Arguing that our attachment to Aristotelian modes of discourse makes a revision of their conceptual foundations long overdue, the author proposes the consideration of unacknowledged factors that play a central role in argument itself. These are in particular the subjective imprint and the dynamics of argumentation. Their inclusion in a four-dimensional framework and the focus on thesis validity allow for a more realistic view of our discourse practice. Exhaustive analyses of fascinating historical and contemporary arguments are provided. These range from (...) Columbus’s advocacy of the Western Passage to India, over the trial of King Louis XVI during the French Revolution, to today’s highly charged controversies surrounding euthanasia and embryo research. Excavating foundational issues such as the purpose of argument itself and the contested role of argument as a generator of knowledge, the book culminates in a discussion of the relationship between rationality and reasonableness and criticizes the restrictions of ‘rational’ argument relying on fixed logical, economic or cultural criteria that in reality are mutable. Here, a true, open argument requires the infusion of Paul Lorenzen’s principle of ‘transsubjectivity’, which recognizes but transcends the partiality of the individual and which can be seen in the pragmatic and expanding consensus that humanity can control itself to safeguard the future of a fragile, damaged world. This paper discusses the ethical implications of perverse incentives with regard to autonomous driving. We define perverse incentives as a feature of an action, technology, or social policy that invites behavior which negates the primary goal of the actors initiating the action, introducing a certain technology, or implementing a social policy. As a special form of means-end-irrationality, perverse incentives are to be avoided from a prudential standpoint, as they prove to be directly self-defeating: They are not just a form of (...) unintended side effect that must be balanced against the main goal or value to be realized by an action, technology, or policy. Instead, they directly cause the primary goals of the actors—i.e., the goals that they ultimately pursue with the action, technology, or policy—to be “worse achieved”. In this paper, we elaborate on this definition and distinguish three ideal-typical phases of adverse incentives, where only in the last one the threshold for a perverse incentive is crossed. In addition, we discuss different possible relevant actors and their goals in implementing autonomous vehicles. We conclude that even if some actors do not pursue traffic safety as their primary goal, as part of a responsibility network they incur the responsibility to act on the common primary goal of the network, which we argue to be traffic safety. Which role does publicity play in an adequate theory of individual and collective reasoning? To analyze the role publicity should play in our societies in solving societal problems, I will start, in the first part, with some general remarks about problems and problem solving. In the second part, I will deal with the role responsible reasoning plays in problem solving. Finally, I will argue that, and why, the public use of reason is necessary for finding the best solutions for problems (...) in society. (shrink)

When ‘we’ in the West talk about philosophy, we most often mean ‘Western Philosophy’, i. e. philosophy with ancient roots in Greece from the pre-Socratic period onwards until today, thereby neglecting other cultures and traditions, whose history of philosophical thinking is at least as old and important. This neglect of other philosophical traditions is a problem in general, since it is unfair, hegemonic, ignorant, and imprudent. The article argues that there are instrumental as well as intrinsic reasons to diversify and (...) globalize the philosophical canon. Different philosophical traditions should engage more substantially with each other to solve philosophical problems. The idea of global philosophy encourages us to look beyond our respective cultural traditions to improve on our current approach of solving philosophical problems by our own lights. (shrink)

Sodann wird ein „Liberalismus mit Auffangnetz“ als Lösung des Problems vorgestellt, die eine unterschiedliche Bewertung von reversiblen und irreversiblen Eingriffen vornimmt. Im letzten Schritt wird überprüft, wie weit diese Konzeption auch anwendbar ist, wenn Eltern ihre Kinder verbessern lassen wollen, also ein „informed consent“ nicht vorausgesetzt (...) werden kann. Despite an increased recognition that plagiarism in published research can take many forms, current typologies of plagiarism are far from complete. One under-recognized variety of plagiarism—designated here as compression plagiarism—consists of the distillation of a lengthy scholarly text into a short one, followed by the publication of the short one under a new name with inadequate credit to the original author. In typical cases, compression plagiarism is invisible to unsuspecting readers and immune to anti-plagiarism software. The persistence of uncorrected instances (...) of plagiarism in all its forms—including compression plagiarism—in the body of published research literature has deleterious consequences for the reliability of scholarly communication. Not the least of these problems is that original authors are denied credit for their discoveries. When unsuspecting researchers read articles that are the products of plagiarism, they unwittingly engage the arguments of hidden original authors through the proxy of plagiarists. Furthermore, when these researchers later publish responses to the plagiarizing articles, not knowing they are engaging products of plagiarism, they create additional inefficiencies and redundancies in the body of published research. This article analyzes a suspected instance of compression plagiarism that appeared within the pages of this journal and considers the particular ways in which plagiarism of this variety weakens the quality of scholarly argumentation, with special attention paid to the field of philosophy. The concept of rationality, predominantly in the guise of rational choice theory, plays a key role in the social sciences. Yet, whilst rational choice theory is usually understood as part of positive political science, it is also widely employed within normative political theories. In this paper, we examine how allegedly positive rational choice arguments can find application within normative political theories. To this effect, we distinguish between two interpretations of rationality ascriptions, one empirical, the other normative. Since, as we demonstrate, (...) empirical readings of the rationality assumption cannot convincingly explain the role of rational choice arguments in normative theories, we argue that the rationality assumption should be given a normative interpretation. We conclude by considering what this result implies for the use of rational choice arguments in normative and positive political science. (shrink)
