussion of religious liberty derives its theoretical significance from his creative repurposing of the Roman idea of liberty as non-domination. Tertullian contends that the Roman magistrates’ treatment of Christian citizens and loyal subjects amounts to tyrannical domination characterized by the absence of the traditional conditions for non-domination: the rule of law, rule in and responsive to the interests of the people, and (...) citizens’ rights. On his reworking of these criteria, he argues that citizens and loyal subjects should have the right to act publicly on the convictions of their conscience even if these actions conflict with the state’s civil religion. Tertullian shows that non-domination is a highly flexible idea that does not necessarily entail the participatory ‘free state’ of republicanism. Moreover, by applying the logic of non-domination to questions surrounding religious liberty, he opens up an important avenue of investigation largely ignored in the contemporary republican literature on non-domination. Recent scholarship on Stoic political thought has sought to explain the relationship between Zeno’s Republic and the concept of a natural law regulating a cosmic city of gods and human beings that is attributed to later Stoics. This paper provides a reassessment of this relationship by exploring the underappreciated influence of Plato’s Laws on Zeno’s Republic and, through Zeno, on the subsequent Stoic tradition. Zeno’s attempt to remove perceived inconsistencies in Plato’s treatment of ‘law’ and ‘nature’ established a philosophical framework (...) that overturned the republicanism of Plato and Aristotle; this same framework established the preconditions for the cosmic city of gods and human beings regulated by natural law. Thus, the early Stoic tradition on the topic of natural law is characterized by continuity rather than by discontinuity. (shrink)

Professor Georges Goriely of the Free University of Brussels has made one more valiant attempt to rescue Sorel the thinker from the reputation fastened upon him by the title of his Rdflexions sur la Violence in 1906. For most readers he has been the author of that one book, which is seldom read in the light of his other works. It is significant that Goriely reaches it only upon his page 199, barely twenty pages before his study terminates. Also worthy of note is the fact that of the over one hundred critical books and articles about Sorel which are listed in his bibliography, only two are in English: Richard Humphrey's Georges Sorel: Prophet Without Honor (1954) and James M. Meisel's The Genesis of Georges Sorel (1951). In European discussions Sorel frequently shares the company of such names as Croce, Bergson, and Nietzsche. But in the Anglo-Saxon world he has had in general a bad press, or none at all. A far-from-systematic philosopher, his writings, most of them originally articles composed in the heat of European controversies, have seemed remote from transatIantic concerns. He has been reputed "the father of syndicalism" in a country where the adjective most often applied to syndicalism is "criminal." When Mussolini proclaimed at one time that the R~flexions was his favorite bedside book, Sorel seemed to add the paternity of Fascism to his list. All that was needed to complete his damnation by labels was the dread word "anti-intellectual," and that has been freely applied to him. Nevertheless, Professor Goriely finds it possible to take Sorel's ideas seriously, quite apart from the political misuses which have been made of them. He sees that Sorel was primarily a pragmatic moralist immersed in his times and intent upon finding some way to bring about a European ricorso, a rejuvenation of classic republican ethics. At the turn of the century he saw only mediocrity and decadence: democracy had become demagogy, and industrial capitalism a mess of corruption. Sorel's great search was for a moral lever, for something dynamic, some source of energy in men which could be tapped in order to restore virtue and dignity and morale in the common man. Being imbued with historical relativism, and played upon by vigorous and contradictory influences (Vico, Marx, Bergson, Nietzsche, P~guy), Sorel steadily revised his views. It is that fact which gives his contradiction-filled philosophy the character of a "dramatic pluralism." Of one thing, however, Sorel was always convinced: intellect alone could not re-invigorate European ethics. The feelings must be stirred by something which, as early as 1894, he called a "myth." He had no use for rationally planned utopias operated by savants in the manner of Saint-Simon or Comte (whom he constantly attacked). This paper offers an alternate explanation of cases from the doxastic wronging literature. These cases violate what I call the degree of inquiry right—a novel account of zetetic obligations to inquire when interests are at stake. The degree of inquiry right is a moral right against other epistemic agents to inquire to a certain threshold when a belief undermines one’s interests. Thus, the agents are sometimes obligated to leave inquiry open. I argue that we have relevant interests in reputation, relationships, (...) and the well-being of our social groups. These interests generate obligations against others to “do their homework” before closing inquiry. This alternate account makes better sense of puzzles that accounts of doxastic wronging fall prey to. (shrink)

Charles Sanders Peirce is regarded as the founding father of pragmatism and a key figure in the development of American philosophy, yet his practical philosophy remains under-acknowledged and misinterpreted. In this book, Richard Atkins argues that Peirce did in fact have developed and systematic views on ethics, on religion, and on how to live, and that these views are both plausible and relevant. Drawing on a controversial lecture that Peirce delivered in 1898 and related works, he examines Peirce's theories (...) of sentiment and instinct, his defence of the rational acceptability of religious belief, his analysis of self-controlled action, and his pragmatic account of practical ethics, showing how he developed his views and how they interact with those of his great contemporary William James. Retributive theories of punishment argue that punishing a criminal for a crime she committed is sufficient reason for a justified and morally permissible punishment. But what about when the state gets lucky in its decision to punish? I argue that retributive theories of punishment are subject to “Gettier” style cases from epistemology. Such cases demonstrate that the state needs more than to just get lucky, and as these retributive theories of punishment stand, there is no anti-luck condition. I’ll argue that (...) Gettier-style cases demonstrate an impermissible instance of punishment, even though they meet the conditions of retributive theories of punishment. Retributive theories are, therefore, too weak. The safety condition from epistemology provides the anti-luck condition needed for permissible punishment. I argue that two forms of retributivism, rights-forfeiture and what I call standard retributivism, are both subject to Gettier-style cases. Unlike the literature on standards of proof, this paper argues that safety is a condition on punishment itself, i.e., in all nearby possible worlds, the accuser must correctly accuse the convicted for the crime they actually committed. This article argues that the dominant “nonconventionalist” theories of promising cannot account for the moral impact of two basic commercial practices: the transfer of contractual rights and the discharge of contractual debt in bankruptcy. In particular, nonconventionalism’s insensitivity to certain features of social context precludes it from registering the moral significance of these social phenomena. As prelude, I demonstrate that Seana Shiffrin’s influential position concerning the divergence between promise and contract commits her to impugning these features of the modern economy. (...) This essay will address a general philosophical concern about autonomy, namely, that a conception of autonomy focused on freedom of the will alone is inadequate, once we consider the effects of oppressive forms of socialization on individuals’ formation of choices. In response to this problem, I will present a brief overview of Diana Meyers’s account of autonomy as relational and practical. On this view, autonomy consists in a set of socially acquired practical competencies in self-discovery, self-definition, self-knowledge, and self-direction. This (...) account provides a distinction between choices that express unreflectively internalized social norms and those that are the result of a critical ‘self-reading’. I conclude that this practical conception of autonomy makes much higher demands upon nurses (and patients) than has previously been thought. In fact, if nurses are to be expected to genuinely promote autonomy, they are going to need specific training in counselling-type communication skills. (shrink)

In this chapter, we shall begin by examining what the concept of race really amounts to, emphasizing its status as a socially constructed concept, before examining in the following section how children first (...) come to recognize the existence of race, and to understand their own racial identity.We will then look at two important areas that illustrate the profound impact that the social presence of race and the child’s developing understanding of racial identity have upon the social conditions of many children. Many authors have argued that epistemic rationality sometimes comes into conflict with our relationships. Although Sarah Stroud and Simon Keller argue that friendships sometimes require bad epistemic agency, their proposals do not go far enough. I argue here for a more radical claim—romantic love sometimes requires we form beliefs that are false. Lovers stand in a special position with one another; they owe things to one another that they do not owe to others. Such demands hold for beliefs as well. (...) Two facets of love ground what I call the false belief requirement , or the demand to form false beliefs when it is for the good of the beloved: the demand to love for the right reasons and the demand to refrain from doxastic wronging. Since truth is indispensable to epistemic rationality, the requirement to believe falsely, consequently, undermines truth norms. I demonstrate that, when the false belief requirement obtains, there is an irreconcilable conflict between love and truth norms of epistemic rationality: we must forsake one, at least at the time, for the other. Should we try to live in the present? Such is the imperative of modernity, Jed Rubenfeld writes in this important and original work of political theory. Since Jefferson proclaimed that 'the earth belongs to the living', since Freud announced that mental health requires people to 'get free of their past', since Nietzsche declared that the happy man is the man who 'leaps into the moment', modernity has directed its inhabitants to live in the present, as if there alone could they (...) find happiness, authenticity, and above all freedom. But this imperative, Rubenfeld argues, rests on a profoundly inadequate, deforming picture of the relationship between freedom and time. Instead, Rubenfeld suggests, human freedom, indeed human being itself, necessarily extends into both past and future; self-government consists of giving our lives meaning and purpose over time. From this conception of self-government, Rubenfeld derives a new theory of constitutional law's place in democracy. Democracy, he writes, is not a matter of governance by the present 'will of the people'; it is a matter of a nation's laying down and living up to enduring political and legal commitments. The result is a rewarding and refreshing book that clarifies longstanding controversies and stakes out novel positions in the debates. In these comments, I subject Short’s statements regarding the validity of induction to critical scrutiny.
